Hendrickson reported she attended the Albertville Royalty Coronation ceremony and they will be
giving City Hall a new picture of the Royalty. She congratulated the new Royalty:

B. Planning/Zoning
1) Towne Lakes 6th Addition PUD Amendment and Variance
Hendrickson called for a motion to open the public hearing.
Motioned by Cocking, seconded by Olson, to open the public hearing. Ayes: Hendrickson,
Cocking, Hudson, Olson, and Vetsch. Nays: None. Absent: None. MOTION DECLARED
CARRIED.
Nafstad provided a review of the development application and explained the applicants are seeking
an amendment to the formerly approved Planned Unit Development (PUD) and a variance to the
PUD standards. The application is for 42 townhomes and six single-family homes. The PUD
amendment is needed for reduced front yard setbacks and the variance is needed for a reduction in
spacing between buildings for the townhomes. He indicated the development will be consistent with
current Towne Lakes architecture.
The City Planner recommends eliminating the rock mulch between driveways in favor of a concrete
gutter. He also recommended replacing evergreen trees on four lots with deciduous trees.
Vetsch inquired about snowplowing and placement of snow. Nafstad replied that is one reason staff
recommends removing the rock landscaping, but the plans also need to be revised to identify snow
storage. Hansen added that often the company hired to plow will also take snow off-site.

Hendrickson was somewhat concerned with the size of the garages and Nafstad reported it is
consistent with what was previously approved.
Nafstad reported that part of the development agreement requires the developer to construct a
sidewalk and landscape the boulevard to the west of the development. The applicants have
requested that requirement be removed and staff felt that was reasonable. Couri stated that if it
isremoved from the development agreement there may not be anything the City can do to require the
purchaser of the future commercial outlet to the west to build it. He stated that the revised
development agreement will need to be approved at the next meeting and he and the planner can
work something out in the agreement to address it. Both Cocking and Hendrickson would like to see
it landscaped and have a finished feel to the neighborhood. Nafstad added that vacation of utility
and drainage easements will be needed on small portions of four lots in order to accommodate the
footprint of the townhome design and that will be before Council at the next meeting as well.
Nafstad invited the development team to address the Council. Hansen explained that he had met
with the Towne Lakes Homeowners Association (HOA) and the HOA had asked for a first floor
powder room added into the townhome design. The group was willing to accommodate that request
and felt it made for a more marketable design. Vetsch inquired about the square footage of the
townhomes. Hansen replied they are just less than 2,000 square feet.
Cocking inquired about the design of the six single-family homes and Hansen replied they would
also follow the current Towne Lakes architectural standards.
Hendrickson called for comments from the public. There were no comments given.
Motioned by Cocking, seconded by Olson, to close the public hearing. Ayes: Hendrickson,
Cocking, Hudson, Olson, and Vetsch. Nays: None. Absent: None. MOTION DECLARED
CARRIED.
Nafstad provided a recap of the resolution before Council.
Olson had concerns about the variance and if that would set precedence. Couri replied that variances
are unique to each property and there is no justification to grant a different applicant a variance just
because one has been granted before. Olson further inquired if the development should be replatted.
Hansen explained that they are utilizing the existing utilities and it would not be cost effective.
Couri stated that it will also save time and allow the developer to move forward with development
more quickly.
Motioned by Cocking, seconded by Hudson, to adopt Resolution No. 2017-013 Approving the
Towne Lakes 6th Addition Planned Unit Development Amendment within the City of Albertville.
Ayes: Hendrickson, Cocking, Hudson, Olson, and Vetsch. Nays: None. Absent: None. MOTION

C. Public Works/Engineering
1) 7090 69th Circle NE Shed License Agreement
Nafstad reported that this is the property he had discussed with the Council at the last meeting where
the homeowner wants to build a shed in the utility and drainage easement. He explained that if the
catch basin would overtop, the shed would be two feet higher than the catch basin and water would
then follow the swale and shouldn’t impact the shed. Council was in agreement with approving the
agreement.
Motioned by Hudson, seconded by Olson, to approve the license agreement for 7090 69th Circle
NE for a shed to be located on drainage and utility easements. Ayes: Hendrickson, Cocking,
Hudson, Olson, and Vetsch. Nays: None. Absent: None. MOTION DECLARED CARRIED.

