Acting Mayor Anderson called the regular meeting of the
Albertville City Council to order.
Vetsch made a motion to approve the agenda yr: presented.
Barthel seconded the motion. All voted aye,

Barthel made a motion to approve the minutes of the ,June 28 ,
1994, meeting as presented. Anderson seconded the motion. All
voted aye.
Barthel made a motion to approve payment of Check #8513 to
Rice Lake Contracting as Partial Payment #6 of the 1992-11A
^ Wastewater Treatment Facility Expansion project. Anderson seconded
the motion. All voted aye.
Acting Mayor Anderson asked if anyone present wished to
address the Council under the Citizen Forum section of the agenda.
No one sought, to address the Council.
Barthel made a motion to approve Change Order #1 for the 1993-
3 Improvement Projects (Psyk's 5th Addition, for excessive street
cleaning. Net result of the change order is an addition of
$993.69. Anderson seconded the motion. All voted aye.
City Engineer Bob Robertson explained to the Council that the
storm sewer line which will be tapped by a beehive for the MLDCO
1st Addition is not centered on the easement. Bernard Marx will
need permission from the property owner abutting the addition in
order to have enough room to construct the beehive. The Council
directed Dale to contact the abutting property owner, Dundee
Nursery, to secure his permission to allow Marx or his contractor
to enter onto the property for the purpose of having the beehive
installed.
Robertson presented the Feasibility Study, for the Barthel
Industrial Drive and 52nd Street improvements. Because borings
have shown there are some poor soil areas to be excavated prior to
.-. construction of improvements, the total estimated cost of the
project has increased to $590,184. Because of the absence of two
of the Councilors and that the Council has not had time to review
the entire report, acceptance of the Feasibility Study will be
scheduled on the next Council agenda.

Robertson has reviewed the drainage calculations presented by
the design engineers. for Psyk-s 6th Addition. He recommended that
the detention pored proposed on the site of Lot 1 as a temporary
solution to the drainage problem onto the Marx property be deepened
to three feet. Robertson further recommended that language be
included in a Developer's Agreement requiring Psyk to escrow money
for a portion of the future storm sewer, The amount of the escrow
deposit, will probably be based somewhat on Bobs estimates of the
costs.
City Attorney Couri told the Council that the information
presented by the design engineer and reviewed by the city engineer
is probably the best information available and recommended that the
Council grant, final plat approval to Psyk's 6th Addition.
Anderson made a motion to grant final plat, approval for Psyk's
6th Addition contingent upon the developer entering into a
Developer's Agreement which details the escrow amount to be
established for future storm sewer construction, Vetsch seconded
the motion. All voted aye.
Norm Gartner from Meyer-Rohlin, Inc. updated the Council on
the progress of the projects under their direction as follows:
Wastewater Treatment Expansion - The project is
basically complete. A final pay request may be ready for
approval at the next meeting.
Sewer Reconstruction Project - Norm explained that Qmann
Blacktopping has used a shingle mixture in the base layer
of Main Street. Testing showed approximately 20% of the
bituminous contained shingle mix. Norm contacted Wright
County and MNDOT regarding the durability of that
mixture. MNDOT indicated that the mixture will be
approved for state specs next year. Because the shingle
mix is a deviation of the spec requirements, Omann has
agreed to a deduction of 50% of the total costs of
installing the shingle mix bituminous, plus reimburse the
City for the $800 testing expenses incurred. Norm
projected that the entire project, including the final
lift of blacktop and restoration will be complete in 10
days to two weeks.
Hardwood Ponds 2nd Addition - Because of the poor drying
conditions in the wooded areas, the developer has agreed
to add geotextile fabric and an additional 3" gravel base
to the streets in this project. These additions will add
about $12,300 to the total cost of the project. Work is
proceeding and curb and gutters should be in next. week.

