7. Public Hearings
A. Evans Park, Inc. Refunding Bonds
Richard Helde, of Dorsey & Whitney, LLC and Troy Hanson of Evans Park, Inc. were present at
the meeting. Helde reported that the City of Albertville has issued conduit debt for Evans Park
Inc. in 2013. Evans Park is now seeking to refinance those bonds under the City of Otsego.
Albertville must provide its consent in order for the refinance to go through.
Mayor Hendrickson opened the public hearing and called for comments. There were no
comments.
Motioned by Vetsch, seconded by Olson, to close the public hearing. Ayes: Hendrickson,
Cocking, Hudson, Olson and Vetsch. Nays: None. Absent: None. MOTION DECLARED

Motioned by Cocking, seconded by Hudson, to approve resolution No. 2017-045 consenting to
the issuance of refunding revenue bonds under Minnesota statues, chapter 462c, by the City of
Otsego, for the refunding of outstanding revenue bonds issued by the City of Albertville. Ayes:
Hendrickson, Cocking, Hudson, Olson and Vetsch. Nays: None. Absent: None. MOTION
DECLARED CARRIED.
B. Small Cell Wireless Ordinance Amendments to the Right of Way and Zoning
Chapters of the Albertville City Code
Brixius reported on the new law that cities must allow small cell wireless facilities in the public
right of way. The equipment can be located on City-owned equipment such as power poles or
street lights. Equipment may also be newly installed up to 50 feet tall. Cities cannot prohibit the
location of the facilities in the right of way, but may prohibit them on private property. Cities
may require a conditional use permit if the location is within or adjacent to a residential zoning
district.
Brixius stated the zoning code must be amended to accommodate the small cell wireless facility
location by CUP. The CUP would address high quality building materials and require the
support structure to be located near the corner of the lot. The City’s right of way ordinance must
also be amended to address location in the right of way. Brixius stated one area of concern deals
with the City’s utility lines and staff recommends a 15 foot setback from utility lines. Applicants
would be required to pull a right of way permit and/or enter into an agreement with the City if
locating on City structures.

Olson inquired if there was anything that would prohibit placement of a structure on a home and
Brixius replied there is not.
Motioned by Hudson, seconded by Cocking, to adopt Ordinance No. 2017-11 amending the
Zoning Ordinance relating to small cell wireless facilities. Ayes: Hendrickson, Cocking,
Hudson, Olson and Vetsch. Nays: None. Absent: None. MOTION DECLARED CARRIED.
Motioned by Olson, seconded by Hudson, to adopt Ordinance No. 2017-12 amending Chapter
2, Right of Way Management. Ayes: Hendrickson, Cocking, Hudson, Olson and Vetsch.

8. Department Business
A. Planning/Zoning
1). Karston Cove 4th Addition Concept Plan
Brixius provided a history of the Karston Cove 4th Addition and stated it is currently platted as an
outlot. He stated the developer, Centra Homes North, felt that attached townhomes are not what
the current market is seeking and they hope to build 9 single family homes on the outlot instead.
He stated that part of their development application was approved in 2016 with several
conditions. One of those conditions was that any homes built would need to join the home
owners association (HOA) to the north. Brixius stated that Centra Homes and the HOA are at an
impasse and Centra Homes felt integrating with the HOA would not be feasible. He explained
that the HOA and any new development would not have similar needs or expenses. The
president of the HOA did submit a letter to the City Council stating the HOA would like to be
notified when action is going to be taken on the outlot and that the HOA would like any
development to be as close to the original plan as possible.
Brixius further explained that if single family homes were to be allowed, the outlot would need
to be rezoned as well as a planned unit development application.
Dave Pattberg, Centra Homes, stated that a new wetland delineation was needed and since the
2004 original platting, the wetlands have grown in size. He felt the single family lots would
work better with the smaller development size now.
Pattberg provided sample elevations of the type of housing they were seeking to build. He stated
that the private road from their original plan would not be feasible with the single family homes.
Pattberg addressed the challenges they have had with the HOA. Vetsch stated that he hoped the
HOA and Centra Homes could come to compromise, perhaps a one-time payment to the HOA.
Council discussed the benefits and downside to requiring Centra Homes to join the HOA.