I. Administration
1) City Administrator’s Update
Nafstad updated Council on the progress of the 2017 Streets and Trail Improvements project. He
stated that staff has received requests from residents to replace the entirety of their driveway during
the project rather than just replacing the section that was removed during construction. Staff could
work with the contractor and then offer an assessment agreement to the homeowner for their portion
of the costs. He felt this was good to offer residents and many driveways in the neighborhood are in
need of replacement.
Couri spoke about the risk to the City in such an agreement and stated it holds a small risk but he
suggests that those residents sign an assessment waiver that says they will not object to the
assessment.
Olson inquired about the duration of the agreement. Couri replied he would recommend no more
than five years and an interest rate of two points above the City’s bond interest.
Motioned by Hudson, seconded by Olson, to approve the City Administrator to enter into
assessment agreements with residents for replacement of their driveways. Ayes: Hendrickson,
Cocking, Hudson, Olson and Vetsch. Nays: None. Absent: None. MOTION DECLARED

Nafstad reported staff will be drafting an agreement that will allow Albertville to provide wastewater
service to the Montgomery development in St. Michael.
Hudson excused himself from the meeting at 8:15 p.m.
Cocking inquired about the Mall of Entertainment AUAR. Nafstad replied the draft traffic study is
in and they will be meeting with the development group on Wednesday next week. Olson inquired if
staff has seen any plans and Nafstad replied they have seen some preliminary plans, but nothing has
been officially submitted.
Olson excused himself from the meeting at 8:20 p.m.
Cocking inquired about the possible truck stop in Otsego, specifically how the City could make
comments or action the City can take. Nafstad replied the draft study is on the Otsego website and
until there is an application submitted, there will not be a public comment period. He did say the
traffic study did not address the mingling of residential and truck traffic. Hendrickson stated she had
concerns about safety.

BACKGROUND: The City processes claims on a semi-monthly basis. The bills are approved
through their respective departments and administration and passed onto the City Council for
approval.
KEY ISSUES:

POLICY/PRACTICES CONSIDERATIONS: It is the City’s policy to review and approve
payables on a semi-monthly basis.

LEGAL CONSIDERATIONS: The Mayor and Council have the authority to approve all bills
pursuant to Minnesota State Law, which requires all bills to be paid in a timely manner,
generally within 30 days unless one party determines to dispute the billing.

MOTION TO: Approve the following street closures for Open Streets on Saturday, September
16, 201:
• Main Ave. NE south of the railroad tracks to 58th St. NE
• 58th St. NE to Lander Ave. NE
• Lander Ave. NE to 57th St. NE
BACKGROUND: This year, the annual Open Streets event will be held on Saturday, September
16, 2017. Open Streets is a national initiative to temporarily close streets to automobile traffic
and promote healthy living and physical activity. There will be local vendors at the event as well
as free family activities.

KEY ISSUES:
• This is the fourth annual Open Streets event in Albertville.
• Last year, there were over 50 vendors and 2,000 participants at the event.
• FYCC has already contacted the Wright County Sheriff’s Office for security and traffic
control.
• FYCC is seeking approval of the street closures so they may begin marketing the event to
possible vendors.
• FYCC has confirmed no large events at St. Albert’s is scheduled for that day and has also
spoken to the Main Avenue NE businesses of Kay Marie Dance Studio, 152 Club, Geez, and
Neighbors.
• A mailing to all surrounding residents will also be sent prior to the event.
POLICY/PRACTICES CONSIDERATIONS: The Mayor and City Council have the authority
to approve or deny requests for street closures.

