RE:Ditch #9 Cleaninf! within the Center Oaks/Kenco Lands
Dear Gary:
Kenco Construction has contacted Wright County regarding the ability to do ditch cleaning for
the above properties. This cleaning would be at no cost to the County or City and would be
performed to improve the flow, water quality and smooth out the transition grades to the ditches.
All of the parcels are making the transition from agriculture uses to urbanized subdivisions over
the next five to ten years. All known public concerns regarding ditch # 9 are south of highway
118. All cleaning efforts are north of highway 118. Improvements such as water quality ponds
will ultimately be built upstream from or surround the ditches. The four properties in question
show up in the County Plat book as owned by Kenco Construction, Leander Becker, Roman &
Donna Becker, and John & Bernadine Roden. All have been recently purchased or are under
contract to be purchased by Kenco Construction, Inc. and its financial partners.
As a .second request, Kenco Construction on behalf of the Center Oaks partnership, (the
purchaser of the John Roden parcel) will seek to reorganize the location of the ditches in the
Southwest quadrant of the parcel to improve water quality, add wetland mitigation areas, and
potentially add recreational trails in plans yet to be approved by Albertville. We need the LGU
contact in order to continue sound environmental planning for this parcel. This concept ~as
received conceptual approval from the soil and water conservation district representatives.
Lastly, the County has requested the City take over the obligations of ditch # 9 north of Highway
118. Kenco seeks to implement long term water quality ponding in these areas prior to land
dedication to the City. The County would like to transfer its interest in the ditch to the City at
the earliest possible time in order to remove their approvals from what is now a ditch entirely
within the City limits. Kenco approves of this strategy so that our consultants can work with the
City, and not the County on what will be part of the City storm water management plan.

Dear Mr. Jensen:
1s a followup to our telephone conversation of October 31, 1996
with espect to your proposed ditch work, no permission/authorization
has b en granted nor is any anticipated in the near future.
In my discussions with Kerry Saxton of Wright Soil & Water this
week, the entire matter or drainage that includes County Ditch #9, 21
and the Regal Creek area (downstream City of St. Michael) there is no
forward action at this time. County Commissioner Rose is coordinating
the entire area for a resolution to the drainage problems that exist.
Her professional advisors are the County Engineer and Wright Soil & Water.
As you are aware the County Auditor and Board hgve legal jurisdiction
with the State of Minnesota's Ditch law. Resolutions to problems
involving ditch law are often cumbersome and time involved which leaves
rapid solutions nearly impossible.
Work related to storm drainage will, as always need to flow through
any and all channels to include proper permitting as required (Corp of
Engineers, State of MN - DNR, Wright Soil & Water, etc.) by law. Ditches
include the County Board/Auditor and the City Engineer. Planning as
you suggest is the usual and best method. Fgst solutions are very
unlikely. Thank you for your williness to work on drainage and to
cooperate on the solutions.
