PRESENT: Mayor Michael Potter, Councilmembers Curt Muyres,
Duane Berning, John Vetsch, and Sharon Anderson, City
Administrator/Deputy Clerk Garrison Hale, City Engineer Peter
Carlson
Mayor Potter convened the special meeting for the purposes of
considering CSAH 37/19 Intersection Right of Way Issues,
Wastewater, Zoning, Drainage, Non -Intoxicating Liquor License, Lot
Survey, Insurance Coverage, Westwind Park Accessibility and a
Sickle Mower.
Anderson made a motion to adopt the agenda as presented.
Berning supported the motion. All voted aye.
Muyres made a motion to authorize negotiating property
acquisitions for the CSAH 37/19 Intersection Realignment Project
and accepting appraisals. The attorney and administrator are
authorized to negotiate. Anderson seconded the motion. All voted
aye.
City Engineer Carlson discussed sewer rates for residents on
a quarterly basis using 250 gallons per day. Carlson distributed
a sewer rate study of various communities and discussed types of
treatment systems and their costs. Peter Carlson suggested further
analysis using debt service and evaluation on hook -on charges
income by the City Staff with results.
Engineer Carlson discussed 40 hook-ups per year of SAC charge
to pay for the most recent wastewater plant expansion. SAC/TAC
charges need to be established to reserve official future expansion
monies.
Engineer Carlson is interested in current revenues covering
expenses and capital costs. Debt service is an ongoing concern.
Discussion went to SAC fees for early debt payoff and future
expansion.
City Engineer Carlson opened discussion on the final "Urban
Service Area". A map was shown to the Council with a review of the
proposed boundaries for consideration and possible action. The
expansion lines would not guarantee sewer service beyond the city
limits but the plant would be planned for extra -territorial growth
by whatever method works.
Carlson suggested forwarding the map to Otsego and St. Michael
for consideration. Councilmembers were concerned about the plan
showing extra --territorial sewer access and were not interested in
forwarding such a plan to other governmental entities at this time.

Further discussion on how to plan for areas of service beyond the
existing city limits took place.
Muyres moved to adopt the "Urban Service Area" plan dated
October 21, 1996, as the final plan. The plan utilizes the full
capacity of 1.3 million gallons per day of the original plant with
all planned expansions. Anderson seconded the motion. All voted
aye.
Berning made a motion to table Consultants Utilization
Projects list to November 4, 1996, to allow for Council
consideration. Vetsch seconded the motion. All voted aye.
Berning made a motion to adopt RESOLUTION #1996-61 titled
DECLARING THE OFFICIAL INTENT OF THE CITY OF ALBERTVILLE TO
REIMBURSE CERTAIN EXPENDITURES FROM THE PROCEEDS OF BONDS TO BE
ISSUED BY THE CITY FOR THE NORTH FRONTAGE ROAD SANITARY SEWER
PROJECT. Anderson seconded the motion. All voted aye.
Berning made a motion to adopt ORDINANCE #1996-19 titled AN
ORDINANCE AMENDING SECTION 4500, B-4 GENERAL BUSINESS DISTRICT
REGULATIONS, OF THE ALBERTVILLE ZONING ORDINANCE (1988-12) RELATING
TO THE CLASSIFICATION OF SINGLE FAMILY RESIDENTIAL PROPERTY AND/OR
SWELLINGS AS INTERIM USES IF THEY EXISTED PRIOR TO JULY 1, 1996.
Anderson seconded the motion. All voted aye.
Anderson made a motion to table indefinitely RESOLUTION #1996-
62, which adopts ORDINANCE #1996-23 and ORDINANCE #1996-24 and ask
the City Planner if stipulations can be placed in a R-1 zoning
district (with restrictions). Vetsch seconded the motion.
Anderson, Vetsch, Potter and Berning voted aye Muyres voted no.
The motion carried.
Anderson made a motion to approve a Conditional Use Permit for
the B-4 zoned property on 60th Street NE, owned by Donald and Patty
Vorderbruggan. Berning seconded the motion. All voted aye.
Berning made a motion to table action on ORDINANCE #1996-22.
Potter seconded the motion. All voted aye.
Mayor Potter moved to the Parkside 4th Addition Preliminary
Plat. City Engineer Carlson reviewed grading, drainage, erosion
control and the hardship created by not having an "eyebrow" which
then created the need for smaller frontage lots.
Muyres made a motion to approve the recommendation of the
Planning Commission allowing Lots 6, 7, and 8 may have the homes
moved forward to the street 10 feet and sewer/water stubs to
Westwind Park with credit for residential park dedication fees.