We see Open Streets STMA as the perfect chance to promote healthy living, local
businesses and civic pride in St. Michael and Albertville. On September 16, 2017
from 10:00 a.m. to 2:00 p.m. we will create safe, car-free streets so that residents
of all ages can walk, bike, participate in activities, and get to know one another.
Family Youth Community Connections (FYCC) is requesting permission to close
down the following streets:
• Main Ave. NE south of the railroad tracks to 58th St. NE
• 58th St. NE to Lander Ave. NE.
• Lander Ave. NE to 57th street NE
We would like to request this closure from 8:00 a.m. to 3:00 p.m. on Saturday to
allow set up and clean up time. Contact has been made with the following
businesses that will be affected by this closure St. Albert’s Parish, Kay Marie
Dance Studio, 152 Club, Geez, and Neighbors.
FYCC has contacted the Wright County Sheriff’s Department and they will be on
site for security as we expect a couple thousand people to attend the event along
with fifty plus vendors.

ACCOUNTS RECEIVABLE: Total accounts receivable outstanding through June 30, 2017 is
$85,441.50.
The percentage of the total due based on the aging report is as follows:

• The majority of the 60-90 days outstanding are rental licenses and if they do not pay or

PRACTICES/POLICY CONSIDERATIONS: The Mayor and Council review quarterly

RESOLUTION VACATING PORTIONS OF DRAINAGE AND UTILITY EASEMENTS
IN TOWNE LAKES 6TH ADDITION
WITHIN THE CITY OF ALBERTVILLE
WHEREAS, the City Council, pursuant to a petition submitted to it by HSB
Ventures, LLC under Minnesota Statute §412.851, did hold a public hearing on July 17,
2017 at 7 p.m. at the Albertville City Hall. At said time and place the City Council heard all
interested parties on whether to vacate portions of drainage and utility easements described
below in this resolution.
WHEREAS, all notice requirements of Minnesota Statute §412.851 have been
satisfied; and
WHEREAS, the City Council finds and determines that it is in the public interest to vacate
those portions of the drainage and utility easements described below as such easements are no
longer required by the City.
NOW THEREFORE BE IT RESOLVED that the City Council of City of Albertville,
Wright County, Minnesota does hereby order as follows:
1. That the drainage and utility easements dedicated in the plat of TOWNE LAKES
6TH ADDITION, lying within Block 1 of said TOWNE LAKES 6TH
ADDITION and described below are hereby vacated:
The north 6.00 feet of Lot 1 of said Block 1.
And
That part of Lot 4 of said Block 1, lying southerly of the following described line:
Beginning at a point on the south line of said Lot 4, said point being 43.46 feet
west of the southeast corner of said Lot 4 as measured along said south line;
thence northwesterly to a point on the west line of said Lot 4 lying 32.28 feet
south of the northwest corner of said Lot 4 as measured along said west line and
terminating thereat.
And
That part of Lot 5 of said Block 1, lying northerly of the following described line:

CITY OF ALBERTVILLE
SECOND AMENDMENT TO PLANNED UNIT
DEVELOPMENT AGREEMENT
TOWNE LAKES 6TH ADDITION
WHEREAS, the City of Albertville (“City”), a Minnesota municipal corporation, and
Contractor Property Developers Company entered into an Agreement titled “Planned Unit
Development Agreement Towne Lakes 6th Addition” (“Developer’s Agreement”) dated
September 7, 2005 and recorded as document number 1003634 at the Wright County Recorder’s
Office, Wright County, Minnesota; and
WHEREAS, Kilber Section 36, LLC (“Kilber”), a North Dakota limited liability
company, purchased the property subject to the Developer’s Agreement; and
WHEREAS, Kilber and the City executed an Amendment to Planned Unit Development
Agreement, Town Lakes 6th Addition (“First Amendment”) which has been recorded as
document number 1164289 at the Wright County Recorder’s Office; and
WHEREAS, Kilber has since sold the property that is the subject of the Developer’s
Agreement and the First Amendment to HSB Ventures, LLC., a Minnesota Limited Liability
Company (“Developer”); and
WHEREAS, Developer acknowledges that it is bound by the Developer’s Agreement
and the First Amendment by virtue of its ownership of the property subject to the Developer’s
Agreement and all references hereafter in this Amendment, the First Amendment and in the
Developer’s Agreement to “Developer” shall mean HSB Ventures, LLC;
NOW, THEREFORE, IT IS HEREBY AND HEREIN MUTUALLY AGREED, in
consideration of each party’s promises and considerations herein set forth, as follows:
1. Paragraph 2.A. of the Developer’s Agreement is hereby amended to read as follows:
A. Developer and the City recognize that setbacks within the Development will vary
depending on housing type to be constructed. However, Developer agrees that setbacks
shall be consistent with the templates provided by Developer, which are attached hereto
as Exhibit C, but in no event shall be less than those set forth below:
1. Front yard setbacks not less than 16 feet from public street right-of-way.
2. Side yard setbacks of 12.3 feet for Lots 19 and 24 from public street right-
of-way.
3. Side yard setbacks of 14 feet for Lots 1 and 42 from the 70th Street right-of-
way.

