Mayor Walsh called the regular meeting of the Albertville City
Council to order.
The letter from Gruys, Borden & Carlson concerning penalties
to the Internal Revenue was added to the agenda under
Administration. Potter made a motion to approve the amended
agenda. Barthel seconded the motion. All voted aye.
Mayor Walsh requested approval of the liquor license for the
152 Club be removed from the consent agenda because the application
form has not been completed and turned into the City.
Vetsch made a motion to approve the follow-up sheet from the
March 17, 1992, meeting. Potter seconded the motion. All voted
aye.
The minutes of the March 17, 1992, meeting were amended at
Page 2 Paragraph 2 to read "RESOLUTION TEMPORARILY RESTRICTING
WEIGHT. . .". Vetsch made a motion to approve the minutes of the
March 17, 1992, meeting as amended. Potter seconded the motion.
All voted aye.
Tom Thelen, a representative of the League of Minnesota
Cities, addressed the City Council on the coverage provided by the
city's errors and omissions insurance. Thelen explained that the
policy does not provide coverage for non-performance of assigned
tasks by city staff. Errors and omission insurance does provide
coverage for third party suits resulting from the actions or
inactions of the Council or its staff.
LeRoy Berning, representing the Albertville Friendly City Days
Committee, requested that another pole be placed along Main Avenue
to allow the Committee to place a banner over the street. The
Council had no problem with the Committee's proposal.
Ken Lindsay discussed striping of Barthel Industrial Drive
with the Council. The Council directed Ken to meet with the city
engineer to determine where the striping should be placed.
The Council requested that the maintenance department and the
park board include striping expenses in their budget requests for
1993.

T & S Trucking. Potter made a motion to accept the low bid for
street sweeping from T & S Trucking at $52.00 per hour. Berning
seconded the motion. All voted aye.
The Council discussed having a compost site for City residents
again this year. Mayor Walsh suggested that instead of having
residents drop off compost material as has been done in the past,
the City should select a day when compost materials will be picked
up curbside by City maintenance. Barthel made a motion to set
Monday, April 27, 1992, for picking up compost material curbside.
Berning seconded the motion. All voted aye. Councilman Vetsch
agreed to work with Linda and Ken setting up the compost pickup
day.
Vetsch made a motion to approve the purchase of a 525 gallon
tank and a chemical feed pump from Feed -Rite controls, Inc. for
$1,069.00. Barthel seconded the motion. All voted aye.
Ken updated the Council on the following projects:
Street Sweeping - will begin about April 15
Crack Sealing - nearly 1/3 complete
Light at City Hall - has been repaired
Flow Meter - scheduled to be installed tomorrow
Sharon Anderson, representing the Park Board, explained the
Park Board is planning a Spring Fling on Sunday, May 17th. The
event is being held to familiarize residents with the City's park
facilities.
Anderson discussed the problems with dogs, skateboarders,
roller skaters, and bicycling in the City parks. The Council
directed the Park Board to discuss how to handle these problems and
make a recommendation to the Council.
Berning made a motion to appoint Dean Spenser to the Park
Board as recommended by the Park Board. Barthel seconded the
motion. All voted aye.
The Council approved the request from Park Board Chair Barb
Creighton to attend the 1992 Safety and Loss Control Workshop on
April 23, 1992 at Minnetonka.
The Council reviewed the preliminary plat of Psyk's 5th
Addition and the recommendations of the Planning & Zoning
Commission. Councilman Potter stated he will abstain from voting
on this decision because he represents a builder who is planning
to purchase some of this property. Vetsch made a motion to grant
preliminary plat approval for Psyk's 5th Addition contingent upon
the following:
(1) A developer's agreement is signed by Doug Psyk.