Hudson felt this is similar to when the City amended the City Code to not have the City enforce
HOA covenants. He did not feel the City should be in the business of enforcing covenants and
this is similar. He felt the situation has changed since 2004 and it is a new developer. Tami
Dehn, lawyer for Centra Homes, reported that legally any new properties cannot join the HOA
until their bylaws are amended to allow additional properties to join. The timeframe for that to
happen has since passed and the bylaws would need to be amended.
Brixius stated that to move forward they would need to rezone the outlot and hold the required
public hearings. He inquired of Council if they felt single family homes would be out of place
within the townhomes in the area. Council did not feel it would be out of place and realize that
is what the market is driving. Pattberg felt they have heard what they needed to from the
Council and they will move forward.
B. Public Works/Engineering
1). Hunters Lake Water Budget Analysis
Tim Olson and Jeff Weyandt were present to explain the water budget analysis. Olson reported
on the impact of the lake with removal of the effluent. He explained there would be cycles of
high and low water in the lake with an average decrease of approximately 6 inches of water to
the lake’s water level. He explained the water quality would most definitely improve and would
help to restore the lake as it is currently considered an impaired water body. Nafstad added that
wetlands would not be impacted and there would be minimal impact to School Lake.
Council member Olson inquired if they could implement controls to help regulate the lake level
such as a valve or gate. Nafstad replied they could but would recommend they see how it goes.
He stated that additional water storage capacity is a good thing.
Olson also reported that with the lower lake level, the lake would most likely freeze and the
many carp in the lake would die. Council discussed removal of the carp from the lake.
Olson stated that the study indicated there may be a possible blockage at the outlet channel but
they plan to investigate that further.
Motioned by Cocking, seconded by Olson, to accept the Hunters Lake Water Budget Analysis
report. Ayes: Hendrickson, Cocking, Hudson, Olson and Vetsch. Nays: None. Absent: None.

I. Administration
1). Towne Lakes 6th Addition Home Modifications – Handout at Meeting
Nafstad stated that Henry Hansen was present to discuss possibly amending the design of the
remaining end units of the townhomes being built in Towne Lakes 6th Addition. Hanson
reported that their market research has since revealed that potential buyers are more interested in
two story townhomes than single story townhomes. Therefore, they would like to change the
single story end units on the remaining buildings to partial two story units. He and Doug
Carlson presented the layouts of how the buildings would look. Vetsch would like to see the
façade broken up in some fashion, such as different siding types.

B. Public Works/Engineering - Continued
2). Central Park Property Acquisition
Nafstad reported that two properties along 58th Street are up for sale and the sellers have inquired
if the City is willing to purchase each property. Hendrickson stated the Parks Committee would
like to see the City purchase the property on the corner of 58th Street NE and Lander Ave NE for
park expansion.
Olson felt that unless a portion of the church property (dance studio) was obtained it didn’t seem
feasible to him. Brixius stated the area is zoned B-4 but it is really not suited for a B-4 zoning.
Nafstad reported the lot on the corner of Main Ave NE and 58th Street NE makes sense to turn
into parking as they will lose some parking with Central Park improvements and it could also be
used for the Main Ave NE businesses. Hudson felt that makes sense but cannot see how the
other would bring value to the park. Hendrickson stated the Parks Committee would like
adjusting the location of some of the park amenities. Hudson felt they need to look at cost versus
value. Nafstad stated that attendees at the park events sometimes gather at that property and the
new owner may not be as tolerant as the current resident. Cocking felt the Council is charged
with making the use of City resources (tax dollars) and he cannot see the cost of purchasing the
lot as the best use. Council discussed holding a joint meeting with the Parks Committee.
Couri stated there are really four moving parts to the situation:
-address the church lot and access across the lot if not purchased
-identify purchase prices
-consider not only purchase price, but other costs involved
-get estimates of additional costs
Council directed staff to pursue the issues identified by Couri.
C. City Council
1). Committee Updates
Joint Powers Water Board
Nafstad reported that the Board is looking to extend lines when the CSAH 18 Improvements
occur. He had questions on ownership of the lines.
D. Finance
1). 2018 Property Tax Levy and Final Budget
Lannes reported there were no changes since the preliminary budget.
Motioned by Cocking, seconded by Hudson, to Approve Resolution No. 2017-046 entitled a
Resolution Adopting Property Tax Levy Collectible in 2018 (for 2.89%). Ayes: Hendrickson,
Cocking, Hudson, Olson and Vetsch. Nays: None. Absent: None. MOTION DECLARED

