GREEMENT dated July ~, 1996 by and' between: the CITY OF
ALB~;rLLE, ,a municipal corporation ("City")" and KENCO
CONSTjRUCTION, :,INC., a Kinnesota corporation (the "Developer").
1. : REQUEST FOR GRADING APPROVAL. The Developer has asked the
o approvie the grading for Parkside 3rd Addition (referred to
is contiact as, the "plat"). The ci 1;:y has ,approved the
inary pl.ia.t for Parks ide 3rd Addi tioD. legally: described on, the
ed Exllii?it "A", but the Developer wishes to grade the plat
final plat approval.
2. CONDITIONS OF APPROVAL. The city hereby approves the
grad. q on the condition the Developer enter into this Contract,
ab:id by its terms and furnish the security required by it.
3. : GRADING AND DRAINAGE PLAN. The plat shall be qraded in
acoo ance with the Gradinq and Drainage plan dated Kay 30, 1996
and ~ 'file, with the city of Albertville. The plan shall not be
atta ed to this permit. If the plan varies from the written terms
of' t is permit, t.he written terms shall control.

g4 . : TIQ OF P~ORHANCE. The Developer sh~ll complete t.he
qr,ad 'nq: and' erosion control by September 30, 19.96. The Developer
may, howevel:', request an extension of time from the city. If an
exte sion is qranted, it shall be conditioned upon updating the
se , -lit l' ,posted by the Developer to reflect cost increases and the
extended completion date.
15.' ERO$ION CONTROL. Developer shall implement, all erosion
cont~ol, measu,res detailed on the Grading and Drainaqe plan
(inC~Udin9 construction of all ponds) in the order required by the
City Engineer. Developer shall also implement any additional
eros . on: control measures required by the City Enqineer or the
wriq t County, Soil and Water Conservation District. All areas
disturb:ed by 'the excavation and backfilinq operations shall be
rese~ded fort~with after the completion of the WOrk in that area.
Exc::e~t as otherwise provided in the erosion control plan, seed
sha:l~ be rye' qrass or other fast-qrowing seed suitab1e to the
exis~in9 soil'to provide a temporary ground cover as rapidlY as
poss~ble. All seeded areas shall be mulched and disc anchored as
nece~sary for 'seed retention. The parties recoqnize that time is
of tlie essence in controllinq erosion. :If the Developer does not
comp~y with the erosion control plan and I or the requirements of the
city I Engineer or wright County soil and Water: conservation
Dist19ict, the City may take such action as it deems appropriate to
contXjol erosiQn. The City will endeavor to notify the Developer in
adva~ce of any proposed action, but failure of the City to do so
will lnot affect the Developer'S and City'S rights or obligations
hereunder. :If the Developer does not reimburse the City for any
cost Ithe City incurred for such work within thirty (3P) days, the
cit;y I may draw down the letter of credit to pay any: costs. No
