the May 15, 2023, agenda as amended. Ayes: Cocking, Hendrickson, Hayden, Olson and

1. Issuance and Sale of 2023A General Obligation Disposal System Bond
Ms. Tammy Omdal of Northland Securities, the City’s Financial Consulting firm, was present.
She provided a summary of the bids received from the bond sale to fund the Waste Water
Treatment facility improvement project. She reported five bids were received with Piper Sandler
& Co being the lowest bidder. Ms. Omdal said the bonds came in approximately a million dollars
less than expected due to the enhanced bond rating the City received with the final amount of
$9,400,000 at a rate of approximately 3.8%. She answered questions regarding the bidding
process and the enhanced bid rating agreement which was approved at the April 3 Council
meeting.
City Administrator Nafstad stated the resolution in the packet provided for $9,855,000 but the
final bid amount was $9,400,000.
MOTION made by Councilmember Olson, seconded by Councilmember Cocking to adopt
Resolution No. 2023-24 providing for the Issuance and Sale of $9,400,000 General Obligation
Disposal System Bonds, Series 2023A, providing for their Issuance and Levying a Tax for the
Payment therefor with the amended sale amount. Ayes: Cocking, Hayden, Hendrickson, Olson
and Zagorski. Nays: None. The motion carried.

2. Authorizing the City of Albertville to submit to receive Grant Funds
City Administrator Nafstad reported in 2020 the City received bonding dollars specific to the
Waste Water Treatment facility improvement project and at the time a resolution was approved
to accept $2,000,000 but the actually amount received by the City was $2,500,000. He said this
resolution was housekeeping item to correct the original amount on resolution. He stated the
facility’s funding plan would not change and he answered questions from Council.
Finance Director Lannes stated the funds would stay in the project fund until the improvements
were completed then the funds could be transferred to reduce the debit levy.
MOTION made by Councilmember Cocking, seconded by Councilmember Hayden to adopt
Resolution No. 2023-26 to authorize the City of Albertville to submit information to Minnesota
Public Facilities Authority and to enter into a grant agreement for the City of Albertville. Ayes:
Cocking, Hayden, Hendrickson, Olson and Zagorski. Nays: None. The motion carried.

1. Consider a Zoning Code Amendment creating Chapter 5200 Planned Unit
Development District Summary and adoption of Updated Zoning Map
City Planner Brixius presented the staff report and said the proposed new chapter included a
summary of all of the Planned Unit Developments (PUD) approved over the years and would
allow for easy access to reference specific districts. He answered questions from the Council.
City Clerk Luedke answered questions from Council regarding the publication of the approved
ordinances.
City Attorney Couri answered questions from Council regarding the PUD districts.
MOTION made by Councilmember Zagorski, seconded by Councilmember Olson to adopt
Ordinance No. 2023-05 approving an amendment to the Albertville Zoning Code Create
Chapter 5200 PUD-Planned Unit Development District summarizing the approved PUD land
uses and performance standards within past PUD approvals and approve summary ordinance for
publication. Ayes: Cocking, Hayden, Hendrickson, Olson and Zagorski. Nays: None. The motion
carried.
MOTION made by Councilmember Zagorski, seconded by Councilmember Cocking to adopt
Ordinance No. 2023-06 adopting the updated Albertville Zoning Map dated April 2023. Ayes:
Cocking, Hayden, Hendrickson, Olson and Zagorski. Nays: None. The motion carried.

I. Administration
1. Approve Planning Services Contract with ABCities Consulting LLC
City Administrator Nafstad presented the staff report which included background information on
the services the City has received from Northwest Associated Consultant (NAC). He answered
questions from Council regarding the planning service contract with ABCities Consulting.

