ADJOURNMENT ALBERTVILLE CITY COUNCIL October 21, 1991 Albertville City Hall 7:30 PM PRESENT: Mayor Jim Walsh, Councilmen Mike Potter, Duane Berning, Mark Barthel and Donatus Vetsch, City Attorney Bill Radzwill, Clerk Linda Houghton Mayor Walsh called the regular meeting of the Albertville City Council to order. Councilman Vetsch asked that the discussion of the Wilfred Barthel lot subdivision be removed from the consent agenda items. Councilman Potter asked that approval of the October 7, 1991, minutes be removed from the consent agenda items. Barthel made a motion to approve the agenda as amended. Potter seconded the motion. All voted aye. The minutes of the October 7, 1991, public hearing were approved on a motion by Barthel, seconded by Potter. All voted aye. The minutes of the October 7, 1991, meeting were amended to show that the Council meeting time was 7:30 PM. Paragraph 5, Page 4 of the minutes will be clarified to state that the Albertville Jaycees donated the money for the retaining wall in the Four Seasons Park and the Albertville Lions donated the labor to install the retaining wall. The amended minutes were approved on a motion by Barthel, seconded by Potter. All voted aye. Barthel made a motion to approve the Resolution Approving Permit for State Gambling Licence for Albertville Area Jaycees. Potter seconded the motion. Ali voted aye. Barthel made a motion to approve the variance for a 1,008 square foot detached garage for Larry Heikes, as recommended by the Planning & Zoning Commission with the following 'contingencies recommended by P & Z: (1) The current attached garage must be discontinued to be used as a garage within one year. (2) The exterior finish of the new garage will be the same as the existing house. Potter seconded the motion. All voted aye. Wilfred Becker told the Council how he proposes to split his parcel. It is the intention of the proposed buyer to install a pump to connect his house to the sanitary sewer system. Councilman Vetsch suggested that the Council consider having a small lift station installed on 50th Street at the time that 50th Street is improved. Attorney Radzwill advised the Council that an assessment for a new lift station can only be made to those properties that benefit. Since most of the homes are fairly new and have good n septic systems in place, there may be no way to prove additional benefit to those homes. The Council tabled discussion of a proposed lift station since there is not enough information _011IN available for the Council to make a decision. Vetsch made a motion to approve the lot division for Wilfred Becker as recommended by the Planning & Zoning Commission. Barthel seconded the motion. All voted aye. Potter made a motion to grant a variance to DJ's Total Home Care Center to allow the placement of four 4' X 8' individual business identification signs on the building, not to exceed 15% of the total wall area as recommended by the Planning & Zoning Commission. Barthel seconded the motion. Potter, Barthel, Walsh and Vetsch voted aye. Berning abstained. The motion was passed. The Council reviewed the Monthly Operation Report of Wastewater Treatment Facility and the Maintenance Department Report. The Council reviewed the October 11, 1991, letter from John C. Weicht requesting a sewer and water extension to the Albertville Meadows apartment complex in the Westwind PUD area. The Council discussed the October 17, 1991, letter from the Minnesota Pollution Control (MPCA). Before more extensions are granted, the MPCA requires that data be submitted to that agency detailing how the City of Albertville plans to handle additional flowage into the current system since it is approaching capacity. The engineer is in the process of providing that data to the MPCA. Attorney n Radzwill explained that the developer can proceed at his own risk and the Council can give him preliminary plat approval contingent upon the MPCA granting the extension. However, Radzwill pointed out that the Council should consider the extension necessary to connect the new high school to the sanitary sewer system the number one priority. The Council also should prioritize the future hook- ons to the system. Radzwill suggested that a developer's plan or a Council resolution be drafted for the Westwind Third Addition project to protect both parties. Mayor Walsh tabled further discussion of the Westwind Third Addition plat until the city engineer is available. Walsh told the developers that the Council will make a decision on the plat at the next Council meeting. Walsh directed the engineer, the clerk, and the attorney to meet and come up with a plan and a time schedule to present to MPCA and to provide the Council with a recommendation in regards to the water and sewer extension to Westwind Third Addition. Radzwill told the Council that the question of realigning the school district boundaries must be addressed by mutual agreement between the two school boards. The school districts must agree to trade equal -valued properties to do the realignment. The Council directed Radzwill to set a date with the Otsego City Council to discuss both the school district boundaries and the fire contract with the Fire Department. Radzwill told the Council that the 1990 fire protection has been provided to Otsego and that the payment should be forthcoming from Otsego. r� Radzwill told the Council they should set a closed session to discuss the City's financial position and fiscal strategies. The Council set a closed session for October 30, 1991, at 8:00 PM to discuss the fiscal