(2) The DRN grants approval regarding the wetlands.
(3) An erosion plan is provided.
(4) Park dedication is provided by land, cash or a
combination of both.
(5) The project will be financed under the 429 state
statutes.
Barthel seconded the motion. Vetsch, Barthel, and Walsh voted aye.
Berning voted no. Potter abstained. The motion carried.
Potter made a motion to approve the request from Dayle Veches
to rezone and subdivide a portion of the Bernard Vetsch property
from A-1 to R-3 to allow a home to be built, contingent upon the
following:
(1) The width of the easement will be increased from the
present 40.75 feet to 48.75 feet.
(2) Payment of park dedication fee in the amount of $170.
Berning seconded the motion. All voted aye.
The Council saw no problem with Ron Long's request for a 25'
setback for Lot 3, Block 4, Westwind Addition. The request was
made because of the lot's unusual configuration. Linda, serving
as zoning administrator, will approve the request.
The Council discussed the request from Fire Chief Rick Wacker
to increase the Firemen's Relief Association benefit from $240 to
$400 for 1993 and to $500 for 1994. According to the schedule
provided by Pat Krause, increasing the benefit will not have an
effect on the 1992 City budget. Potter made a motion to set the
Firemen's Relief Association's benefit at $300 per year. The
motion died for a lack of a second.
Barthel made a motion to increase the Firemen's Relief
Association's benefit to $350 per year for 1992. Vetsch seconded
the motion. Vetsch, Barthel, Potter and Walsh voted aye. Berning
abstained. The motion carried.
The City of St. Michael has been sent a copy of the proposed
excavation of the Eicher property as proposed by Dennis Fehn. The
Council reviewed the response by the St. Michael Clerk and
engineer. Potter made a motion to approve the excavation permit
for Dennis Fehn to excavate the Eicher property. Barthel seconded
the motion. All voted aye.
City Engineer Thore Meyer told the Council that between 500-
600 feet of the sanitary sewer line has been installed at this
time.
Thore reported that Frankfort Township has not yet acted to
appoint two members of their board to a storm water committee as
requested by their engineer. The Council agreed to make a decision

on how to proceed at the next regular meeting on April 20.
Linda was directed to contact the Frankfort Township clerk to
find out what progress has been made on the fire contract.
Linda was directed to contact Tom Holstrom from the Minnesota
Pollution Control Agency to set up a meeting with the full Council
to discuss expansion of the wastewater treatment facility.
City Attorney Bill Radzwill updated the Council on the Fraser
Steel agreement. The documentation should be ready for signatures
by next week.
Radzwill's office has prepared draft ordinances for the
Planning and Zoning Commission to consider on April 28.
The Council agreed that in an attempt to keep legal fees down,
the attorney will be scheduled on future agendas at 8:30 pm.
Vetsch made a motion to approve the Financial State for the
period of March 12 - April 3. Potter seconded the motion. All
voted aye.
Vetsch made a motion to pay the bills as presented (Check #'s
6264 - #6309). Potter seconded the motion. All voted aye.
A decision on selecting a new city logo was tabled until the
next meeting.
Vetsch made a motion to approve the annual on -sale liquor
license, the Sunday On -Sale liquor License and the Off -Sale Liquor
License for the Albertville Bar. Potter seconded the motion. All
voted aye.
Vetsch made a motion to approve the Off -Sale Liquor License
for Hackenmueller's. Potter seconded the motion. All voted aye.
Linda reported on the numerous dog complaints City Hall
receives. The Council directed Linda to contact the City's animal
control officer to find out the cost of a monthly all day patrol
in the city in an effort to control the number of animals running
loose.
Vetsch made a motion to approve the list of election judges
presented for the presidential primary election. Potter seconded
the motion. All voted aye.
Vetsch made a motion to pay the Presidential Primary election
judges $6.00 per hour. Potter seconded the motion. All voted aye.

The Council set the 1991 audit report meeting for 7:30 pm
April 29, 1992.
John Kricek has requested a refund of his liquor licence
application fee of $1200. Kricek explained that the deal to
purchase the old Ronay's building has fallen through. The Council
directed Linda to contact Mr. Kricek and request that he submit a
written request for a refund for the Council to consider.
Linda reported that the special assessments on the lot owned
by Carl Swanson were paid in full to the City in 1986. Wright
County was not notified of the pay-off. Consequently, the
Swanson's have continued to pay the special assessment annually
listed on their tax statement. The Council directed Linda to
determine exactly what the Swansons have paid in principal and
interest since 1987 and the Council will make a decision at the
next Council meeting.
Upon written request from two of the City employees, a special
closed session of the City Council will be conducted on Monday,
April 13, 1992, at 7:30 PM to discuss a complaint against the
employee.
Vetsch made a motion to adjourn at 11:25 PM. Berning seconded

Mayor Walsh called the regular meeting of the Albertville City
Council to order.
The Council reviewed the agenda and made the following
additions under:

Potter made a motion to approve the amended agenda. Barthel
seconded the motion. All voted aye.
The Consent Agenda items were discussed next. Berning
gi..estioned check #6247 which is payable to Lindenfelser Excavating
for raising manholes. He feels it is the responsibility of the
engineer. Walsh and Berning will meet with Thore to discuss the
Situation. Walsh will set up the meeting.
Berning questioned the Maintenance Department's vehicle
journals and requested that a note be placed in Ken`s employee file
regarding the fact that the truck had never been greased.
Linda clarified that check #6257 should be changed to refler.t
that it rer:laces check #"s 5421-5424.