Further the signing of a developer's agreement with approval of the
city attorney. Berning seconded the motion. All voted aye.
Muyres made a motion to request that the Planning Commission
consider a Subdivision Ordinance change that requires preliminary
platting of an entire property before part of the property could be
platted. Anderson seconded the motion. All voted aye.
Mayor Potter discussed the need to replace a culvert/pipe at
70th Street NE. Marvin Vetsch has agreed to an easement for ditch
cleaning as part of the project. Potter and Vetsch attended a
meeting of the Otsego Creek Authority on Tuesday, October 15, 1996,
where the matter was considered.
Muyres made a motion to replace the 70th Street culvert in a
50%-50% cost split with the City of Otsego and the ditch cleaning
at a rate of 100% to the City of Albertville. Funds for tree
project will come from the storm water fund. Anderson seconded the
motion. All voted aye.
Potter made a motion to approve a Non -Intoxicating Malt Liquor
License for the Albertville Lions on October 27, 1996. Anderson
seconded the motion. All voted aye.
City Administrator Hale discussed the need for a fire hall lot
survey in order to submit for a variance on setbacks in a
Public/Institutional zone for a salt shed. Councilmembers were
concerned about building a salt shed in the City and setting an
example for others. Opposition for recreating an eyesore that was
cleaned up in 1995.
Berning made a motion to deny performing a fire hall for the
fire hall and not to consider further the matter of a salt stied.
Muyres seconded the motion. All voted aye.
Mayor Potter discussed shared roads. Otsego will agree to
bill the city for roads snow maintained by them. St. Michael could
plow Marlowe and the City could plow 50th Street to Marlowe. More
refinement is required on road snow maintenance.
Anderson made a motion to have the City Administrator and
Mayor prepare a "Shared Roads Contract" with the Cities of Otsego
and St. Michael. Berning seconded the motion. All voted aye.
Anderson made a motion to approve the LMCIT 1996-97 insurance
proposal. Berning seconded the motion. All voted aye.
Mayor Potter moved to large lot single family residential
discussion. Purpose was to consider whether the Marx and Psyk
lands should be considered for a change to R-1A.

Muyres made a motion to hold on Comp Plan Zoning as approved
June 16, 1996. Anderson seconded the motion. All voted aye.
Councilmember Anderson reviewed wheelchair accessibility for
Westwind Park.
Potter made a motion to approve Earl F. Anderson, Inc. to
install a Westwind Park wheelchair accessibility at a cost of
$1,720 with installation in the spring of 1997. Anderson seconded
the motion. All voted aye.
Mayor Potter introduced purchasing a sickle mower. City of
Dayton has one available with a minimum bid of $500. Discussion
focused on the mower being a high maintenance item but useful for
newly annexed lands. The Council was concerned over potential high
maintenance costs.
Anderson made a motion to deny the purchase of sickle mower
and direct the City Administrator to coordinate with neighboring
communities for shared mowing starting in the spring 1997. Muyres
seconded the motion. All voted aye.
Mayor Potter discussed repairing the City pickup truck.
Muyres made a motion to authorize the repair of the pickup
truck for an estimated cost of $3870 at Precision Auto Repair and
to authorize the city clerk -treasurer to issue a check in the
amount of $2,819.06 as a down payment (engine). Anderson seconded
the motion. All voted aye.
Anderson made a motion to adjourn at 9:50 PM. Muyres seconded
the motion. All voted aye.

