ADJOURN ALBERTVILLE CITY COUNCIL October 4, 1993 Albertville City Hall 7:30 PM PRESENT: Mayor Mike Potter, Councilmembers John Vetsch, Duane Berning, Sharon Anderson and Albert Barthel, City Clerk Linda Houghton, City Engineers Ron Guerts and Norm Gartner, City Attorney Mike Couri Mayor Potter called the regular meeting of the Albertville City Council to order. The agenda was amended by adding preliminary plat approval for Parkside 2nd Addition under engineering. Barthel made a motion to approve the agenda as amended. Berning seconded the motion. All voted aye. Vetsch made a motion to approve the Follow -Up sheet from the September 20, 1993, meeting as presented. Barthel seconded the motion. All voted aye. Vetsch made a motion to approve the minutes of the September 20, 1993, regular meeting as presented. Barthel seconded the motion. All voted aye. Vetsch made a motion to approve the minutes of the September 28, 1993, work meeting as presented. Barthel seconded the motion. All voted aye. Russ Voght did not appear at the meeting to discuss his concerns over a failed septic system on the Ralph Ackerman property. Bill Dwinnell addressed the Council. He requested that the Council approve a building permit to allow him to pour the footings and foundation for a new home in Hardwood Ponds 2nd Addition. Linda explained that the developer has not yet signed the Developer's Agreement or presented the Letters of Credit for the project. Consequently, the City has not signed the contract with the contractor for the improvements to be installed. The Council told Dwinnell they could not consider the possibility of issuing any permit unitl all paperwork for the project has been completed. Doug Psyk addressed the Council regarding his concerns that Joint Powers Board will not allow any connections to the water system until after the bacteriological test results and the as- builts have been completed. Psyk requested that Albertville's representatives to the Joint Powers Board discuss allowing final approval for connections to be an administrative decision, rather than the current requirement of Board action. ALBERTVILLE CITY COUNCIL October 4, 1993 Page 2 of 4 Ken Lindsay explained to the Council that he, Linda and Mayor Potter had met at the wastewater facility to look at the condition of the old storage garage. All agreed that the garage is in poor condition and should be removed to avoid having a retaining wall constructed around it. Potter and Ken measured the area and found there is sufficient room for a new building to be constructed on site. Lindsay presented the prices he'd gotten for constructing a three sided storage shed. The Council concurred that the old storage garage should be removed, but Councilman Berning questioned whether there would be the need for additional storage when the administrative offices are moved to the old clinic building and the fire department is moved to a new building. Mayor Potter reported that he is waiting a price quote from Lyman Post and Beam. Gartner will get the information from the contractor on when grading is proposed around the current storage building. The Council agreed to table the decision until all information is available. Ken presented a quotation from Albertville Body & Fender for the installation of a window in the right door of the plow truck that will enable the driver to see the wing as he is plowing. The window will be installed before snow plowing season. Ken reported that there may be excess dirt from the Hardwood Ponds 2nd Addition project that could be used in the Westwind Park. No decision was made at this time. Ken will remove the signs from the old Park & Ride site and install posts as barriers. The Council tabled the quotation from Rice Lake Contracting to demolish and bury the materials from the old tank at the wastewater treatment facility. Kent Roessler, the developer of the Parkside 2nd Addition, discussed his preliminary plat with the Council. The plat consists of 18 separate lots and are proposed for twin homes with a zero lot line. Roessler explained that the units will be quality, but affordable, units with maintenance -free exteriors with some brick and attached 20' X 20' double garages. The split entry units are 860 square feet on the main floor with an 800 square foot unfinished lower level. Roessler is proposing a 25' front yard setback to coincide with the 25' front yard setback in the rest of the Westwind PUD. Roessler stated that the yards will be sodded 150' back from the curb. There will be restrictive covenants recorded with the plat. Roessler agreed to include the specifications detailed above in the Developer's Agreement to insure that all units will be constructed as proposed. Barthel made a motion to grant preliminary plat approval to Parkside 2nd Addition with the following stipulations: (1) All units will meet a 30' front yard setback. ALBERTVILLE CITY COUNCIL October 4, 1993 Page 