March 2, 1992 meeting. The motion was seconded by Potter. All

Barthel made a motion to approve the minutes of the March 2,
1992 meeting. Potter seconded the motion. All voted aye.
The street sign project is nearly complete. The signs have
been ordered for Westwind. Ken is to check with Donatus Vetsch
regarding their location prior to installation.
Weight restrictions on City Streets was discussed next. Main
Avenue and Barthel Industrial Drive are the only 9 ton capacity
Utreets in Albertville. Can the City put signs on residential
streets regulating weight? Couri will check the City Ordinances
regarding road restrictions.

Potter will make sure the builder puts curb blocking in Psyk's
Addition to prevent curb damage.
Barthel made a motion to adopt Resolution 1992-10 (A
RESOLUTION RESTRICTING WEIGHT ON ALL RESIDENTIAL STREETS TO 5 TONS,
WITH THE EXCEPTION OF EMERGENCY VEHICLES AND ESSENTIAL CITY
SERVICES SUCH AS SANITATION TRUCKS, SCHOOL BUSES, ETC.) The motion
was seconded by Berning. All voted aye.
The Council directed Ken to file a damage report on the fence
located between City Hall and the Post Office by the next Council
Meeting.
The Council also directed Ken to contact' Wright County
regarding when they will begin street sweeping and crack sealing.
Ken is to coordinate the sweeping of the sidewalks with the street
sweeping. Ken is also to schedule crack sealing to coincide with
the County.
Potter made a motion to accept the Planning Commission's
recommendation to appoint Tim Phillips to fill the vacancy in the
Planning Commission. Barthel seconded the motion. All voted aye.
The Planning Commission had requested clarification of proper
procedure for scheduling public hearings. The Council"s decision
was that all requests for public hearings should first go before
tha Planning Comm'.saion and the Planning Commission Will direct
Lin da to schedule a public hearing after they feel they have the
proper documentation, etc. to warrant a public hearing.
Fire Chief Wacker requested an increase in the Fireman`s
Relief Fund from $240/year to $400/year. Walsh would like further
information. Potter and Barthel are to work with the Fire
Department to research this and will present their findings to the
Council.
The flow meter has been repaired and has been shipped back to
Albertville. It should arrive any day and will be installed as
quickly as possible. Wash will meet with Thore and the MPCA
regarding the stipulation for the Wastewater Treatment Plant.
Thore wrote a letter to St. Michael regarding the proposed
site grading on the Eicher and High School properties.
Berning would like to get going on 50th Street as quickly as
possible. Thore will set up a meeting with the Frankfort Township
Engineer before anything gets underway.

The City has no signed Security Agreement or Promissory Note
with Fraser Steel at this time. Fraser is proposing to assign TIF
money to the City for the next 8 years in lieu of hoist, overhead
cranes, etc. Couri is asking that the Council approve striking the
language from the Security Agreement relating to overhead cranes,
hoist, etc. and that the Council approve the City entering into the
Security Agrement in favor of the City which would assign Fraser
Steel's TIF monies to the City if Fraser defaults on the loan.
Potter made a motion to approve the changes to both Security
Agreements as noted by Couri. The motion was seconded by Berning.
All voted aye.
Barthel made a motion to approve the Financial Statement dated
February 26, 1992 through March 11, 1992. Potter seconded the
motion. All voted aye.
Barthel made a motion to approve the payment of check #6230
through check #6263. The motion was seconded by Potter. All voted
aye.
Mrs. ion Krizek of Applejax was present and stated that Kevin
Mealhouse had already inspected their building (the old Ronay's).
Potter made a motion to approve the liquor licenses for Applejax.
Barthel seconded the motion. All voted aye.
Berning made a motion to table the application for a
Charitable Gambling License for Applejax until there is further
info rmat4.on available. The named organization on the permit
application is MN Therapeutic Camp, P.O. Box 763, Brainerd, MN.
The Council expressed its desire for the charitable gambling to
remain local. The Council directed Couri to check into the laws
regarding this. The motion to table the application was seconded
by Potter. Al. voted aye.
Potter discussed the seminar he attended regarding noxious
weeds. He stated that the County will not spray ditches and that
weed control is entirely the responsibility of the City.
Linda is to contact the League of Minnesota Cities and request
that they forward their weekly bulletin to each of the Council
members at their homes.
Linda is to check into rates at different financial
institutions for the CDs that will soon reach maturity.
Potter attended a meeting regarding the proposed school
boundaries. He stated that the entire Corporate limits of
Albertville will be within I.S.D. 0885. He has given the
information to Linda so that it will be available to anyone who is
interested.