SUBJECT: PETERSON & VINGE APPRAISALS, HIGHWAY 19 & 37 IMPROVEMENT
PROJECT

The appraisals on the Vinge and Peterson properties have just
been completed (copies are in Linda's office). The compensation to
the Peterson property is $38,417, and compensation to the Vinge
property is $64,835. The appraiser believes that the Peterson
property will show no assessable benefit from the project since the
entire length of the Peterson property currently fronts on the
existing highway 37. The benefit to the Vinge property is
estimated at $31,000.
I anticipate negotiating a swap with the Petersons regarding
the land and streets that we will be turning back to them as part
of this project. The Peterson property was appraised at $1.40 per
square foot. Although no formal calculations have been done, it
appears that at $1.40 per square foot, we will be turning back
approximately $35,000 to $40,000 in property to the Petersons. If
the Petersons cooperate, the Peterson property should be able to be
acquired with little or no cash.
A significant portion of the Vinge compensation relates to
improvements that will need to be done to the property to allow the
continued use of the property after the taking. For instance, the
open ditch will need to be enclosed or moved so that the back
portion of the property can be used; the parking currently used at
the side of the building will be moved between the building and the
street; and the existing drive way to the property will be closed
and the driveway at the south of the property improved since it
will be the only remaining driveway to the property. Many of these
issues will need to be discussed with the Vinges.
Because the Peterson and Vinge parcels are not part of the
current condemnation, the Council need take no formal action in
regard to these appraisals. However, I believe that we should
start negotiating with the landowners in an attempt to obtain the
necessary easements by January. If we are unable to obtain the
easements, I believe that we will at least have an idea as to how
much compensation these landowners believe they are entitled to
(the landowners have the right to get their own appraisals, which
may differ in amount from those the City obtained). The City will
then be in a position to make an informed decision as to whether

the properties should be condemned for the necessary easement.
The impact of these appraisals upon the proposed bond issue is
currently being worked on, with revised numbers expected shortly.
Bob Thistle believes that the necessary bond issue can be
negotiated locally rather than bid, thus allowing less lead time
for its issuance. We will attempt to provide proposed bond
issuance numbers to the Council at its first meeting in November.
At this point, I am requesting that the Council authorize City
staff to begin negotiations with Petersons and Vinges, and if an
agreement can be worked out, to bring that agreement back to the
Council for approval.

DECLARING THE OFFICIAL INTENT OF THE
CITY OF ALBERTVILLE TO REIMBURSE
CERTAIN EXPENDITURES FROM THE PROCEEDS
OF BONDS TO BE ISSUED BY THE CITY
WHEREAS, the Internal Revenue Service has issued Treas. Reg. § 1.150-2 providing that
proceeds of tax-exempt bonds used to reimburse prior expenditures will not be deemed spent
unless certain requirements are met; and
WHEREAS, the City expects to incur certain expenditures which may be financed _
temporarily from sources other than bonds, and reimbursed from the proceeds of a bond;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ALBERTVILLE (THE "CITY") AS FOLLOWS:
1. The City reasonably intends to make expenditures for the project described in
( Exhibit A (the "Project"), and reasonably intends to reimburse itself for such expenditures from
the proceeds of debt to be issued by the City in the maximum principal amount described in
Exhibit A.
2. The City Administrator is authorized to designate appropriate additions to Exhibit
A in circumstances where time is of the essence, and any such designation shall be reported to
the Council at the earliest practicable date and shall be filed with the official books and records
of the City as provided in Section 3.
3. This resolution is intended to constitute a declaration of official intent for purposes
of Treas. Reg. § 1.150-2 and any successor law, regulation, or ruling.

