CALL TO ORDER - PLEDGE OF ALLEGIANCE Mayor Hendrickson called the meeting to order at 7:00 p.m. 2. RECOGNITIONS – PRESENTATIONS – INTRODUCTIONS A. Oath of Office: Mayor Hendrickson and Council members Cocking and Vetsch Clerk Olson administered the oaths of office and provided Certificates of Election for Mayor Hendrickson and Councilmembers Cocking and Vetsch. B. STMA Bond Referendum Update – Douglas Birk STMA ISD #885 Director of Administrative Services, Douglas Birk, was present to provide information to the Council about the upcoming capital bond referendum. Birk gave a presentation on the following items: • why the district is pursuing a referendum at this time • resources for residents to find information • what is included in the bond • the tax impact of the bond • upcoming meetings on the bond Birk invited the Council the share with local groups that they can meet and get information from district staff and School Board. Agenda Page 4 City Council Meeting Minutes Page 2 Regular Meeting of January 3, 2017 Vetsch inquired if the district has reached a point that would prompt closing open enrollment. Birk replied the district would have to state they are at capacity and there are also a number of factors that go along with closing open enrollment that could lead to unintended consequences. Couri inquired if there will be savings that will occur at the district if the referendum succeeds and the improvements are made. Birk replied that the district will gain efficiencies and cost savings. He added that there are possible revenue increases if the dome facility is rented out. Hudson stated that it has been eleven years since the last bond and inquired what threshold was met to warrant a bond at this time. Birk replied that the district had been aware of both the technology and security improvements that were needed. They also knew the pool needed to be repaired and all those improvements would have come out of the operating levy. At the same time, there was discussion about the second sheet of ice at the arena and the School Board felt it was time to address multiple issues and to put the matter before the voters. 4. Committee Updates (STMA Ice Arena, Planning, JPWB, Parks, Fire Board, FYCC, etc.) There were no committee updates. B. Planning/Zoning 1). City Code Amendments - Fees Brixius reported that staff has drafted a comprehensive City Code amendment that consolidates all fees, escrows, and penalties into one chapter of the City Code. Currently, any modification to fees require amendments throughout the Code. In consolidating the fees to a single chapter, it improves ease of access for both City staff and the general public as well as reducing the number of amendments to the City Code. Ideally, this chapter would be reviewed annually and any amendments would be made at that time. Brixius stated that the fees were removed in the first ten chapters of the City Code and compiled into one chapter totaling 79 amendments. He further stated that language was added that State sales tax may be applicable to certain fees and charges and the amendment will set the fees for the 2017 calendar year. Cocking inquired if there were any new or increased fees in the amendment. Brixius stated that consumption and display liquor license was also added to the fees as the City must either approve or deny that State-issued license. He added that Fire Department fees would be charged per the Wright County Fire Chief Association Rate Schedule. Nafstad stated that park reservation fees were modified to match the fees charged by the City of St. Michael. He stated that any other changes to the fees were to accurately reflect the City’s current practices and charges. Couri made a correction to the fees charged for car accidents and fires to match the Wright County Fire Chief Association Rate Schedule. Olson corrected the base fee charged for the water and sewer base rate. Brixius included language in 10-2-3 that allows for the surcharge and plan review fees to be charged per Minnesota Statute 326B.148 and 326B.106 respectively. Motioned by Hudson, seconded by Olson, to Approve Ordinance 2017-01 amending the Albertville City Code to consolidate all City fees and escrows in Title 3, Chapter 1, Section 3-1-3; standardize misdemeanor and petty misdemeanor penalties under Title 1, Chapter 4, Section 1-4-1; establish licensing requirements for consumption and display of liquor licenses; and authorize a summary ordinance for publication with corrections as noted above. Finance 1). 4th Quarter Budget to Actual Report (Unaudited) Lannes presented the un-audited summary of revenues and expenditures for the 2016 4th quarter. She explained the variances in both revenue and expenditures in the report. She added that she is still continuing to process expenses and must also complete transfers, allocations of interests for investments, receivables, contract payments, and capital assets. Administration 1). 