Linda requested that the City purchase a new American flag for
City Hall due to the fact that the one we have is in a very poor
state of repair. The Council said to replace as soon as possible.
Linda was directed to contact the Sheriff's office and
instruct them to closely monitor the traffic problem on Lansing
Avenue. There are too many speeders in this area.
Linda was directed to notify Ken that the light outside City
Hall is still not working properly and to have him fix it
immediately.
Barthel made a motion to adjourn the meeting at 9:00 PM. The
motion_ was seconded by Potter. All voted aye.

Wright County is in the process of setting up its pavement striping bid for 1992. We
have been asked to allow the Cities and Townships in Wright County to be able to obtain pavement
striping services off of the County's contra. The purpose of this memo is to let you know how to
obtain these services and what the County will need from you so that it can prepare the proper bid
documents.
ADMINISTRATION:
The purpose of allowing the Cities and Townships to obtain striping seriices from the
County is to save money. The theory is that we will be able to obtain better overall prices due to the
larger quantities of striping materials and the ability to reduce mobilization costs.
The County will be responsible for preparing the specifications and implementing the
contract with the vendor. The striping contractor will coordinate the striping of the City and
Township roadways with the striping of County roadways. The striping contractor will be responsible
to contact each unit of government and to bill each unit of government directly for the striping
services rendered.
RE00RE'.MENTS:
The Cities and Townships must submit to Wright County an 8 'f" x I I" map or macs
showing the roadways to be striped. We have prepared an example to help you in this effort DO
NOT USE InGHI.IGHTERS ON THESE MAPS AS THEY MUST BE REPRODUCIBLE. In
addition you must submit Form "A" which I have enclosed. This will enable us to set a bid quantity
for paint and drop on glass beads. We have enclosed a sheet explaining how to measure and calculate
the quantity of yellow paint and white paint. These documents must be submitted to the County
by ;March 20, 1992 to be included in the County bid. Cities and Townships may want to contact
their Engineer to resolve special striping concerns or issues prior to submitting the information
to the County. Prior to striping of the roadways the Cities and Townships must have the roadways
properly marked using the standard markings which I have enclosed. In addition, rural roadways
must be surveyed for no -passing zones if they are to be striped. The striping contractor will not
stripe any rural roadway that has not been surveyed for no -passing zone striping. If the Cities
and Townships need assistance in marking their roadways they should contact Bill Cordell, Wright
County Traffic Technician, at 682-7391 to receive assistance. If enough interest is shown we will try
to have a training session in which we can meet with all of the interes ,d Cities and Townships.

RE: FENCE BY POST OFFICE
We removed snow from by the fence. Some of the snow was pushed
there by us, some of the snow was put there by the Post Office.
Due to the large amount of snow which had collected, I felt it was
getting to be a hazard for the fire trucks, etc., so I had Mike
remove the snow with the bucket. He damaged the fence while doing
that. We told the Post Mistress that we would replace the broken
post when spring came. The post is currently on order and we are
waiting for it to arrive.
As far as blowing snow against the Post Office and cracking the
wall, I think not.

On the week of April 16th or April 23rd, kids pulled up flags
that were placed next to the sprinkler heads in the City Park. The
flags were placed there last fall when the sprinkler system was
flushed out for the winter. The reason they were placed there was
to locate them so they would not be damaged when we aerated the
ballfield this spring. Now we have to wait until the water is back
on to relocate the sprinkler heads and then aerate.
On April 23rd, we were at the Four Season Park and Mike
checked the tennis court. On April 24th, I saw people inside of
the tennis court. I stopped to see how they got in and found that
the lock on the gate had been disassembled. The people inside
informed me that it was that way when they came down there.
Someone has done a lot of roller blading inside of the tenniv
court because you can see the marks on the surface.
Also, there is damage to the blacktop in one spot. on the
court. I have a call in to Omann Brothers (the contractor who
originally installed the court) to see wwha, can be done ro repair
this on April 26th.