3 of 4 (2) All units will have a 20' X 20' garage. (3) Restrictive covenants will be recorded with the plat. Anderson seconded the motion. All voted aye. Roessler requested that building permits be issued for the Parkside Addition prior to curb, gutter, and gravel completion. He stated it is crucial to his business to get several model homes up this fall. Curb, gutter and gravel will be put down later this fall. Since he is paying for his own improvements, additional work caused because of damage to the streets will be borne by Roessler. Councilmember Vetsch stated that the City may be unable to get emergency vehicles to the building sites and the City would be liable. Roessler offered to sign an indemnification agreement releasing the City from all liability or risk. City Attorney Mike Couri recommended that the City issue the building permits with the stipulation that no Certificate of Occupancy will be issued until after the curb, gutter and gravel base are in if an Indemnification Agreement is signed by Roessler and the City. Barthel made a motion to allow building permits to be issued in the Parkside Addition, subject to Mayor Potter and Linda reviewing and signing the Indemnification Agreement. Vetsch seconded the motion. All voted aye. City Engineer Norm Gartner presented the abstract of bids for the Westwind Third Addition Improvements in his letter dated September 30, 1993. Randy Kramer Excavating is the apparent low bidder in the amount of $86,693.20. Anderson made a motion to adopt RESOLUTION #1993-32 awarding the bid for the Westwind Third Addition Improvements to Randy Kramer Excavating in the amount of $86,693.20. Barthel seconded the motion. All voted aye. Chem Marx was not in attendance; therefore, the Council did not address the storm sewer project on his property. Vetsch made a motion to grant Machtemes Construction a four week extension for detention pond excavation in the Psyk's Fifth Addition. Barthel seconded the motion. All voted aye. Norm reviewed the cost figures for the 50th Street Improvement Project. There were cost overruns in both the sodding and the retaining wall. The Council questioned why there were overruns and Norm explained that the bid price is on a per unit basis and more sod and more retaining wall construction were necessary. Pricing per unit, rather than by job, is generally the cheaper option. However, in this case, the amount of sod and the amount of retaining walls were greater than anticipated. Attorney Couri reviewed the basic draft of the contract to release Healthspan from the lease agreement for the clinic building. The final contract should be ready for Council approval ALBERTVILLE CITY COUNCIL October 4, 1993 Page 4 of 4 at the next meeting. Couri presented the Loan Agreement with the Public Financing Authority. The interest rate on the $1,490,000 bond is set at 3.32% over twenty years. Couri needs some clarification from PFA regarding how the SAC fees were to be applied to this debt service, because the City has already obligated the SAC fees to other debt service funds. He expects to get the questions clarified tomorrow. Anderson made a motion to adopt RESOLUTION #1993-30 entitled RESOLUTION GIVING PRELIMINARY APPROVAL TO THE ISSUANCE OF A NOTE AND EXECUTION OF A LOAN AGREEMENT BETWEEN THE CITY OF ALBERTVILLE AND THE MINNESOTA PUBLIC FACILITIES AUTHORITY, contingent upon Mayor Potter reviewing the document after Couri has clarified his concerns. Barthel seconded the motion. All voted aye. Barthel made a motion to adopt RESOLUTION #1993-31 entitled A RESOLUTION AWARDING THE SALE OF, AND PROVIDING THE FORM, TERMS, COVENANTS AND DIRECTIONS FOR THE $1,490,000 GENERAL OBLIGATION SEWER REVENUE NOTE, SERIES 1993, continent upon necessary clarification of the Loan Agreement with PFA. A'_'_ vote: aye, Bob Braun requested that building permits in the Hardwood Ponds Second Addition be issued before the bituminous surface is installed. Thore explained that the contractor for the project is requested to complete the first lift of blacktop before winter; however, if weather conditions are not optimal, the first lift of blacktop may not be completed before June of next year. The City's policy has been to allow building permits to be issued after the curb, gutter and gravel base are in place. Don Anderson, representing Kenco's Parkside Addition, also appealed to the Council to issue building permits before curb and gutter are in place. He explained that the Westwind 2nd Addition is completely filled and Kenco would like to begin construction of ALBERTVILLE CITY COUNCIL September 20, 1993 Page 2 of 7 model homes on the lots adjoining West -wind 2nd Addition. Vetsch made a motion to allow building permits to be issued in new developments after curb, gutter and gravel base are in place. Anderson seconded the motion. All voted aye. Henry Becker addressed the Council concerning the blocked culvert under 50th Street by