4500.3. Interim Uses. Subject to the processing procedures of the Conditional Use
Permit provisions of this Chapter, the following are interim uses allowed in the "134" District :
(1) Lawfully existing residential properties and dwellings which were established as
single family uses prior to 1 July 1996, subject to the following:
(a) Residences have been specifically designated an interim use by the City
Council.
(b) Single family residential uses may be continued in the style and manner of
operation through routine maintenance procedures. Expansion of such facilities is
allowed, but not exceeding twenty (20) percent of the building square footage existing on
1 July 1996. Any expansion beyond twenty (20) percent of the square footage existing on
1 July 1996 shall require an amended Interim Use Permit.
(c) Homes which have been damaged by natural causes or fire shall require
Interim Use Permit approval for repair or replacement if the damage encompasses more
than seventy-five (75) percent of the structure (residence; excluding detached garages or
accessory structures) value as determined by the City Building Official.
(d) New construction or change in use is prohibited without an Interim Use
l Amendment.

(e) Business activities are not permitted within residential dwellings unless
qualifying as a home occupation and shall be subject to procedures set forth in and
regulated by Section 1600 of this Chapter.
(f) So as to maintain compatibility and protect the health, safety and general
welfare of the public, the City Council may impose additional limitations or requirements
as it deems necessary upon approval of an Interim Use Permit for residential use within
the "B-4" District.
4500.4 Accessory Uses. The following are permitted accessory uses in a "B-4"
District:
(a) All permitted accessory uses in a "B-2" District.
4500.5 Conditional Uses. The following are conditional uses in a "B-4" District.
(Requires a Conditional Use Permit based upon procedures set forth in and regulated by Section
400 of this Chapter.)
(a) All conditional uses subject to the same conditions as allowed in the "BA", "B-2",

WHEREAS, on 21 October 1996, the Albertville City Council met in regular session to
consider the rezoning of residential properties which front on 60th Street from R-3 to R-1 and B-3
to 13-4, and
WHEREAS, the Planning Commission and City Council of the City of Albertville identified
twelve (12) single family residences along bath Street, eleven (11) of which are zoned R-3 and
one which is zoned B-3, and
WHEREAS, the twelve homes are located in an area which is designated for commercial
land uses under the City's Comprehensive Land Use Plan to promote the long term
redevelopment of the isolated neighborhood, and
WHEREAS, the City of Albertville identified issues related to the harmony and compatibility
of the residences with adjacent and future commercial land uses in the vicinity, and
WHEREAS, eleven of the twelve properties are currently zoned R-3 which allows two
family residences in addition to single family residences as permitted uses and such designation
is no longer desired in an area designated for long term commercial uses, and
WHEREAS, to prevent the establishment of two family dwellings and thus the
intensification of the neighborhood, the City wishes to rezone these eleven properties to R-1, and
WHEREAS, the one B-3 zoned property upon which a single family home exists is located
closest to the Main Avenue/CSAH 37 intersection and has been identified as a site which will likely
be one of the first to be redeveloped under its commercial land use designation, and
WHEREAS, to accommodate the B-3 property, an ordinance was adopted which allows
single family residences to lawfully exist as interim (conforming) uses within the B-4 District, and
WHEREAS, the property owner and City have agreed to rezone the property to 8-4 in this
regard because such action is in the best interest of the residential property owner in the interim
to maintain and/or sail the property; and of the City in the long-term establishment of commercial
uses, and
WHEREAS, a duly noticed hearing on the rezoning was held before the Planning
Commission on 13 August, 17 September and 8 October, 1996 where public comment was heard
and considered accordingly, and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the

Request: Kenco has submitted a preliminary plat for the subdivision of 17 single family lots.
The property is zoned R-1, Single Family, and is located immediately north of
Parkside 3rd Addition. The plat provides critical connection between Parkside 3rd
and Westwind. While the street and lot configurations for the plat are limited to the
arrangement shown on the plat, two concept plans were previously submitted to the
Planning Commission in order for them to make a determination on the inclusion or
exclusion of a cul-de-sac (eyelid) in the northeast corner of the plat. The Planning
Commission and City Staff concurred that "eyelids" are a maintenance headache
and that it should be eliminated. The same number of logs are possible either way,
except that three variances are needed for lot width on Lots 6,7 and 8 of Block 1.