PARR BOARD MEETING
MARCH 19, 1992

PRESENT: Barb Creighton, Sharon Anderson, and City
Maintenance Foreman, Ken Lindsay
ABSENT: Amy Peterson, Councilman Mike Potter
Chairman Creighton called the meeting to order at 7:00 PM.
Anderson made the motion to approve the minutes of the
February 20, 1992, regular meeting. Creighton seconded the motion.
Anderson is to check on getting cement blocks from Eull
Concrete for placement around the grills in Four Seasons Park.
Lindsay stated that the tennis and volleyball nets will be
installed in Four Seasons Park on May 1, 1992.
Lindsay will also call and have BFI bring satellites by May 1,
1992.
Lindsay stated that there is a need for sod and fill in the
Park. The Park Board has tabled this item until the retaining
wail, which was started last fall, is completed.
Lindsay will be unable to attend the April 16th meeting of the
Park Board due to surgery, therefore, the Park Board has requested
that Mike Rutkowski attend in Ken's place.
Lindsay informed the Park Board that there will be re�_-titjaition
workers available to do Spring clean-up in the parks the week of
March 23rd.
The Park Board thanked Lindsay and Rutkowski for the work they
did with regard to changing the park signs.
Anderson is to contact Councilman Potter, who is in charge of
the retaining wall at Four Seasons Park, and confirm the necessity
of a May 1, 1992 completion date.
Lindsay stated that the picnic tables in the parks are going
to be painted, repaired, and cleaned up prior to May 1st,
Discussion regarding the future park in Westwind was tabled.
There is a serious problem with dogs in the parks. People are
not cleaning up after their dogs. The Park Board is going to check
with the City Council and request that they amend the current
ordinance and restrict all dogs from the Par!-,. Lindsay was
directed to check into the cost of signs prohibiting dogs in the
parks. Anderson was directed to approach the Council regarding the
requested ordinance change.
Lindsay requested that a used aerator be purchased for the
betterment of the lawns in the parks at a cost of $850.00. Due to
budget restraints, the Park Board requested that Lindsay check into
renting this equipment with an option to buy.
Applications to fill the current vacancy on the Board were
reviewed. Anderson made the motion to recommend that the City
Council appoint Dean Spencer to fill this vacancy. Creighton
seconded the motion.
A tentative meeting is scheduled at the request of the
Planning Commission for April 14, 1992. The purpose of this
meeting is to give the Commission and the Board the opportunity to
discuss future goals for the City Park system.
Chairman Creighton made a motion to request payment for the
Park Board members for meetings attended in December, January,
February, and March, as follows:

Barb Creighton 4 meetings
Sharon Anderson 4 meetings
Amy Peterson 1 meeting
Mike Potter 2 meetings
Creighton also requested payment of $3.09 be made to J111
Merges as reimbursement for thank you notes purchased.
Lae Board also requested clarification from the City Council
regarding the following:
1. [dumber of meetings a Board member is allowed to miss
before they are requested to resign.
?. Is a Board member paid the entire $15.00 if that member
has attended only a small part of a meeting.
Anderson was directed to request to be placed on the City
Council agenda for the April 6th meeting in order to discuss the
Park Board's plans to hold a "Spring Fling" in the parks on Sunday,
May 17th.
Anderson made a motion to adjourn at 9:10 PM. Creighton
seconded the motion.

During the morning of April 25th I saw several kids roller
skating and skateboarding on the walkways in Four Season Park. I
informed them that skating was not allowed on the walkways. I also
told them to read the signs by the path entrances.
Shortly after I got back to the shop, i found that Duane
Berning had called. I stopped to see what he wanted. He said
that, since no ,one was at City Hall, Mrs. Corell had called him
and said that the signs were up there only for insurance reasons
and that the kids could indeed skate on the walkways. Duane said
to tell her kids i t was ok to skate on the walkways.
I called ParK Board member, Sharon Anderson, to find out

