The agenda was amended as follows: • Add Item 5b(5) - Contract with S.E.H., Inc. for the Wastewater Treatment Facility • Add 6d(6) — City Park hockey rink maintenance Berning made a motion to approve the agenda as amended. Gundersen seconded the motion. All voted aye. Stalberger made a motion to approve the minutes of the November 16, 1998, regular City Council meeting and the minutes of the December 2, 1998, Truth in Taxation hearing as presented. Gundersen seconded the motion. All voted aye. Mayor Olsen asked if anyone present wished to address the Council under the Citizen Forum portion of the agenda. No one addressed the Council. Gundersen made a motion to approve payment of Check #'s 11211 — 11269 as presented. Stalberger seconded the motion. All voted aye. Gundersen made a motion to approve the Financial Statement for the month of November as presented. Stalberger seconded the motion. All voted aye. Gundersen made a motion to approve the WWTF Monthly Operations Report for October 1998 as presented. Stalberger seconded the motion. All voted aye. Gundersen made a motion to approve the 1999 annual contract with PSG in the amount of $97,894 for Contract Operations, Maintenance and Management of the Albertville WWTF. Stalberger seconded the motion. All voted aye. Gundersen made a motion to approve the 1999 Budget proposal for the Joint Powers Board as presented. Stalberger seconded the motion. All voted aye. ALBERTVILLE CITY COUNCIL December 7,1998 Page 2 of 6 Mayor Olsen opened the public hearing to consider the assessment of the CSAH 19/37 Intersection Realignment Project. City Attorney Couri explained that the project was a joint project with Wright County and the City paid a portion of the construction costs and the land acquisition costs. The proposed assessment roll was presented showing that benefiting property owners are proposed to be assessed on a front footage basis, up to the City appraiser's opinion on the amount of benefit per parcel. Mayor Olsen called for public comment. John Kolb, an attorney representing Andrew and Michael Savitski, presented the city clerk with Notices of Objection to Special Assessment. Kolb explained that his clients believe the proposed assessments excessive considering that their properties were previously assessed for the original street, curb, gutter and utilities. City Engineer Pete Carlson explained that the properties were not being charged for utilities. Several hydrants were relocated only and the City is paying for those charges by not assessing the total cost of the project. The City also paid for the construction of the street off County Road 37 to the north allowing access to DJ's Hardware. Donald Savitski questioned whether the City used the same appraiser for the land acquisition amounts and the benefit amounts per parcel. Mayor Olsen stated the same appraiser was used for both appraisals. There was no further comments from the public. Berning made a motion to close the public hearing at 7:48 PM. Gundersen seconded the motion. All voted aye. City Attorney explained that in order to get the assessments on the tax rolls in 1999, the Council needs to approve the assessment roll and the resolution authorizing the assessments at this meeting. Otherwise, the Wright County Auditor would be unable to include the assessments on the next year's tax rolls. ALBERTVILLE CITY COUNCIL December 7,1998 Page 3 of 6 Berning made a motion to adopt RESOLUTION #1998-27 titled RESOLUTION ADOPTING ASSESSMENT FOR STREET IMPROVEMENTS. Gundersen seconded the motion. All voted aye. John Kolb, representing Andrew and Michael Savitski, served a Notice of Appeal to Objection to Special Assessment to the city clerk. Berning made a motion to appoint Councilmembers Vetsch and Stalberger to a committee to meet with the Savitski's to attempt to negotiate a settlement on the special assessments. Gundersen seconded the motion. All voted aye. City Attorney Couri explained that the TIF Agreement for the senior housing development needs to be amended from the Zedakah Foundation to Cottages of Albertville Two. Steve Feneis, representing Cottages of Albertville Two, stated his attorney wants to review the Agreement prior to Council action and requested the Council table further discussion at this time. Vetsch made a motion to table discussion on the TIF Agreement for the senior housing project until the next Council meeting. Berning seconded the motion. All voted aye. The Council discussed the park dedication fees for the Mike Savitski building. Mike Savitski offered to pay $1,500 in park dedication fees and to donate the necessary easements for the trail to the City. The Council discussed Savitski's offer and countered with a $3,000 cash park dedication payment and the land easement for the trail. Savitski agreed to accept the Council's counter- proposal