4. Garages shall be set back a minimum of 22 feet from private streets.
5. Setbacks between buildings shall be not less than eight feet. All buildings
must have a fire suppression system and have approved fire wall
construction where setbacks are less than 10 feet.
6. Side yard setbacks from private streets shall not be less than 8.3 feet.
2. Paragraph 2.B. is hereby amended to read as follows:
B.
1. The townhomes shall be constructed in the locations identified in the plans
attached hereto as Exhibit D. The townhomes shall be designed and constructed
consistent with plans attached hereto as Exhibit E.
2. Building design and exterior finishes shall be per building plans dated 6/1/17.
3. Exhibit D to the Developer’s Agreement is hereby replaced with the Exhibit D attached
hereto.
4. Exhibit E to the Developer’s Agreement is hereby replaced with the Exhibit E attached
hereto.
5. Paragraph 2.T. is hereby added to the Developer’s Agreement, as follows:
T. Dedication and Construction of Large Avenue.
i. Upon the execution of this Second Amendment, Developer shall dedicate
that portion of the proposed right of way of Large Avenue located on the
Subject Property to the City in substantially the configuration as shown on
the attached Exhibit H. Developer shall provide a legal description for
such dedication that meets the approval of the City Engineer and City
Attorney.
ii. Developer understands and agrees that the construction of Large Avenue
according to the plans attached as Exhibit H is necessary to serve as an
access point to the Development as well as to the property adjoining the
Development on the east property line of the Development (“Adjoining
Property”). At the time of the signing of this document, it is not known
whether the Development or the Adjoining Property will first plat property
abutting Large Avenue. Developer agrees that if it plats property abutting
large Avenue prior to the Adjoining Property, Developer shall dedicate and
construct the entire width of Large Avenue consistent with plans and
specifications as required by the City Engineer. In such event, Developer
shall pay one-half of the cost of the construction of Large Avenue and the

owner of the Adjoining Property shall pay the other half pursuant to a
separate agreement with the City.
iii. In the event the Adjoining Property is the first to plat property abutting Large
Avenue, the owner of the Adjoining Property shall construct Large Avenue
and Developer shall pay the owner of the Adjoining Property one-half of the
cost of constructing Large Avenue.
iv. All such payments made pursuant to paragraphs 2.T.ii. or 2.T.iii. shall be
made within 30 days of billing by either party, provided the City Engineer
has first confirmed that the costs billed for approximately correspond to
quantities installed. Engineering costs incurred by the City in the design and
inspection of Large Avenue as well as any other costs incurred by the City
related to the construction of Large Avenue shall be included in the costs of
construction of Large Avenue, and Developer agrees to pay one-half of such
costs incurred by the City within 30 days of billing by the City. Any billing
dispute which may arise between the Developer and the owner of the
Adjoining Property shall not be a basis for delay in the completion of Large
Avenue.
v. In the event the Adjacent Property owner constructs Large Avenue,
Developer shall provide the City with temporary construction easements
over the Subject Property as necessary for the construction of Large Avenue.
6. The Exhibit H attached to this Agreement is hereby made Exhibit H to the
Developer’s Agreement.
7. Variances are approved to allow the following setbacks:
a. Setbacks between buildings not less than eight feet. All buildings
must have a fire suppression system and have approved fire wall
construction where setbacks are less than 10 feet.
b. Side yard setbacks from private streets shall not be less than 8.3 feet.
8. Building design and exterior finishes shall be per building plans dated 6/1/17 on
file with the City Clerk’s Office.
9. Lancaster Way shall be signed to allow on-street parking on the west side of the
street.
10. The private streets shall be designed and constructed at 22 feet. Said private
drives shall be signed “no parking – fire lane.”