Psyk's 5th Addition - The punchlist items are being
completed at this time.
Barthel Commercial Park - The- filial wear i=i) rso_:t was laid
last week. Final restoration and minor grading work
still need to be completed.
Westwind 3rd Addition - Geotextile fabric was added to
the turn lane which was completed last week. Ditch
grading and final restoration work are ,vet to be
completed.
Parkside - The base coat of the streets is down. Gartner
recommends that the wear course not be installed until
next fall --after the majority of the home construction
work is done. Norm also reported that the wear course is
separating from the base course on 62nd Street in the
Westwind 2nd Addition. Buffalo Bituminous, the
blacktopping contractor in both the Parkside and the
Westwind 2nd Additions, will repair this area.
50th Street - This project 16 essentially complete. The
only issue remaining to be. resolved is the Rion Becker
drainage problem. Dale sent a letter to Mr. Becker after
the last Council meeting requesting that Backer contact
him to set up a time to meet to discuss the issue. Dale
has not received a response from Becker: Since Becker
was present at this meeting, he agreed to meet with Dale
and Ron Guerts at 7:00 AM at City Hall tomorrow morning.
City Attorney Couri does not have an engineering contact back
from SEH at this time. The contract will be reviewed at the next
Council meeting.
Barthel made a motion to approve the Financial Statement for
the period June 16 - June 29 as presented, Anderson seconded the
motion. All voted aye.
Barthel made a motion to approve payment of the bills (Check
#'s 8575-8609 and Payroll Check #'s P1101-1105) as presented.
Anderson seconded the motion. All voted aye.
Anderson made a motion to approve Ken's registration to the
Minnesota Wastewater Operators Association Conference August 2-5 in
Plymouth at a cost of $95. Barthel seconded the motion.
Councilmember Vetsch stated that he feels the employee should pay
for one-half the registration fee himself. Acting Mayor Anderson
called for a vote on the motion. Barthel and Anderson voted aye.
Vetsch voted no. The motion carried.

Barthel made a motion to approve Dale's registration to the
Clerk's Orientation Conference sponsored by LMC July 19-21 in
Shoreview at a cost of $95. Anderson seconded the motion.
Councilmember Vetsch stated that he feels the employee should pay
for one-half the registration fee himself, Acting Mayor Anderson
called for a vote on the motion. Barthel and Anderson voted aye.
Vetsch voted no. The motion carried.
Dale explained that he feels it very important for someone in
the City or EDA to attend the "Tapping Capital Markets for
Community Development" seminar. The conference is being held July
13-14 in St. Paul and July 28-29 in Two Harbors. He is unable to
attend the St. Paul conference due to a conflicting schedule. 11.
S. West will reimburse the City for $200 of the $300 registration
fee. Dale has contacted Minnegasco and they have agreed to
reimburse the City for the additional $100 fee, Anderson made a
motion to send Linda to the St. Paul seminar on July 13-14.
Barthel seconded the motion. All voted aye.

Sharon Anderson, Albert Barthel and John Vetsch (7:35 PM), City

Mayor Potter called the regular meeting of the Albertville
City Council to order.
The agenda was amended under Administration as follows:
(1) Delete Microtech discussion
(2) Change Resolution #1994-7 to Resolution #1994-9
(3) Accept letter of resignation from the Park
Board from Anita Roden
Berning made a motion to approve the agenda as amended. Barthel
seconded the motion. All voted aye.
Councilman Berning requested that a follow-up sheet be
included in all future agenda packets.
Mayor Potter presented certificates for $100 savings bonds to
the new Albertville Royalty: Miss Albertville Lisa Roden,
Princesses Jenny Holland and Shari Lindenfelser, Junior Royalty
Kari Valerius, Emily Vorderbruggan, Jacob Bebeau and Matthew
O'Donnell.
The minutes of the June 6, 1994, meeting were amended as
follows:
Page 2, Paragraph 12 "Anderson/Vetsch unanimous to
authorize getting specs prior to letting of bids for a
new tanker truck".
Page 3, Paragraph 13, Sentence 2 "Mayor Potter will
attend the June 23rd meeting of the Frankfort Township
Sewer Committee".
Barthel made a motion to approve the June 6, 1994, minutes as
amended. Anderson seconded the motion. All voted aye.
Dayle Veches discussed his inability to get a Certificate of
Occupancy for the house he has constructed on Lot 1, Block 1, MLDCO
1st Addition, because the drainage plan cannot be completed until
the beehive required by the plat has not been installed on the
corner of the lot. Closing on the house has been scheduled for
Friday, June 24, and if the house does not close on that day, the
buyers will lose the lock on their interest rate. Veches and
realtor Dan Frie asked the City Council to enforce the conditions
of the Developers Agreement and either force the developer to have

