They have not been able to secure a Letter of Credit from Security Bank Northwest and they requested that the City reduce the surety amount to $30,000 for the duration of the project, or reduce the Letter of Credit automatically when 75'of the lots are sold. Attorney R~dzwill recommended that the Council proceed with the Developer's Agreement as prepared in order to protect the City's interests. Radzwill told the developer's that they could approach the Council for a reduction in the Letter of Credit at the time that 75' of the lots are sold. Barthel made a motion to approve the Developer's Agreement for the Westwind Second Addition as presented. Vetsch seconded the motion. Vetsch, Barthel, and Potter voted aye. Berning voted no.
