Committee Updates (STMA Ice Arena, Planning, JPWB, Parks, Fire Board, FYCC, etc.) There were no committee updates. B. Planning/Zoning 1). Karston Cove 4th Addition Preliminary and Final Plat Couri explained that Centra North LLC purchased the 29 undeveloped lots south of 64th Street NE as well as the rights to the letter of credit money from the previous developer. He stated they must either require the improvements outlined in the expiring development agreement or litigate by October 31, 2016. He stated the City had drawn on the letter of credit and has it in cash. The letter of credit cash can be used to install the improvements such as sidewalks and streetlights with the remainder to be returned to Centra after completion. He clarified that although the City can require the improvements, they cannot force Centra to build the 29 townhomes. Couri explained that Centra is not intending to build the 29 attached townhomes as previously platted in 2003 as they would not sell favorably in the housing market now. He also added that due to wetland elevations as well as new city ordinances, it is not possible to build all 29 lots. Willis stated they would likely remove 12 of the lots and build a total of 17 homes. Brixius stated the development application requests replatting the 29 lots to an outlot. However, an outlot cannot be issued a building permit, so the outlot would need to be replatted and subdivided back into lots and blocks prior to development. Couri reported the next steps would be to approve the preliminary and final plats and to amend the developer’s agreement. Couri explained that the 14 townhomes to the north have concerns about the future of their homeowner’s association (HOA). He reported the 29 lots to the south were originally supposed to be a part of the HOA and since they have remained undeveloped, it has placed a significant burden on the original 14 townhomes for their dues and maintenance costs. Couri suggested the City amend the developer’s agreement to allow the City the right to require any future lots developed be required Agenda Page 5 City Council Meeting Minutes Page 3 Regular Meeting of October 3, 2016 to enter into the HOA. However, he said that the HOA must revise their HOA declaration language to allow the lots into the HOA. Couri reviewed the drainage and utility easements that were put across the development in the 1st and 3rd Additions. Staff is recommending vacating the 3rd addition easements, but keeping the 1st Addition easements. Nafstad stated that staff is also looking at taking over the maintenance of the drainage pond for Karston Cove. Hendrickson suggested a resolution to that effect be brought to the next City Council meeting on the Consent Agenda. Jeff Hampton, 6448 64th Street NE, is president of the current HOA. He stated that the cost to maintain the drainage pond when the other properties are developed will be very expensive. He stated that the HOA is fiscally challenged by only having 14 members rather than 43 as originally planned. He stated that if the sidewalk and streetlights are not installed now, it may be another five or ten years out before they are done. He stated they should have been installed ten to twelve years ago. Hampton presented the following language to be added to the resolution approving the preliminary and final plats, development agreement amendment, and vacation of easements: • The City of Albertville includes in their notes when vacating the plat that any future costs regarding the shared retention/water outlet ponds be shared with the owners of the vacated plat, future PUD or development. • Prior to the final release of the funds related to vacating this plat, the following improvements be completed per the original PUD agreement; connect the 2 sidewalks from neighboring properties across the vacated plat, install street lighting, include minor landscaping around the sidewalk area (grass and trees) as included in the agreement. City to determine the look to match neighboring properties with sidewalks. Willis stated that Centra is okay with sidewalk installation and suggested a $15,000 escrow be set for the construction of it. He felt they would not be able to get the sidewalk done yet this year. He also suggested an 18-month period in which they have to develop the lots. However, he is hoping to build in summer of 2017. Vetsch inquired as to the type of lots they hope to develop and Willis stated detached townhomes may be successful. Ron Klecker, Planning Commission Chair, stated that he had concerns with new lots being required to enter into the HOA and footing the cost of repairs for the original homes. He felt the developer could help with the association costs. Motioned by Hudson, seconded by Sorensen, to direct staff to craft a resolution authorizing the City to take over maintenance of the Karston Cove drainage pond and to bring it to the next City Council meeting. Couri replied that he has included language that allows the agreement to be amended if met with City Attorney approval and felt they should have a revised development agreement at the next City Council meeting. Motion to Approve Resolution No. 2016-027 Approving an amendment to the Karston Cove Conditional Use Permit/Planned Unit Development and the Preliminary and Final Plat of the Karston Cove 4th Addition and to vacate select easements within Karston Cove 4th Addition with the following amended conditions being met: 1. The City retains the option to require the future development on Outlot A Karston Cove 4th Addition to join with the existing Karston Cove HOA on the north side of 64th Street through a revised PUD development agreement to be recorded against the Outlot A property with the future final plat. Notwithstanding this reservation of rights, the City acknowledges that it may not impose any obligation on the developer to add the future lots to the existing Karston Cove HOA unless the Declaration establishing the HOA has been modified, on or before the time of final plat approval, to allow for the addition of the Outlot A land to the Homeowner’s Association. 