ADJOURN ALBERTVILLE CITY COUNCIL April 5, 1993 Albertville City Hall 7:30 PM PRESENT: Mayor Mike Potter, Councilmembers Duane Berning, Sharon Anderson, Albert Barthel, John Vetsch, City Attorney Mike Couri, City Engineer Thore Meyer, and Secretary Ann Culley. Mayor Potter called the regular meeting of the Albertville City Council to order at 8:40 PM. The agenda was amended by adding the following under Administration: (1) Set up meeting of Fire Committee (2) Set date for composting (3) Clarify release of minutes Berning made a motion to approve the agenda as amended. The motion was seconded by Anderson. All voted aye. Berning requested that check #7354 to Meyer-Rohlin and check #7364 to Radzwill Law (.Office be removed from the consent agenda until the fees have been clarified. Berning further requested that the Liquor Permit for the 152 Club be amended to specify the closing time as 12:00 AM. Berning made a motion to approve the amended consent agenda. Barthel seconded the motion. All voted aye. Berning requested that the date of origination and the completion dates be included on all future follow up sheets. Berning made a motion to approve the follow-up sheet for the March 15, 1993 meeting. Barthel seconded the motion. All voted aye. Potter requested that the minutes of the March 15, 1993 meeting be amended on page 6, paragraph one to reflect that Carol Larson did return his call, however, not in a timely manner. He further stated that Larson did not initiate any calls to him, the City Council, or City Hall after the decision was made to change official newspapers. Berning made a motion to approve the amended minutes of the March 1, 1993, meeting as submitted. Anderson seconded the motion. All voted aye. Brian Bebeau addressed the Council regarding the problems he has encountered in trying to hook up to the City sewer system. The contractor did not properly mark the location of the stub. Meyer stated that the contractor measured incorrectly and the line has since been televised and will be properly located for Bebeau. Bebeau has requested that he be allowed to submit a claim against Kadlec Construction for the $350 already spent trying to locate the stub and the additional sod ripped up due to this problem. Bebeau further stated that there is an 8" sag at the edge of his driveway which needs to be filled. The Council advised Bebeau to get copies of his additional costs to Thore and he will forward to Kadlec. ALBERTVILLE CITY COUNCIL April 5, 1993 Page 2 of 6 The Council further directed Thore to include in this claim to Kadlec any additional costs incurred on behalf of the City due to Kadlec's oversight. Virgil Pouliot addressed the Council regarding problems he is having with special assessments on his property tax statement. Pouliot stated that he thinks these assessments were to have been levied against a property which he has since sold, not the property at which he now resides. He stated that he thinks the special assessment was deferred at the time he granted an easement to the City for Lander Avenue, but is not really certain. The Council directed Ann to check the minutes of the April 16, 1985 Council meeting to forward the information to Couri, who will further research the situation and report back to the Council. Russ Voght was present to address the Council regarding the complaint from Ben Hergel regarding a possible septic problem on the Ralph Ackerman property. Voght stated that the Ackerman yard is almost always wet and that the septic odor is very offensive, especially during the summer months. The Council directed Ann to contact Kevin Mealhouse to research the situation and report back to the Council. The Council will advise Voght of the findings. Berning made a motion, per the recommendation from the Planning Commission, to approve the variance for Steffens Brothers Meats, Inc., allowing them to place their sign under that of Pat's 66 with the stipulation that no further pylon signs will be allowed for either property owner and that if, in the future, the Steffens sign is removed, the variance will become null and void. Anderson seconded the motion. All voted aye. Vetsch made a motion to allow Mike Potter to sign the permit application, as acting Zoning Administrator in the absence of Houghton, in an effort to expedite issuance of the permit for Steffens Brothers Meats, Inc. Anderson seconded the motion. All voted aye. The drainage problems on the Voght/Roden properties were addressed. Meyer stated that he had reviewed the old topography map of that area, dating back to before PPM was built, and that the high point was the Ackerman's driveway and that the water was directed to run to either side of the driveways. Meyer stated that he had contacted the County and they had indicated that they may be willing to assist in cleaning out both the culvert and the ditch. Voght will coordinate these efforts with Meyer and Fingalson, County Engineer. n ALBERTVILLE CITY COUNCIL April 5, 1993 Page 3 of 6 Berning made a motion to recess the public meeting at 9:25 PM and to enter into a closed meeting to discuss settlement proposals and litigation strategy between the City and Douglas and Beatrice Psyk and John -George, Inc. regarding assessment appeals. The public meeting was reconvened at 9:55 PM. The Council addressed Berning's concerns regarding check #7364 to Radzwill Law Office, page two of the Sewer Bill. Couri explained the questions to the satisfaction. City Attorney, Mike Couri, left the meeting at 10:10 PM. The memo from Wright County Dated March 18, 1993, regarding Pavement Striping and Markings was addressed. Ann stated that she had talked to Ken Lindsay and he was uncertain whether or not there was any funding in the '93 budget for this type of project. Berning stated that he thought there was and he would check his records. The Council noted that the deadline for application was April 2, 1993. The Council directed Ann to check with the City Attorney to determine the best way for the City to dispose of its surplus equipment as noted in the memo from Lindsay and dated March 23, 1993. Thore Meyer addressed his letter to the Council regarding the traffic problem on 51st Street. Meyer