his property. The water is now traveling over his driveway toward the area where his septic system is located. The catch basin shown on the original plan was not installed and he questioned why that had been deleted. Thore explained that the natural drainage of the water is to the northeast and the catch basin was deleted because property owners on the south side of 50th Street did not want additional water going into the pond behind their properties. The plan was revised to place a catch basin on the north side of the street on Ron Becker's property. Becker stated that had he known that the catch basin would not be installed on his property, he would not have signed the easement. Thore reiterated the natural drainage way has not been changed and the water now goes in the same direction as it has always traveled. Additionally, the drainage area is still exactly the same as it was before the street was improved. Henry Becker -requested that the culvert under 50th Street be reopened immediately and the Council decide which option to pursue on Ron Becker's property. Thore presented another proposal to eliminate the drainage problem on the Ron Becker property. This proposal provides for 15" storm sewer pipe to be installed on the south border of the property that drains into a 6' wide X 1' deep grassy Swale along the east border of Becker's property and drains onto 51st Street. Ron Becker has told Thore that the dirt removed in creating the swale could be put into the washout on his field. To pursue this option, a fence will have to be moved that is now located on several of the back lots in Barthel Manor Second Addition. Three trees would have to be removed and an easement must be granted by Ron Becker. The Council expressed concern over the water from the drainage swale emptying onto 51st Street. Thore will revise this proposal to include a catch basin at the end of the Swale and storm sewer piping along Lots 1 and 2, Block 1, Barthel Manor Second Addition to the catch basin now located at the intersection of 51st Street and Lansing Avenue. Attorney Couri explained that he has received copies of the proposed letters of credit for the Parkside Addition. Because this is a developer -financed project, these letters of credit are not the typical format. The letter of credit covering the costs of improvements is reduced correspondently with payments to the contractor as the project is completed. The second letter of credit in the amount of $29,400 insures compliance with the on and off site improvements, as well as any other items in the Developer's Agreement and is not reduced until the Council acts upon it. Couri recommended accepting the letters of credit as proposed. Barthel made a motion to accept the two letters of credit for Parks_de Addi t_cri as proposed. This agreement does not set the standards for front lot widths; however, it allows a 25' 7-_ont yard setback. City Ordinance requires a 90' front lot line on all residential lots. There are also some lots that do not meet the ordinance in square footage. Couri explained that the Council could require that a homeowners association is required, but he recommends restrictive covenants be required instead because the City has authority to enforce all deviations from the covenant standards. These concerns are lot sizes, lot widths, front setbacks and garage sizing. Barthel seconded the motion. All voted aye. Barthel made a motion to adopt ORDINANCE 1993-10 entitled AN ORDINANCE AMENDING SECTION 1200.4 OF THE ALBERTVILLE ZONING REGULATIONS (1988-12) RELATING TO OFF-STREET PARKING REQUIREMENTS IN CASES OF BUILDING EXPANSION AND SPECIAL DRAINAGE NEEDS as recommended by the Planning Commission at the September 14, 1993, meeting. Anderson seconded the motion. All voted aye. Barthel made a motion to adopt ORDINANCE 1993-11 entitled AN ORDINANCE AMENDING SECTION 1000.6 OF THE ALBERTVILLE ZONING REGULATIONS (1988-12) REGARDING OUTSIDE STORAGE AREAS ASSOCIATED WITH NON-RESIDENTIAL PROPERTIES as recommended by the Planning Commission at the September 14, 1993, meeting. Anderson seconded the motion. All voted aye. City Engineer Thore Meyer reviewed the Feasibility Study dated September 10, 1993, for the I-94 watermain crossing and the extension of sanitary sewer north of the freeway. Thore explained that the watermain casing was opened at each end and elevation and alignment shots were taken at intervals of every 6'-8' through the 260 feet casing length.. He showed the Council an oversized drawing of the casing which appears to indicate that a 10" ductile or PVC watermain may be possible, however questionable. An 8" ductile or PVC pipe would probably be the maximum size that could be easily installed. Thore added that the AWWA and the Minnesota Health Department have recently approved the use of a polyethylene water pipe. This pipe is fusion jointed and is relatively flexible. Thore believes that a 14" polyethylene