2023-05-01 City Council Minutes ALBERTVILLE CITY COUNCIL REGULAR MEETING MINUTES May 1, 2023 – 7 pm Council Chambers Albertville City Hall 1. Call to Order Acting Mayor Olson called the meeting to order at 7 pm. 2. Pledge of Allegiance – Roll Call Present: Acting Mayor Olson, Councilmembers Cocking, Hayden and Zagorski. Absent: Mayor Hendrickson Staff Present: City Administrator Nafstad, City Attorney Couri, Finance Director Lannes and City Clerk Luedke. 3. Recognitions – Presentations – Introductions A. 2022-2023 Albertville Royalty Court The 2022-2023 Royalty Court listed some of their favorite activities they participated in over the last year. The 2023-2024 Royalty candidates introduced themselves. The Royalty Court thanked the Council for their continued support. The City Council thanked the Royal Court for their service to the Albertville Community. 4. Public Forum Mr. Felix Langstad, 10253 78th Street NE, Otsego, said he was interested in if a timeline had been set as to when the City of Albertville would move forward with the licensing for THC products within the City. He answered questions from Council. There was Council discussion regarding the current legislative session regarding the proposed cannabis house bill and the Council’s consensus was to wait on a THC licensing ordinance until the session was over to see if the State moved forward with proposed bill. They discussed revisiting the THC ordinance at first meeting in June. City Administrator Nafstad and City Attorney Couri answered questions from Council regarding the City’s process for licensing if the bill were passed. Attorney Couri said the City would review the bill if passed for local licensing regulations. 5. Amendments to the Agenda MOTION made by Councilmember Hayden, seconded by Councilmember Zagorski to approve the May 1, 2023, agenda as submitted. Ayes: Cocking, Hayden, Olson and Zagorski. Consent Agenda All items under the Consent Agenda are considered to be routine by the City staff and will be enacted by one motion. In the event an item is pulled, it will be discussed in the order it is listed on the Consent Agenda following the approval of the remaining Consent items. Items pulled will be approved by a separate motion. A. Approve the April 17, 2023, Local Board of Appeals and Equalization minutes as presented. B. Approve the April 17, 2023, regular City Council Meeting minutes as presented. C. Authorize the Monday, May 1, 2023, payment of claims as presented, except bills specifically pulled which are passed by separate motion. The claims listing has been provided to City Council as a separate document and is available for public view at City Hall upon request. D. Adopt Resolution No. 2023-21 accepting a donation in the amount of $5,000 from the STMA Youth Baseball Association for baseball field improvements in Central Park. E. Approve a temporary on-sale liquor license for Albertville Friendly City Days for June 8 through 11, 2023, for the Annual Friendly City Days Festival contingent upon receipt of liquor liability insurance certificate for a flat fee of $100 for the event. F. Approve street closures as requested for Albertville Friendly City Days and extended hours for Central Park for June 7 through June 11, 2023. G. Adopt Resolution No. 2023-22 approving a new lawful gambling premise permit for STMA Youth Hockey Association at Cedar Creek Golf Course located at 5700 Jason Avenue NE. MOTION made by Councilmember Cocking, seconded by Councilmember Hayden to approve the May 1, 2023, Consent Agenda as submitted. Ayes: Cocking, Hayden, Olson and Zagorski. Nays: None. Absent: Hendrickson. The motion carried. 7. Public Hearing – None 8. Wright County Sheriff’s Office – Updates, reports, etc. There were no updates from the Wright County Sheriff’s Office. 9. Department Business A. City Council 1. Committee Updates (STMA Ice Arena, Planning, JPWB, Parks, Fire Board, FYCC, etc.) Councilmember Zagorski provided an update from the Joint Power Water Board meeting which included a discussion on an agreement between the Water Board and Verizon for placement of antennas on a water tower. City Administrator Nafstad provided additional information on the Verizon agreement and answered questions from Council. Councilmember Olson provided an update from the Parks Committee meeting and said Park’s Night was set for May 19 at Westwind Park, Linwood Park and Four Seasons Park. B. Building – None C. Approve Purchase of Microsoft Office Professional 365 Finance Director Lannes presented the staff report and provided details on the Microsoft Office conversion. She answered questions from Council. MOTION made by Councilmember Hayden, seconded by Councilmember Zagorski to authorize staff to purchase Microsoft Office Professional 365 and installation assistance not to exceed $17,000 and a monthly subscription fee of approximately $511. Ayes: Cocking, Hayden, Olson and Zagorski. Nays: None. Absent: Hendrickson. The motion carried. E. Fire – None F. Planning and Zoning – None G. Public Works/Engineering – None H. Legal – None I. Administration 1. Planning Commission Member Appointment Discussion City Administrator Nafstad provided an update on open Planning Commission seat and said the City had received two applications. As directed by the Council in February, he said the Personnel Committee reviewed the applications and he contacted the Planning Commission Chair to discuss the applications and the Chair recommended the appointment of Jay Eull for the open seat. Administrator Nafstad answered questions from Council regarding the advertising process used for the open seat. There was Council discussion regarding the open Planning Commission seat and the consensus was to move the appointment decision to a Council meeting in June when Mayor Hendrickson would be in attendance. 2. City Administrator’s Update City Administrator Nafstad reviewed the City Administrators Update and provided an update on the City’s Building Official who has been out ill. He said retired Building Official Heins has been hired temporarily to assist with the building inspections. City Attorney Couri addressed the zoning enforcement issues on Mr. Potter property. He said the southwest part of the property was being leased to Mr. Norby for his business that consists of outdoor storage and no principal building which was not allowed at on the property. Attorney Couri reported, on another part of Potter’s property, large piping, lawnmowers and other construction related items were being stored illegally. He recommended the City move forward with the court process because code enforcement letters had been sent to both parties and neither of them have complied. Mr. Couri also reported on wetland issues due to Mr. Potter’s addition of landfill. He answered questions from Council regarding enforcement of the issues and said at this time he was not sure if the City would enforce the wetland concerns or if the enforcement would be through the Board of Water & Soil Resources. City Council Meeting Minutes Page 4 Regular Meeting of May 1, 2023 City Administrator Nafstad answered questions from the Council regarding the illegal land use and wetland issues. There was Council discussion regarding the illegal use of land, the wetland issues and whether the City would be responsible to enforce the wetland land fill matters. The Council’s consensus was to direct the City Attorney to begin the complaint process and provide an update at the next Council meeting. 3. Closed Meeting – Update on City of Albertville vs. Chuck Maeyaert Litigation The Council moved to a Closed Meeting to discuss the City of Albertville vs. Chuck Maeyaert Litigation. MOTION made by Councilmember Hayden, seconded by Councilmember Zagorski to close the meeting. Ayes: Cocking, Hayden, Olson and Zagorski. Nays: None. Absent: Hendrickson. The motion carried. City Attorney Couri provided an update to the Council regarding the on-going litigation. MOTION made by Councilmember Cocking, seconded by Councilmember Hayden to re-open the Council meeting. Ayes: Cocking, Hayden, Olson and Zagorski. Nays: None. Absent: Hendrickson. The motion carried.