stated that the state is emphatic that no stop signs be placed in the middle of the street due to the fact that driver awareness of such placement is very poor. Potter suggested that the City may be able to relocate the "Children at Play" sign for better visibility. He further suggested that the City could possibly obtain a larger "Children at Play" sign to aid in promoting driver awareness. Meyer stated that he will have to wait until the water level is down before he is able to assess the condition of the culverts on Andy Savitski's property. Meyer will gather more information and will report to the Council at the May 3, 1993, meeting. Meyer stated that construction on the sidewalks on Main Avenue will begin first thing this spring. Potter stated that he wants the Main Avenue sidewalks completed prior to Albertville Friendly City Days. ALBERTVILLE CITY COUNCIL April 5, 1993 Page 4 of 6 The Council questioned Meyer as to why the bill from Ericksen Ellison and Associates was more than the $7500 maximum fee which was quoted. Meyer stated that although some further work had been requested, he has requested further explanation from Ericksen Ellison regarding their billing. Meyer suggested that the Council pay Ericksen Ellison $4,687.98 and wait with paying anything further until he has received a satisfactory response from Ericksen Ellison. Berning made a motion to readopt the Findings of Fact dated December 22, 1992, as they relate to the proposed Adult Use Ordinance, per the recommendation of the Planning Commission. Anderson seconded the motion. All voted aye. Berning made a motion to approve the bills, check #7332 - check #7375, except check #7354 to Meyer-Rohlin and check #7364 to Radawill Law Office. Barthel seconded the motion. All voted aye. ALBERTVILLE CITY COUNCIL April 5, 1993 Page 5 of 6 Berning made a motion to approve the liquor permit for the 152 Club, Softball Fund Raiser at City Park April 23, 24, and 25, subject to closing time being 12:00 AM. The motion was seconded by Barthel. All voted aye. Berning made a motion to approve the liquor licenses for Hackenmueller's, Off Sale; K.D.`s Family Restaurant, On Sale and Sunday; Albertville Bar, On Sale, Off Sale, and Sunday; 152 Club, On Sale, Off Sale, and Sunday. Barthel seconded the motion. All voted aye. A joint meeting with the Council, Park Board, and Planning Commission is scheduled for Monday, May 10, 1993, at 7:00 PM to discuss and review the City's Comprehensive Plan. The Council directed Houghton to contact Donna at the Joint Powers Board and clarify how they want their request to hold the developer's escrow deposit handled. 110111� Meyer stated that the Joint Powers Board has approved the use of PVC for water mains and questioned if the Council was in agreement with this. Potter stated that the Joint Powers Board is leaving the decision of whether or not to use PVC to each city. Meyer stated he would check into this further. The first meeting of the Personnel Committee is scheduled for Thursday, April 15, 1993, at 8:30 AM. The consensus of the Council is that there is no need for a work session for the Council at this time. Potter recommended that Berning and Anderson, Fire Committee, meet with Black and Fournier of Otsego to discuss the possibility of extending fire service to Otsego. The Council directed Ann to contact Elaine at Otsego City Hall and advise her that this Committee has been formed and that they should schedule a date to meet and discuss the situation. The Council discussed spring composting. Potter and Vetsch volunteered to help the Maintenance Department in picking up the composting materials. It was felt that a Monday would be a good day and that the first part of May would be best. Potter will coordinate with Lindsay. Potter mentioned that the County is working on a large appliance removal program. He will keep the Council informed of any developments. ALBERTVILLR CITY COUNCIL April 5, 1993 Page 6 of 6 Berning requested and the rest of the Council agreed that in the future all unapproved minutes of meetings will carry a note stating "Tentative notes of the meeting and may have inaccuracies within them". The Council agreed that all approved minutes are to be faxed to the Wright County Journal Press the morning after approval. Under Other Business, the Council addressed a memo they had received from Ann Culley regarding a harassing phone call received at her home. The Council stated that they do not condone nor encourage any action of this nature and further stated that all complaints should be addressed in an orderly manner at a public forum. Michael Potter, Mayor Ann Culley, Secretary n n ALBERTVILLE CITY COUNCIL April 5, 1993 PUBLIC HEARING PROPOSED VACATION OF ALLEY Albertville City Hall 7:00 PM PRESENT: Mayor Mike Potter, Councilmembers Duane Berning, Sharon Anderson, Albert Barthel, John Vetsch, City Attorney Mike Couri, City Engineer Thore Meyer, and Secretary Ann Culley. Mayor Potter called the public hearing to order. Secretary Ann Culley read the notice of public hearing. Paul Ederer, President of Security Bank Northwest pointed out the proposed alley vacation. Anderson questioned if curb stops are proposed along the property line. Ederer stated that they are not. Dennis Eull expressed concern that the bank's drive-thru will cause traffic congestion for the car wash. It was explained that the access will remain the same. Ederer explained that there will be an entrance off of Large Avenue also. Ederer further explained that there will be two drive-thrus, one cash machine lane, and that the fourth lane would be for future expansion. C,ouri explained that if the property is vacated, one half will go to the bank property and one half will go to the car wash property, and that each property owner will be required to pay taxes on their particular portion. Eull stated that as far as he can determine no problems will be created for his property and that he felt the bank would probably enhance the car wash business. He further stated that he would have no objection if the vacation was granted, nor would he have an objection if it remained as is. Cornelius Paulson, Sr. stated that he is opposed to using public