Mayor Potter called the regular meeting of the Albertville
City Council to order.
Berning made a motion to approve the agenda as presented.
Anderson seconded the motion. All voted aye.
Barthel made a motion to approve the Follow -Up Sheet from the
October 17, 1994, meeting as presented. Anderson seconded the
motion. All voted aye.
Barthel made a motion to approve the minutes of the October
17, 1994, regular meeting as presented. Anderson seconded the
motion. All voted aye.
Barthel made a motion to approve the minutes of the October
25, 1994, special meeting as presented. Anderson seconded the
motion. All voted aye.
There was no one who wished to address the City Council under
the Citizen Forum section of the agenda.
Ken Lindsay reglaested a meeting with the City Council to
discuss the definition of "informal on -call" as it is used in his
job description. He would also like to discuss the question of
compensation if he is required to be on -call and within a 5-7 mile
range of his residence indefinitely. The Council decided to check
with the city attorney when he arrives for his legal opinion before
making a decision.
Berning made a motion to increase the hourly wage for Dave
Kock, the temporary maintenance worker, from $7.00 per hour to
$7.50, based on the terms of the employment contract with. Mr. Koch
and Lindsay's evaluation and recommendation. Anderson seconded the
motion. All voted aye.
The Council reviewed the Report to Employee report submitted
by Mike Rutkowski's doctor. According to the report, Mike is able
to come back to work on a very limited basis, if light work is
available. The Council concurred that until Mike is able to work
at full strength, he should remain off duty.
Ken reviewed the City's scores on the MPCA survey with the
Council. The survey was completed earlier in the year and the
results have just become available.

Ken discussed having Mike Rutkowski attend a wastewater
treatment school while he is off -duty. Since Mike would actually
be in the City's employment while attending the school, the Council
agreed, that to limit the City's exposure to liability for a
reinjury, Mike should not attend the school on City time.
Ken explained to the Council that it now takes longer than
eight hours to complete the snow plowing procedures. He requested
that he be allowed to hire temporary help as needed. The Council
agreed that the clerk or the administrator will make the judgment
call to authorize additional help.
City Attorney Mike Couri reported that negotiations are still
continuing on the new administrator's contract. He expects to have
the contract completed by late in the week.
Couri also reported that the judgment in the 50th Street
assessment appeal has been returned. All of the assessments have
been cut back by 20%, with the exception of Rita Bistodeau. Her
assessment has been capped at $3,000. Greg Vetsch's assessment for
his driveway will remain the same, but the street assessment is
reduced 20%. Couri told the Council that they have the right to
appeal the decision to the appellate court. The Council's
consensus is to accept the judgment as passed. Couri also
indicated that the landowners also have the right to appeal the
judgment.
Couri advised. the Council to set a reassessment hearing to
make the changes in the assessment roll as ordered in the judgment.
Anderson made a motion to conduct a public hearing on Tuesday,
November 29, 1994, at 7:30 PM for the purpose of reassessing the
50th Street landowners. Berning seconded the motion. All voted
aye.
Couri advised the Council that it would be appropriate to set
a meeting with Ken Lindsay as he has requested. Anderson made a
motion to set a closed meeting on Wednesday, November 16, 1994, at
7:30 PM. Barthel seconded the motion. All voted aye.
City Engineer Pete Carlson updated the Council on various
projects:
(1) A catch basin will be installed on the Dundee property
to take care of the drainage problems.
(2) The curb in Psyk's 6th Addition has been completed.
Because of the soft soil conditions, a two inch lift of asphalt
will be used. The weal- course may be delayed another year to make
sure that the soils have corrected under the street.
(3) Pete has completed the wetland delineation map of the
Marx property.