Bishop welcomed new Commission member Tim Phillips.
The Commission reviewed the agenda and added Ron Long's
request for a 25' setback on a lot which has an unusual
configuration. Berning made a motion to approve the amended
agenda. Bishop seconded the motion. All voted aye.
Berning made a motion to approve the minutes of the March 10,
1992 meeting as submitted. Bishop seconded the motion. All voted
aye.
Haller opened the public hearing for Doug Psyk's plat approval
of the 5th and 6th Additions on the motion made by Bishop and
seconded by Berning.
The Park land dedication as indicated on the plat shows much
of the proposed dedicated area to be low land and unusable. Psyk
stated that this property is shown by the DNR to be wetlands.
Thore stated that the use and development of this wetland will
probably be restricted by the DNR. Couri stated that the Ordinance
does state that the dedicated park land must be usable. It was
suggested that the City could request a dollar dedication instead
of land, or a combination of both land and money. The Commission
feels that the Park Board should be consulted on this issue. Psyk
stated that if he is required to dedicate money, he wants to see it
used for parks in his area. Couri stated that where that money is
spent is entirely up to the City Council's discretion. Psyk will
contact the DNR to find out exactly how much of this land is
wetland. Couri reminded the Commission that it would be wise to
keep their options open regarding this dedication.
Phillips questioned why natural gas isn't brought into these
developments at the same time as other utilities. The Developer's
Agreement could be drawn up to include this stipulation.
No further comments were forthcoming from the floor and
Berning made a motion to close the public hearing. Bishop seconded
the motion. All voted aye.

The public hearing regarding preliminary plat approval for
Westwind 4th Addition was opened by Haller ion a motion made by
Berning and seconded by Bishop. All voted aye.
Berning questioned the park dedication. Darkenwald stated
that they had dedicated 14+ acres and $10,000 which was paid in
1988. The Commission expressed their concern that so much of this
dedicated land is wet and is currently unusable. Darkenwald stated
that in dry years it could be used as ball fields, although the
City would never be able to build upon it. The Commission felt the
Park Board should be consulted on this issue.
Finishing Kahler Drive was discussed. Darkenwald stated that
they intended to finish it as a class 5 road until they decided for
what use they would develop outlots a and b. Thore stated that he
felt this situation would be fine. The Commission and-:Couri
expressed their concern due to the fact that the bulk of the
traffic would continue to use the same street they currently do and
that as development progressed it would become progressively
heavier.
The Commission expressed their concern that access to the park
was not as convenient as it should be. Darkenwald stated that he
didn't want to put an access to the park between private homes.
The Commission questioned whether the City's concern should lie in
what is most advantageous to the Developer, or in what is most
advantageous to the City and its residents.
With no further discussion from the floor, Berning made a
motion to close the public hearing. Bishop seconded the motion.
All voted aye.
Bishop made a motion to table this issue until the concerns
regarding the park and finishing Kahler Drive are resolved more
satisfactorily. Berning seconded the motion. All voted aye.

The Fehn property is currently zoned R-3. Fehn is requesting
that his property be rezoned to I-2, however, the property does not
meet the 5 acre requirement. A Conditional Use Permit is also not
a solution since Fehn's business is not a permitted use for a
C.U.P. The Commission questioned whether or not a change in the
Zoning Ordinance was a feasible solution. Couri stated that if
that was the solution the Commission settled on, they would have to
amend the Ordinance and map prior to doing any rezoning.
Berning made a motion to close the public hearing. Bishop
seconded the motion. All voted aye.

ordinance and map changes until the next meeting. Bishop seconded

The Commission directed Ann to call Frankfort and find out
what they have the MacAlistar area near Fehn zoned as.

rezoning request from Dayle Veches. The motion was seconded by

The proposed easement for a possible future frontage road was
discussed and it was agreed to change the easement width to 48.75'
from 40.75 feet.
The Commission feels it is important that when this lot, split
takes place a park dedication fee of $170.00 be made. Veches
stated that this would not be a problem.
Haller made a motion to close the public hearing. Berning
seconded the motion. All voted aye.
Berning made a motion to recommend that the City Council
approve the rezoning request for Dayle Veches with the easement
change from 40.75' to 48.75'. Bishop seconded the motion. All
voted aye.
Ron Long presented a survey of lot 3, block 4, Westwind, which
has a very unusual configuration, and requested that he be allowed
a 25' setback.
Berning made a motion to recommend that the Council approve
the 25' setback in this case. Bishop seconded the motion. All
voted aye.
Berning made a motion to schedule a public hearing for April
28, 1992 at 7:00 PM to discuss possible changes to the Zoning
Ordinance regarding fees, charges-, and expenses be paid for various
subdivision and zoning related expenses. Bishop seconded the