2). Enterprise Funds Update
Lannes reported that the sewer fund would need a base increase of $4.40 to fund operations,
capital, and depreciation and would also need to be annually increased as well. The water fund
would need an increase of $2.50 and continue to increase annually to fund operations, capital,
and depreciation. The recycling fund has $76,797 and some is being used to buy down rate for
residents. Currently, staff time is not being charged to the account which differs from the water
and sewer funds.
E. City Clerk
1). Polling Location Discussion
Hodena reported that four years ago the City’s one polling location was moved to STMA Middle
School West because City Hall was no longer large enough to accommodate the number of
voters. She stated that there are approximately 4,200 pre-registered voters and Albertville is one
of the largest precincts in the state with only one precinct. Whether or not the precinct is split
into two, Albertville needs additional judges and equipment. Election night results could be
obtained faster due to having to process half of the overall ballots at each location. A graph
showing the number of precincts that cities of comparable size was included. Cocking and
Hudson felt it was time to split the precinct. Vetsch agreed. Council directed staff to move
forward with splitting the precinct.

2). Trailblazer Agreement
Nafstad reported that Wright County has agreed to join Wright County Area Transportation
(WCAT) and there is a joint powers agreement for the Council to approve. Each entity that is in
WCAT will need to approve the agreement. Couri pointed out that Wright County will be a
majority funding partner and will have 50% voting rights.
Motioned by Olson, seconded by Vetsch, to approve the agreement between Wright County
and Wright County Area Transportation Joint Powers Board relating to transit. Ayes:

3). City Administrator’s Update
Hendrickson stated that she has only heard good comments about the improvements to the
CSAH 19 and 57th Street NE intersection.

Nafstad reported the agreement with Don’s Bus has been executed for the additional parking for
the ice arena. The parking lot has been graveled and parking stalls identified. He added that
they have added stop signs near the entrance to the arena for safety. The signs have flashing
lights to help drivers see them at night.

Lannes gave a presentation on the proposed levy and 2018 budget. She highlighted the changes
to both revenue and expenditures. The total increase to the levy is 2.89%.

RECOMMENDATION: It is respectfully requested that the Mayor and Council consider the
following:
MOTION TO: Authorize the Monday, December 18, 2017 payment of the claims as presented
except the bills specifically pulled, which are passed by separate motion. The claims listing has
been provided to Council as a separate document. The claims listing is available for public
viewing at City Hall upon request.
BACKGROUND: The City processes claims on a semi-monthly basis. The bills are approved
through their respective departments and administration and passed onto the City Council for
approval.
KEY ISSUES:
• Account codes starting with 810 are STMA Arena Expenses/Vendors (bolded) and
key issues will be presented in the claims listing document.
POLICY/PRACTICES CONSIDERATIONS: It is the City’s policy to review and approve
payables on a semi-monthly basis.
FINANCIAL CONSIDERATIONS: City staff has reviewed and recommends approval of
payments presented.
LEGAL CONSIDERATIONS: The Mayor and Council have the authority to approve all bills
pursuant to Minnesota State Law, which requires all bills to be paid in a timely manner,
generally within 30 days unless one party determines to dispute the billing.

WHEREAS, the City Council is desirous of establishing the 2018 City Observed Holidays for
the City of Albertville effective December 31, 2017; and
NOW, THEREFORE, BE IT RESOLVED that the City Council of Albertville, Wright

RECOMMENDATION: It is respectfully requested that the Mayor and City Council consider
the following:
MOTION TO: Approve Resolution No. 2017-049 Establishing the 2018 City Council Regular
Meeting Dates.
BACKGROUND: Each year the City Council shall identify its official meeting dates for the
coming year.
KEY ISSUES:
• There are several recognized holidays that fall on the first and/or third Mondays
throughout the year. These include:
o Monday, January 1, 2018
o Monday, January 15, 2018 - Martin Luther King Jr. Day
o Monday, February 19, - 2018 - President’s Day
o Monday, September 3, 2018 – Labor Day
The City Council meetings that would normally meet on these days have been moved to
the Tuesday immediately following the holiday.
• Generally, if a fifth Monday falls during a calendar month, the Cities of Albertville and St.
Michael and the STMA School Board have generally set a joint meeting for the fifth
Monday.
POLICY/PRACTICES CONSIDERATIONS: Council may choose to change, add or delete
meetings as needed throughout the year and will be required to post notice at least 72 hours in
advance of changes, cancellations, or additional meetings.
LEGAL ISSUES: The City Council has the authority to set its official meeting dates each year.