City Planner Brixius provided background information his plans for NAC and his desire to
continue to retain the City of Albertville as a client through 2024.
City Attorney Couri requested to have section C under Article 5 deleted from the contract
because the City’s insurance has a limit on the amount it would pay if a claim were received and
he answered questions from Council regarding the section. City Planner Brixius reported he was
fine with deleting the section C.
MOTION made by Councilmember Hayden, seconded by Councilmember Zagorski to adopt
Resolution No. 2023-25 approve a contract with ABCities Consulting, LLC for Planning
Consultant Services through 2024 as amended. Ayes: Cocking, Hayden, Hendrickson, Olson and
Zagorski. Nays: None. The motion carried.
2. Building Inspection Services Discussion
City Administrator Nafstad provided information on the City’s Building Official and current
staffing. Nafstad stated current lead times for an inspection was on average 3 to 4 days, and have
been more. The City Council expressed concerns with the lead times and felt the scheduling lead
time needed to be 48 hours or less. Nafstad stated the interim fix was to use a consultant building
inspection for supplemental services on a limited basis, especially for the Kingston Crossing
project. Administrator Nafstad stated he contacted a couple of companies and the general rate for
supplement service is approximately $95 an hour. He answered questions from Council
regarding the current contract and pay formula the City has with St. Michael. He said he would
meet with the Personnel Committee to compare the options of contracting for service versus
hiring an inhouse person and bring the information back to the next Council meeting.
There was Council discussion regarding the inspection lead times, budget and how the City
should move forward with building inspection services. The Council consensus was to move
forward with a supplemental consultant building inspections on a limited basis, but not limited to
just the Kingston Crossing project.
City Attorney Couri answered questions from Council regarding the supplemental contract.
MOTION made by Councilmember Cocking, seconded by Councilmember Hayden to direct
Staff to enter into a supplemental inspection service contract to allow all inspections be
conducted within a 48 hours timeframe. Ayes: Cocking, Hayden, Hendrickson, Olson and
Zagorski. Nays: None. The motion carried.

BACKGROUND: The City processes claims on a semi-monthly basis. The bills are approved
through their respective departments and administration and passed onto the City Council for
approval.

POLICY/PRACTICES CONSIDERATIONS: It is the City’s policy to review and approve

pursuant to Minnesota State Law, which requires all bills to be paid in a timely manner,

RECOMMENDATION: It is respectfully requested that the Mayor and Council consider the

MOTION TO: Adopt Resolution No. 2023-27 establishing Juneteenth (June 19) as a 2023 City
observed holiday.
BACKGROUND: The Minnesota legislature recently passed a bill establishing Juneteenth as a
state recognized holiday which was signed by Governor Walz. The original language was
modified to make the holiday effective in 2023, instead of the original date of 2024. Per MN
State Statute 645.44, subd. 5, no government work shall be conducted on this day. Cities need to
update their existing schedules to reflect the June 19 holiday.
KEY ISSUES:
•Recently adopted legislature established Juneteenth (June 19th)as a State observed
holiday beginning in June 2023.
•No government business shall be conducted on State observed holidays.
POLICY/PRACTICES CONSIDERATIONS: Per State Statute, no government business may
take place on State recognized holidays.
LEGAL CONSIDERATIONS: In accordance with Council procedures, the Mayor and City
Council have the authority to set the City’s holiday schedule.

RESOLUTION ESTABLISHING JUNETEENTH AS A 2023 CITY
OBSERVED HOLIDAY
WHEREAS, Juneteenth (June 19) has been recognized as a new federal holiday
celebrating freedom from slavery in the United States; and
WHEREAS, the State of Minnesota outlines holidays in State Stature and after being
duly passed in both the House (HF 48) and the Senate (SF 13), the Governor signed the bill into
law recognizing Juneteenth as a state holiday; and
WHEREAS, the effective date has been set to go into effect this year, June 19, 2023; and
WHEREAS, no public business can be conducted on state mandated holidays.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Albertville,
Minnesota, does hereby approves Juneteenth (June 19) as a paid holiday as listed in Exhibit A.