land and that if the City intends to vacate any portion of that alley, he feels that the City should vacate the entire alley. Paulson further stated that the bank knew what they bought and he is strongly opposed to giving them public land. James Walsh questioned why this issue was brought before the Council again since it had been previously denied. Walsh further stated that in 1984 the City denied Ken Barthel's request for vacation of the alley and 60th Street. Ederer stated that the proposed vacations are not crucial to the bank's plans. CITY COUNCIL PUBLIC HEARING PROPOSED VACATION OF ALLEY April 5, 1993 Page 2 of 2 Couri stated that in making their decision, the Council must determine if the action is in the best interest of the public, not the best interest of the private party or parties. He further stated that should the Council wish to consider vacating the entire alley, the rest of the abutting property owners must be noticed. Potter stated that he feels it is in the best interest of the public not to vacate the alley due to the fact that the City Maintenance Department still used the portion of that alley abutting the Paulson property. He further stated that the area in question would not be large enough to accommodate the big plow truck, if the request for vacation was granted. Walsh stated that he is concerned with the precedent that would possibly be set by taking this action. Gary Schwensfeier stated that he feels the property in question may be needed for future City use. Anderson made a motion to deny Security Bank Northwest's application for vacation of the alley. No second to the motion was forthcoming and the motion failed. Vetsch questioned if it would be possible to vacate the alley and move the jail and the salt shed in order to accommodate the plow truck. Anderson stated that she felt the expense would be too great. Culley stated that the City would be required to bring the building in question up to code if it was to be moved. Considering the condition of the building, it would probably be more cost effective to demolish the building as opposed to moving it. Anderson made a motion to close the public hearing at 7:55 PM. Berning seconded the motion. All voted aye. There being no motion on the floor, no action was taken by the Council. Michael Potter, Mayor Ann Culley, Secretary r"*111 ALBERTVILLE CITY COUNCIL April 5, 1993 PUBLIC HEARING PROPOSED VACATION OF 60th STREET Albertville City Hall 7:55 PM PRESENT: Mayor Mike Potter, Councilmembers Duane Berning, Sharon Anderson, Albert Barthel, John Vetsch, City Attorney Mike Couri, City Engineer Thore Meyer, and Secretary Ann Culley. Mayor Potter called the public hearing to order. Secretary Ann Culley read the notice of public hearing. Paul Ederer, President of Security Bank Northwest, pointed out that the street in question is a 66' street and that there will be an easement for City utilities. Cornelius Paulson, Sr. asked Ederer, "If, as you previously stated, the bank has all the land they need, why do they want this vacation?" Ederer stated that the vacation would afford additional parking to the bank. Paulson stated that he didn't feel the City should give away property. Couri suggested that if the City were to vacate the road, the City could maintain all as a permanent easement and advises the City to stipulate that the easement area will not be covered with anything other than blacktop or landscaping. He further advised the City to stipulate that, in the event the easement area must be torn up, the City will not be liable for any damages incurred in placing or repairing utilities. Meyer stated that a minimum easement of 35' to 40' would be necessary. The City currently has 60'. Meyer stated that 40' would be tight, and that even with 60' there may be some problems. Meyer recommended that the City maintain the same easement it now has. Couri stated that the City must make the road passable after the sewer line replacement if it does not vacate the property. It must be made passable with either gravel or blacktop. Couri stated that if the City vacates the street, one half of the vacated land would go to the original/former landowner to the north and one half would go to the bank. Couri stated that he suspects the City owns the northern lot area. n A CITY COUNCIL PUBLIC HEARING PROPOSED VACATION Page 2 of 3 OF 60TH STREET The consensus of the Council is that it is not in the best interest of the public to have to blacktop or gravel that area after the sewer line goes through. James Walsh stated that if the future interchange for I-94 goes through, County Road 37 may have to be expanded to four lanes. If that is the case, the City would have to buy the property in question back from the bank. He stated that he saw no sense in having to buy back at a future date what the City already owns. Paulson stated that he didn't feel the City could go ahead with the proposed vacation without more information. Couri stated that if there is another property owner to the north, they may have a right to challenge these proceedings, but that would not preclude the City from vacating the road in question at this hearing. Couri further stated that he feels the City is probably the fee owner. Paulson stated that he wants to see the paperwork before the City Council makes any motion or takes any action regarding this matter. Couri stated that the City can vacate the road, retaining ownership of that portion which the City owns in fee if the road is vacated. Couri suggested that the City set policy with regard to how they will deal with this type of situation. If the City vacates the street as proposed, the bank will receive a triangular shaped portion of the vacated street. Vetsch stated that he wants more information in addition to some possible policy options. Potter called for a motion to vacate 60th Street as per the legal notice with 33' from the center line for underground utility easement and that the Council finds it is in the best public interest to vacate this street, with the stipulation that in the event the City must, for any reason tear up that area, the City will be held harmless from any financial liability. MARQUETTE Right of