SUBJECT: CONSENT - FIRE – 2017 STANDARD OPERATING PROCEDURES AND GUIDELINES
RECOMMENDATION: Staff respectfully requests Council consideration regarding the revised
and updated 2017 Fire Department Standard Operating Procedures and Guidelines.
MOTION TO: Approve the updates to the 2017 Fire Department Standard Operating
Procedures and Guidelines.
BACKGROUND: The current Fire Department Standard Operating Procedures (SOP) and
Guidelines were approved at the April 3, 2017 meeting. During the following months, minor
changes and revisions were worked through by the Fire Department Board of Officers.
The revisions were discussed and approved by the Board of Officers and reviewed by the City
Attorney.
The following is a summary of the 2017 SOP updates:
• Section 3.2.F = Updated turn-out gear language
• Section 3.4.D = Updated the driving of equipment SOP
• Section 3.5.A/B = Updated required wearing of gear and equipment
• Section 5.1.E = Clarified the distinction between training, calls, meetings, activities,
and events.
• Section 5.3.B = Updated training session objectives. Added requirement to be able to
drive and operate all FD vehicles and apparatus before moving off of paid-on-call /
probationary status.
• Section 5.3.E = Clarified the distinction between paid training and calls, and unpaid
meetings, activities, and events.
• Section 5.4.B = Updated training session objectives. Added requirement to be able to
drive and operate all FD vehicles and apparatus as a paid-on-call firefighter.
• Section 5.4.E. = Clarified the distinction between paid training and calls, and unpaid
meetings, activities, and events.
If approved by Council, the updated SOP’s will be discussed and implemented at the January 11,
2018 Fire Department business meeting.

approve policies as they deem necessary.

The Incident Commander, an Officer, or the ranking Firefighter in charge may give permission to remove turn-out gear at appropriate times. a. Complete Turn-out Gear Includes: i. Bunker Coat ii. Bunker Pants iii. Structural Fire Boots iv. Helmet with Eye Protection (chin strap under chin & earflaps down) v. Structural Fire Gloves a. Extrication Gloves allowed on rescue scenes vi. MOTION TO: Approve Ordinance No. 2017-13 entitled An Ordinance Amending Title 6,
Public Safety, Chapter 1, Volunteer Fire Department of the Albertville Municipal Code
BACKGROUND: In response to the addition of a Deputy Chief position to the Albertville Fire
Department Board of Officers, the City Code needs to be amended to account for the new
position and align with the Fire Department Standard Operating Procedures.
KEY ISSUES:
• Updating the City Code to reflect the current composition of the Fire Department Board
of Officers and align the City Code and the Fire Department Standard Operating
Procedures.
POLICY/PRACTICES CONSIDERATIONS:
• Requested change in the City Code include:

AN ORDINANCE AMENDING TITLE 6, PUBLIC SAFETY,
CHAPTER 1, VOLUNTEER FIRE DEPARTMENT OF THE
ALBERTVILLE MUNICIPAL CITY CODE
The City Council of the City of Albertville, Minnesota hereby ordains:
Section 1. Section 6-1-1 (Fire Department Established, Composition) of Chapter 1 (Volunteer
Fire Department) is hereby amended to read as follows:
6-1-1: FIRE DEPARTMENT ESTABLISHED; COMPOSITION:
There is hereby established in the city a volunteer fire department, consisting of a fire
chief, a deputy fire chief, an assistant fire chief, a department president, a department
vice-president, a department secretary, a board of officers, and not less than ten (10) nor
more than thirty-three (33) firefighters, including the above positions. The number of
firefighters shall be determined by the city council.
Section 4. Section 6-1-4 (Board of Officers) of Chapter 1 (Volunteer Fire Department) is hereby
amended to read as follows:
A. Composition: The board of officers of the department shall consist of the fire chief,
deputy fire chief, assistant fire chief, three (3) captains, three (3) lieutenants,
president, vice-president, and secretary.
B. Secretary: The department secretary shall serve as the secretary of the board of
officers and shall be a nonvoting member.
C. Duties: The duties of the board of officers shall be set forth in the department’s
Standard Operation Procedures.
Section 6. Section 6-1-6 (Duties of Department Officers) of Chapter 1(Volunteer Fire
Department is hereby amended to read as follows:
The duties of the fire chief, deputy fire chief, assistant fire chief, and all other elected or
appointed officers of the department shall be set forth in the Standard Operating
Procedures of the department.