Vetsch made a motion to accept a $3,000 cash payment and the easements for the trail from Mike Savitski as payment in full of the park dedication fee on his building located at the intersection of Lachman Avenue NE and Country Road 37, contingent upon a signed written agreement from Savitski. Stalberger seconded the motion. Vetsch, Stalberger, Berning and Gundersen voted aye. Olsen voted no. The motion carried. Stalberger made a motion to adopt RESOLUTION #1998-17 titled A RESOLUTION ADOPTING THE WASTEWATER TREATMENT PLAN PUBLIC FACILITIES PLAN AND IMPLEMENTING THE SELECTED ALTERNATIVE. Gundersen seconded the motion. All voted aye. ALBERTVILLE CITY COUNCIL December 7, 1998 Page 4 of 6 City Engineer Pete Carlson reviewed the recommendations from the Technical Advisory Board regarding the Joint Powers Water Board. The Council recommends the following revisions: (1) The Joint Powers Board make-up will remain as is, i.e. two members from each member community. (2) Recommendation #4 is amended to read "...basic set of standards which will be adopted at a minimum by each community." (3) Each member community has policing powers over illegal hydrant use over the entire district. Carlson reported the he and Councilmember Stalberger had met with concerned property owners to discuss the Greenhaven Drainage Project. A number of the residents do not want the project to be constructed and would prefer that the I-94 ditch be re -graded to promote drainage. Other parties are concerned with the maintenance of the ditch. Carlson believes the project can be constructed in conjunction with a maintenance agreement through the Otsego Creek Authority. Councilmember Berning pointed out that MnDOT has refused to allow the I-94 ditch re -grading. The Council concurred to proceed with the installation of the piping for the Greenhaven Drainage Project. Carlson reported that JMJ Properties are in the process of redesigning their site layout to avoid wetland concerns presented by WSWC. Attorney Couri suggested several amendments to the contract with S.E.H. for the wastewater treatment expansion design. Berning made a motion to approve the contract with S.E.H., contingent upon the following terms: (1) Auto liability insurance is increased to $750,000. (2) Clarification that S.E.H. will maintain insurance coverage for the duration of the contract. (3) Exempt the toxic section from the Limitations on S.E.H.'s liability in Paragraph D.1. Stalberger seconded the motion. All voted aye. ALBERTVILLE CITY COUNCIL December 7, 1998 Page 5 of 6 Berning made a motion to approve the Findings of Fact & Decision approving a variance from the roofing materials requirement for the STMA Ice Arena. Gundersen seconded the motion. All voted aye. Berning made a motion to approve the Findings of Fact & Decision granting final plat approval for the Cedar Creek North 2nd Addition contingent upon the developer resolving the conflict with the Joint Powers Board regarding the change of plans and installation of an uninspected portion of the watermain. Gundersen seconded the motion. All voted aye. Gundersen made a motion to approve the Findings of Fact and Decision granting final plat approval of the Karston Cove 2nd Addition contingent upon the following: • The developer resolves the conflict with the Joint Powers Board regarding the change of design and installation of an uninspected portion of the watermain. • The developer removes all materials and equipment presently stored on property in the Fairfield Addition. Stalberger seconded the motion. All voted aye. The Council reviewed the letter from the Minnesota Amateur Sports Commission regarding the extension for disbursement of the Mighty Ducks grant to January 31, 1999. Olsen made a motion to loan the Joint Powers Ice Arena Board one-third of the grant to be repaid upon receipt of the Mighty Ducks grant. Vetsch seconded the motion. All voted aye. The Council received a request from residents along 61st Street and Kalland Drive for a street light. Berning made a motion to approve the installation of a street light at 61s' Street NE and Kalland Drive NE. Gundersen seconded the motion. All voted aye. The Council reviewed the sample job descriptions for clerk -administrator, zoning administrator and public works supervisor. Linda was directed to revise those job descriptions for the City of Albertville. Vetsch made a motion to adopt RESOLUTION #1998-25 titled A RESOLUTION ADOPTING THE FINAL 1998 TAX LEVY COLLECTIBLE IN 1999. Stalberger seconded the motion. All voted aye. ALBERTVILLE CITY COUNCIL December 7,1998 Page 6 of 6 Vetsch made a motion to adopt RESOLUTION #1998-26 titled A RESOLUTION ADOPTING THE 1999 FINAL BUDGET. Stalberger seconded the motion. ADMINISTRATOR -CLERK -TREASURER DESCRIPTION OF WORK General Statement of Duties: Performs administrative work conducting