Way Agent 682-7386 Wright County is in the process of setting up its pavement striping and marking bid for 1993. As a service to the Cities and Townships in Wright County, we will allow other local government units to be able to obtain pavement striping and marking services off of the County's contract. The purpose of this memo is to let you know how to obtain these services and what documentation the County will need from you so that we can prepare the proper bid documents. ADMINISTRATION: The purpose of allowing the Cities and Townships to obtain striping and marking services from the County is to save money. The theory is that we will be able to obtain better overall prices due to the larger quantities of striping materials and the ability to reduce mobilization costs. The County will be responsible for preparing the specifications and implementing the contract with the vendor. The striping contractor will coordinate the striping of the City and Township roadways with the striping of County roadways. If the City and Township timelines differ from that of the County's striping schedule each local governmental unit will be responsible for scheduling striping with the contractor. The striping contractor will be responsible to contact each unit of government and to bill each unit of government directly for the striping services rendered. REQUIREMENTS - PAVEMENT STRIPING: The Cities and Townships must submit to Wright County an 8'/2" x I I" map or maps showing the roadways to be striped. We have prepared an example to help you in this effort. DO NOT USE HIGHLIGHTERS ON THESE MAPS AS THEY MUST BE REPRODUCIBLE. In addition you must submit Form "A" which I have enclosed. This will enable us to set a bid quantity for paint and drop on glass beads. We have enclosed a sheet explaining how to measure and calculate the quantity of yellow paint and white paint. If you prefer we will calculate the quantity of paint and beads for you, however, you will still need to measure your roads as indicated. Prior to striping of the roadways the Cities and Townships must have the roadways properly marked using the standard markings which I have enclosed. In addition, rural roadways must be surveyed for no -passing zones if they are to be striped. In addition you must submit Form "B" which I have enclosed. The necessary documents as described above must be submitted to the County by April 2, 1993 to be included in the County bid. ESTIMATED COSTS: I am sure some of you are interested in the typical unit costs for striping and pavement markings and will need this information to determine what your budget may allow. This paint is relatively slow to dry and thus one can expect some tracking problems in high traffic areas. This paint however, is the more durable and less expensive than the quick drying paints. The striping specifications require that the contractor place a 4" line at a 15 mil thickness which equates to 17.5 gals/mi for a solid line. In addition the striping specifications require that floatation beads be applied at the rate of 4 lbs/gal. Box 131 Albertville, MN 55301 Honorable Mayor and City Counsil Members As directed by the city council at the Monday, March 15, 1993 meeting, we have checked into the safety concerns expressed by residents on 51st street. We contacted Mr. David Buss, a traffic and signing specialist with the Minnesota Department of Transportation. The following is a summary of the various items discussed with him: 1. Very definitely, no stop sign should be placed in the middle of a block. Drivers are not accustomed to stopping in mid -block, therefore, creating a very low driver awareness of any mid -block stop signs. This could result in a sense of false security for anyone playing on the street or crossing the street and could very possibly create a greater safety hazard than presently occurs. 2. Any reduction in speed limits would need to be requested of MnDOT. An on -site study would be made by MnDOT with a follow up report identifying any changes that may be recommended. His intial reaction was that no change in the 30mph would be made. 3. "Watch for Peds" or "Children playing" signs could be installed, and if not successful could be followed up with the addition of a flashing amber caution light. This could be quite costly to the city, however. 4. The most positive action to create a safer street would be the installation of sidewalks on both sides of the street, providing a place for children to play, ride tricycles, roller skate, etc., rather than being on the street. A pedestrian crossing connecting the sidewalks could then be striped and signed at the crest of the hill, making drivers aware of a specific crossing. The cost of this sidewalk would possibly have to be assessed to the abutting properties either in total or partially as the city council would determine. Thore P. This would be quite costly and would most probably create some steep driveway situations on either side of the street. Section 200.2 is hereby amended to add the following: (3.1) Adult Uses: Adult uses include adult bookstores, adult motion picture theaters, adult motion picture sales and rental, adult mini -motion picture theaters, adult massage parlors, adult steam room/bathhouse/sauna facilities, adult companionship establishments, adult rap/conversation parlors, adult health/sport clubs, adult cabarets, adult novelty businesses, adult motion picture arcades, adult modeling studios, adult hotels/motels, adult body painting studios, and other premises, enterprises, establishments, businesses or places open to some or all members of the public, at or in which there is an emphasis on the presentation, display, depiction or description of "specified sexual activities" or "specified anatomical areas" which are capable of being seen by members of the public. Activities classified as obscene as defined by Minnesota Statutes 617.241 are not included. (a) Specified Anatomical Areas: (1) Less than completely and opaquely covered human genitals, pubic region, buttock, anus, or female breast (s) below a point immediately above the top of the areola; and (2) Human male genitals in a discernibly turgid state, even if completely