2. The City finds that the drainage and utility easements dedicated on the Karston Cove 3rd Addition plat (but excluding those easements dedicated on the first plat of Karston Cove) are no longer needed for public purposes and that it is in the interest of the public to vacate said drainage and utility easements. 3. The City vacates the drainage and utility easements shown on the Karston Cove 3rd Addition plat, provided the 4th Addition final plat is revised to preserve as drainage and utility easements all drainage and utility easements originally dedicated on the first plat of Karston Cove said easements shall be subject to the review and approval of the City Engineer prior to recording the final plat. The vacation of said easements shall be effective upon the recording of the Karston Cove 4th Addition plat. 4. The City approves the preliminary and final plat of Karston Cove 4th Addition, subject to the conditions set forth in the City Planner’s report dated September 8, 2016, including execution of a development agreement as set forth below. 5. The Developer shall be required to install sidewalk per approved plans, boulevard grading and restoration to a turf condition by June 30, 2017 as a condition of final plat approval, unless Developer submits a completed preliminary plat application for the site by June 30, 2017, in which case the June 30, 2017 installation date shall be automatically extended to June 30, 2018. 6. The applicant enters into a development agreement with the City that includes the aforementioned conditions of approval, addresses the issues identified in the RCA Agenda Page 7 City Council Meeting Minutes Page 5 Regular Meeting of October 3, 2016 for this matter, and meets the approval of the City Attorney. The development agreement shall be recorded against the property with the final plat. 7. Upon execution of the development agreement and recording of the plat, the City shall release the monies it holds in escrow from the proceeds of the letter of credit for Karston Cove 3rd Addition, except for an amount sufficient to cover 125% of the cost of the installation of sidewalk, boulevard grading and restoration and the anticipated expenses of the City Attorney, Planner and Engineer related to Karston Cove 3rd Addition and Karston Cove 4th Addition. The City Engineer shall determine the amount of escrow to be held for the installation of such items and the City Finance Director shall determine the remaining amount of escrow to be held to cover anticipated City expenses. Purchase of a Used Utility Chipper Nafstad reported this is a much needed piece of equipment that will assist Public Works with maintaining the trees that have matured throughout the City as well as the annual Christmas tree pickup. The chipper would be a 2013 used model that includes a warranty. Olson inquired if the City could then offer storm debris pickup after large storm events. Guimont replied that it really depends on the severity of the storm and could be determined on a storm by storm basis. Hudson inquired about funding for replacement of the chipper and Guimont anticipated the chipper to have a twenty year life to it. Motion to approve purchasing a used 2013 Bandit M-200 Utility Chipper in the amount of $20,000 from Tri-State Bobcat. Ayes: Hendrickson, Hudson, Olson, Sorensen, and Vetsch. Nays: None. Responsible Person: Tina Lannes, Finance Director Submitted through: Adam Nafstad, City Administrator-PWD Attachment: List of Claims (under separate cover) Agenda Page 10 1 CITY OF ALBERTVILLE PLANNED UNIT DEVELOPMENT AGREEMENT KARSTON COVE FOURTH ADDITION THIS AGREEMENT, entered into this ______ day of October, 2016 by and between Centra North, LLC, a Minnesota Limited Liability Company, referred to herein as “Developer”; and the CITY OF ALBERTVILLE, County of Wright, State of Minnesota, hereinafter referred to as “City”; WITNESSETH: WHEREAS, Developer is the fee owner of the real property described as Outlot A, Karston Cove Fourth Addition according to the plat of record on file in the Wright County Recorder’s Office, Wright County, Minnesota, which real property shall hereinafter be referred to in its entirety as “Said Plat” or “Subject Property”; and WHEREAS, Said Plat had previously been platted as 30 lots in the plat of Karston Cove Third Addition, Wright County, Minnesota and had been subject to that Conditional Use/Planned Unit Development Agreement recorded as document number 942285 in the Wright County Recorder’s Office, Wright County, Minnesota (“Original Developer’s