the beehive installed or have the CIty install the beehive with the
funds provided by the developer's letter of credit. Berning made
a motion to allow the building inspector to issue a temporary
certificate of occupancy for Veches' house provided that only the
drainage and grading are incomplete and to give the developer
thirty (30) days in which to have the beehive installed. If the
beehive is not completed in that time frame, the City will have the
beehive installed with the funds provided by the developer's letter
of credit. Anderson seconded the motion. All voted aye.
Gerald Johnsted requested permission to install a mounting
pole to hold an antenna for his ham radio. Mayor Potter advised
Johnsted to apply to the Planning Commission for a Conditional Use
Permit before the Council would act on his request.
Clem Marx requested permission to change the culvert that he
stated collapsed when the trunk sewer line was installed. The
culvert is located west of the St. Albert's Church and north of the
proposed 57th Street. Marx indicated that if the culvert is
replaced, the ditch would need to be cleaned to allow proper flows.
City Engineer Bob Robertson reported that the topo map indicated
that is the culvert is located properly and the ditch cleaned, the
ares should drain. The Council agreed to have the wetlands areas
delineated before proceeding with a clean -out of the ditch. Dale
was directed to contact Kerry Sexton of the Wright Soil and Water
Conservation office to have the delineation process started. The
City will also get a quote from Dennis Fehn on the cost of getting
the ditch cleaned. Attorney Couri advised that until the wetlands
are delineated, he would not advise that City to take any action
on the ditch cleaning. He further indicated that the first step
to the delineation process should be up to Marx.
Linda was directed to check if the performance bond for Kadlec
Excavating has expired and to contact both the bonding company and
the contractor regarding recently discovered along the trunk sewer
line.
Since Ron Becker was not present, the Council agreed to
discuss the drainage swale on his property under Engineering.
Engineer Bob Robertson reported on his findings regarding the
Marx/Psyk drainage problem. One potential solution that would
allow Pysk's 6th Addition to proceed is to have the drainage from
the north end of the proposed development go to the end lot into
a detention pond and detained on that lot by a wide berm. This
would prevent quick run-off into the Marx wetland. This solution
would be a temporary (interim) solution and would be changed once
permanent storm sewer pipe is installed. Attorney Mike Couri
advised that the addition of a second detention pond, on the last
lot as Robertson suggested may be workable if calculations show