issues. The Council also agreed to meet in a separate closed session at 8:30 PM on October 30, 1991, to discuss an employee issue. The clerk was directed to publish notice of the closed hearings. Assistant Attorney Mike Couri reviewed several items with the Council. The City has a signed agreement with Hackenmueller's stating that they agreed to pay 90% of the costs of the improvements to the road in front of their building. The total cost of the project was in excess of $10,000. Linda was directed to contact Ed Hackenmueller to explain that the City will be invoicing him for this improvement. Couri recommended that the Council consider having an appraisal done to appraise the property where the trunk sewer line to service the high school will be installed to avoid problems with the assessment of the costs. He advised that a second public hearing on the trunk line be held after the appraisal is completed. Potter made a motion directing Radzwill to contact Malcolm Watson about doing the appraisal on the trunk sanitary sewer line property. Vetsch seconded the motion. All voted aye. Couri suggested that one of the Council contact Andy Savitski concerning the reassessment of his Sunrise Commercial Park. Walsh agreed to meet with Savitski. Couri also pointed out that there are two areas that the City must begin work on. The City ordinances need to be reorganized as soon as possible. The attorney will be getting started on updating the shoreland ordinances under the Shoreland Grant Agreement the City has signed with the state. Barthel made a motion to accept the Financial Statement for the period October 1 through October 17, 1991, as presented. Potter seconded the motion. All voted aye. The Council agreed to rent out City Hall at a $25 per day rental fee. The prospective renter will also be required to pay a $75 damage and cleaning deposit for the rental, which will be returned if the building is left in good condition. The clerk has been advised by the insurance agent that the renter must provide the City with a certificate of insurance proving he has host liability insurance to protect the City from any liability. Barthel made a motion to approve payment of the bills (Check #5581-5605). Potter seconded the motion. All voted aye. The Council tabled discussion on the Ron Becker water problems until the November 4, 1991, meeting. The Council directed Linda to contact Mr. Vosika to advise him that all proposals must first be directed to the Planning and Zoning Commission before the Council will act. Clerk Linda Houghton read the Notice of Public Hearing for Proposed Trunk Sewer Improvement No. 1991-2. City Engineer Thore Meyer explained with the use of maps the proposed location of the trunk sewer extension. The sewer main will be a gravity line that will flow to the lift station near Sunrise Commercial Park. The line will make sanitary sewer service available to the Eicher property at the south edge of Albertville as well as the new high school and the undeveloped property it crosses. The portion of the line running along 50th Street will be installed within the right of way of the street. The cost of installing the sewer lines will be assessed to the abutting property owners at an equivalent rate of a lateral line. The cost of oversizing the line and the overdepth expenses will be deducted from the total cost of the project prior to the assessment. The cost of running the lines through the wetland areas will be borne by the City. Thore calculated that the total assessable amount will be approximately $219,000, based on approximately 9,650 assessable feet at between $22-$23 per foot. The assessment will be spread over a 15-20 year period. The Council asked Thore if a lateral line could be run west on 50th Street to provide sanitary sewer service to the houses west of the Joint Powers property. Thore explained that this could be done, but those property owners should contact the City to make the request that the amity extend a lateral line to serve their property. There were no further questions or comments from the audience. Barthel made a motion to close the public hearing. Potter seconded the motion. All voted aye. Ron Becker explained that he has been experiencing drainage problems on his property since the plat of land adjacent to his property was developed. City Engineer Thore Meyer explained that there was no indication that the tile line could have been taken out when the plat was graded. He suggested that a possible solution to Becker's problem would be to regrade the back of the lots and drain the water into the storm sewer. The Council directed Thore to inspect the area and try to come up with a solution to the problem. The Council took no action on the petition concerning the storm water charges because there was no one in the audience to address the Council on their concerns. The Council reviewed the letter dated September 27, 1991, from Kelvin Howieson, District Hydraulics Engineer from MNDOT concerning the interstate drainage problems. Howieson stated that the reduced tile line installed by Frankfort Township has not solved the drainage problem. MNDOT has given funding approval for a proposed drainage project along I-94. The Council directed City Engineer Thore Meyer to contact Frankfort Township's engineer with the plans and cost estimates for solving the drainage problems. The Council reviewed the letter dated September 24, 1991, from Dennis D. Douglas of Redstone Construction Company, Inc. requesting an extension of time for completion on the Westwind Second Addition iue to