The business will have a tobacco shop in the back room selling fine cigars, pipes, tobacco, etc. The front portion of the business will sell espresso coffees, cappacino, and gourmet muffins, etc. The Council asked if Young has a business license from the state at this time. Young does not. Anderson made a motion to table the decision until the City Attorney can look into whether the City can approve a cigarette license for a business before the husiness is actually licensed. The Council directed Fngi.nPer Carlson to check the area regarding the complaint. Berning made a motion to approve the Financial Statement for the period May 30 - June 27, 1995, as presented. Anderson seconded the motion. All voted aye. Berning made a motion to accept the pledged security effective June 13, 1995, from Security Bank Northwest. Anderson seconded the motion. All voted aye. Jeff and Shelley Bursch addressed the Council for the second timeconcerning the berm in their backyard. The Burschs feel that the developer should be responsible for removing the berm as it appears on their survey. AI.RF.RTVTT.T.F. CITY COUNCT.T. July 3, 1995 Page 7 of S City Engineer Pete Carlson has visited the site and reported that the berm is fairly substantial and was prior to the home construction. Carlson does not feel there was enough dirt excavated from the basement to create the berm. The developer, Kent Roessler, has also visited the property and has indicated that the berm existed before construction of the home began. City Administrator Hale reported that he has had discussions with the City Attorney, who indicated that this is legally an issue between the property owner and the developer and the City should not be involved. Muyres made a motion directing the City Attorney to draft a letter to Kenco, Inc., and request a written response to the concerns raised by the Rur.schs. Anderson seconded the motion. All voted aye. While the grades of the rear yards are flat, it does appear there is drainage to the existing catch basins in the rear yards. One or two rear yards do stay wet due to sump pumps draining to the rear yards. Drainage paths have been altered due to improvements in the yard, however, these improvements have not blocked any drainage. Previously, I had reported to you that 51 st Street is in need of an overlay and, at the minimum, the pavement should receive a seal coat. Due to budget constraints, we decided to seal coat the road at an estimated cost of $8,000. While 51st Street still needs an overlay, in my opinion, the City would receive greater benefit by using the $8,000 to patch streets where needed. The forcemain could not hold the air pressure indicating there is probably a leak somewhere in the forcemain. However, a leak in the forcemain would not cause the motor for the pump to burn Out. Sewage would simply teak out of the pipe, as well as drain to the manhole in 50th Street. Other possibilities regarding why the motor for the pump has been burning out include: Thp fnrrPmain hoc gettled allnwinQ sewage to freeze during the winter months. No check valve on the forcemain, preventing sewage from running back through the pump once the pump shuts off. A check valve was purposely not installed so sewage would not freeze in the forcemain. Meiny Construction indicated they typically do not install check valves on this type of design, and have not experienced any problems with sewage running back into the holding tank after the pump shuts off. 3. Motor is too small. Original pump was installed with a 0.6 hp motor. Subsequent pumps have been installed with 0.4 hp motors. 1 .5F-CRT ELL'07_ HENDR!CNSON INC ST PAUL. MN CHW$'_.VA r-AL_S Syr a .. 4. Floats that control when the pump turns on and off are not set correctly. The ejector type pump that the Mason's have is not designed to pass solids. This pump is designed to pump effluent water. if the floats are not set correctly, the water level may get too low and the solids may end up in the pump, clogging the system. Solids that settle out of the sewage in the holding tank needs to be removed from the holding tank on a periodic basis. The typical recommendation is once a year. It is my understanding the Mason's holding tank has only been pumped once to remove the solids since the pumping system was installed in 1989-- and that was within the last year. Currently, there does not appear to be an obvious reason why the Mason's motor and purltp have burned out several times over the last couple of years. I do not believe the problems they are experiencing are related to the SOth Street project. Based on the information we have to date, I recommend the ?Mason's have as experienced plumber set the float elevations to prevent solids from being pumped, and the holding tank be pumped outt on a yearly basis. Without further information to the contrary, I believe the problems the Mason's are experiencing are theirs to resolve and the City should not be involved. As part of our examination, we made a study and evaluation of the City's system of internal accounting control to the extent we considered necessary to evaluate the system as required by generally accepted auditing standards. Under these standards, the purposes of such evaluation are to establish a basis for reliance on the system of internal accounting control in determining the nature, timing, and extent of other auditing procedures that are necessary for expressing an opinion on the financial statements and to assist in planning and performing the examination of the financial statements. The objective of internal accounting control is to provide reasonable, but not absolute, assurance as to the safeguarding of assets against loss from unauthorized use or disposition, and the reliability of financial records for preparing financial statements and maintaining accountability for assets. The concept of reasonable assurance recognizes that the costs of a system of internal accounting control should not exceed the benefits derived and also recognizes that the evaluation of these factors necessarily requires estimates and judgments. There are inherent limitations that should be recognized in considering the potential effectiveness of any system of internal accounting control. In the performance of most control procedures, errors can result from misunderstanding of instructions, mistakes of judgment, carelessness, or other personal factors. Control procedures whose effectiveness depends upon segregation of duties can be circumvented intentionally either with respect to the execution and recording of transactions or with respect to the estimates and judgments required in the preparation of financial statements. Further, projection of any evaluation on internal accounting control to future periods is subjected to the risk that the procedures may become inadequate because of change in conditions and that the degree of compliance with the procedures may deteriorate. Our examination of the financial statements made in accordance with generally accepted auditing standards, including the study and evaluation of the City's system of internal accounting control for the year ended December 31, 1994 that was made for the purposes set forth in the first paragraph of this report, would not necessarily disclose all weaknesses in the system because it was based on selective tests of accounting records and related data. Cash and Investment Reconciliations Currently the bank account is being reconciled to the check register, however, there is not an ongoing reconciliation of the cash and investment accounts to the books (computer reports). We recommend that this reconciliation process be completed each month. General Fond Balance At December 31, 1994 the unreserved General Fund balance was negative $231,860. Inasmuch as a fund balance of about one half of expenditures is necessary for cash flow purposes, we recommend that a fund balance of at least that amount (approximately $275,000) be targeted, perhaps over several years. Special Assessment Records We recommend that special assessments records be kept in a manner that would facilitate access to control totals and balances. This would include totaling each outstanding assessment by project and by fund and reconciling the City's record of unpaid assessments with the County's records each year. Emphasis On Accounting At year end, computer reports were not available on a timely basis due to computer problems and lack of available time. We recommend that the city devote sufficient resources to assure that monthly and year end financial statements are prepared on a timely basis. We further recommend that in addition to the cash and investment reconciliation mentioned in item 1, other financial statement accounts be reviewed on a regular basis for accuracy. Fixed Asset Records We recommend that the city establish and maintain a detailed record of its fixed assets.