and opaquely covered. (b) Specified Sexual Activities: (1) Actual or simulated sexual intercourse, oral copulation, anal intercourse, oral -anal copulation, bestiality, direct physical stimulation of unclothed genitals, flagellation or torture in the context of a sexual relationship, or the use of excretory functions in the context of a sexual relationship, and any of the following sexually -oriented acts or conduct: anilingus, buggery, coprophagy, coprophilia, cunnilingus, fellatio, t necrophilia, pederasty, pedophilia, piquerism, sapphism, zooerasty; or (2) Clearly depicted human genitals in the state of sexual stimulation, arousal or tumescence; or (3) Use of human or animal ejaculation, sodomy, oral copulation, coitus, or masturbation; or (4) Fondling or touching of nude human genitals, pubic region, buttocks, or female breast; or (5) Situations involving a person or persons, any of whom are nude, clad in undergarments or in sexually revealing costumes, and who are engaged in activities involving the flagellation, torture, fettering, binding or other physical restraint of any such persons; or (6) Erotic or lewd touching, fondling or other sexually - oriented contact with an animal by a human being; or (7) Human excretion, urination, menstruation, vaginal or anal irrigation. (3.2) Adult Uses - Accessory: The offering of goods and/or services which are classified as adult uses on a limited scale and which are incidental to the primary activity and g o o d s and/or services offered by the establishment. Examples of such items include the sale of adult magazines, the sale or rental of adult motion pictures, the sale of adult novelties, and the like. (3.3) Adult Uses - Principal: The offering of goods and/or services which are classified as adult uses as a primary or sole activity of a business or establishment and include but are not limited to the following: (a) Adult Use - Body Painting Studio: An establishment or business which provides the service of applying paint or other substance, whether transparent or non -transparent, to or on the body of a patron when such body is wholly or partially nude in terms of "specified anatomical areas". (b) Adult Use - Bookstore: A building or portion of a building uses for the barter, rental or sale of items consisting of printed matter, pictures, slides, records, audio tape, videotape, or motion picture film if such building or portion of a building is not open to the public generally but only to one or more classes of the public extending any minor by reason of age or if a substantial or significant portion of such items are distinguished or characterized by an emphasis on the depiction or description of "specified sexual activities" or "specified anatomical areas". 2 t (c) Adult Use - Cabaret: A building or portion of a building used for providing dancing or other live entertainment, if such building or portion of a building excludes minors by virtue of age or if such dancing or other live entertainment is distinguished or characterized by an emphasis on the presentation, display, depiction or description of "specified sexual activities" or "specified anatomical areas". (d) Adult Use - Companionship Establishment: A companionship establishment which excludes minors by reason of age, or which provides the service of engaging in or listening to conversation, talk or discussion between an employee of the establishment and a customer, if such service is distinguished or characterized by an emphasis on "specified sexual activities" or "specified anatomical areas". (e) Adult Use - Conversation/Rap Parlor: A conversation/rap parlor which excludes minors by reason of age, or which provides the service of engaging in or listening to conversation, talk, or discussion, if such service is distinguished or characterized by an emphasis on "specified sexual activities" or "specified anatomical areas". (f) Adult Use - Health/Sport Club: A health/sport club which excludes minors by reason of age, or if such club is distinguished or characterized by an emphasis on "specified sexual activities" or "specified anatomical areas". (g) Adult Use - Hotel or Motel: Adult hotel or motel means a hotel or motel from which minors are specifically excluded from patronage and wherein material is presented which is distinguished or characterized by an emphasis on matter depicting, describing or relating to "specified sexually activities" or "specified anatomical areas". (h) Adult Use - Massage Parlor, Health Club: A massage parlor or health club which restricts minors by reason of age, and which provides the services of massage, if such service is distinguished or characterized by an emphasis on "specified sexual activities" or "specified anatomical areas". (i) Adult Use - Mini -Motion Picture Theater: A building or portion of a building with a capacity for less than 50 persons used for presenting material if such building or portion of a building as a prevailing practice excludes minors by virtue of age, or if such material is distinguished or characterized by an emphasis on "specified sexual activities" or "specified anatomical areas" for observation by patrons therein. (j) Adult Use - Modeling Studio: An establishment whose major business is the provision, to customers, of figure models who are so provided with the intent of providing sexual 3 S stimulation or sexual gratification to such customers and who engage in "specified sexual activities" or display "specified anatomical areas" while being observed, painted, painted upon, sketched, drawn, sculptured, photographed, or otherwise depicted by such customers. (k) Adult Use - Motion Picture Arcade: Any place to which the public is permitted or invited wherein coin or slug - operated or electronically, electrically or mechanically controlled or operated still or motor picture machines, projectors or other image -producing devices are maintained to show images to five or fewer persons per machine at any one time, and where the images so displayed are distinguished or characterized by an emphasis on depicting or describing "specified sexual activities" or "specified anatomical areas". (1) Adult Use - Motion Picture Theater: A building