2017 Board and Committee Appointments Nafstad reported that the draft appointments had replaced former Council member Sorensen’s appointments with new Council member Cocking. Hendrickson stated her interest to serve on the Cable TV Board. Council was in agreement on the appointments including Hendrickson’s minor change. Motioned by Vetsch, seconded by Olson, to approve Resolution 2017-002 appointing City Council members to various boards and committees for 2017 as amended. MOTION DECLARED CARRIED. 2). 2017 Transportation Alternatives Solicitation – Application Update Nafstad reported the costs associated with a pedestrian bridge at CSAH 37 over I-94 have increased to the point that the City could not undertake the project and he will not be pursuing the application. 3). City Administrator’s Update Nafstad reported the I-94 Coalition will be hosting a legislative preview breakfast on Friday, January 6 and he can register any Council members interested in attending. Hendrickson requested the meeting be posted in case there is a quorum of the Council present at the event. Hudson inquired about the activation timing at the CSAH 37 and CSAH 19 signal. He felt there is a long delay at the light and he seemed to recall there was some type of detection for traffic at the light previously. Nafstad replied that he also received complaints on the signal at CSAH 19 and CSAH 18 and he has forwarded these requests to the Wright County Highway Department. Nafstad inquired of the Council if they have any discussion items for the January 30 Joint Governance meeting and if not, if the Council would be willing to cancel the meeting. He indicated that he is not aware of any discussion items desired by any of the entities. Council was in agreement to cancel the meeting. Brixius indicated they received several letters of interest for the two Planning Commission seats that have expired. Nafstad reported that the current commissioners have indicated their desire to maintain their seats and five other letters have also been received. Brixius stated that in years past, the Personnel Committee has made recommendation to the City Council and the other option would Agenda Page 7 City Council Meeting Minutes Page 5 Regular Meeting of January 3, 2017 be to have the full Council handle the interviews. Brixius suggested that each applicant should meet briefly, and individually, with the Council. BACKGROUND: Annually, the Albertville City Council has appointed corporate authorized signers for the City of Albertville. Corporate authorized signers are allowed to invest in the best interests of the City. Past practice has been to authorize the Mayor, Acting Mayor, City Administrator, Finance Director, and City Clerk as corporate signers for the City of Albertville. This ensures that should key staff be indisposed, there are others who can sign/act on the City’s behalf if needed. KEY ISSUES: • The appointment of corporate authorized signers has traditionally been done annually at the beginning of the year. PRACTICES/POLICIES CONSIDERATIONS: The City Council has the authority to appoint corporate authorized signers as it deems necessary. FINANCIAL CONSIDERATIONS: There are no financial considerations relating to authorization of corporate signers. BACKGROUND: Annually, the Albertville Fire Relief Association holds a department-wide party and dinner event. Members and guests are allowed to consume alcoholic beverages at the event. No liquor retail sales will occur at the event, so a One-Day Temporary Consumption and Display Liquor License must be obtained in order to consume alcoholic beverages. In addition, City Code Section 8-4-2 prohibits the following: LIQUOR CONSUMPTION: A. Prohibited Areas: The consumption of alcohol is prohibited at the fire hall, the public works facility, the wastewater treatment facility and on any of the property on which those facilities are located unless the city has issued a permit for such consumption pursuant to subsection B of this section. Therefore, the Albertville Fire Relief Association is seeking a one-day exemption from this prohibition. KEY ISSUES: • This is a one-time annual event and the St. Michael Fire Department covers all Albertville Fire Department calls for the evening. • This license is granted by the MN Department of Alcohol and Gambling Enforcement, but requires either City approval or denial of the license prior to issuance. • The association has held previous consumption and display licenses for their annual party. BACKGROUND: The Albertville Lions have submitted an application for a One-Day Temporary Intoxicating Liquor License. The license will be for the Lions Club’s annual Comedy Night on Friday, February 17, 2017 at the St. Albert Parish Center. KEY ISSUES: • The Lions have submitted the appropriate application and fee. • The City has not