Agreement”) between the City and Woodside Karston Cove, LLC (“Woodside”); and WHEREAS, the City and Woodside had entered into an Amendment to the Conditional Use/Planned Unit Development Agreement, Karston Cove Third Addition, recorded as document number 1147922 in the Wright County Recorder’s Office, Wright County, Minnesota (“Amended Developer’s Agreement”); and WHEREAS, Woodside assigned to Developer all of its rights to the Subject Property and all escrows or other money being held by the City on behalf of Woodside and related to the Karston Cove Third Addition plat; and Agenda Page 11 2 WHEREAS, the City and Developer desire to release Said Plat from the Original Developer’s Agreement and Amended Developer’s Agreement and subject Said Plat to the terms of this Agreement; and WHEREAS, the City has given final approval of Developer’s plat of Karston Cove Fourth Addition (attached hereto as Exhibit A) contingent upon compliance with certain City requirements including, but not limited to, matters set forth herein; and WHEREAS, the City requires that a sidewalk (hereafter “Municipal Improvements”) be installed to serve the Subject Property and be financed by Developer; and WHEREAS, this Agreement is entered into for the purpose of setting forth and memorializing for the parties and subsequent owners, the understandings and covenants of the parties concerning the development of the Said Plat and the conditions imposed thereon; NOW, THEREFORE, IT IS HEREBY AND HEREIN MUTUALLY AGREED, in consideration of each party's promises and considerations herein set forth, as follows: 1. Release of Prior Development Agreements. The terms of the Original Developer’s Agreement and Amended Developer’s Agreement shall not apply to Said Plat. The terms of this Agreement are intended to replace the Original Developer’s Agreement in its entirety. 2. Future Replat of Said Plat. In the event Said Plat is ever replatted, in whole or in part, into numbered residential lots, the City may require, as a condition of approval of such future plat, that such future numbered residential lots join with the existing Karston Cove Townhomes of Albertville Association that currently includes all lots in Block 1 of Karston Cove Third Addition (“HOA”) through a development agreement to be recorded against said future lots with the future final plat. Notwithstanding this reservation of rights, the City acknowledges that it may not impose any obligation on the Developer to add the future lots to the HOA unless the Declaration establishing the HOA has been modified, on or before the time of final plat approval, to allow for the addition of said future lots to the HOA. 3. Construction of Municipal Improvements. Developer shall install a 5 foot wide, 4 inch thick concrete sidewalk along the south side of 64th Street in the general location shown in the Plans and Specifications for Karston Cove Third Addition, as prepared by Meyer-Rohlin, Inc. and dated July 27, 2004 and on file with the City Agenda Page 12 3 Clerk. Developer agrees to warranty the Municipal Improvements from defects in materials and workmanship for a period of two years from the date of acceptance of such Municipal Improvements by the City. Unless the City Engineer specifies a later date, said improvements shall be installed by June 30, 2017 (“Municipal Improvement Deadline”). Notwithstanding the foregoing, in the event that Developer submits an application for preliminary plat approval for the development of the Property on or before June 30, 2017, the Municipal Improvement Deadline shall be automatically extended to June 30, 2018. 4. Construction of On- and Off-Site Improvements. The City acknowledgesDeveloper shall ensure that Said Plat is sufficiently level such that the non-wetland areas can be mowed with a commercial lawn mower. Developer agrees to establish turf over all non-wetland areas of Said Plat that are impacted by the installation of the Municipal Improvements within one hundred twenty (120) days following the installation of the Municipal Improvements. 5. Surety Requirements. A. The City is currently holding $442,634.5560,000.00 in funds that were drawn from the letter of credit that the Developer of the Karston Cove Third Addition plat originally provided to the City to secure the installation of improvements to the Subject Property. The City shall retain $20,843.75 of said funds as a cash surety to ensure that Developer constructs the Municipal Improvements and the On- and Off-Site Improvements as required by this Agreement and to ensure compliance with the terms of this Agreement. The City may also use the letter of credit funds to reimburse itself for any fees incurred in processing Said Plat and drafting this Agreement. B. Upon failure of the Developer to cure a default as provided in this Agreement, the City may draw on said cash surety to complete work not performed by Developer (including but not limited to the Municipal Improvements and on- and off-site improvements described above), to reimburse itself for costs incurred in the drafting, execution, administration or enforcement of this Agreement, to repair or correct deficiencies or other problems which occur to the Municipal Improvements during the warranty period, or to otherwise fulfill the obligations of Developer under this