OUNCIL MINUTES
DECEMBER 19, 1988
The re alar meeting of the Albertville City Council was called to order
by Mayor Gretta Roden. Members present included Bob Braun, Don Cornelius,
Donatus Vetsch and Gary Schwenzfeier. Others present included Maureen Andrews,
Bob Miller, Brad Farnham David Licht, Bob Sullentrop and Lorie Villareal. Ken
Lindsay was absent. PiaGing Commission members Don Berning, Mark Daleiden,
Kevin Mealhouse and Brian Bebeau were also present.
The agenda for the evenir `s meeting was reviewed by the Council. Don
Clornelius made a motion and Bob L�raun seconded it to approve the agenda. All
were in favor and the motion carried.
The minutes of the December 6th special meeting; were reviewed by the
Council. Hearing, no corrections or additions, Gary Schwenzfeier made a motion
to approve the minutes of December 6th. Donatus Vetsch seconded the motion.
All were in favor and the motion carried.
The Public Hring on the Comprehensive Zoning Ordinance was called to
-'^ order for both the Planning Commission and the City Council.
Bob Braun made a motion and Don Cornelius- seconded the motion to open the
public hearing. All were in favor and the motion carried.
David Licht then presented to tree Council and the Planning Commission
the changes made to the zoning ordinance. These changes were discussed
previously at a joint work meeting of the Council and the Planning Commission
on December 7th and are reflective in the zoning ordinance document.
A motion to close the public hearing was made by Lon Cornelius and
seconded by Donatus Vetsch. All were in favor and the motion carried.
Brian Bebeau then asked for a motion from the Planning Commission to
recommend the approval of the zoning ordinance. Kevin Mealhouse made a motion
to recommend to the Council the Planning Commission's approval of the
Comprehensive Zoning Ordinance, Mark Daleiden seconded the motion. All were in
favor and the motion carried.
Gary Schwenzfeier then made a motion to approve the Comprehensive Zoning
Ordinance 1988-12. Don Cornelius seconded the motion. All were in favor anci
the motion harried.
A motion was then made by Gary Schwenzfeier to adopt a su m,ary of said
ordinance for newspaper publishing. Bob Braun seconded the motion. All were in
favor and the motion carried.
The Council next heard a Joint Powers update . The 1989 budget was
approved with increase. A relief valve was thought to be part of the water
pressure problem. Things are being left "as is" on the wells, at least for the
time being. There was some discussion about the cleaning of the tank and the
possibility of radion.
The Council heard from the Maintenance Department next. Ken was not
rresent so Gary presented the updates.

The dirt around the fire hydrants at the Phillips 66 station needs to be
cut down in order to get them ready for winter. Nbareen informed the Council
that Barthel`s had been contacted and that they had made assurances that the
problem would be corrected.
It was pointed out that there had already been skating on the rink even
thougri the rink is not ready yet and is not open for skating. Bob Braun
questioned when the rink would be done because of the upcoming vacation.
Gary also stated that Ken was concerned about the fact that it a pears
that there seems to be a significant increase in the amount of per roducts
1�eir one thro��gh at City H 11.. It waf suggested that perhapo to Ci , needs
to 0o at increasing the hall being more specific abous clean
up rules.
The issue of the shelter for the lift station was discussed again. Bob
Sullentrop was asked how long it should take to open the lift station shelter
in order to check it. He tho�.aght 5 minutes or so - rou.--ahly 15 minutes all
Nether to open, check and then close.
The Council had quite hesitant reactions on Wilding a lift station
shelter. It was suaggested that a different kind of closure could be looked
into - perhaps something with a padlock.
The Council was informed that the Minnesota Department of Transportation
will be Wlding a hearing of the Franklin sign issue here at City Hall on
January 11, 1989. Bob Miller stated that he did not feel that the City should
be taking an active role in this matter since the Council acted in good faith
when issuing the the permits for constriction. He pointed out that the State
is questioning the tiiliir.+g of the applications made to them (which occurred
after the rezoning was fi_nalized).
DJ's sign request is still pending. Bob contacted DJ.s office but s o e
with someone other than U.J. Bob asked that a message be passed on to DJ to
make a request to the City for what he wants.