Pete discussed the County Road 19 and I-94 interchange
possibility. He believes the cost of the project is too cost
prohibitive for the City, without financial support of partners,
i.e., Wright County and/or MNDOT. Although the Transportation
Study completed by Wright. County discusses the interchange, it is
not identified as "needed". Pete explained that a "needs" study
must first be prepared proving that the interchanged is indeed
needed. This study is expensive --in the area of $30,000. An
additional $55,000 would be spent preparing the Environmental
Assessment Worksheet. Wright County will not participate in the
costs. Pete has contacted MNDOT requesting their participation,
but he has not gotten a response.
As the first part of the "needs" study, the wetlands area must
be delineated. Peter further explained that if the interchange is
targeted for completion in 1996, the delineation should be done as
soon as possible. Councilmember Anderson questioned what the
delineation portion of the needs study alone would cost the City.
Pete was unable to estimate the cost of only the delineation.
Anderson made a motion to have Linda check with Wright County
Soil and Water Conservation to determine if they could do the
delineation and what the costs would be and to have Pete break out
the costs for the delineation only. Both estimates will be brought
to the next Council meeting for discussion. Barthel seconded the
motion. Barthel, Anderson, Berning and Vetsch voted aye. Potter
abstained. The motion carried.
Mayor Potter removed himself from the City Council and
directed Acting Mayor Berning to proceed with the meeting.
Potter addressed the Council and explained that the project
that precipitated the need for- the interchange is time sensitive.
The need to have the interchange opened by 1995 is real. Delays
in proceeding with the delineation of the wetland areas may cause
the project to fold. The Council questioned Potter if the property

Counciimember Berning indicated that he is uncomfortable in
approving expenditures when the City has no certainty that the
development will proceed regardless.
Anderson asked to amend her previous motion to reflect that
the delineation -only portion of the project could be set up to
begin immediately after the Council reviews the cost estimates from
both Pete's firm and WCSWC in an effort to save time. Barthel
agreed to second that amendment to the original motion. Berning,
Vetsch, Anderson, and Barthel voted aye. Potter abstained. The
motion carried.

Barthel made a motion to approve the Financial Statement for
the period October 13 - November 2 as presented. Anderson seconded
the motion. All voted aye.
Barthel made a motion to approve payment of Check #'s 8868-
8906 and P1168-P1172 as presented. Anderson seconded the motion.
All voted aye.
Barthel made a motion to accept the resignation of Virgie
Bistodeau from the Park Board effective immediately. Anderson
seconded the motion. All voted aye.
Barthel made a motion to approve the Joint Powers Board's
request to allow a change in the completion date for the removal
of the water tower as detailed in the Termination of the Water
Tower Lease. The tower and the building will be removed yet this
year but removal of underground apparatus and restoration will not
be completed until the spring of 1995. Anderson seconded the
motion. All voted aye.
Barthel made a motion to approve RESOLUTION #1994-14 entitled
A RESOLUTION APPROVING AN OFF -SITE, ONE DAY GAMBLING LICENSE FOR
THE ALBERTVILLE' JAYCEES. Anderson seconded the motion. All voted
aye.
Mayor ?otter and Pete Carlson will attend the Wright County
Transportation meeting on November 16.
Vetsch made a motion to contribute $500 to the R<-y Simms Library in 1995. Anderson seconded the motion. All voted aye.
The Council chose not to respond the proposed amendment of the
Wright County Zoning ordinance.
Linda presented four quotes on upgrading her computer from a
386 to a 486. Because each of the quotes are nearly as high as the
cost of a new 486 computer, she recommended that the Council table
further consideration of the upgrade.
The Council reviewed the proposals from four auditing firms
for preparing the 1994 audit report. Babcock, Langbein and Company
submitted the low quote of a not -to -exceed amount of $4,400.
Because of the low quote, the fact that Babcock has prepared the
audit for the previous two years and is familiar with the City's
books, ana major changes in staffing and procedures will occur at
the beginning of the year, Linda recommended that the Council
r� accept Babcock's proposal to prepare the 1994 audit. The Council
concurred with Linda's recommendation but demand that the audit is
completed no later than April 15th.