Planning Commission Members:
Mr. Doug Psyk, the applicant, has submitted an application for
preliminary plat approval of a 19-lot, single-family subdivision to
be named Psyke's Fifth Addition and an 18-lot, single-family
subdivision to be named Psyk's Sixth Addition. It is our
understanding that preliminary plat approval is requested for both
the 5th and 5th Additions; however, only the 5th Addition can be
developed at this time. A release from MPCA for additional sewer
service will be required for the 6th Addition. Both the 5th and 6th
are submitted at this time to assure compatibility of street
grades, drainage, etc. for the two.
1. The property in question is zcned R-3, single and t-vc-family

2. The proposed preliminary plat indicates the required five- (5)
foot drainage and utility easement along all lot lines. The plat
also provides a 10-foot easement along the street lines.
Additional drainage easements are shown in areas subject to
storm water drainage and storage.
3. The walkway, or access to the wetland area, shall be over a
14-foot dedicated park land between Lot 1, Block 4 and Lot 1,
Block 5. This dedicated walkway coincides with the sanitary
sewer trunk easement.
4. The drainage system for the 5th Addition utilizes the existing
lowlands as detention ponds with outlets into the wetland areas.
Storm sewer will be provided for the street and rear lot line
drainage system with eventual outlet into the wetland areas. As
the general terrain is relatively flat with very little relief
from high land to the wetlands, cross sections have been
provided with the drawings to assure each house pad will receive
proper drainage. The grading of the streets and sites will be
done under a city contract and supervision, to be assessed back
to the developer, to assure proper drainage of all critical
areas. Final construction plans may vary slightly from the
preliminary plans.
The drainage for the 6th Addition will be dependent upon a
drainage easement over the adjacent property. The natural
drainage direction from the 6th Addition is to the northeast
into the large 7-acre wetland area located on the Marx property.
A storm sewer easement or temporary drainage way easement will
be needed on this adjacent property if the 6th Addition is to be
developed.
S. The utilities, water and sanit-ary sewer, sh=ll be installed
under a city contract and supervision to assure coordination and
compatibility with the existing system and planned future
expansion areas.
6. Street grades are at or greater than the minimum street grades
(0.5°0) required by the ordinance. Street construction will be
done under city contract and supervision and will be according
to the city standard for residential streets (36-foot width,
concrete curb and gutter, 12" gravel base and 3" bituminous
surfacing) .
7. This subdivision is subject to the City's Parkland Dedication
requirements. As no parkland is shown on the preliminary plat, a
per -lot deposit for parkland will be required. This should be
clarified with the Park Board.

Based upon the above review, our office would recommend approval of
the proposed preliminary plat subdivision that would create 19
single-family lots and 18 future single-family contingent upon the
following:
1) Clarification of the parkland dedication requirement,
2) The developer enters into any required developer agreements,
3) Enter into Chapter 429 Improvement Agreements with the City
for all platting, site and street grading, utility and street
construction.

collected prior to City action on any application. All such
applications must be accompanied by a written agreement between the
City and the applicant/landowner (when the applicant is not the
same person or entity as the landowner, both the landowner and the
applicant must sign the agreement) whereby the applicant/landowner
agrees to pay all applicable fees, charges and expenses as set by
Council resolution as provided above, and which allows the City to
assess the above fees, charges and expenses against the landowner

Meyer-Rohlin, Inc., engineers for the City of Albertville and engineers for
Dennis Fehn Gravel, Inc., have forwarded me a proposed grading plan for a
mining project on the Eicker property in the City of Albertville. A copy of
their transmittal letter is attached.
The project proposes considerable gravel mining in the easterly portion of
the Eicker property and a small adjoining area of the school property. The
final grades will be 30 feet below existing grades at the point of maximum cut.
The plan provides a 3:1 slope along the common property line between the
Eickers and the City of St. Michael. This is a stable slope as long as good
topsoil and turf restoration is placed. No general drainage patterns will be
changed; the site will still slope to the north.
The only point we should make is that the City of St. Michael will not be
responsible for any erosion problems that may arise during or after mining,
caused by drainage from St. Michael. Some drainage does now flow onto the
Eicker property, but over much more gradual slopes.

We removed snow from by the fence. Some of the snow was pushed
there by us, some of the snow was put there by the Post Office.
Due to the large amount of snow which had collected, I felt it was
getting to be a hazard for the fire trucks, etc. , so I had Mike
remove the snow with the bucket. He damaged the fence while doing
that. We told the Post Mistress that we would replace the broken
post when spring came. The post is currently on order and we are
waiting for it to arrive.
As far as blowing snow against the Post Office and cracking the
wall, I think not.