agreement. C. In the event that any cash, irrevocable letter of credit, or other surety referred to herein is ever utilized and found to be deficient in amount to pay or reimburse the City in total as required herein, the Developer agrees that upon being billed by the City, Developer will pay within thirty (30) days of the Agenda Page 13 4 mailing of said billing, the said deficient amount. If there should be an overage in the amount of utilized security, the City will, upon making said determination, refund to the Developer any monies which the City has in its possession which are in excess of the actual costs of the project as paid by the City. D. Developer hereby agrees to allow the City to specially assess Developer's property for any and all costs incurred by the City in enforcing any of the terms of this Agreement should Developer's surety prove insufficient or should Developer fail to maintain said letter of credit or surety in the amount required above within 30 days of mailing of written request by the City. E. That portion of said cash surety with respect to the performance of Site Improvements shall be released upon certification of the City Engineer and approval of the City Council that all such items are satisfactorily completed pursuant to this Agreement. F. Upon the execution of this Agreement by all parties and the payment of all of the City’s expenses in processing Said Plat and preparing this Agreement, and in processing any issues related to Lots 1-30, Block 2, Karston Cove Third Addition, the City shall release the remaining funds that were drawn from the Karston Cove Third Addition letter of credit, except the $20,843.75 referred to in paragraph 5A above, and except for any amounts that the City used to reimburse itself for any fees incurred in processing Said Plat and drafting this Agreement. in the amount of $439,156.25 to Developer. 6. Surety Release. A. Periodically, as payments are made by the Developer for the completion of portions of the on- and off-site Improvements and when it is reasonably prudent, the Developer may request of the City that the surety be proportionately reduced for that portion of the On- and Off-site Improvements which have been fully completed and payment made therefor. All such decisions shall be at the discretion of the City Council, but such release shall not be unreasonably withheld, conditioned or delayed if such Improvements have been completed and paid for and no other monetary obligations of Developer remain outstanding under this Agreement. The City's cost for processing reduction request(s) shall be billed to the Developer. Such cost shall be paid to the City within thirty (30) days of the date of mailing of the billing. Agenda Page 14 5 B. The Developer may request of the City a reduction or release of any surety as follows: i. When all or a portion of the Municipal Improvements and on- and off- site improvements have been installed, the letter of credit or surety may be reduced by the dollar amount attributable to that portion of improvements so installed, except that the City shall retain the letter of credit or surety in the amount of 10% of the estimated construction price of the Municipal Improvements during the first year of the warranty period and 5% of the estimated construction price of the Municipal Improvements during the second year of the warranty period. ii. As to all requests brought under this paragraph B, the City Council shall have complete discretion whether to reduce or not to reduce said letter of credit or surety, provided however, in the event that the City Council does not reduce said letter of credit or surety, the City Council shall provide the Developer with specific reasons as to why such request for release is being denied. C. The costs incurred by the City in processing any reduction request shall be billed to the Developer and paid to the City within thirty (30) days of billing. 7. Developer to Pay City's Costs and Expenses. It is understood and agreed that the Developer will reimburse the City for all reasonable administrative, legal, planning, engineering and other professional costs incurred in the creation, administration, enforcement or execution of this Agreement and the processing and approval of Said Plat, as well as all reasonable engineering expenses incurred by the City in designing, approving, installing, and inspecting said Improvements described above. Developer agrees to pay all such costs within thirty (30) days of billing by the City. If Developer fails to pay said amounts, then the City may specially assess such costs against the lots within Said Plat. Developer has the right to request time sheets or work records to verify said billing prior to payment. 