11. The townhome units shall have a minimum garage size of 440 square feet.
12. The landscape plan attached to the Developer’s Agreement as Exhibit F is hereby
replaced with the Landscape Plan attached hereto as Exhibit F, and is approved
with the following conditions:
A. The Public Works Director approves the species and location of all boulevard
trees.
B. The applicants shall erect a six foot vinyl fence along the west lot line of Lot
44 of the 6th Addition.
13. Mailboxes shall be clustered in a manner in a location approved by the City
Planner and the Post Office.
14. Paragraph 3A of the Developer’s Agreement is modified to read as follows:
A. On or before October 31, 2017, the Developer shall construct those Municipal
Improvements located on Said Plat as detailed in the Plans and Specifications for
Towne Lakes Sixth Addition, as prepared by Westwood Professional Services dated
February 8, 2005 and revised September 22, 2005 and on file with the City Clerk,
including completion of all items listed on the attached Exhibit A, except that
completion of the following items may be delayed as follows:
i. Sidewalks shall be installed consistent with the timeline set out in
this subparagraph:
a. On the south Side of 68th Street, between Linwood Drive and
Wright County State Aid Highway No. 19 (the Shoppes at
Towne Lakes 2 plat), the sidewalk shall be installed by
Developer when a building is constructed on the lot adjacent to
68th street where there is no sidewalk currently.
b. On the north Side of 68th Street, between Linwood Drive and
Wright County State Aid Highway No. 19 (Outlot A to Said
Plat), the sidewalk shall be installed by Developer when a
building is constructed on the lot adjacent to 68th street, and such
sidewalk shall extend from the western edge of said lot east to the
intersection of 68th Street and Linwood Drive.
c. On the west side of Linwood Drive north of 68th Street, the
sidewalk shall be installed by Developer when a building is
constructed on a lot adjacent to Linwood Drive, and such
sidewalk shall extend from 70th Street to 68th Street.
d. On the east side of Linwood Drive, north of 68th Street, the
sidewalk shall be installed by Developer adjacent to the
townhomes abutting Linwood Drive prior to the issuance of an

occupancy permit for such townhomes, and such sidewalk shall
extend south to the intersection of Linwood Drive and 68th Street.
e. On the west side of Lancaster Way, north of 68th Street, the
sidewalk shall be installed by Developer adjacent to the
townhomes abutting Lancaster Way prior to the issuance of an
occupancy permit for such townhomes, and such sidewalk shall
extend south to the intersection of Lancaster Way and 68th Street.
f. Notwithstanding the foregoing, all sidewalks shall be installed no
later than the earlier of 1) the time of issuance of the final
occupancy permit for the last residence to be constructed on Said
Plat or 2) four years from the date of this Agreement.
ii. Final finish grading of lots shall be performed prior to issuance of an
occupancy permit, but Developer shall ensure that the Subject
Property drains in a manner consistent with the grading and drainage
plan attached to the Developer’s Agreement and shall immediately
correct any areas of the Subject Property that do not drain properly.
iii. All such improvements shall be constructed at Developer’s expense
according to the standards adopted by the City, along with all items
required by the City Engineer. The City Engineer will promptly
inspect the Municipal Improvements upon their completion and,
when satisfactorily completed, recommend acceptance of such
improvements by the City Council. The City Council shall not
unreasonably withhold acceptance of such completed Municipal
Improvements.
15. Paragraphs 6A and 6B of the Developer’s Agreement are hereby modified to read as
follows:
A. Developer will provide the City with an irrevocable letter of credit as security that
the obligations of the Developer under this contract shall be performed. Said letter
of credit or surety shall be in the amount of $116,525. Said letter of credit or surety
must meet the approval of the City attorney as to form and issuing bank.
B. The City may draw on said letter of credit or surety to complete work not performed
by Developer (including but not limited to on- and off-site improvements, Municipal
Improvements described above, landscaping, erosion control, and other such
measures), to pay liens on property to be dedicated to the City, to reimburse itself for
costs incurred in the drafting, execution, administration or enforcement of this
Agreement, to repair or correct deficiencies or other problems which occur to the
Municipal Improvements during the warranty period, or to otherwise fulfill the
obligations of Developer under this agreement.