RECOMMENDATION: It is respectfully requested that the Mayor and City Council consider
the following:
MOTION TO: Approve Ordinance No. 2017-2017-14 An Ordinance Amending Title 3,
Chapter 1, Section 3-1-3 (City Fees, Fines and Rates Schedule and Other Various Titles in the
Albertville Municipal Code.
BACKGROUND: In January 2017, the Albertville City Code was amended to list all fees in the
Code book in one table. This was completed to improve ease of access for staff or the general
population; would improve ease of review and update by City staff and Council; and would
reduce the range of amendments through the City Code if fees or charges are changed.
Annually, the City reviews fees to ensure fees cover service costs. Listed below are the most
significant changes to the fee table:
KEY ISSUES:
• Room/facility rental fees were increased to cover maintenance costs associated with room
rentals and to fund commercial cleaning of the kitchen. Civic organizations still receive
one room free (up to four hours) per month.
• Fees were added for setup and use of the audio/visual equipment.
• Included fees associated with small cell wireless facility collocation.
• Included the recycling fee and buy down amount.
• Incorporated building permit flat fee costs.
• Removed plumber license fee as the City does not license plumbers.
• Corrected the false alarm fee to reflect fee after the third false alarm.
• Added language that the City charges a fee for fire lock/key boxes and fire suppression
inspections.
• Removed reference to fee for a final Certificate of Occupancy. That cost is included in
the cost of the building permit.
• Included actual fee for fire response rather than reference the Wright County Fire Chief
Association rate schedule.
• Reduced the fee for a temporary one day intoxicating liquor license from $200.00 to
$100.00. This more accurately reflects actual costs and was a request from the local non-
profit groups.
• Increase fence permit fee from $25 to $50 to cover for permit review and site inspection.
• Added a fee to cover the cost of consultant to prepare a zoning letter.

Section 2. Title 3, Chapter 5, Section 2.A1 (False Alarms) is hereby amended to read as follows:
a. False Alarms: Fees for response to false fire alarms and false carbon monoxide
alarms shall be charged to the property owner or tenant for any incident after the third
call to the property within a twelve (12) month period.
Section 3. Title 9, Chapter 3, Section 3 (Fees and Charges) is hereby amended to read as follows:
A. Sewer Connection And Inspection Fee: No connection shall be permitted to the city
sewer system until a permit and inspection fee, as established in section 3-1-3 of this
code, has been paid to the city. Any reinspection fee is established in section 3-1-3 of this
code per occurrence. A twenty four (24) hour notice is required before the inspection will
commence.
B. User Charges: Each user of sewer service shall pay the charge(s) applicable to the user
class type of service as established in section 3-1-3 of this code. (Ord. 2017-01, 1-3-
2017)
C. Responsibility For Charges: All charges authorized by this chapter shall be imposed
against the owner of the premises or against the owner and occupant, jointly and
severally, if the premises is not owner occupied. The owner shall be responsible for
monitoring and shall be liable for sewer service supplied to the owner's property, whether
the owner is occupying the property or not, and all charges shall be a lien upon the
property until paid. All charges shall be due and payable as provided in this chapter or as
provided by separate resolution of the city council or by administrative billing statement,
if not provided in this section. Any unpaid charges shall constitute a lien against the
premises from and after the date they were due and unpaid and shall be certified to the
county auditor for collection with real estate taxes, which shall be in addition to any other
remedies available to the city.
D. Delinquent Accounts: Delinquent accounts shall be certified by the finance director
who shall periodically prepare an assessment roll each year providing for assessment of
the delinquent amounts against the respective properties served. The assessment roll shall
be delivered to the city council for adoption for certification to the county auditor for
collection along with taxes. Such action is optional and may be subsequent or in addition
to taking other legal action to collect delinquent accounts.
E. Discontinuance Of Service: The city may discontinue water service to any premises
pursuant to subsection 9-2-11B of this title which has an outstanding delinquent sewer
billing sixty (60) or more days past due.
Section 4. Title 10, Chapter 1, Section 1C (Certificate of Occupancy for Commercial and
Industrial Buildings) shall be amended as follows:

C. Fee: Applications for temporary certificate of occupancy shall be accompanied by a
fee as established in section 3-1-3 of this code. (Ord. 2017-01, 1-3-2017)
Section 5. Title 10, Chapter 2, Section 3 (Permits and Fees) shall be amended as follows:
The issuance of permits and the collection of fees shall be as authorized in Minnesota
statutes section 326B.153, subdivision 1.
Section 6. Title 10, Chapter, Section 8A. (Key Box and As Built Plans) shall be amended as
follows:
A. Key Box: When access to or within a multi-housing building of three (3) or more units
or other multi-housing, commercial or industrial structure, or an area is unduly difficult
because of secured openings, or where immediate access is necessary for lifesaving or
firefighting purposes, the chief of the fire department may require a key box to be
installed in an accessible location. The key box shall be a type approved by the chief of
the fire department and shall contain keys to gain necessary access as required by the
chief of the fire department. A fee as established in section 3-1-3 of this code will be
required.
Section 7. Title 10, Chapter 3, Section 9 A and B (Fire Safety Inspections) shall be amended as
follows:
A. All new construction in which a fire suppression system or a fire alarm system is
installed shall be inspected by the city's fire chief or fire marshal and shall satisfactorily
pass such inspection prior to the issuance of an occupancy permit for such structure. The
owner of any building so inspected shall pay a fee as established in section 3-1-3 of this
code for such inspection.
B. The owner of any building which has been the subject of a fire safety inspection for
which the city's fire chief or fire marshal has to return to the building to reinspect any
violation of the fire code found on a previous inspection shall pay a fire inspection fee as
established in section 3-1-3 of this code per visit by the fire chief or fire marshal,
commencing with the third return inspection addressing the same violation. There shall
be no charge for the initial inspection plus two (2) return inspections addressing the same
issue.
This ordinance shall be in full force and effective immediately following its passage and
publication.

SUBJECT: CONSENT – MNDOT DELEGATED CONTRACTING PROCESS AGREEMENT
RECOMMENDATION: It is respectfully requested that the Mayor and Council consider the
following:
MOTION TO: Approve Resolution No. 2017-050 Approving Entering Into the State of
Minnesota Agency Agreement Between Department of Transportation and the City of
Albertville for Federal Participation in Construction.
INFORMATION: This agreement between the City and MnDOT allows for MnDOT to act as
the City’s agent in accepting federal aid monies. The agreement is intended to cover all federally
funded projects that the City is awarded funds for until revisions are needed to the agreement.
This agreement supersedes the agreement (No. 99998) executed in 2011, which is referenced in
the agreement. In general, the agreement outlines the roles and responsibilities of the City and
MnDOT in conducting the Delegated Contract Process (DCP) including project administration,
letting, and payments.
KEY ISSUES:
• This agreement is required for Albertville to receive federal funds through MnDOT.
• This is a MnDOT Standard Agreement, which is a requirement of Federal Highway.
• This is not an agreement for a specific project.
• This agreement supersedes and is an updated version of the 2011 Agency Agreement.
POLICY CONSIDERATIONS: It is the City’s Policy for the Mayor and City Council to
approve all agreements and contracts entered into on behalf of the City.
FINANCIAL CONSIDERATIONS: There are no financial impacts associated with execution
of this agreement. This agreement allows the City to receive awarded federal funds from Federal
Highway through MnDOT. Financial considerations will be on a project by project basis.
LEGAL CONSIDERATIONS: The Mayor and Council possess the authority to approve or

BE IT RESOLVED, that pursuant to Minnesota Stat. Sec. 161.36, the Commissioner of
Transportation be appointed as Agent of the City of Albertville to accept as its agent, federal aid
funds which may be made available for eligible transportation related projects.
BE IT FURTHER RESOLVED, the Mayor and the Clerk are hereby authorized and
directed for and on the behalf of the City to execute and enter into an agreement with the
Commissioner of Transportation prescribing the terms and conditions of said federal aid
participation as set forth and contained in Minnesota Department of Transportation Agency
Agreement No. 1029912”, a copy of which said agreement is on file with the office of the City
Clerk and which is made a part hereof by reference.