RECOMMENDATION: It is respectfully requested that the Mayor and Council consider the
following:
MOTION TO: Approve a Special Event Permit including a Temporary Outdoor Music Permit
for The 152 Club located at 5794 Main Avenue NE for the Chad Smith Ride for Life Benefit
event on June 17, 2023.
BACKGROUND: The 152 Club has submitted a special event permit application which
included an outdoor music permit for the Chad Smith Ride for Life event on Saturday, June 17,
2023. The benefit event will be held at The 152 Club starting at 5 pm.
KEY ISSUES:
• The event will be held at the 152 Club located at 5794 Main Ave NE on June 17, 2023.
• The applicant has submitted a site plan showing the location of the bike parking to allow
for biker’s safety in and out of area and has indicated the St. Michael Fire Department
will be escorting the bikers.
• The bike parking area will be controlled by manned cones which will no completely
block the street from 10 am to 11 am and again from 4:30 pm to 5:30 pm. The applicant
will follow the requirements set forth by the Albertville Fire Chief.
• The 152 Club’s special event permit application includes a request for a temporary
outdoor music permit for the event. They are requesting outdoor music from 7:30 pm to
11:59 pm.
POLICY/PRACTICES CONSIDERATIONS: Special events permits are subject to the
approval of the City Council.
LEGAL CONSIDERATIONS: The applicant shall comply with the regulations for a special
event permit and outdoor music ordinance.

City Administrator’s Update

GENERAL ADMINISTRATION
Albertville Friendly City Days Social: This year’s social will be on Thursday, June 8, 2023, at 6
pm in Central Park in the Beer Gardens by the Main Stage. Thursday night is the Albertville
Firemen’s Relief Craft Beer night.
Albertville Fire Department: The Albertville Fire Department is planning an Open House on
Saturday, June 10, 2023, from 9 am to noon during this year’s Friendly City Days Festival.
Law Enforcement Contract: Wright County cities have been invited to meet with Sheriff
Deringer and the County Commissioners to discuss upcoming changes to the law enforcement
contracts. The meeting is at 9:00 a.m. on Thursday, June 8 at the Wright County Government
Center.
League of Minnesota Cities 2023 Annual Conference: This event will be held on Wednesday,
June 21 through Friday, June 23 in Duluth. Registration is open for the event. Please let me
know if you would like to attend this year.
July 3 Council Meeting: A reminder there will not be a Council meeting the first week in July.
Building Inspection Services: The Personnel Committee met to review options for the City’s
Building Department and at the meeting, I will present service options for your consideration.
The City is contracting with Metro West Inspection to supplement inspection services in an
effort to shorten the scheduling lead time for inspections.
City’s Bond Rating: Moody’s announced and reaffirmed the City’s GO rating of Aa2. The
evaluation was required as part for the 2023 bond issuance.
Parks Committee: The Parks Committee held their Parks Night Out event for May 19 in Four
Seasons Park, Linwood Park and Westwind Park. The event featured a Public Works equipment
display, the Albertville Fire Department, Wright County Sheriff’s Office K9 unit and other family
entertainment. The event was well attended.
Annual Recycling Rate Increase: In 2021, The City negotiated the 5-year contract extension
with Republic Services. Resolution No. 2021-016 approved on March 15, 2021 set the recycling
fees for the five-year period. Beginning June 1, 2023 through May 31, 2024, the new recycling
rate will be $4.67.
Code/Zoning Enforcement: The code enforcement regrading illegal land use on Potter’s
property located at the southwest corner of 60th Street NE and Mackenzie Avenue has been
turned over to the City Attorney.

2023 Street Overlay: The pre-construction meeting has been scheduled for June 15 and it is
understood the contractor will commence work after the 4th of July.
Depot Parking Lot: Construction will begin immediately following Friendly City Days and the
contractor anticipates the project will take approximately 6 weeks.
WWTF Improvements: Modifications to the existing reed bed structures are underway as well
footing work for the new electrical building. Partial pay estimate number two is included on
the agenda.
Lift Station Upgrades: Public Works is working on 4 lift station upgrades. Generally, upgrades
are related to control panels and electrical components. Eligible expenses can be paid with
ARPA funds otherwise are paid with enterprise capital reserves.
I-94 Gap Project: MnDOT is anticipating 2024 construction and has a consultant working on the
final design. We have a question into MnDOT as to whether a ped bridge at CR 37 can be
included in the project.
County Road 137: The County will be reconstructing 137 in 2024. Staff is working with the
County on options for a trail along 137 and crossing provisions at the 62nd Street intersection.