16. Paragraphs 7A and 7B of the Developer’s Agreement are hereby modified to read as
follows:
A. Periodically, as portions of the Municipal Improvements and landscaping are
completed, and when it is reasonably prudent, the Developer may request of the City
that the surety be proportionately reduced for that portion of the Municipal
Improvements and landscaping which have been fully completed and payment made
therefor. All such decisions shall be at the discretion of the City Council. The City's
cost for processing reduction request(s) shall be billed to the Developer. Such cost
shall be paid to the City within thirty (30) days of the date of mailing of the billing.
The City may at all times retain the letter of credit in an amount sufficient to
complete the unfinished Municipal Improvements and landscaping required by the
Developer’s Agreement.
B. The Developer may request of the City a reduction or release of any surety as
follows:
i. When another acceptable letter of credit or surety is furnished to the City to
replace a prior letter of credit or surety.
ii. When all or a portion of the Municipal Improvements or landscaping have
been installed, the letter of credit or surety may be reduced pursuant to
paragraph 7A above, except that the City shall retain the letter of credit or
surety in the amount of 10% of the estimated construction price of the
Municipal Improvements during the first year of the warranty period and 5%
of the estimated construction price of the Municipal Improvements during
the second year of the warranty period.
iii. As to all requests brought under this paragraph, the City Council shall have
complete discretion whether to reduce or not to reduce said letter of credit or
surety.
17. The boulevard trees located on the Landscape Plan attached to the
Developer’s Agreement shall be installed consistent with the timelines set out in this
paragraph:
a. On the east side of Linwood Drive, upon the issuance of an occupancy permit for
townhomes abutting Linwood Drive, but only from such townhomes south to the
intersection of Linwood Drive and 68th Street.
b. Developer shall not be required to install trees on the west side of Linwood Drive or
on 68th Street west of Linwood Drive.
c. On 68th Street between Linwood Drive and Lancaster Way, upon the issuance of an
occupancy permit for any of the townhome units abutting 68th Street.
d. On the west side of Lancaster Way, upon the issuance of an occupancy permit for
townhomes abutting Lancaster Way, but only from such townhomes south to the
intersection of Lancaster Way and 68th Street.

e. On the east side of Lancaster Way, upon the issuance of an occupancy permit for a
single family home, but only where trees are abutting the lot that contains such
single family home.
f. Notwithstanding the foregoing, all boulevard trees required to be installed by this
paragraph shall be installed no later than the earlier of 1) the time of issuance of the
final occupancy permit for the last residence to be constructed on Said Plat or 2) four
years from the date of this Agreement.
18. City and Developer agree that HSB Ventures, LLC, as successor to Contractor Property
Developers Company under the Developer’s Agreement, shall not be liable for any of
Contractor Property Developers Company’s obligations under developer’s agreements
pertaining to the Towne Lakes first, second, fourth, or fifth additions, and that HSB
Ventures, LLC’s liability under the developer’s agreement pertaining to Towne Lakes
Third Addition, recorded in the Wright County Recorder’s Office as document number
894487, shall arise only to the extent that HSB Ventures, LLC is the successor to
Contractor Property Developers Company in the Towne Lakes Sixth Addition Developer’s
Agreement. Notwithstanding this paragraph, Developer shall not be released from any
liability arising from a wetland permit covering land in the Towne Lakes Sixth Addition,
regardless of whether that permit also covers prior Towne Lakes additions.
19. Developer shall take all necessary steps to amend the NPDES permit for Said Plat to
make Developer the responsible party under such permit.
20. Upon 1) the execution of this Agreement by the City and Developer, and 2) the posting
of an acceptable letter of credit with the City by Developer, Kilber shall be released
from all obligations of the Developer’s Agreement and the First Amendment, and the
City shall release the entire remaining balance of Kilber’s letter of credit via a written
acknowledgement to the issuing bank that the City authorizes such issuing bank to
terminate the Kilber letter of credit immediately.
21. Notices. All notices required to be given to the Developer under the Developer’s
Agreement, the First Amendment, or this Amendment shall be sent to the Developer at
the following address:

22. Misc.
A. Each townhome unit shall have separate utility connections.
B. The 6th Addition shall be subject to the master homeowners association
established with Towne Lakes 1st and 2nd Additions.

C. The developer shall establish townhome association documents that shall
be subject to review and approval of the City Attorney.
D. Lot 43 of Towne Lakes 6th Addition shall be deeded to the townhome
association.
E. Cross access easements over Lot 43 shall be established and conveyed to
each townhome lot.
F. All townhomes shall be owner-occupied. Rentals are prohibited.

RECOMMENDATION: This space on the agenda is reserved for the City Council to consider

MOTION TO: Approve Resolution No. 2017-015 entitled A Resolution Accepting Low Bid for
CSAH 19 and 57th Street NE Intersection Improvements.
INFORMATION: The proposed improvement project was advertised and on July 11, 2017 bids
for the improvements were opened. A total of two (2) bids were received with proposals ranging
from $274,736.44 to $313,427. The general project components include the addition of
dedicated turn lanes and raised medians on 57th Street NE, and the addition of dedicated left
arrow signals, flashing yellow arrows, replacement and relocation of the signal controller, the
addition of pedestrian crosswalks, and accessibility improvements at the pedestrian ramps.
KEY ISSUES:
• Low Bid for the project is $274,736.44.
• Low Bid Received by Omann Contracting Companies, Inc.
• Currently the signal at CSAH 19 and 57th Street NE does not have dedicated left turn
lanes or left turn signalization for 57th Street NE traffic.
• Improvements to the intersection are needed to improve safety and efficiency of the
intersection.
FINANCIAL CONSIDERATIONS: The proposed project would be funded through capital
reserves identified for Municipal State Aid Streets. The low bid amount is for $274,736.44.
These figures do not include the overhead costs associated with surveying services or
construction inspection and testing. Overhead and construction contingencies are estimated to be
approximately 15% of the construction amount.
LEGAL CONSIDERATIONS: The Mayor and Council possess the authority to authorize
municipal improvements, and to accept or reject bids for municipal improvements.

WHEREAS, plans and specifications for signal, sidewalk, street, utility, drainage and other
related municipal improvements to the intersection at CSAH 19 and 57th Street NE have been
prepared by SRF, Inc. and such plans and specification have been presented to the Albertville
City Council for approval; and
WHEREAS, pursuant to an advertisement for bids for the proposed improvements, bids
were received, opened and tabulated; and
WHEREAS, it appears that Omann Contracting Companies of Albertville, Minnesota is the
lowest responsible bidder; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Albertville,
Minnesota, as follows:
1. The bid of Omann Contracting Companies, Inc., said “Low Bidder”, in the amount of

SUBJECT: ARENA – REFRIGERATION OPTION
RECOMMENDATION: It is respectfully requested that the Mayor and City Council consider
the following:
MOTION TO: share the cost of upsizing for a common refrigeration system to be shared by
both ice sheets and to connect the existing sheet of ice to the new sheet of ice.
BACKGROUND: The School District’s Architect has identified an option to connect the
existing arena to the new arena’s refrigeration system. The cost to do this as part of the project is
estimated to be approximately $261,000. If this connection is not completed as part of the
project, but instead as a separate project in the future, the Architect estimates the cost to be
approximately $800,000. Capital expenses for the existing Arena are shared equally by the three
parties.
Refrigeration Connection – Funding Breakdown
$87,000 STMA School District
$87,000 St. Michael
$87,000 Albertville
$261,000 Estimated Total Project Cost (if included with expansion project)
The existing refrigeration system has been well maintained; however, the system is
approximately 20 years old and the refrigerant is being phased out. In addition, many of the
systems components including the controller, fans, primary pump, and unit heater have exceeded
their expected life.
KEY ISSUES:
• Albertville’s cost would be an estimated $87,000.
• There is a significant cost savings by upgrading with the arena addition now verses a
separate project in the future.
POLICY/PRACTICES CONSIDERATIONS: The Mayor and City Council have the authority
to order the improvement and repairs of city facilities.
FINANCIAL CONSIDERATIONS: At mid-year the City has collected more revenue than
projected in the budget which will increase the general fund reserve balance if expenses for the
year do not exceed budget. Staff recommends paying the estimated $87,000 from the general
fund if we move forward with the upgrade.