or portion of a building with a capacity of 50 or more persons used for presenting material if such building or portion of a building as a prevailing practice excludes minors by virtue of age or if such material is distinguished or characterized by an emphasis on "specified sexual activities" or "specified anatomical areas" for observation by patrons therein. (m) Adult Use - Novelty Business: A business which has as a principal activity the sale of devices which stimulate human genitals or devices which are designed for sexual stimulation. (n) Adult Use - Sauna: A sauna which excludes minors by reason of age, or which provides a steam bath or heat bathing room used for the purpose of bathing, relaxation, or reducing, utilizing steam or hot air as a cleaning, relaxing or reducing agent, if the service provided by the sauna is distinguished of characterized by an emphasis on "specified sexual activities" or "specified anatomical areas". (o) Adult Use - Steam Room/Bathhouse Facility: A building or portion of a building used for providing a steam bath or heat bathing room used for the purpose of pleasure, bathing, relaxation, or reducing, utilizing steam or hot air as a cleaning, relaxing or reducing agent if such building or portion of a building restricts minors by reason of age of if the service provided by the steam room/bathhouse facility is distinguished or characterized by an emphasis on "specified sexual activities" or "specified anatomical areas". 4 Section 2. following: ADULT USES Section 2800 is hereby amended to add the Section 2800 2800.1 Purpose 2800.2 General 2800.3 Adult Uses -Principal 2800.4 Adult Uses -Accessory 2800.5 Non -Conforming Adult Use -Principal or Accessory 2800.1. Purpose. The nature of adult uses is such that they are recognized as having adverse secondary characteristics, particularly when they are accessible to minors and located near residential property or related residential uses such as schools, day care centers, libraries or parks. Furthermore, the concentration of adult uses has an adverse effect upon the use and enjoyment of adjacent areas. The nature of adult uses requires that they not be allowed within certain zoning districts, or within minimum distances from each other or residential uses. Special regulation of adult uses is necessary to ensure that the adverse secondary effects would not contribute or enhance criminal activity in the area of such uses nor will it contribute to the blighting or downgrading of the surrounding property and lessening of its value. 2800.2. General. Adult uses as defined in this Ordinance shall be subject to the following general provisions: (a) Activities classified as obscene as defined by Minnesota Statute 617.241 are not permitted and are prohibited. (b) Adult uses, either principal or accessory, shall be prohibited from locating in any building which is also utilized for residential purposes. (c) Adult uses, either principal or accessory, shall be prohibited from locating in any place which is also used to dispense or consume alcoholic beverages. (d) An adult use which does not qualify as an accessory use shall be classified as an adult use -principal. 2800.3. Adult Uses - Principal. (a) Adult use -principal shall be located fifty (250) radial feet, as measured in the closest point of the property line which the adult use -principal is located of: 5 at least two hundred a straight line from of the building upon to the property line t (1) Residentially zoned property (2) A licensed day care center (3) A public or private educational facility classified as an elementary, junior high or senior high (4) A public library (5) A public park (6) Another adult use. (7) An on -sale liquor establishment. (b) Adult use -principal shall be located at least two hundred fifty (250) radial feet as measured from one another. (c) Adult use -principal activities, as defined by this Ordinance, shall be classified as one use. No two adult uses - principal shall be located in the same building or upon the same property and each use shall be subject to Section 2800.2. (b) and (c) . (d) Adult use -principal shall adhere to the following signing regulations. (1) Sign messages shall be generic in nature and shall only identify the type of business which is being conducted; and (2) Shall not contain material classified as advertising; and (3) Shall comply with the requirements of size and number for the district in which they are located. (e) Adult use -principal activities shall be prohibited at any public show, movie, caravan, circus, carnival, theatrical, or other performance or exhibition presented to the general public where minors are permitted. 2800.4. Adult Uses - Accessory. (a) Adult use -accessory shall: (1) Comprise no more than ten percent (100) of the floor area of the establishment in which it is located. (2) Comprise no more than twenty percent (200) of the gross receipts of the entire business operation. (3) Not involve or include any activity except the sale or rental of merchandise. 9 f (b) Adult use -accessory shall be restricted from and prohibit access to minors by the physical separation of such items from areas of general public access: (1) Movie Rentals. Display areas shall be restricted from general view and shall be located within a separate room, the access of which is in clear view and under the control of the persons responsible for the operation. (2) Magazines. Publications classified or qualifying as adult uses shall not be accessible to minors and shall be covered with a wrapper or other means to prevent display of any material other than the publication title. (3) Other Use. Adult uses -accessory not specifically cited shall comply with the intent of this section subject to the approval of the Zoning Administrator. (c) Adult use -accessory shall be prohibited from both internal and external advertising and signing of adult materials and products. Section 2800.5. Non -Conforming Adult Use -Principal or Accessory. Adult uses which are classified as legal non -conforming uses may continue in accordance with the provision of this Ordinance, except that any such non -conforming use shall be terminated and become illegal on