8. Erosion and Siltation Control. Developer shall also install all erosion control measures deemed necessary by the City Engineer if any grading is to occur on Said Plat. 9. Maintain Public Property Damaged or Cluttered During Construction. Agenda Page 15 6 Developer agrees to assume full financial responsibility for any damage which may occur to public property including but not limited to streets, street sub- base, base, bituminous surface, curb, utility system including but not limited to watermain, sanitary sewer or storm sewer when said damage occurs as a result of the activity which takes place during the installation of Municipal Improvements or on- and off- site improvements as required by this Agreement. The Developer further agrees to pay all costs required to repair the streets, utility systems and other public property damaged or cluttered with debris when occurring as a direct or indirect result of the construction required under this Agreement. Developer agrees to clean the streets on a daily basis during such construction if required by the City. Developer further agrees that any damage to public property occurring as a result of construction required under this Agreement will be repaired immediately if deemed to be an emergency by the City. Developer further agrees that any damage to public property as a result of construction activity on Said Plat will be repaired within fourteen (14) days or such additional time as necessary if such repair cannot reasonably be effected in said fourteen (14) day period if not deemed to be an emergency by the City. If Developer fails to so clean the streets or repair or maintain said public property, the City may undertake making or causing it to be cleaned up, repaired or maintained. When the City undertakes such activity, the Developer shall reimburse the City for all of its expenses within thirty (30) days of its billing to the Developer. If the Developer fails to pay said bill within thirty (30) days, then the City may exercise any remedy permitted under law or under this Agreement, including specially assess such costs against the lots within Said Plat and/or taking necessary legal action to recover such costs and the Developer agrees that the City shall be entitled to attorneys fees incurred by the City as a result of such legal action. 10. Temporary Easement Rights. Developer shall provide access to the Subject Property at all reasonable times to the City or its properly credentialed representatives for purposes of inspection or to accomplish any necessary work pursuant to this Agreement. 11. Miscellaneous. A. Developer agrees that all construction items required under this Agreement are items for which Developer is responsible for completing and all work shall be done at Developer's expense. If any portion, section, subsection, sentence, clause, paragraph or phrase of this Agreement is for any reason held invalid by a Court of competent jurisdiction, such decision shall not affect the validity of the remaining portion of this Agreement. C. The action or inaction of either the City or Developer shall not constitute a waiver or amendment to the provisions of this Contract. To be binding, amendments or waivers shall be in writing, signed by the parties and approved by written resolution or motion of the City Council. The City's failure to promptly take legal action to enforce this Contract shall not be a waiver or release. D. The City acknowledges that it has received satisfactory evidence that Developer has good and marketable title to all of Subject Property. E. Developer shall comply with all water, ponding and wetland related restrictions, if any, required by the City of Albertville, Wright County Soil and Water Conservation District and/or any applicable provisions of State and Federal law. F. Developer shall obtain all required driveway, utility and other permits as required by the City Engineer, Wright County and/or the State of Minnesota. 12. Violation of Agreement. A. Except as otherwise provided in this Agreement, upon any default by Developer, its successors or assigns, of any of the covenants and agreements herein contained, the City shall give Developer thirty (30) days mailed notice thereof (via certified mail), and if such default is not cured within said thirty (30) day period, the City is hereby granted the right and the privilege to declare any deficiencies governed by this Agreement due and payable to the City in full. The thirty (30) day notice period shall be deemed to run from the date of deposit in the United States Mail. Upon failure to cure by Developer, the City may thence immediately and without notice or consent of the Developer complete the Developer's obligations under this Agreement, reimburse itself from Developer’s surety, and specially assess the costs thereof in excess of the available surety against the lots within Said Plat and/or bring legal action against the Developer to collect any sums due to the City pursuant to this Agreement, plus all costs and attorney's fees incurred in enforcing this agreement. Notwithstanding the 30-day notice period provided for in paragraph 12A above, in the event that a default by Developer will reasonably result in irreparable harm to the environment or to public property, or result in an imminent and serious public safety hazard, the City may immediately exercise all remedies available to it under this Agreement in an effort to prevent, reduce or otherwise mitigate such irreparable harm or safety hazard, provided that the City makes good-faith, reasonable efforts to notify the Developer as soon as is practicable of the default, the projected irreparable harm or safety hazard, and the intended actions of the City to remedy said harm. 13. Dedications to the City. The City acknowledges that the Developer has met its park dedication requirements for the 29 residential lots that had previously been