Dear Ron:
At your request, on May 11, 1995 Gary Hale, the City Administrator, Ken Lindsay, the Public Works
Supe~.ntendem, you, and I inspected the above referenced projt:ct. This inspection revealed numerous
areas where the pavement failed, catch basins and storm sewer that needed to be cleaned out, senko
concrete curb, an.d tlie street was tracked with mud and graveL It was obvious, and we all agreed. that
the project was not ready for a final inspechon.
'l'he main issue preventing the final inspection was the amount of mud and gravel tracked on the streets
by the home builders. You had indicated it was difficult, if not impossible, to keep the home builders
off the pavement long enough to ailow the pavement to be swept and allow us time to inspect the
pavement. Therefore, it was agreed to delay the final inspection and installation of the bituminous wt:ar
COt..l.......e. until the majority of the home building was complete. The schedule for completing this work was
left to your discretion.
It was always your option to have the pavement swept in May 1 so the pavement could be inspected. If
the pavement was swept in May, it is my opimon,based on the pavemem failures that were observed,
we wuuld have uncovered the same amount of broken bituminous base as \Vas found in August,
Therefore, your claim of $6,032.41 for broken bituminous.repair is hereby rejected.