received any past complaints regarding the event. • The Lions hold the required liquor liability insurance. • This liquor license requires both City Council and Minnesota Alcohol and Gambling Control Board approval. FINANCIAL CONSIDERATIONS: There is a $220 fee per day for a Temporary Intoxicating Liquor License. Olson, City Clerk Submitted through: Adam Nafstad, City Administrator-PWD Attachments: Lions One-Day Intoxicating Liquor License Application Agenda Page 15 Agenda Page 16 Agenda Page 17 M:\Public Data\City Council\Council Packet Information\2017\011717\2017-01-17 REE Cottages RCA.docx Meeting Date: January 17, 2017 Mayor and Council Request for Action _____________________________________________________________________________ January 12, 2017 SUBJECT: CONSENT – FINANCE DEPARTMENT – REE COTTAGES REGULATORY AGREEMENT ASSIGNMENT RECOMMENDATION: It is respectfully requested that the Mayor and City Council consider the following motion: MOTION TO: Approve Resolution 2017-004 Approving Assignment and Assumption of Amended and Restated Regulatory Agreement, Cottages of Albertville BACKGROUND: In December, the City was approached by REE Cottages of Albertville LLC (the “Buyer”) with a request to consent to an assignment of the Contract for Private Development and the TIF Note by the original owner of the facility to the Buyer, and a collateral assignment of the Contract and TIF Note to the lender providing the financing to the Buyer. Under the original Contract, the City agreed that it would consent to such assignments if required by the lender, so City Development Counsel (Kennedy & Graven) recommended approval of the consent as required under the Contract. The Council approved the assignments and the consent at its meeting on December 19, 2016. After the Council had taken its action, but just before closing on the sale of the facility to the Buyer, the lender’s attorney discovered one other document requiring consent. This document is the Amended and Restated Regulatory Agreement that was originally required in connection with bonds that were issued to finance the construction of the facility back in 1999. The Regulatory Agreement contains various occupancy and rental restrictions for the facility. Primarily, 40% of the units at the facility must be occupied by persons whose income is 60% or less of area median gross income. Since the facility has been sold to the Buyer, the Buyer is now required to abide by these restrictions. The way to accomplish this legally is through an assignment of the Regulatory Agreement, which requires the City’s consent because the City was a party to the original Regulatory Agreement. Ms. Brown is looking to lease space at the Shoppes at Prairie Run, 5262 Kyler Avenue NE, to open an art studio where customers can bring and consume their own alcoholic beverages. She has conducted this type of event in other cities at locations that have full on-sale intoxicating liquor licenses. Ms. Brown contacted MN AGED (Minnesota Alcohol and Gaming Enforcement Division) and was informed she could apply and would be eligible for an annual consumption and display permit. KEY ISSUES: • Consumption and display permits are not issued by the City, but by the State. However, the local authority (Albertville City Council) must either approve or deny any applications for consumption and display. • The City Code was amended at the last meeting to identify this type of liquor license. • The City may be more restrictive in it’s regulation of this type of liquor license. • There is no issue with the license application from a land use perspective. • The MN statute as written allows any applicant to be eligible for this type of license so long as they have not been convicted of a felony or liquor law violations within five years. • There is a discrepancy between the statute as currently written versus the original intent of the statute. (See Exhibit A.) • There could be an open ended amount of eligible applicants or establishments that may wish to pursue this type of license. • Council may wish to consider stricter regulations in the future, if needed, such as limiting the number of licenses, adopting the League language listed in Exhibit A, requiring insurance, etc. • This type of license is not widely advertised by the State. POLICY/PRACTICES CONSIDERATIONS: The City Council has the authority to approve or deny liquor licenses and/or more strictly regulate this type of liquor license. FINANCIAL CONSIDERATIONS: The City would receive no revenue from this license. A fee of $250 is payable to the State and must accompany the application. BACKGROUND: The Public Works and Water/Wastewater employees serve as the evening/weekend on-call staff for the City of Albertville and have been issued City phones to use for such duties. This has resulted in employees carrying both personal and work phones. Some employees have