A.Public hearing to consider a request of the City of Albertville for a Zoning
Text amendment and Zoning Map amendment adding Chapter 5200 PUD
Summary District to the Albertville Zoning Code and adopting the updated
Zoning Map.Brixius went through the Albertville PUD District Summary report. He informed Commissioners that the summary is to identify the special conditions applied to each of these PUD districts. There are many PUD districts in Albertville so staff thought it would be beneficial to summarize each PUD to memorialize these within the zoning code so that future

staff will not need to search through the files and/or development contracts to apply the performance standard applicable to the individual PUDs with each development application or zoning question. Brixius showed the updated zoning map to the Commissioners and brought up one of the PUD’s listed for an example to show them how it works. Buhrmann asked how we did the PUD for the East side of the outlet mall to allow church use as an allowed use. Brixius informed that it went through a PUD amendment for the church. Commissioners discussed the number of PUD’s there are for this size of city. Commissioners had discussion on brick and mortar and grocery stores. Commissioners discussed the old Hana site and the uses for that specific location.

BACKGROUND
Bravera Holdings Inc., on behalf of Bavera Bank, has requested site and building plan
approval to allow an addition to their existing 6,500 square foot bank building located at
11102 57th Street NE. Specifically, the applicant wishes to construct a 4,344 square foot
addition on the west side of the bank building in conjunction with the remodeling of the
interior of existing bank space.
In total, 10,844 square feet of floor area would result from the proposed addition. The
addition is intended to provide additional office space for bank employees. In addition to
the proposed building expansion, the applicant also plans to add 28 off-street parking
stalls upon the site, increasing the parking supply from 37 stalls to 65 stalls.
The subject site measures 2.8 acres in size and is zoned B-2A, Special Business. Within
B-2A Districts, “general offices” are listed as permitted uses.

ISSUES AND ANALYSIS
Site Access. The subject site is presently accessed from the east via two points along
LaCentre Avenue NE. The north access point measures 24 feet in width while the
south access point measures 36 feet in width. No changes to the existing curb cut
locations and widths are proposed.
Building Setbacks. The subject site is unique in that it is bordered on the south and
west by public streets and a private street on the east. In this regard, a minimum
building setback requirement of 35 feet is imposed along the public streets and a
minimum of 15 feet from the back of curb from the private street.
As shown below, the proposed building expansion meets applicable B-2A District
setback requirements.

Off-Street Parking. As previously indicated, a total of 28 new off-street parking stalls
are proposed on the site. As shown on the submitted site plan, the single loaded
parking lot on the north side of the site is to be expanded to provide additional parking
on the north side of the existing drive aisle. In the southern area of the site, a row of
parking (17 stalls) is proposed on the north side of the existing ATM drive lane.
As shown below, a total of 52 off-street parking stalls are required to accommodate the
expanded bank facility.

In satisfaction of the off-street parking supply requirement, a total of 65 parking stalls
are proposed on the site.
According to American Disability Act (ADA) requirements, a parking lot having between
51 to 71 stalls must provide at least three ADA disability parking spaces. In
conformance with the requirement, three disability stalls are proposed upon the subject
site.
All parking areas meet applicable setback requirements. The parking stalls and drive
aisles meet the dimensional requirements of the zoning code.

ATM Island. According to the applicant, the ATM island located in the southeast corner
of the site is to be relocated to serve patrons under the bank teller drive-through
canopy. As a result, the existing proposed east/west ATM drive lane will slightly
reconfigured and serve as a drive aisle for abutting off-street parking spaces.
The proposed “reuse” of the former ATM lane (as a parking area) will not conflict with
vehicles utilizing the nearby bank teller lanes.
Building Design and Materials. The proposed building addition incorporates many
design elements of the existing bank building such that the “addition” will likely not be
perceived as such. In this regard, the roof design features (gable and hip roof elements
and color), and façade design and materials (and colors) are identical to that of the
existing building.
According to the submitted building elevations, the addition will incorporate sloped
stone corners, stone piers, EIFS (exterior insulating finishing system) and glass. Also,
of note that earthtone colors applied to the addition will match those used on the
existing building.
The exterior finish materials proposed upon the building addition meet applicable
Zoning Code requirements.
Building Height. The proposed building measures 19 feet in height (measured at the
midway point between the eave and roof ridge). This is well within the maximum 35-
foot height requirement imposed in B-2A zoning district.
Trash Handling. A trash/recycling enclosure presently exists in the northeast corner of
the site, on the south side on the north access drive. Appropriately, the enclosure is
screened from view from LaCentre Avenue NE to the east via a several evergreen
plantings.
No changes to the existing trash/recycling enclosure are proposed.
Mechanical Equipment. In review of the submitted site plan and building elevations, it
does not appear that any rooftop mechanical equipment is proposed. Rather, exterior
air conditioning equipment is located near the northeast corner of the existing bank
building.
Such mechanical equipment is located such that it is not visible from surrounding
properties and rights-of-way.
Landscaping. A landscape plan has been submitted for review. (Exhibit F)
The plan calls for a total of 61 new plantings around the perimeter of the building
addition. Such plantings consist of the following:

Also of note is that new sod and seed mix are proposed to be located around the
periphery of the stormwater pond (located near the subject site’s northern boundary).
The proposed site planting’s location, number and sizes are considered satisfactory.
The landscape plan proposes a low maintenance turf and a stormwater turf seed mixes
on the north end of the lot and around the storm pond. This turf restoration is
appropriate for this area of the lot.
Lighting. It is unclear if any new lighting is proposed in conjunction with the proposed
building addition. All new lighting, either wall mounted, or freestanding must be
identified on the site plan and details should be provided regarding light location, fixture
type, height of freestanding lights and the photometric light levels across the site. All
lighting shall be 90-degree cutoff fixtures with a shield light source. and luminaries must
not extend beyond the 90-degree cutoff. Light levels at the property lines shall not
exceed 1 footcandle.
Signage. According to notes on the submitted plan set, the existing monument sign
located in the southeast corner of the site is to remain in place. It does not appear that
any new freestanding or wall signs are proposed.
Grading, Drainage and Utilities. According to the “Area Summary” included on the
site plan drawing, the amount of impervious surface coverage on the site is to be
increased from 46.9 percent to 55.1 percent.
The site grading, drainage and utility plans be subject to review and approval by the
City Engineer.
RECOMMENDATION
Based on the preceding review, Staff recommends site and building plan approval of
the proposed bank addition subject to the following conditions:
1.If new exterior lighting is proposed on the site, applicant shall provide a lighting
and photometric plan for the site identifying the location of all freestanding and
wall mounted exterior lights, light fixture details, height of freestanding lights, and
light levels across the site. All lighting shall be 90-degree cutoff fixtures with
shielded light source.

2.Grading, drainage and utility plans shall be subject to review and approval by the
City Engineer.

BACKGROUND
The City of Albertville has received complaints regarding the placement and duration of
temporary storage Container (PODs), construction dumpsters and dumpster bag in
residential neighborhoods. It is understood that these items may be needed at time
when households are moving in or moving out of the house. Or needed in relation to a
construction or remodeling project. However, in some cases the duration of these
temporary use has become a nuisance for adjoining property owners.
Currently the City has no code addressing the use of these temporary uses. Staff is
recommending the attached zoning code amendment that defines the uses, and
identifies the location and duration that theses uses may be allowed. The City would
enforce only on a complaint basis and will not have a record for the start date on the
use of the items, as such through enforcement the property owner will have to produce
a contract or receipt demonstrating that they are not in violation of the code’s limited
duration.
The Planning Commission is requested to review and discuss the code elements and
provide a recommendation to the City Council on this issue. Staff will take any
suggested edits or modifications recommended by the Planning Commission.

AN ORDINANCE AMENDING APPENDIX A, SECTION 1000.15 A OUTSIDE
STORAGE ACCESSORY TO RESIDENTIAL USES, OF THE ALBERTVILLE
MUNICIPAL CITY CODE, ESTABLISHING REGULATION FOR THE USE AND
TERMS FOR TEMPORARY STORAGE CONTAINERS AND RESIDENTIAL
DUMPSTER BAGS.
THE CITY COUNCIL OF THE CITY OF ALBERTVILLE, MINNESOTA ORDAINS:
SECTION 1. SECTION 200.2, Definitions is amended to include the following:
Residential dumpster bag: a storage bag temporarily placed on a property for use in storing
materials for household relocation or improvement projects.
Temporary storage container: an enclosed freestanding container temporarily placed on a
property for use in storing materials for household relocation or
improvement projects.
SECTION 2. Section 1000.15 A. of the Albertville zoning code is amended as follows:
7. Temporary storage containers including, but not limited to, cargo containers, portable on
demand storage units, and dumpsters, are not allowed as permanent storage structures.
Temporary storage containers being used for household relocation and improvement projects
are permitted subject to the following conditions:
a. The temporary storage container is enclosed and secure.
b. The temporary storage container is located on a property for no more than 30
consecutive days in one calendar year, unless there is an active building permit in place for the
property, in which case the temporary storage container may be located on the property for no
more than 90 consecutive days.
c. The temporary storage container is located on a driveway or hard surface area in the
front yard, must be setback a minimum of 15 feet from the public street curb and five feet from
a private street curb, and five feet from side property lines, and may not intrude on sidewalks.
d.No permit is required for the temporary storage container. The city may require
information appertaining to the dates upon which the temporary storage container was placed
on a property and when it will be removed if concerns are raised over the duration of time
during which the storage container is located on the property.

8. Residential dumpster bags being used for household relocation and improvement projects
are permitted subject to the following conditions:
a.The residential dumpster bag is located on a property for no more than 30
consecutive days in one calendar year, unless there is an active building permit in place for the
property, in which case the residential dumpster bag may be located on the property for no
more than 90 consecutive days.
b.The residential dumpster bag must be setback a minimum of 15 feet from the public
street curb and five feet from a private street curb, and five feet from side property lines, and
may not intrude on sidewalks.
c.No permit is required for the residential dumpster bag. The city may require
information pertaining to the dates upon which the residential dumpster bag was placed on a
property and when it will be removed if concerns are raised over the duration of time during
which the residential dumpster bag is located on the property.
THIS AMENDMENT SHALL BE IN FULL FORCE AND EFFECTIVE IMMEDIATELY
FOLLOWING ITS PASSAGE AND PUBLICATION.