The Council discussed the option of different insurance
packages for the employees. No decisions were made.
Dale has accepted a position with the City of Eagle Lake and
will start that position on Monday, November 14th. Linda will
contact the Wright Vocational School and a temporary agency to get
help.

Mayor Potter called the regular meeting of the Albertville
City Council to order.

Berning made a motion to approve the agenda as amended. Anderson

The minutes of the October 3, 1994, regular meeting were
amended as follows:
Page 1 - Community Forum - Replace the third sentence to read:
"The curbing is uneven due to the settling of the soil after the
placement of the sewer service line".
Page 4 - Staff Hours - Replace the second sentence to read: "Both
elected officials had concerns about staff being available during
business hours".
Anderson made a motion to approve the minutes of the October
3, 1994, regular City Council meeting as amended. Vetsch seconded
the motion. All voted aye.
Anderson made a motion to approve the minutes of the October
4, 1994, Special Meeting on Organized Collection as presented.
Vetsch seconded the motion. All voted aye.
Russ Voght addressed the City Council regarding the Ackerman
property adjacent to_1i _ property. Voght had previously discussed
concerns regarding drainage issues with the Council several times.
He explained that he understands that the property has been sold
and would like the Council to address the elevation problems when
and if there is a site plan presented by the new owners. The
Council explained that the City has not be approached by a new
owner but the City will contact Voght if and when a site plan for
the property comes in to allow Voght to give his input at that
time.
Bertha Paulson explained that she has conducted the
Albertville Charity Drive in the City since 1979, when it was
approved by the Council. She has found that she is unable to

continue because of time constraints and because of the fact that
she is unable to get help. She indicated she is willing to help
with the drive but can no longer do it alone. Linda was directed
to check with the legal department to see if there is any reason
why the drive could not be suspended. The Council thanked Mrs.
Paulson for her years of service.
The Council agreed that due to budgetary constraints there
will not be a fall street sweeping. The Council approved the
annual fall sanitary sewer cleaning project.
City Engineer Pete Carlson reviewed the extension of sanitary
sewer to the Hack' property. Carlson indicated that the adjoining
property owners probably will not waive their rights to appeal the
assessment. The bottom line,y according to Carlson, is that the
project is not likely to be completed this year. He also indicated
that the City will probably need to pick up the trunk costs of the
project. The Cnurcil asked'Pete to continue working on the trunk
sewer access charge system for the City.
The Wright Soil and Water Conservation District has completed
the wetland e-lineation and bete will shortly have the mapping of
the wetlands completed..

catch basin that will provide gooddrainagefor the property.
Pete explained that the roads in the Psyk's 6th Addition are
quite soft. The contractor has added Class 5, but inclement
weather probably prevents the road from being built this year.
Mayor Potter and Engineer Carlson will meet with the Wright
County engineer to discuss the Focus Study on the I-94 exchange as
soon as possible.
The meeting with Ron Becker to discuss the drainage swale on
his property has not been held at this time.
The Council took no action on the Wright County Planning
Commission petition to amend the Wright County Zoning Ordinance
Section 724.3(3)(a).
Anderson made a motion to approve the Financial Statement for
the period September 30 - October 12 as presented. Vetsch seconded
the motion. All voted aye.

Anderson made a motion to set a public hearing for Wednesday,
November 9, 1994, at 7:30 PM to set the special assessments for the
Hardwood Ponds 2nd and the Westwind 3rd Additions. Vetsch seconded
the motion. All voted aye.
Berning made a motion to set a special meeting of the City
Council to discuss the fire hall proposal with the Fire Building
Committee for Tuesday, October 25, 1994, at 6:30 PM preceding the
informational meeting for the public to be conducted at 7:00 PM.