the owner's financing delays. The work will be done on October 181Ch. POND DIKES On October 9, the dikes and the road were torn up. The Sheriff's Department ticketed Math Sly for the damage. The City must fill out a damage report and also let the County Attorney know the City wants to prosecute to the fullest extent. Th,s ma_v be the person who has been doing most of our past damage. Sheriff's report is coming. TIRES New t4Lres on the pickup were mounted after word hours 3n Wednesday, October 16th. The rims on the back of the pickup were bent. These rims were put on the front of the truck this spring. This may be part of the reason all the tires went bad. The letter also expresses the concerns MnDOT has over the current ponding water adjacent to I-94, the reduced capacity of the 8-inch tile line from the original existing 18-inch tile, and their agreement to participate financially in the resolution of this drainage situation. In .July of 1990, we were directed by the Albertville City Council to meet with the Frankfort Township Engineer regarding the near -flooding condition of the wetland area abutting I-94 and County Road 37. In meeting with Mr. Pete Raatikka, the Frankfort Township Engineer, it was agreed that as the existing 18-inch the line in question was located in Frankfort Township, that Mr. Raatikka would write and submit the report. This report, dated September 16, 1990, and the subsequent amendment letter dated October 1, 1990, reflect the concurrance between the two engineers. We are including a copy of the report and the amendment letter with this correspondence. At the time of the submission of the resolution to MnDOT requesting cost participation, it was felt the most desirous solution, considering the flow of water through the agricultural lands, would be in a southerly direction into the existing 48-inch Albertville storm sewer. This determination needs to be reviewed, however, as do the questions of the undersized 8-inch the line in lieu of the blocked 18-inch tile line and future maintenance costs and accessibility through the agricultural lands. Either alterna- tive "A" or "C" will provide the needed relief to the flooding wetland situation. Thore P. Box 113 St. Michael, MN 55376 Re: Drainage, County Road 37 and Interstate 94 Area Dear Board Members: We have completed an evaluation of tributary areas, surface runoff, ponding and outflow alternatives for an area of the City of Albertville, Frankfort Township and Otsego Township near Interstate 94 and CR37. This evaluation was undertaken in response to high water levels on the ponds this year and subsequent flooding of agricultural lands when the pond outlet was opened. Three alternatives were identified with costs as follows: a) Route flow south to a City of Albertville $33,906 system. b) Route flow east along Interstate 94. $62.000 c) Maintain existing ditch and tile system $25,50d The initially proposed pipe sizing for alternative "A" was a 12" size with costs as identified by the City of Albertville engineer. Alternate "B" costs are based on is" diameter conduit constructed at 0.3% grade to provide 6.3 c.f.s. outlet flow. Alternative "C" primarily provides ditch cleaning work north of CR37 with reconstruction of an 18" drain tile system in drainage district "D" south of CR37. If the pipe in Alternative A is increased to 18 inch size to be consistent with other alternatives, the cost is estimated at $41,000. Alternative B is the least significantly higher cost and downstream highway ditches. 222 Monroe Street Anoka, Minnesota 55303 desireable option due to its to the rerouting of flow to 612/427-5860 Fax 612/427-3401 Page 2 September 11, 1990 Alternative A has the benefit of removing flow from the drainage district by rerouting it to a 48" storm sewer system in the city of Albertville. This alternative has the benefit of providing a new flow outlet path from the wetland areas that the developmental areas drain into. This flow rerouting will__ eliminate the perception that developmental runoff is causing agricultural flooding problems. This alternative, if ce'-ccted, would best be implemented by the City of Albertville with cost participation by other political bodies. Alternative "C", ditch system maintenance, is the least expensive option and is the recommended alternative. It is effective so long as adequate ponding of developmental flow is maintained. The alternative includes reconstruction of the 18" the system in drainage subdistrict "D" by Frankfort Township and cleaning of ditches in Otsego Township. The project can be implemented by the two townships with cost participation to be determined by negotiation between the'fownship, Mn/DOT and Albertville. Our evaluation concludes that existing ponding of developmental flow is adequate, that an 18" drain tile system in the Frankfort Township lands south of CR37 is necessary and that the drainage system from the study area through Otsego Township can accept and convey the flow if the system is fully operational and maintained. If a drainage outlet path is desired that reduces flow to the Otsego ditch system, Alternative A that routes flow to the Albertville system is the best selection. Regardless of which alternative is selected, we recommend that the historical 18 inch drain system size be provided or maintained. The 18 inch system is properly sized for agricultural runoff. We are available to discuss the report and recommendation with all parties of interest. Upon selection of an alternative, we can assist with implementation and cost sharing discussions.
