No Date Marx-Psyk Drainage Agreement
MARX-PSYK DRAINAGE AGREEMENT
WHEREAS, this agreement will provide for the continued use of
the existing surface drainage ditch from the Marx and psyk
properties, as shown on the attached exhibits 1, 2 and 3, to the
existing drainage pond with the following stipulations:
1. Culvert shall be placed at the north end of Lachman Avenue NE
to provide access for the Marx property over the drainage
ditch.
2. Drainage ditch shall provide continued surface drainage until
such time that a permanent storm sewer is constructed to
replace the existing drainage ditch. At such time as a
permanent storm sewer is constructed, it is understood and
agreed the psyk property will assume and pay the pro-rata cost
of the storm sewer to replace the drainage ditch. Each party's
(Marx & Psyk) pro-rata cost of the storm sewer improvement
shall be based upon their respective land areas that contribute
storm water to the storm sewer improvement.
3. Any maintenance cost associated with maintaining the existing
di tch (grass mowing, brush removal, etc.) shall be shared
equally by the Marx and psyk properties.