inquired if they can use their personal phone for City business. There are several department head employees that currently utilize their personal phone for City business and receive a reimbursement from the City for those costs. The attached policy is proposed to ensure clear understanding of reimbursements and the use of wireless communication devices. KEY ISSUES: • Employees may choose to use either a City-provided phone or their personal phone with reimbursement for City business. • If the employee chooses to use their personal phone, they must sign the wireless communications device policy indicating their agreement with the policy and the reimbursements. • The City may require the employee to show proof of wireless device by providing a copy of their cellular service bill upon request. • The policy includes best practices for wireless device communications that are in alignment with language in the personnel policy. POLICY/PRACTICES CONSIDERATIONS: The Mayor and City Council have the authority to adopt City policies. FINANCIAL CONSIDERATIONS: The cost of the reimbursement shall not exceed the $80 per month or the actual cost of the service paid by the employee. The cost of the reimbursement is essentially the same as the cost of a City-provided phone and will not impact the budget. This policy has been implemented to prevent improper use or abuse of wireless communication devices, ensure city employees exercise the highest standards of care with property in their use and provide a layer of security when accessing City data from a mobile device. Policy: Based on business need, the City Administrator, Department Director or designee will determine which positions in the department require a wireless communications device and whether the needs are best served through the allocation of a city-purchased/leased wireless communications device or through authorizing an employee to use his/her own personal device for City business, for which he/she will receive a reimbursement by the City as outlined below. Some of those needs include, but are not limited to: • When safety of self or others may be of concern • To provide immediate communication with staff in the department and other agencies, as required, to coordinate programs or to provide customer service • To retrieve messages from voice mail while working in the community • To contact customers in situations where a land line is not available • In personal emergencies including unexpected illness, car trouble, inclement weather, etc. • When the employee's main work location is in the field where land lines are not available • When on call Employees receiving a cell phone reimbursement will be paid a rate of $40 per month for phone service, an additional reimbursement of $10 per month for texting service, and data service for city business on a smart phone device may receive an additional reimbursement of up to $30 per month; however, the total amount of monthly reimbursement shall not exceed the lesser of: 1) $80 per month; or 2) the actual costs of the service paid by the employee. Employees on the reimbursement method shall provide proof that they have a wireless device by providing a copy of their cellular service bill upon request of the City. The employee shall be reimbursed on a bi-weekly basis. Information related to the use of a personal device for City business may be government data. However, it may be considered personnel data which is classified as private data on an individual, but pursuant to court order Employees receiving either a city-purchased wireless communications device or personal wireless device reimbursement are subject to the following requirements: Agenda Page 31 2 • The wireless communications device must be available for use during all hours of work and when the employee is subject to call. • Use of the device must not provide a distraction to the employee during work hours. This includes limiting personal use during work hours and setting the wireless communications device to a "silent alert" mode during meetings and other times that an interruption is undesirable. • All employees must follow federal, local and state laws pertaining to wireless device use (texting, emailing and voice communications) while driving a motor vehicle. • Adequate security for the device must be provided by the employee to prevent unauthorized users from finding client/work-related information stored in the device's memory. • Use of public resources, as it relates to this policy, by City employees for personal gain and/or private use including, but not limited to, outside employment or political campaign purposes, is prohibited and punishable by disciplinary action which may include termination and/or criminal prosecution, depending on the nature and severity of the transgression. Electronic Mail: The City may provide employees with an email address for