platted on this property. In the event the Developer replats Said Plat in the future into residential lots, it shall not have to pay park dedication on the first 29 residential units that may be constructed on Said Plat. 14. Phased Development. If the plat is a phase of a multi-phased preliminary plat, the City may refuse to approve final plats of subsequent phases until public improvements for all prior phases have been satisfactorily completed. Development of subsequent phases may not proceed until Development Contracts for such phases are approved by the City. Approval of this phase of the Development shall not be construed as approval of future phases nor shall approval of this phase bind the City to approve future Development phases. All future Development phases shall be governed by the City's Comprehensive Plan, Zoning ordinance, Subdivision ordinance, and other ordinances in effect at the time such future Development phases are approved by the City. 15. Indemnity. Developer shall hold the City and its officers and employees harmless from claims made by Developer and third parties for damages sustained or costs incurred resulting from Said Plat approval and development, except that the Developer shall not be required to indemnify or hold the City harmless from negligent acts of the City. The Developer shall indemnify the City and its officers and employees for all costs, damages or expenses which the City may pay or incur in consequence of such claims, including attorney's fees. Third parties shall have no recourse against the City under this Agreement. 16. Sanitary Sewer and Water Trunk Line Fees. City trunk sewer and water charges have been previously paid on Said Plat. This Agreement represents the full and complete understanding of the parties and neither party is relying on any prior agreement or statement(s), whether oral or written. BACKGROUND: The Albertville Fire Department’s current SCBA’s were purchased with charitable gambling proceeds in 2005. National Fire Protection Agency (NFPA) guidelines recommend that the service life of SCBA’s is 10 years. There is no NFPA allowance for refurbishing or partially replacing SCBA pieces if they do not all meet the current NFPA standard. The NFPA continually updates the safety standards and required safety features in the SCBA’s. The standard that regulates our current SCBA’s was formulated in 2002. Since then the NFPA has made regulation changes in 2007 and most recently in 2013. The Department currently has 18 SCBA packs, 36 SCBA bottles, 34 SCBA masks, and 2 RIT Packs. The SCBA masks are fit-tested yearly and are specific to each individual fire fighter. The current SCBA’s are out of their warranty period and reached their 10-year service life in December of 2015. On November 2nd, 2015 the Albertville City Council authorized the advertisement of bids for the purchase of new SCBA’s. After this approval, the Fire Department did some further research into the new AFG Grant guidelines, and decided to pursue an AFG Grant request for new SCBA’s. In December 2015, the Fire Department submitted a 2015 FEMA AFG grant request for $171,369. This grant request included money to replace all of the current stock of SCBA packs, SCBA bottles, SCBA masks, and RIT Packs. In August 2016, the Fire Department received a turndown notification from FEMA, advising that the AFG grant request had been denied. The current SCBA order would be smaller than the quantity requested in the FEMA Grant request. Due to the removal of the old Heavy Rescue vehicle from the Fire Department fleet, 6 of the SCBA’s and 6 bottles will not be replaced at the current time. The current order would be for 12 SCBA packs, 30 SCBA bottles, 34 SCBA masks, and 2 RIT packs. This purchase would be done either in conjunction with the new Engine order, or prior too, when the current NFPA standard is updated, which ever comes first. The new NFPA standard is expected to take effect in December of 2017, with the last date to purchase any 2013 standard SCBA’s being August 31st, 2018. The Fire Department is including the remaining 6 SCBA packs and 6 SCBA bottles in a current 2016 FEMA AFG Grant request. The Fire Department’s Board of Officers has received product demos from the 4 major SCBA manufacturers that are represented in our area. After the product demos, the Board of Officers requested price quotes from 3 of the companies. Prices from all of the SCBA manufacturers should be expected to increase 3-4% for 2017. The following is a comparison of 2016 pricing quotes: Alex Air / Draeger: $84,716 Company B: $89,115 Company C: $90,976 Staff is recommending approval of the purchase of SCBA’s not to exceed $84,716. The SCBA’s would be ordered this year, with delivery and payment in early 2017 (2016 pricing). KEY ISSUES: • The Fire Department Board of Officers, City Staff, and the Joint Fire Committee have reviewed the purchase and are recommending Council action. • The SCBA order would be made now and the Department would take delivery early next year. • Ordering in 2016 guarantees the 2016 price. • The SCBA purchase is a planned purchase and part of the Fire Department’s capital equipment budget. • The upcoming capital purchases have been discussed at Fire Department Board of Officer meetings and Joint Fire Committee meetings. POLICY