the Tift station.
Donatus Vetsch made a motion and Gary Schwenzfeier seconded it to approve
the payrequest for Latour Construction in the amount of $26, 351.20. All were
in favor and the motion carried.
The income received and the bills to he p� id were reviewed next by the
Council. Hearing no cquestions or comments, Ltan Cornelius made a motion to
ap rove the bills. Bob Braun seconded the motion. All were in favor and checks
9208 through 9244 were paid.
A motion was Trade to change the meeting dates for the following meetings:
January 2nd to January 3rd -- New Year's Holiday
Janivary 16th to January 17th -- Martin Luther Kings Birthday
Holiday
February 20th to February 21st -- President's Birthday Holiday
Don Cornelius made the motion to che the meeting dates and Donatus
Vetsch seconded it. All were in favor and the motion carried.
There was some discussion abo t the possibility of raising the license
fees for the coin operated game machines and for cigarettes. Bob Braun
commented that what would the City be accomplishing by raising them? Licenses
are not a big money maker. After some further discussion, it was decided to
leave as is but take a look at the on sale license fees before April.
Gary Schwenzfeier made a motion to approve the renewal of the following
licenses. Bob Braun seconded the motion. All were in favor and the motion
carried.

The Council next heard about Ostego Township's request for Albertville to
participate in their efforts to obtain special legislation giving them the
same authority as a city. Bob Miller will talk with Bill Radzwell to et an
idea as to what the Township wants. The City will make no commitment until we
have heard further from Bob.
The 1939 Sheriff's Contract was discussed for approval. The change on the
amendment was again not made. Maureen will make the change and send back to
the C ianty. Bob Braun made a motion to appprove the 1939 sheriff's contract
with the appropriate ch e. Donatus Vetsch seconded the motion. All were i.ri
favor and the motion carried.
The Council held on the approval of the pull tab license for the Multiple
Sclerosis Society at Ronay`s on Main. Money is not being spent in this City by
M.S. and it was felt that perhaps the Park Board or the Firemen should be
offereid the pull tabs at Ronay's before approving them for M.S.
The building Permits were then approved by the Council. Donatus Vetsch
made a motion and Gary Schwenzfeier seconded it to approve building permits
numbered 42 through 53. All were in favor and the motion carried.
The next item on the agenda was a review of bond issues that might be
likely candidates for defeasance. (Please refer to the minutes of December
13th for more detail on the defeasance process.) Brad informed the Cn ncil
that in reviewing the candidates it appeared that there was not enough cost
savings to make it worth the City"s effort. The Council agreed and no further
action was taken on the matter.
Brad also provided the Council with a schedule showing how much it would
cost to finance a new buildirj; under the traditional method financing or by
using a lease agreement. No action was taken on this information, the C',fl>tancil
will review this information and another meeting will be scheduled to discuss
at a later date.
There was no members report and no other business to discuss so a motion
to arourn the meeting was rude by Gary Schwer�zfeier and seconded by Don
C,farnelius. All were in favor and the meeting adjourned.

The Department's authority to hold this hearing and to
take the action proposed is set out at Minn. Stat. § 173.13, Subd.
10. The purpose of the hearing is to ensure that under the
provisions of Minn. Stat. § 173.13, Subd. 10, all parties and

on the question of the denial of outdoor advertising device permits
to Franklin Outdoor Advertising for devices proposed to be located
along Trunk Highway I-94, Control Station 8680, Mile Posts

The petition by counsel for Franklin Outdoor Advertising

"By virtue of this letter, Franklin Outdoor Advertising

refusal of the Minnesota Department of Transportation to
issue permits for these locations."
The known parties to this proceeding are Franklin Outdoor
Advertising and the Minnesota Commissioner of Transportation acting
through his employees.