work-related use. Some personal use of the City email system by employees is allowed, provided it does not interfere with an employee's work and is consistent with all City policies. Employee emails (including those that are personal in nature) may be considered public data for both e-discovery and information requests and may not be protected by privacy laws. Email may also be monitored as directed by the City authorized staff and without notice to the employee. Employees must adhere to these email guidelines: • Never transmit an email that you would not want your supervisor, other employees, council members, city officials, or the media to read or publish (e.g., avoid gossip, personal information, swearing, etc.). • Use caution or avoid corresponding by email on confidential communications (e.g., letters of reprimand, correspondence with attorneys, medical information). • Do not open email attachments or links from an unknown sender. Delete junk or "spam" email without opening it if possible. Do not respond to unknown senders. • Do not use harassing language (including sexually harassing language) or any other remarks, including insensitive language or derogatory, offensive, or insulting comments or jokes. Employees may be are required to keep their electronic calendar up to date and, at a minimum, must grant all staff the ability to view their calendar. Instant Messaging: Due to data retention concerns, the City does not provide employees with resources or tools to communicate by instant messaging (IM) when conducting City business. Employees are not allowed to use IM as a mechanism for personal communication through the City's computer network or when using City equipment, and are not allowed to download or install any IM software on their City computer. Personal Devices: Employees may choose to use their own equipment to read or compose email, text, or other City data as governed in this policy. Employees understand that by connecting their Personal equipment to the City's email server, their personal devices could be searched during an e-discovery or other court-ordered scenarios, and agree to grant access to their personal devices should such a situation arise. Specifically, staying true to the “Ultimate Build” plan previously approved by MnDOT. Planning Commission Terms: The Council has set a workshop for 6:30 p.m. on February 6, 2017 to briefly interview eight (8) applicants that have expressed their interest in serving on the Commission. I will send out the letters of interest next week and prepare an interview outline for Council to review/discuss at the meeting. Fire Service Awards: Annually the City Council recognizes Firefighters for years of service, retirements, etc. The Chief is working to schedule the service awards for one of the February meetings. The AFD has scheduled their annual party for February 11 at the Fire Hall (5:00 p.m. – Happy Hour, 6:00 p.m. – Dinner). Wright County Economic Development Partnership: Albertville’s membership dues for 2017 are $1,935. Please let me know if you have any questions regarding Albertville’s involvement with the WCEDP. Central Park Depot: Staff met with the representatives of the Lions to discuss the Depot project and a tentative time line that includes starting the project in the fall of 2017. ENGINEERING/PUBLIC WORKS I-94 St. Michael to Albertville Project: Last week, MnDOT and SRF presented their draft noise wall analysis to Albertville and St. Michael staff. The noise study is part of the Environment Assessment Worksheet (EAW) that is a requirement of the project. As it pertains to Albertville, the noise analysis determined that walls would not meet the required performance/effectiveness standards required to merit construction of walls. Copies of the draft EAW and noise study are available at City Hall. Municipal State Aid Streets: The annual certification of mileage has been completed and we will be reviewing our system to determine if any “system revisions” are required prior to the March “Needs” reporting. Mall of Entertainment-Traffic Study: SRF is underway with the traffic study for the Mall of Entertainment and surrounding area. We met with the Developer’s engineer last week and they are working on finalizing the land use map for the AUAR update. In February, we would like to have a workshop to provide an update and discuss discharge requirement options. Joint Powers Water Board: SEH is working on a comprehensive master plan for the JPWB. John and I met with Chris Larson to review future water extensions, loops, etc. for Albertville. Chris hopes to have a draft of the JPWB comp plan in the next few months. 2017 CSAH 19 and 57th Street NE Signal Improvements: Project plans and specifications are being prepared. 2017 Street Project: Plans and specifications are underway and we are currently planning for the resident meeting to be held in February.