CONSIDERATIONS: It is City policy for the Council to review and approve all capital purchases and investments. FINANCIAL CONSIDERATIONS: The cost associated with the SCBA’s has the potential to be funded in three different ways: • The SCBA purchase will be funded through fire department capital reserves and the 2017 capital budget. Approximately 44% of the capital equipment budget is funded as part of the service agreement with Otsego. LEGAL CONSIDERATIONS: The City has the authority to purchase equipment under the State of Minnesota contract or by quotes. At the 2016 LBAE meeting, Wright County Assessing staff introduced the possibility of moving to the “Open Book” format rather than the formal LBAE meetings. This “Open Book” format would allow homeowners to discuss with the Assessor’s Office their valuation rather than making a case to the LBAE at a formal meeting. It also provides an informal setting where residents can meet with County Assessing staff with no appointment necessary and allows a longer period of time for a resident to appeal their valuation. If the homeowner’s still not in agreement after the “Open Book” meeting, they may still appeal to the Wright County LBAE. KEY ISSUES: • Each LBAE is required to have at least one trained and certified member who has completed the MN Department of Revenue Board of Appeal and Equalization training. • Albertville currently has three trained and certified members. • Continuing the LBAE format allows for local control on property valuations. • The “Open Book” format allows the County to combine several jurisdictions into one meeting. • At the April 18, 2016 LBAE, several members of Council were supportive of maintaining the LBAE format. POLICY/PRACTICES CONSIDERATIONS: The Mayor and City Council have the authority to maintain the current LBAE format or to change to the “Open Book” format. To move to the “Open Book” format, a vote must be taken by the City Council adopting a resolution changing to the “Open Book “format. Basically, we will be reviewing another option that includes modifying our rate structure to more closely represent the JPWB rate structure and proposed adjustments to address the operations shortfall. Joint Fire: The Fire Chief, City Attorney, and I have been discussing options for the shared service agreement; however, we recently learned Otsego commissioned a station study. I don’t have all the details, but it is believed it would be best to have that analysis in hand prior to negotiating a JPA. Cell Phone Policy: We are working on a cell phone policy that would provide reimbursement to employees that choose to use/provide their personal phone in lieu of using the phone issued by the City. Resignation: We have received notice from Jane Arnoldy that her last day will be on November 10, 2016. Jane and her husband will be retiring and moving to Mankato. I will be evaluating the position and staffing needs in general prior to posting the position. Jane will be missed and we wish her the best. Joint Governance Meeting: All three entities have agreed to cancel the Monday, October 31 Joint Governance meeting and to reschedule to Monday, January 30, 2017. Newsletters: The fall/winter newsletter will hit mailboxes late next week. Mall of Entertainment: The development group is working to update the existing AUAR, including the traffic impact analysis, for the site. We expect to have a reimbursement agreement for Council to consider at the next meeting that would allow the City to move forward with commissioning a traffic study. ENGINEERING/PUBLIC WORKS Prairie Run: Home sales for the 15 lots of block 1 are going well for Fieldstone. The original plans did not include a storm sewer or drainage design that would accommodate underground sump pump discharge lines. We have developed a storm sewer plan for these lots that will be located in the R/W and owned by the city. The cost of the work is approximately $24,000 and it is proposed that the City pay for the portion that is located in the R/W, which will be approximately half the total cost. I will discuss more at the meeting. I will present the preliminary scope, cost estimate, and draft schedule at the first meeting in November. 2017 CSAH 19 and 57th Street Signal Improvements: I have included this as an agenda item and would like to discuss the next steps for this project at the meeting. Ballfield Lighting: Public Works has constructed the new warning track and the new outfield fence is in place. The poles are scheduled to be set around the first week of November, with the electric work to be soon after. We are working with Xcel on options for 3-phase 277/480 v service. Main Avenue RR Crossing: I have been in contact with the Railroad, but still do not know when they will replace the crossing. Assuming it is yet this year, the City’s portion of the project will not commence until next spring. CenturyLink Fiber Projects: CenturyLink recently picked up three R/W permits to extend fiber to several neighborhoods. Project information will be added to the website as it becomes available. Drainage Projects: If weather permits, Public Works has several residential drain tile projects they hope to complete yet this year. CSAH 18 Striping: We are working to have the new striping on 50th Street NE for Middle School West completed yet this fall.