and after To the extent possible, the City shall attempt to identify all such uses which become classified as non -conforming under the provisions of this subdivision and shall notify the property owners and operations of such uses in writing of the change in status and the terms and conditions which apply. The owner of any property on which an adult use is located may apply to the City Council for an extension of the termination date. Any such application shall be in writing and be received by the City no later than Failure to submit a timely extension application shall constitute a waiver of the right to request an exception, if upon the Council's determination, the. applicant demonstrates that the amortization period is an unreasonable burden upon the business and does not allow adequate time to recover a reasonable return upon the business investment. The applicant shall have the burden of proof to demonstrate hardship with the established termination date and also the time required for an extension. In making its decision, the City Council may consider any factor relevant to the issue, including but not limited to: (a) The degree or magnitude of threat to the public health, safety, and general welfare posed by the secondary impacts of the operation. (b) The length of time that the adult use has been operating. 7 (c) The ease by which the property could be converted to a conforming use. (d) The nature and character of the surrounding neighborhood. (e) The value and condition of the improvements on the property. (f) The amount of the applicant's investment in the business. (g) The amount of investment already realized. (h) The cost of relocating the adult use. Section 3. Section 4200 is hereby amended to add the following: 4200.3 Accessory Uses. Wendi McDermeit addressed the Council regarding the problems on 51st Street and requested that the Council consider placing two stop signs, one in either direction, on that street. She further stated that the hill created a dangerous blind spot. Houghton stated that she has contacted the Sheriff's Department and requested that they keep a close watch on that area. Potter stated that the problem with placing stop signs where McDermeit has requested is that there is not a cross street there. It is the consensus of the residents that the businesses in the Industrial Park contribute heavily to the excessive traffic on 50th Street. The Council directed Linda to contact the Sheriff's Department once again and also to contact the businesses in the Industrial Park and request that they post signs to their employees asking then, to drive cautiously. i ALBERTVILLE CITY COUNCIL March 15, 1993 Page 2 of 6 Thore Meyer was directed by the Council to check into what options are available to alleviate this problem. Speed bumps, 15 MPH speed limit, and flashing amber lights were some of the suggestions. Meyer will contact Wayne Fingalson, County Engineer, and find out who to contact with MNDOT to check into the matters of legality and liability. The residents stated their concern that the blind spot created by the hill is a bigger problem than the speed limit is. The Council also directed Meyer to provide them with a topography map of 51st Street. The Council will contact Wendi McDermeit after they have explored the options. Ken Lindsay presented a quote for a used cab for the John Deer. The cost is $1500. Linda explained the Maintenance Departments proposal for future capital outlay to the Council (a copy of which is attached as a permanent record of the minutes). Lindsay further explained that the figures projected did not include any trade in value of the current equipment. He also stated that if the City continued to grow at its current rate, another plow truck would be needed. Anderson made a motion to approve the purchase of the used cab for $1500 from the capital outlay fund of the Maintenance Department contingent upon Potter physically inspecting the cab. Barthel seconded the motion. Anderson, Barthel, Vetsch, and Potter voted aye. Berning voted nay. Potter brought up .a continuing problem with the storm sewer on 60th Street, near Barthel Industrial Drive, freezing up every spring. Potter suggested placing 2" of styrofoam and a layer of dirt on top of the pipe in that area to act as an insulator. Lindsay stated that there is an open catch basin there and that it could be dangerous. Lindsay recommended placing a beehive in that location after the sewer replacement project is completed. Meyer discussed a letter received from the Railroad regarding upgrading the railroad crossing on Main Avenue. The cost, which the railroad is not willing to share, would be $36, 000+, It was the consensus of the Council that the City could not afford the expenditure at this time. Meyer stated that the MPCA had to date received three responses to their environmental assessment worksheet regarding the wastewater treatment expansion. The responses were from the Historical Society, the DNR., and the City of Otsego. He further stated that he and Attorney Radzwill will meet with the City of Otsego and try to settle any concerns and answer any questions they may have. Meyer said that Widmer has completed the first leg of the sewer line replacement and will not complete the remainder of the project until after Albertville Friendly City Days. ALBERTVILLE CITY COUNCIL March 15, 1993 Page 3 of 6 Potter mentioned that Meyer should check the manhole on the frontage road to the north of I-94 and see if it needs to be raised and sealed. Lindsay stated that he and Norm Gartner had already discussed this situation and that Gartner is looking into raising it. The Council next addressed the Planning Commission's recommendation to adopt Ordinance #1993-2, Shoreland Management Ordinance. Attorney Couri advised the Council that, should they decide to publish the ordinance summary as opposed to the entire ordinance, they will be required to post the entire ordinance in a place where it is available for anyone to read. Couri stated that there would be no problem posting it in City Hall. He further stated that, after Council approval, the ordinance would have to be forwarded to the DNR for their final