that the amount of drainage and the velocity of the drainage is not
increased. He suggested that the runoff factors and calculations
be submitted to the city engineer for his review prior to Council
action on the proposed development.
Robertson reviewed the Feasibility Study for Barthel
Industrial Drive and 52nd Streets. The study estimates the cost
of street and watermain construction from the finished section of
Barthel Industrial Drive to 50th Street at $163,125. Street,
sanitary sewer, watermain and storm sewer construction along 52nd
Street is estimated at $282,790. Street, sanitary sewer and
watermain for the MacKenzie Circle portion is estimated at $72,026.
The entire total project (Barthel Drive, 52nd Street and MacKenzie
Circle) is estimated at $517,941. Bob will have a complete report
available for the next Council meeting.
Dale was directed to set up a meeting with the property owners
whose property will be affected by the proposed improvements,
including Ed Lens , who actually is a resident of Frankfort.
Bob reported that the corners of the Westwind Park have been
staked.
Linda was directed to check the Developer's Agreements and the
PUD Agreement for the Westwind Addition to see if language is
included that requires excess dirt from the development to be
reserved for the park.
Ron Guerts will put together a status report on the MNDOT/I-
94 drainage project for the Council's review.
Dale reported that he had visited the Ron Becker property and
observed two breaks in the swale allowing water to go to the pond.
Dale also observed that the berm originally placed next tot he
swale has been plowed under and Becker is actually farming the
easement. Attorney Couri indicated that if no other property is
being affected, the responsibility for rebuilding the berm could
rest with Becker. Dale was directed to contact Ron Becker
regarding restoring the berm and to meet with him regarding his
Kelly Koopmeiner, who lives next to Becker's pond on 51st
Street, told that Council that water ponds in her back yard and she
would like to have the drainage corrected to eliminate the ponding.
Ron Guerts from Meyer-Rohlin, Inc. will have the swale reshaped
from the back corner of her lot to the beehive. This should stop
the water from ponding. The maintenance department will haul dirt
around the beehive to improve the aesthetics.
Bob Braun. one of the developers of Hardwood Ponds 2nd
Addition, requested City assistance in getting the engineer and
contractor- to proceed with his improvements. Linda will speak to

the engineer.
Attorney Couri presented Resolution #1994-8, as requested by
Mayor Potter. The resolution details the reason that Mayor Potter
is recommending that the Municipal Engineering Services contract
with RCM, Inc. be terminated because RCM has been unable to appoint
a permanent engineer to replace Pete Carlson. Bob Robertson
indicated that RCM does have an engineer in the St. Cloud office
who he would recommend to represent the City, if the Council
agreed. Mayor Potter explained that the determining factor in
appointing RCM as engineer was that Pete Carlson would be the City
representative, and he is recommending in the resolution that
Carlson be appointed city engineer.
Anderson made a motion to adopt RESOLUTION #1994-8 terminating
REC as city engineer effective thirty days from the mailing of
written notice and retaining Pete Carlson of Short, Elliot &
Hendrickson as city engineer, pending approval of a written.
contract. Berning seconded the motion. All voted aye.
Barthel made a motion to approve the Financial Statement for
the period June 1 - June 15 as presented. Anderson seconded the
motion. All voted aye.
Barthel made a motion to approve payment of Check #8527 -
#8573 as listed. Anderson seconded the motion. All voted aye.
The Council reviewed the 1993 Audit Report. Because of errors
discovered in the employee benefit and insurance portions of the
audit, Anderson made a motion to set a meeting with Mark Babcock
to finalize the audit on June 27th at 6:00 PM. Vetsch seconded the
motion. All voted aye.
Barthel made a motion to accept the resignation of Anita Roden
from the Park Board effective immediately and directing Linda to
send a letter of appreciation to Ms. Roden. Anderson seconded the
motion. All voted aye.
Barthel made a motion to approve Change Order No. 3 for the
1992-11A (Wastewater Expansion Project) which deletes floor
hardener from the plan. The net result of the change order is a
deduct of $220. Anderson seconded the motion. All voted aye.
The time of the meeting for Dale's performance evaluation was
changed to 6:00 PM on June 22nd. The meeting will he closed to the
public,

Anderson made a motion to prohibit parking on both sides of
58th Street due to the narrowness of the street. Berning seconded
the motion. Anderson and Berning voted aye. Barthel and Vetsch
voted no. Mayor Potter cast a no vote. The motion failed.
The Council agreed to continue with the parking of vehicles
on one side of 58th Street, and directed that "No Parking on this
Side of the Street" be placed on the sod side of 58th Street.
Vetsch made a motion to have the City Clerk and the
Administrator attend Council meetings. Berning seconded the
motion. All voted aye.
Berning made a motion that the City of Albertville not become
a member of the Minnesota Association of Small Cities. Barthel
seconded the motion. All voted aye.
Berning made a motion to deny the request to sponsor youth on
a trip to Washington, D.C. made by Word of Peace Lutheran Church.
Barthel seconded the motion. Barthel, Berning, Vetsch and Potter
voted aye. Anderson abstained. The motion carried.
The Council reviewed the correspondence between the City and
property owner Jim Hennum. The Council decided to table further
action.
Anderson made a motion to hire Katie Buttweiler to update the
community profile for the City at a rate of $8 per hour for eight
hours per week, not to exceed 10 weeks total. Funding for the
employment will be from the AEDA. Barthel seconded the motion.
Anderson, Vetsch, Berning and Barthel voted aye. Potter voted no.
Berning made a motion tc adjourn at 11:35 PM. Barthel