The Council reviewed the prP'_imina_-y plat for the Simonson
Addit1on. Pete Carlson hao reviewed the drainage plans presented

Pete's concerns. The Council agreed to continue the meeting while
Pete met with Guerts to review the revisions.
Bob and Christine Heuring are requesting minor variances for
a side setback and for a front setback for a new house to be
constructed on Jason Avenue. The City's Zoning Ordinance requires
a 150 foot front setback from a county road. Heuring is proposing
to build his house with an approximate 90 foot front setback.
According to the information presented in the letter dated October
17, 1994, from Liz Stockman of NAC, Inc., the Council can treat the
front setback variance as a minor variance since the house will be
constructed partially on an existing foundation that was
constructed prior to the adoption of the Zoning Ordinance and was
treated as a non -conforming use. Based on that information,
Anderson made a motion to grant a variance for a 90' front setback
and a 5' deviation from the side yard setback. Berning seconded
the motion. All voted aye.
Mayor Potter explained that one City employee is requesting
a closed meeting cf the Council to discuss disciplinary action.

The Council set the date for conducting the final round of
interviews with the three top candidates for the position of City

C'ty Engineer Pete Carlson reported that the upgraded drainage
plans for the Simonson Addition are acceptable. The area will be
subject to pending at times, but the plan should work. The Council
required that storm water piping be installed beyond the L & D
Trucking building rather than ditching.
The plat has been revised to meet the Planning Commission's
requirement that the lumber rack on the northeast corner of the
property be changed by removing the east/west portion of the rack.
Anderson made a motion to approve the revised preliminary plat
of Simonson Addition contingent upon the developer meeting the
following requirements:
(1) All conditions set forth in the planner's report are met.
(2) There is a resolution of the construction of 60th Street
and Lachman Avenue issues.

(1) A rear yard setback of five feet.

Mayor Potter called the special meeting to order at 6:20 PM.
The purpose of the special meeting is to select the candidate to
offer the position of City Administrator.
The final candidates for the position of City Administrator
are Marvin Harr, David Hemze, and Garrison Hale.

MAINTENANCE REPORT
November 3, 1994
The parks have been winterized and we are waiting for Fehn's
to relevel the skating rink.
Patch seal coating has been completed.
The brakes on the Ford dump truck were bad and have been
repaired.
Sand and salt have been hauled in for winter.
Final mowing has been completed.
The annual sewer line cleaning has been completed.
The plows are ready to go for the winter.

When we hired Dave, we promised a $.50 per hour raise at the
end of the first two pay periods.
Dave has done an outstanding job so far. He has been a fast
learner and has handled every'job with professional results.
I feel he deserves the rate increase as promised. He is a
good asset to the City Maintenance Department.
WHEREAS, the City of Albertville ("City") desires to employ,
on a temporary basis, a full-time maintenance person during the
absence of Mike Rutkowski, one of its regular maintenance
personnel; and
WHEREAS, David Paul Koch ("Koch") desires to be employed by
the City as a temporary, full-time general maintenance person
during the absence of one of the City's regular maintenance
personnel;
THEREFORE, the City and Koch hereby agree as follows:
1. The City shall employ Koch as a temporary, full-time general
maintenance person. Such employment may be terminated by the
City Council at any time, without notice. Koch understands
that the City will not employ Koch as a permanent employee,
and that this position is temporary in nature.
2. Koch shall be paid $7.0W per hour with no health insurance or
other benefits provided by the City. The City Council (or
other City official, as designated by the City Council) may
consider a merit -based per-4formance increase of $.50 per hour,
such increase to be considered every other pay period and
granted only if deemed warranted by the City.