3. A parking lot containing a minimum of six (6) stalls is provided by the developer on land
dedicated to the City as parkland. A portion of the land is located within Parkside 4th and
should be designated as parkland on revised plans. The lot should contain one

4. The remainder of cash dedication requirements are satisfied with a cash payment as

5. An off-street asphalt trail is constructed along the renamed Kalenda Drive from the stub

Dear Mr. Couri:
This letter outlines the acceptance of the conditions of approval as outlined in the Planning
Commission findings of fact dated October 9, 1996 with the exception of condition number 7 and
a clarification of condition # 4 & 5. This letter should accompany our letter of September 30
addressed to the Planning Commissioners via Ms. Stockman, planning consultant.
Condition #4 & 5
Consistent with park dedication code requirements in place at the time of application for the
preliminary plat, Kenco is installing facilities and providing land in lieu of cash dedication to the
City in order to satisfy condition #4. Kenco's letter of September 30 outlined the proposal.
Condition # 5 will be fulfilled via the provision of a 6' minimum width asphalt trail to connect to
the existing trail at the park in Parkside 3rd addition. Since the trail lineal footage is beyond the
scope of the plat, credits or rebates are likely due the developer. Bids for this trail will be
forwarded to the City Engineer and Attorney prior to the final plat development contract. Costs
for the trail will be examined against the dedication requirements of cash/land less the acreage of
park land, less sewer and water stubs. The remaining balance if any will satisfy condition #4. If
an overage occurs, Kenco requests a rebate of park dedication currently paid to the City as part
of the Parkside 3rd plat release money.

During discussion of the plat at Planning Commission, concern surfaced about access to the B-3
parcel east of the project. Kenco does not believe that it is legal nor appropriate to attach
conditions which have no relationship to this plat merely because it is an adjacent parcel.
The parcel east of Parkside 4th stands alone, has legal access to a County highway, has a full
intersection at 60th street present and has no code requirement to attach to any adjacent parcel,
especially Parkside 3rd or 4th additions. This condition should be deleted from project approvals
and be dealt with solely at the time of the development of the Beatrice Roden B-3 zoned
property.
Kenco accepted the condition to plant evergreens which usually falls to the higher category land
use owner to provide in condition #6. Kenco accepted in Parkside 3rd addition since we were
the higher land use owner. As proposed, Kenco would request that the planting of evergreens be
a non bonded item so that we can keep our development costs lower.

Pete Carlson, Liz Stockman and myself believe that the city's
subdivision ordinance should be modified to require a subdividing
landowner to preliminarily plat all of the land from which they are
subdividing. This amendment would make it easier to plan and
engineer drainage, sewer, street and park issues over the whole
property at one time, rather than piecemeal as the property is
platted. Adoption of an amendment of this sort would likely have
prevented the Little Mountain/Sylvester Kolles subdivision/platting
problem which recently occurred, and will most likely simplify
similar development issues in the future.
Please have the planning commission consider an amendment of
this type.

The City of Ostego discovered the aforementioned culvert had
rusted out while mowing the 70th St R/W (mower fell in hole).
In further investigating found that the culvert was quite
rusted out and would need replacement.
As per request, the Ostego Creek Authority met and discussed
the situation. Recommendation: 1)Immediate replacement with
2)Ditch cleaning to facilitate a better flow pattern.
Presently, there is a 36 inch C.M.P. (corregated metal culvert)
36 feet long under 70th St. Proposal is to: 1)Install a concrete
culvert with concrete flaired ends; 2)To ditch clean on
both sides of 70th St and that Albertville would try to go all
the way back to Mud Lake.
Cost: 40 foot Concrete Culvert/flaired ends $5,436 with Fehn
Excavating doing the installation and local ditch cleaning.
Additional ditch cleaning price to be obtained by October 21st
for the meeting. Property owner Bernard Vetsch has agreed to
a temporary ditch cleaning easement and one would be required from
Harold Swanson (Balfany Group).
Funding sources: 1)Storm Water Fund; 2)T.I.F. Storm Funds allocated
for the purpose and 3)Sewer Fund Reserve since some of drainage is
created by wastewater discharge.