approval. Vetsch made a motion to approve RESOLUTION # 1993-7 adopting Ordinance #1993-2 entitled AN ORDINANCE AMENDING ORDINANCE NO. 1988-12 (LAND USE ZONING REGULATIONS) OF THE CITY OF ALBERTVILLE, RELATING TO SHORELANDS AND PROVIDING FOR THE ADMINISTRATION AND ENFORCEMENT OF SUCH REGULATIONS. Berning made a motion to recess the public meeting at 8:37 PM and to enter a closed meeting to discuss settlement, proposals and litigation strategy between the City and Douglas and Beatrice Psyk and John -George, Inc. regarding assessment appeals. The public meeting was reconvened at 9:28 PM. City Attorney, Mike Couri, left the meeting at 9:30 PM. Wally Boris of Jones Intercable presented the City with a check in the amount of $2,068.21, representing their 1992 franchise fee. Boris requested that Linda send copies of all new plats to them. He stated that Hardwood Ponds is scheduled for cable installation this summer. The Council directed Linda to contact the railroad once again regarding the drainage and culvert problems behind Andy Savitski's property. She has already written to them twice and called them once with regard to this matter. The Council directed Meyer to meet with Savitski and see what the City can do. Berning made a motion to direct Linda to provide monthly budget reports, including revenue and expenditure figures to the Fire Department, the Planning Commission, and the Park Board. These reports are to be distributed by the 15th of each month. Anderson seconded the motion. All voted aye Wage Increases for Mike Rutkowski and Ann Culley was discussed by the Council. Linda stated that she had met, with Barthel, Anderson, and Vetsch to discuss the employee reviews. Linda stated that the current deficit would be approximately $7,000 less than last, year. She further proposed a 3.5% increase for Rutkowski and Culley. Said proposed increase would be .33/hour for Rutkowski and .30/hour for Culley. Vetsch stated that he can't ,justify an increase as the Council has other things to consider right now. Anderson stated she felt some type of compensation should be given but was not sure that much could be given at this time. Potter suggested a 2% increase for both of the employees. This would amount to .19/hour for Rutkowski and .18/hour for Culley. Linda questioned if the Council felt the increase should be retroactive to January 1, 1993. Anderson made a motion to grant, a 2% increase to both Rutkowski and Culley, retroactive to January 1, 1993. Barthel seconded the motion. Anderson and Barthel voted aye. Berning and Vetsch voted nay. Potter cast the determining vote by signifying aye. The motion was carried. Linda stated that all of the City`s employees had met with Potter and Berning in order to address continuing problems due to lack of communication. It was the consensus of those meeting that a Personnel Committee be formed, said committee to consist of two Councilmembers and the City employees. The purpose of the Committee being to gain more insight, and to promote better teamwork. The Committee would meet once a month. She further stated that in a memo directed to the Council, the City employees had requested that Barthel be appointed to this committee. Berning made a motion to appoint Barthel and Potter to the Personnel Committee. Vetsch seconded the motion. Linda explained that many times it is not possible to transcribe the minutes that quickly due to the fact that many other City matters take priority. Kioka Secretary To Albertville City Council, This is a letter to show my opinion in dealing with Ken Lindsay of the city maintenance department. This is chronological from when I became involved with the Albertville City Park Board. These are personal observations and happenings to the best of my recollection. SPRING 1992 ** Julie McGrew Wright County Horticulture stated that all green areas in both City Park and Four Seasons Park were in terrible condition due to incorrect application of fertilizer. Both in timing of application and type of fertilizer. I guess 15 years working with parks isn't enought time to learn correct procedures. ** Commercial applicators license --Who needs it? ** Citizens/ ball players bought up concerns about exposed concrete around post of the outfield fence at City Park. I guess no park inspections need to be done to help protect citizens from injury or City from possible liability. ** Ken Lindsay was direct to buy a lock for softball lights and make sure Mark Barthel and director of softball league were to get keys. As director of the softball league I can attest I received a key, too bad it was after the games were played! SUMMER 1992 ** Installation of drinking fountain --can't be put into words! !!!!! SEE PICTURES ACCOMPANYING!!!!! ** Inspection by Park Board of City Park. Cement ring around tree but where is the tree? Again possible injury or liability. Trimming around signs were looking good but something resembling motor oil was used to control growth (kill weeds). ** Merry Go Round at City Park needs repair --board did give him the go ahead to repair it. I thought that was what maintenance is all about? FALL 1992 ** Level the ice rink after some rainy weather. Guess who left ruts and where. Lucky one of our local contractors help level it with their skidloader. ** Guess who insisted on having constant input in building the new shelter and seem to spend ample amount of time there to over see the construction. WINTER 1992 ** Best ice we had in a long a time. A feeling of cooperation was building because Mike was in charge!! ** Then one Friday I received a call, " Mary where should I put the broomball nets?" asked a broomball player on the other end. Funny, Ken Lindsay told him there was no room for them -- I wonder why we even add a new park shelter! ** Just last week I heard that Ken was telling some one he was in charge of the parks again. Interesting where Ken gets this self-imposed authority. These are just a few of the incidences and dealings I recollect having with Ken Lindsay. To continue on it would just get repetitious. This is not a personal attack on Ken Lindsay but incidences I drew my conclusion not caring to deal with him as head of park maintenance.
