1998-08-27 Addendum to Purchase Agreement ADDENDUM TO PURCHASE AGREEMENT DATEDAUGUST cf<7 ,1998 The parties to that certain Purchase Agreement referred to above, hereby agree, in addition to all terms and conditions of said Purchase Agreement that: I. The City may install 57th Street as a 9-ton road but shall not include in the costs assessed to the landowners the difference in cost between installing a 7-ton road and installing a 9-ton road. The City shall not assess the Sellers property for the cost of any trails or paths installed by the City along 57th Street. 2. Any excess dirt or fill excavated from the subject property shall be deposited on Sellers adjoining property. 3. That Buyer agrees to assist Seller and cooperate with Seller and/or Assigns in reducing wetlands to a minimum amount. 4. Seller and/or Assigns agree to be assessed without objection for] 00% of the cost of constructing 57th street as a 7-ton street, with curb, gutter, sanitary sewer, municipal water, and storm sewer, provided the assessment is spread upon all abutting landowners (including Buyer) on a linear foot basis in a roughly proportionate manner to the benefits received. Seller and/or Assigns hereby waive their right of appeal to the District Court herein, pursuant to Minnesota Statute 429.08] . 5. Seller and/or Assigns agree to dedicate to the City an easement for street purposes at no charge, said easement to be no less than 70 feet wide, beginning at the westerly most portion of the existing platted 57th street and continuing due west to County Highway No. ] 9. Said dedication shall occur no later than the date the City approves plans and specifications for the construction of 57th street to County Highway No. 19. 6. The Seller's remaining parcel is subject to park dedication requirements. 7. The Buyer agrees to deter all 57th Street assessments for two years after completion of 57th Street unless Seller's property abutting 57th Street is developed. 8. The parties intend for the closing on this property to occur on or about October 8, 1998. 9. Seller shall deliver a copy of this agreement to Cascade Corporation and any other prospective purchasers of the remainder of Seller's property.