RE: 1993 Annual Evaluation and Planning Survey
Thank you for participating in the 1994 Annual Evaluation and Planning Survey
process. We have completed our review of your survey and enclosed is a report
based on your responses and a copy of the survey form for reference. In
addition, for all cities which discharge to a surface water, a summary of some
of your discharge monitoring repoi''t data for the last year is also enclosed.
We recommend you discuss this report at an upcoming municipal council/board
meeting. In some cases, items identified in the report may require immediate
attention. At the least, it should help your focus your planning efforts to
meet future needs. After the meeting, the mayor should certify that the city
council has discussed the report, and submit this certification to the MPCA. If
possible, this should be done within 30 days of your receipt of the report.
We believe the AEPS will prove useful for both the municipalities and the MPCA.
The individualized report can be used as a planning tool for your municipality's
wastewater treatment system. If you need assistance in implementing suggestions
from the report, we suggest you contact the Agency or your consulting engineer.
We are in the process of combining data from all participants into several
statewide reports. This process should be completed within the next 60 days.
If you wish to receive a copy of the statewide summaries, please contact us
after that time.

continuing education hours in order to maintain their certification status.

>>> SECTION SEVEN: FINANCIAL AND ORDINANCE STATUS
The area of sewer service charge systerns and sewer use ordinances is cocplex and
confusing. Municipalities which received funding fran the federal or state
construction grants program or the State Revolving Fund (loan program) face
certain requirements in the area of ordinances. We have sample ordinances and
charge systems which you can use to create your own documents. If you have
questions concerning ordinances, charge systems, rate setting, or whether you
must meet the requirements of specific funding programs, please contact the MPCA
Operations/Training Unit at 1-800-657-3864.
Question 73. An equipment replacement account contains funds set aside for
replacement of equipment that will wear out during the life of the system. Such
an account should be part of your operation and maintenance budget.
Depreciation information will provide the dollar amounts to be set aside each
year for this account. This both ensures adequate funding for equipment
replacement and helps your municipality avoid emergency funding problems.
Question 80.5. Your sewer use ordinance should require annual notification of
cost to all users. Users should be notified annually regarding what is
encompassed in the user charge.

Tower Lease regarding the domplete removal of the tower and
buildings down to 10 feet below grade 6 months after the
completion of the tower protect (June 7, 1994). The Board was
Informed at their October 24, 1994 meeting that the towers and
buildings would be removed yet this year, but anything below
ground and restoration would be completed in the spring of 1995.

Re: Second Township and City Meetings - Wright County Transportation Study
Dear Ms. Houghton:
As you know, Wright County in conjunction with Mn/DOT has been working on a transportation plan
for the County and we have asked all of the 'townships and Cities to participate in the study. As part
of this participation the County asked you for input on transportation issues that concerned you. We
appreciate the input we have received from you. This input was gathered for the most part during the
initial meetings with the you on either the April 27th or 28th. We would now like to meet with you
again to discuss some possible solutions to the issues that you raised and also share with you
information that has been developed over the last number months. The County has scheduled the
meetings on a Regional basis as shown in the attached schedule. The meetings will last approximately
two (2) hours for each region. We realize that due to harvest time, deer hunting, etc., some of you
may not be able to make the meetings, however, we feel this regional format will provide a good
exchange of information with adjacent government units that would not take place in a individual
meeting. Therefore we would appreciate it if you could make every effort to attend. If, however, you
cannot attend and want to provide input please contact Wayne Fingalson or myself to schedule a
separate meeting or you may provide written comments to us.
The attached schedule shows the selected time for your agency to meet with us. If you are
unable to make this time please call Dave Montebello, Project Manager, at 682-7387 or 1-800-
339-6881 ext. 7387. The meetings will be held in the Community Room in the Wright County
Government Center.