On a routine inspection of culverts in the City of Otsego, our Public Works
Superintendent and City Engineer discovered that the culvert crossing 70TH Street with
Otsego Creek is deteriorated to the extent that replacement will be necessary.
The existing pipe is a 36" C.M.P. and is approximately 36 feet long. The lower 1/3 of the
culvert is rusted out to the point that the flow line is rusted away.
With the wet weather we have had in the last several years, we could not tell the
condition of the pipe as it was under water. The lack of rain in August and September
has caused that portion of Otsego Creek to dry up completely. This situation has allowed
for inspection of the pipe. In high water this pipe is critical to the watershed and the
street above it. Now would be the time to replace the culvert in the dry conditions.
We are proposing to in -stall a 40 LF of 36" RCP with flared end sections.
The reason for using reinforced concrete pipe is that it will not deteriorate as has the
existing corrugated metal pipe. Apparently the water's chemistry is harmful to the metal
pipe in this area.
Although the RCP will handle more flow than the same size CMP, the actual volume
should be within the recommended flow found in the Otsego Creek Hydrology Plan.
We have solicited a quote from Dennis Fehn, Inc. in the amount of $5,432.00. Class 5
gravel to repair the street is extra for a cost of $8.00/Cubic Yard. Also, if pipe bedding
is required, using 1-1/2" rock, the price for rock is $15.00/Ton.

Since the street is now in both Cities, the cost of replacement is a matter to be shared. If
split into two equal shares, the cost would be $2,716.00 each, plus gravel and pipe
bedding, if needed..
This work must be done as soon as possible, as further deterioration could cause road
failure in this location and possible spring flooding due to failure of the culvert.

Description of Request(s): Approve Setbacks that permit installation of salt shed
closer to lot lines than permitted in zoning ordinance. Presently, the "P/I" Public/
Institutional District establishes Side Yard Setbacks at (20) feet on any one side
and Rear Yards at (25) feet. The lot is not large enought to permit the installation
of a one bay salt shed and comply with the ordinance requirements.

At the City Council/Planning Commission workshop on 14 October, issues related to the
large lot single family residential (R-1A Zoning District) were raised and discussed. It was
generally agreed that the current standards and application are satisfactory as now stated
in the Comprehensive Plan and Zoning Ordinance text and map. Raised, however, an
issue was whether the large lot residential should also be applied to the vacant,
undeveloped properties east of County Road 19 which are designated for single family
use.
At the meeting on 21 October, the City Council is therefore requested to provide formal
directive as to whether the area east of County Road 19 should be evaluated for an
application of the large lot residential designation. It is emphasized that a "final" decision
is not being sought, only whether or not this matter should be considered. In this regard,
we would also note that a change in land use classification and eventually rezoning from
R-1 to R-1A would require a four -fifths approval of the Council. Therefore, if there is not
near unanimous agreement to undertake a review, we are suggesting it not be done.
To aid the Council in their consideration of the matter, a brief summary of the two sides of
the issue needs to be provided. The basis of the current plan with the area west of County
Road 19 being R-1A and the area east being R-1 is that the area east of 19 was previously
an R-3 District which allowed 12,500 square foot lots for single and twin homes. The
change from R-3 to R-1 eliminates the potential of twin home development. The area west
of 19 was, however, previously zoned agriculture and as a result, no lessening of
opportunity was created by the new R-1 A application.

The counter argument for the undeveloped area east of 19 being also R-1A is that it treats
all vacant undeveloped property in an equal manner.
City staff has no position as to a preferred approach, as both options work to achieve the
goals established by the City for a variety of housing types, the encouragement of higher
value housing, and the likely slower pace of residential development.
Should the Council decide that the matter requires further study, it will be referred to the
Planning Commission for public hearing and recommendation.