watermain could be threaded through the existing casing. However, the Joint Powers Board has not approved the use of polyethylene watermains at this point. Polyethylene piping is somewhat more expensive that PVC. Mayor Potter will discuss approval of polyethylene pipe at the next Joint POwers Board mee:=ng. Linda was directed to contact Philip Morris and other property owners north of the freeway in rega'_dS. to the Feasibility Study to bring water availa?cilit, to -hose properties. Anderson made a motion to proceed with the ditch cleanout by the Savitski property as proposed at the previous Council meeting, approve the Temporary Occupancy Permit with Burlington Northern Railroad (Check #7835 in the amount of $250.00), and award the bid for the ditch cleanout to Fehn Gravel and Excavating in the amount of $3,800.00. Gartner reported that Dave Montebello had explained to him that the paved shoulder was required for maintenance purposes. Gartner does not feel that the City nor a developer should be required to pave the County's houlders for maintenance purposes. He asked the Council for directives. The Council's consensus is to have Gartner negotiate with the Wright County Engineer to see if the permit can be changed. Linda wa directed to send a letter to Wright County Commissioner Judy Rose asking that the County appeal to have the speed limits on County Road 35 by the high school and on County Road 37 by the Westwind additions reduced. Gartner reported that the expansion of the wastewater treatment plant _S still ahead of schedule. The Council discussed Richard Bistodeau's complaint regarding contractor's work hours, noise, etc. The city engineer was directed to incorporate specific work hours in the specifications on all future projects. Linda was asked to procure a copy of a model nuisance ordinance for the Council to consider. The Fire Building Committee will conduct a meeting October 5, 1993, at 7:00 PM at City Hall. Linda will notify all committee members. Barthel made a motion to close the old Park & Ride lot effective October 1 and to have the maintenance department set up barriers on that date. The Council set a meeting with the park maintenance employee to be conducted on September 23, 1' 93, at 7 :00 PM. The meeting will be closed to the public if requested by the employee. The Council asked Linda to contact NSP to see if an additional light can be installed on the light pole next to County Roads #19 and #37 to add more light to the new Park & Ride area. Michael Potter, Mayor ALBERTVILLE CITY COUNCIL SPECIAL WORK MEETING September 28, 1993 Albertville City Hall 7:40 PM PRESENT: Mayor Mike Potter, Councilmembers John Vetsch, Duane Berning, Sharon Anderson and Albert Barthel, City Clerk Linda Houghton, City Engineers Thore Meyer and Ron Guerts, City Attorney Mike Couri Mayor Potter called the special work meeting of the Albertville City Council to order to discuss the methods for assessing the 50th Street Improvement Project. Thore explained that most of the costs of the project have been compiled. He anticipates that the City will assess approximately $222,000 in construction costs, plus the bonding expenses. This excludes the Frankfort Township share of the project (approximately $34,200), the cost of the sidewalks (approximately $12,000) and the cost differential between a 7-ton and a 9-ton surface (approximately $16,500). The proposal presented to the Council at an earlier meeting suggesting assessment options used the assessable amount of approximately $243,000. Attorney Couri recommended that the Council consider having the properties appraised. Spot appraisals could be done, if the Council chooses, only on particularly unique lots. He strongly recommended the Council order at least a minimum number of appraisals and that the Council conduct a one-time only assessment hearing regardless of how long the hearing continues. Linda had the quotes from two different appraisers dated July of 1992. The quoted prices may or may not be valid at this time. Couri recommended a firm called R. A. Field & Associates, who have done similar appraisals based on lot size, market values and special conditions. One of the appraisers with this firm, Clarence Eull, is a local resident. Linda was directed to contact this firm to get a quote. The Council feels that almost all of the parcels to be assessed are unique and, if an appraisal is needed, all parcels should be appraised. Anderson made a motion to have all parcels to be assessed on 50th Street appraised, to direct Linda to get quotes on the appraisals, and to authorize the mayor and clerk to accept the lowest quote and authorize the appraisals to be completed within thirty days. ALBERTVILLE, MN. 497-1936 July 13, 1993 City Clerk City of Albertville 5964 Main Ave. Albertville, MN 55301 Ms. Houghton As directed by the City of Albertville, on April 16, 1993 I inspected the Ralph Ackerman property to determine