SUBJECT: ADMINISTRATION – REQUEST FOR THE STATE OF MINNESOTA TO DEED TAX
FORFEITED PROPERTIES TO THE CITY
RECOMMENDATION: It is respectfully requested that the Mayor and Council consider the
following motion:
MOTION TO: Adopt Resolution No. 2017-051 Requesting the State of Minnesota to Deed Tax
Forfeited Land to the City of Albertville.
BACKGROUND: Wright County has recently forwarded to the City a property that has gone
tax forfeit in the County. City Staff recommended to the Council at the October 16, 2017 City
Council meeting that the City acquire the parcel. Staff was directed by the Council to indicate to
Wright County of the City’s intent to purchase the lot and attempt to negotiate a price on the
parcel. A resolution to that effect was prepared by the City Attorney and sent to Wright County.
Staff received notice within the last few weeks of the price the Wright County Board approved
for the parcel. The price set by the County Board for the parcel is $15,000. Fees and taxes
associated with the sale are $615.50, for a total purchase price of $15,615.50. Staff is seeking
feedback from Council on whether to purchase the parcel for that amount.
KEY ISSUES:
• The County Board has approved the sale to the City.
• Currently this is not a developable parcel, as it does not have sewer or water. Once
utilities have been extended to this area, the parcel could be developed.
• Purchasing this parcel would allow the city to use it for highway or drainage easement, if
needed.
FINANCIAL CONSIDERATIONS: The cost of the property is $15,615.50, which can be paid
from the general fund.
LEGAL CONSIDERATIONS: The City Council can purchase property for public use on the
behalf the City.

RESOLUTION REQUESTING THE STATE OF MINNESOTA TO DEED TAX
FORFEITED LANDS TO THE CITY OF ALBERTVILLE
WHEREAS, Wright County informed the City that several properties in the
City have been forfeited for failure to pay taxes and that the City could acquire such
properties for a lawful public use under Minn. Stat. 282.01, Subd. 1a; and
WHEREAS, the City desires to acquire one of the tax forfeited properties
pursuant to Minn. Stat. 282.01, Subd.1a.(b) for economic development purposes; and
WHEREAS, Wright County informed the City that the property identified by
PID no. 101-124-004030 has been forfeited for failure to pay taxes and that the City
could acquire such property for a lawful public use under Minn. Stat. 282.01, Subd.
1a;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ALBERTVILLE, WRIGHT COUNTY, MINNESOTA:
1. The Public Works Director is directed to notify Wright County in writing that
the City of Albertville intends on acquiring the following property for a
lawful public purpose under Minn. Stat. 282.01, Subd. 1a(b):

City Administrator’s Update

GENERAL ADMINISTRATION
Planning Commission Interviews: Interviews are scheduled for December 18 at 6:30 p.m. prior
to the Council meeting.
Ice Arena Temporary Parking: Staff has executed the agreement and submitted payment to
Don’s Bus for the temporary parking agreement and our public works crews have set up the lot
to accommodate approximately 95 stalls. We have also changed the intersection of Lachman
Avenue and 60th Street to an all-way stop controlled intersection and are working with Xcel to
improve lighting along Lachman.
Ice Arena Management Agreement: All three entities have approved the agreement and it is
being circulated for execution.
Board/Committee Appointments: Council will need to approve board and committee
appointments at the meeting. Let the Mayor or me know if you would like make any changes
to the appointments.
Polling Locations: Based on conversations with Secretary of State’s office and Wright County, it
will take additional time to change the boundary lines of the precinct(s), resulting in the
splitting of the precinct in 2020 rather than 2018. This will allow the judges to work together as
one group with new equipment for 2018 before splitting to two precincts in 2020. Additionally,
the three new developments should be built by that time and will help to even out the
population between the two precincts.
ENGINEERING/PUBLIC WORKS
CSAH 18 (Barthel to Naber) Improvements: I have attached the most recent concept of the
roundabout planned for the 50th Street, Barthel/MacIver intersection.
CSAH 19 Median Lights: We are working with an electrician to update the decorative median
lights to LED.
Sliding Hill: Staff is reviewing options for a sliding hill in Central Park.
Park Property: Staff is researching park property pursuant to previous Council discussions.
CSAH 19 and 57th Street Signal Improvements: In the spring the Contractor will need to sod all
disturbed areas, and paint the signal poles and mast arms per the contract.