GENERAL ADMINISTRATION
Arena Board: The updated JPA/ownership/operations agreement was presented and discussed
at the July 10 Arena Board meeting. The agreement will be presented to the City Council in
August and will be an agenda items for the large group meeting with the School District and St.
Michael in October. The Arena Board also discussed connecting the existing sheet of ice to the
new refrigeration system for arena addition.
Towne Lakes 6th and 7th: The formal public hearing for Towne Lakes 6th Addition draining and
utility easement vacation and approval of the development agreement is scheduled for Monday
at the Council meeting. We continue to expect a preliminary and final plat application for the
7th Addition in the coming month.
Second Sheet of Ice: The School District is working to finalize the design of the new facility. City
staff has met with the architect to discuss the city application and review process and is
anticipating a mid-summer application.
Primary School Addition: We anticipate an application for the Primary School addition at any
time.
Karston Cove 4th Addition: Centra Homes is not ready to install the sidewalk, which was to be
installed by the end of June per the amended developer’s agreement. It is understood they are
working on a development concept, but have not been able to meet with the HOA and discuss
how things will move forward. At the meeting I would like to discuss allowing an extension to
the sidewalk requirement.
Joint Governance Meeting: STMA Superintendent has asked if October 30, 2017 and January
29, 2018 will work to hold a joint governance meeting with Albertville, St. Michael and the
STMA School Board.
LBAE Training: The 2017 Board of Appeal and Equalization online training is now available on
the MN Department of Revenue website for all local board of appeal and equalization board
members. We currently have two trained members, but additional members are encouraged to
take the training. To complete the training go to www.revenue.state.mn.us and in the Search
Box type “ LBAE online training” and “ Board of Appeal & Equalization”.
I-94 West Coalition: The Coalition is working with LGN to organize a visit to D.C. The dates will
be September 13 and 14. Please let me know if you are interested in going.
ENGINEERING/PUBLIC WORKS
Repairs to 51st Street NE Cul De Sac: We are reviewing options to improve this temporary
dead-end and will report back to the Council.

Montgomery Property: The Excelsior Group has submitted a formal development application to
St. Michael and presented it to the St. Michael Council at their July 11 meeting. We are working
on a sewer service agreement with St. Michael and expect that it will be presented to Council at
the first meeting in August.
2017 Street and Trail Improvements Project: Construction of the new sidewalk is generally
complete and next week the contractor will be grading boulevards and possibly patching
driveways. Street work will begin once all sidewalk and boulevard work is complete. The
contractor is working to have the project complete around August 1.
Mall of Entertainment-AUAR: We have received the draft AUAR and have met with the
development team. The development group has asked for a special meeting, but schedules
have been difficult to coordinate; it is planned that the item will be presented at the first
meeting in August.
CSAH 37 and I-94 Signal and Striping Revisions: Wright County has identified this as a 2017
County project.
WWTF: I have Bolton and Menk scheduled to present the facility plan at the September 5
meeting. Currently, we are focusing on the option to relocate the discharge in lieu of the very
extensive plant upgrades.
Ballfield Lighting: The lights are working and Public Works is restoring the disturbed areas. We
will be ordering and installing the batting cages, distance markers, and bullpens soon.
CSAH 19 and 57th Street Signal Improvements: The project has been advertised for bids and
bid results will be presented to the Council on Monday.