During the morning of April 25th I saw several kids roller
skating and skateboarding on the walkways in Four Season Park. I
informed them that skating was not allowed on the walkways. I also
told them to read the signs by the path entrances.
Shortly after I got back to the shop, I found that Duane
Berning had called. I stopped to see what he wanted. He said
that, since no one was at City Hall, Mrs. Corell had called him
and said that the signs were up there only for insurance reasons
and that the kids could indeed skate on the walkways. Duane said
to tell her kids it was ok to skate on the walkways.
I called Park Board member, Sharon Anderson, to find out
whether -vr not i was Supposed to enforce the signs. She stated
that yes, the signs were to be enforced and that she would take it
up at the next Council meeting.

On the week of April 16th or April 23rd, kids pulled up flags
that were placed next to the sprinkler heads in the City Park. The
flags were placed there last fall when the sprinkler system was
flushed out for the winter. The reason they were placed there was
to locate them so they would not be damaged when we aerated the
ballfield this spring. Now we have to wait until the water is back
on to relocate the sprinkler heads and then aerate.
,1 On April 23rd, we were at the Four Season_ Park and Mike
checked the tennis court. On April 24th, I saw people inside of
the tennis court. I stopped to see how they got in and found that
the lock on the gate had been disassembled. The people inside
informed me that, it was that way when they came down there.
Someone has done a lot of roller blading inside of the tennis
court because you can see the marks on the surface.
Also, there is damage to the blacktop in one spot on the
court. I have a call in to Omann Brothers (the contractor who
originally installed the court) to see what can be done to repair
this on April 26th.

Planning Commission Members:
Mr. Doug Psyk, the applicant, has submitted an application for
preliminary plat approval of a 19-lot, single-family subdivision to
be named Psyke's Fifth Addition and an 18-lot, single-family
subdivision to be named Psyk's Sixth Addition. It is our
understanding that preliminary plat approval is requested for both
the 5th and 6th Additions; however, only the 5th Addition can be
developed at this time. A release from MPCA for additional sewer
service will be required for the 6th Addition. Both the Sth and 6th
are submitted at this time to assure compatibility of street
grades, drainage, etc. for the two.
1. The property in question is zoned R-3, single and two-family
district. The following chart indicates the zoning requirements
and the proposed plats' conformance to the requirements:

2. The proposed preliminary plat indicates the required five- (5)
foot drainage and utility easement along all lot lines. The plat
also provides a 10-foot easement along the street lines.
Additional drainage easements are shown in areas subject to
storm water drainage and storage.
3. The walkway, or access to the wetland area, shall be over a
14-foot dedicated park land between Lot 1, Block 4 and Lot 1,
Block 5. This dedicated walkway coincides with the sanitary
sewer trunk easement.
4. The drainage system for the 5th Addition utilizes the existing
lowlands as detention ponds with outlets into the wetland areas.
Storm sewer will be provided for the street and rear lot line
drainage system with eventual outlet into the wetland areas. As
the general terrain is relatively flat with very little relief
from high land to the wetlands, cross sections have been
provided with the drawings to assure each house pad will receive
proper drainage. The grading of the streets and sites will be
done under a city contract and supervision, to be assessed back
to the developer, to assure proper drainage of all critical
areas. Final construction plans may vary slightly from the
preliminary plans.
The drainage for the 6th Addition will be dependent upon a
drainage easement over the adjacent property. The natural
drainage direction from the 6th Addition is to the northeast
into the large 7-acre wetland area located on the Marx property.
A storm sewer easement or temporary drainage way easement will
be needed on this adjacent property if the 6th Addition is to be
developed.
5. The utilities, water and sanitary sewer, shall be installed
under a city contract and supervision to assure coordination and
compatibility with the existing system and planned future
expansion areas.
6. Street grades are at or greater than the minimum street grades
(0.5%) required by the ordinance. Street construction will be
done under city contract and supervision and will be according
to the city standard for residential streets (36-foot width,
concrete curb and gutter, 12" gravel base and 3" bituminous
surfacing) .
7. This subdivision is subject to the City's Parkland Dedication
requirements. As no parkland is shown on the preliminary plat, a
per -lot deposit for parkland will be required. This should be
clarified with the Park Board.

Based upon the above review, our office would recommend approval of
the proposed preliminary plat subdivision that would create 19
single-family lots and 18 future single-family contingent upon the
following:
1) Clarification of the parkland dedication requirement,
2) The developer enters into any required developer agreements,
3) Enter into Chapter 429 Improvement Agreements with the City
for all platting, site and street grading, utility and street
construction.