project. Attached to this memo is a copy of the change order.
I was told by Norm Gartner that the developer will pick up the additional cost,
as part of his developer's agreement. 17his results in no net cost, to the City.

RE: Psyk/Marx Drainage
Dear Dale:
In an attempt to get City Council approval of the Psyk 6th
Addition plat, we are submitting the following for your review:
1. Exhibit "A" is 'a composite copy of the topography flown in
November, 1981, and the field surveyed topography by Meyer-
Rohlin, Inc. in December, 1972. This would be the topography
prior to any development work in the area and represents the
pre -development drainage patterns. On this exhibit we have
delineated by extra heavy lines the drainage areas that
originally surface drained through the Psyk property to the
wetlands on the Marx property. The area outlined in yellow is
that portion of the above drainage area that is contained in
the Psyk 5th and 6th Additions and potential future Psyk
additions to the west, and approximates 26.37 acres. Runoff
calculations based on the S.C.S. TR55 method, for the Psyk
portion only, are enclosed based on the original soil and
farming conditions (row crops) and summarized as follows:

2. With the design of the Psyk 5th and 6th Additions, and
potential future additions to the west, a drain -dry detention
pond is being utilized outletting to the south into a
sedimentation pond before entering the large Psyk area
wetlands. Exhibit "B" indicates this detention pond, outlet-
ting to the south and the greatly reduced area which will
continue draining to the northeast. The area draining to the
northeast following the original drainage pattern from the
designed 5th, 6th and future additions to the west has been
reduced from the above 26.37 acres to 7.9 acres. The runoff

calculations for this 7.9 acre parcel, based on the SCS-TR 55
Method, are enclosed, based on the residential, 1/3 acre
sites and are summarized as follows:

3. The detention pond design is based on controlling the peak
runoffs from the major storm and releasing the storm water at
a rate equal to or less than the runoff from the pre -
development drainage pattern. In this case, with a culvert
designed to restrict the outlet flow from the detention pond
to a rate of 15.99 cfs. (Peak flow from the 26.37 acres for
the 2 year storm event based on pre -development conditions).
As per the calculation sheets, for the 100-year storm event
this would require a detention pond of 0.43 acre/feet storage
capacity. By using the northeasterly lot of the Psyk 6th
Addition as a temporary detention pond, approximately 0.55
acre/feet of storage is provided. (Bottom elevation of 953.3
and an overflow berm of 955.3). Other combinations of outfall
rate and detention pond storage can be used; i.e. lower
outlet flow from the pond with an overflow of the detention
pond berm at a storm event less than 100 years.
In any case, this is the natural flow from the Psyk and Marx
property that is proposed to be controlled by a restricting
culvert and a temporary detention pond. The delineation of the
Marx wetland areas, certainly being needed before any develop-
ment of the Marx property could begin, has no bearing upon the
Psyk 6th Addition. Mr. Psyk has been held up on this project for
months, while much time and effort has been spent attempting to
work out an amiable agreement with Mr. Marx. The current
proposal protects the Marx property to a much greater degree
than existing and past conditions until such time that the Marx
property would be developed. At that time the needed storm sewer
systems would be installed on a pro-rata cost basis as has been
discussed for the past few months.

can be taken regarding the approval of the Psyk 6th Addition at
the next Albertville Council meeting.