Thank you for the opportunity to submit the following proposal to the City of Albertville for
the 1994 City audit and the Albertville Firemen's Relief Association audit.
We will perform the audit of the City of Albertville for the year ending December 31, 1994
for a cost of $6,250. This includes the preparation of the forms required by the state auditor
and a management letter. This proposal is based upon the City providing us accurate and
timely financial information.
This engagement is conditioned on our understanding that the management will assume the
City's full responsibility for the following:
► recording and reconciling all general ledger account activity before submitting the
trial balance to us
► making all final adjustments to all general ledger accounts
► preparing all working papers and schedules in support of your balance sheet
accounts - we'll assist with the format
► preparing schedules for revenue and expenditure accounts as requested
This proposal is based on the content of the 1993 financial statements, anticipated
cooperation from your personnel and timely receipt of copies of workpapers or other
information requested from your previous auditors. Should a problem develop during our
engagement or additional services be requested by the City, we will resolve these with you
immediately before any additional costs are incurred.
We propose to do the majority of the field work before March 15 and have completed
reports to you by May 31. If a problem arises with this timetable we will inform you
immediately.

The Albertville Firemen's Relief Association is not required to have an audit. Since the
Association has assets and liabilities under $200,000 the State Auditor's office requires the
submission of Reporting Form LS along with an independent accountant's review opinion by
March 31. We will prepare and review the financial information included within the
financial section of Reporting Form LS for 1993 for $450 - $600. We can, however,
perform an audit if the Council would prefer. We will perform an audit of the Albertville
Firemen's Relief Association and prepare Reporting Form LS for $650 - $800.
The quotes for the Firemen's Relief Association are based upon the Association providing us
with summaries of the 1994 activities of both the general and special funds by February 15.
The Association also must submit Schedules I and II for State Fire Aid Year 1996 to the City
Council by August 1, 1995. We have assisted in the preparation of the forms in the past.
Fees for this service would be based upon our hourly rate.
We have the expertise in the Governmental Auditing area to serve you well. We are
represented and actively participate on the Minnesota Society of Certified Public
Accountants' "Governmental Auditing Committee." Gruys Borden Carlson & Associates
P.A. has a long history of serving the City of Albertville as auditors and would like to
reestablish that relationship. I have personally worked on the audits of the City of
Albertville for seven years and would be the manager for the 1994 audit.

We are pleased to confirm our understanding of the services we are to provide for the City of
Albertville for the year ended December 31, 1994.
Our audit will be made in accordance with generally accepted auditing standards and will
include tests of your accounting records and other procedures we consider necessary to
enable us to express an unqualified opinion that your financial statements are fairly
presented, in conformity with generally accepted accounting principles consistently applied.
If our opinion is other than unqualified, we will fully discuss the reasons with you in
advance.
Our procedures will include tests of documentary evidence supporting the transactions recorded
in the accounts, test of the physical existence of inventories, and direct confirmation of
receivable and certain other assets and liabilities by correspondence with selected
customers, creditors, and banks. We will request written representations from your
attorneys as part of the engagement, and they may bill you for responding to this
inquiry. At the conclusion of our audit, we will also request certain written
representations from you about the financial statements and related matters.
An audit is based primarily on the selective testing of accounting records and related data;
therefore, our audit will involve judgment about the number of transactions to be examined and
the areas to be tested. Because we will not perform a detailed examination of all
transactions, there is a risk that material errors, irregularities, or illegal acts, including
fraud or defalcations, may exist and not be detected by us. We will advise you, however, of
any matters of that nature that come to our attention.
We understand that you will provide us with the basic information required for our audit and
that you are responsible for the accuracy and completeness of that information. We will advise
you about appropriate accounting principles and their application and will assist in the
preparation of your financial statements, but the responsibility for the financial statements
remains with you. This responsibility includes the maintenance of adequate records and related
controls, the selection and application of accounting
principles, and the safeguarding of assets.
We understand that your employees will prepare all cash, accounts receivable, accounts payable
and other confirmations we request and will locate any invoices we select for testing.
Our audit is not specifically designed and cannot be relied on to disclose material weaknesses
in accounting control. However, during the audit, if we become aware of such material
weaknesses in internal accounting control or ways that we believe management practices can be
improved, we will communicate them to you in a separate letter.
We expect to begin our audit in January 1995, and to complete and issue our report
on, or about March 31, 1995.
Our fees for these services will be based on our proposal previously submitted.