if the septic system at this property was working properly, or if the system was creating a hazard to public heath or property. When I arrived at the property I introduced myself to Mr. Ackerman and explained to him that I was there to inspect his septic system because of a complaint that was filed at the City of Albertville. Mr. Ackerman agreed to let me inspect the system, and he then showed me the aprox. location of the system. My inspection revealed that the system was leaking effluent from the septic tank, directly to the ground surface. I also probed the area of the drainfield and found that the ground in the area of the drainfield was soft and appeared to be saturated. Mr. Ackerman informed me that he had contacted a septic pumper, and scheduled him to come out and pump the system later that afternoon. At that point I informed Mr. Ackerman that I would be stopping periodically in the next few months to see whether the system was still leaking to the surface. I also informed Mr. Ackerman that if the city received any more complaints in reference to his septic system leaking to the surface that I would immediately come out to inspect the system and if it was leaking to the surface the city would take the appropriate action to insure the system would be brought into compliance with the cities ordinance. On July 12, 1993 I received a call from Russ Vought, he informed me that Mr. Ackermans septic system was leaking to the ground surface at the very moment we were speaking on the phone. At aprox. 5:00 PM I stopped at the Ackerman property and informed Mr. Ackerman that I had received a call in regards to his septic system leaking to the surface again. Mr. Ackerman agreed that the system was leaking to the surface, and gave me permission to inspect the system. Again I found the septic system to be leaking directly to the ground surface, and f it appeared that it had been leaking for a substantial amount of time as it was evident by the amount of fluid over the septic tank area and on the neighboring property directly to the north of Mr. Ackermans property. I then explained to Mr. Ackerman the procedures that must be taken to abate the problem. Before leaving I informed Mr. Ackerman that he would receive a notice from the City of Albertville explaining the time frame and procedures to correct the violation. Those are the words of an 11-year-old boy responding to the Minneapolis Star Tribune's November, 1990 Mindworks question about violence in television and movies. The words are haunting. They reflect both the influences of a violent home life and the very real influences of violent media. I am writing to ask you to support the "Turn Off The Violence" campaign which the County Attorney's Office is again coordinating for Wright county this year. Turn Off the Violence originated in Minnesota in the summer of 1991 as a response to a series of tragic, highly -publicized violent crimes in the state. Two police crime prevention specialists said to each other, "If we could just turn off the violence... If we could even just get people to turn off violent entertainment, wouldn't that be something?" The discussion turned to how ironic it is that Americans are horrified by rising rates of violence yet seem so fascinated by violent television, movies and music. Based on the same concept as "D-day," (the stop smoking campaign), October 14, 1993 has been declared "Turn Off The Violence Day." On that day, everyone is asked to turn off violent television, movies, music and begin to choose non-violent ways to solve conflicts. We hope that for many people the increased awareness will lead to long term changes in their behavior. The attorney general's office has sent a Turn Off the Violence educational guide to each school principal in Minnesota. Beyond that, the campaign is strictly a grassroots effort. It is up to individuals to take personal ownership of the cause to impact their community for change. Our office will send informational kits to churches, civic groups, newspapers, chamber of commerce offices, and a letter of endorsement to each school principal. We are asking you, as mayor of your community, to also consider giving your support to the campaign in any or all of the following ways: 1) Designate the week of October 10-16 as "Turn Off The Violence" week. See if your actions can be publicized. 2) Urge other community organizations to join in the campaign. 3) Duplicate the enclosed brochures (3 provided, fits 8 1/2" X 11" size paper for duplication) and poster. Have them available in your city offices and/or distribute to city businesses and citizens. As coordinator of the Victim Assistance Program for the County Attorney's Office, I see the effects of violence daily. I would urge you as a leader in your community, to take a proactive effort to promote the "Turn Off The Violence" campaign as we can no longer ignore the escalating violence in our communities.