the daily business activities of the City; conducts City elections; performs skilled bookkeeping and record keeping; acts as the administrator for the City Council and performs related duties as required. Supervision Received; Works under the general and administrative, supervision of the City Council and specifically reports to the mayor. Supervision Exercised: Exercises general supervision over other clerical personnel in the administration department of the City. TYPICAL DUTIES PERFORMED The listed examples may not include all duties performed by all positions in this class. Duties may vary somewhat from position to position within a class. Accounting Related Duties • Prepares accounts payable and receivable transactions and post information to journals, verifies account information and generates checks for bill payments. • Maintains and processes payroll, payroll deductions, payroll records and reports, etc; processes claims and warrants for all funds. • Deposits and transfers money between accounts and reconciles accounts; keeps Council informed. • Identifies money available to be invested in conjunction with the auditor, tracks due dates of investments and invest funds with Council approval in accordance with City policy. • Prepares and presents the annual budget to the City Council, including capital improvement plans. • Monitors expenditures and receipts during the year. • Oversees and approves all City purchases through purchase order system. Administration Related Duties • Coordinates the operation of all departments in City government to ensure citizens promptly receive high quality products and services. • Recommends and coordinates the development of administrative rules, policies and procedures necessary to ensure proper functioning of all departments; researches and assists in the development of solutions to problems. • Identifies and researches current municipal issues, insurance risks, legislative mandates, and regulation changes and provides an analysis of issues and changes to the City Council (Keeps the Council informed of issues which they may wish to take action on or should take action on in the best interest of the City.) Page 1 of 3 • Prepares special assessment rolls, bills for special assessments, collects payments and records as appropriate. • Receives requests, complaints and information from the public and transmits to staff and/or Council. May handle if an administrative matter. • Establishes procedures and guidelines for the effective operation of the clerk/administrator's office. • Prepares and analyzes quotes and bids for products and services; executes or recommends execution of contracts to the City Council. • Acts as liaison with State, County, City Attorney and Auditors and Boards and Commissions. • Administers local elections in accordance with State and County requirements. • Oversees, schedules, trains election judges and maintains election records. • Assists in bid openings, reviews bids and highlights areas for review by City Attorney. • May assist in completing grant and loan applications; administers grant money that is received and prepares related reports. • Prepares a variety of reports and files with appropriate state, federal or county offices. • Carries out assignments as designated by the City Council. • Reviews and assists in overseeing all contracts and agreements. • Assists in planning or coordinating annual City events. • Attends conferences and schools to keep abreast of current city issues and apprises the Council of coming issues which will require Council action. • Supervises all City staff directly or indirectly though subordinate supervisors, including interviewing and recommending hire; training; assigning and reviewing work; recommending reward and discipline, approving time cards, etc • .Assists with codification of ordinances and maintains resolution, ordinance and meeting minute books. Clerical and General Office Duties • Prepares and types correspondence, reports, memos, letters, ordinances, etc., on behalf of the Council. • Attends and participates in regular and special City Council meetings, records Council actions, prepares agenda and maintains records of all action taken. • Provides Council with a report of administration activity on a regular basis. • Arranges and publishes notices of meetings and ordinances as required by law. • Attests the mayor's signature on official documents wherever required and maintains responsibility for the City Seal. • Provides certified copies of proceedings and record of the City upon request. • Oversees and processes applications for all licenses. • Answers phones and provides information and assistance to the public. • Determines public information needs; identifies timely newsletter articles. • Monitors operations to ensure compliance with applicable laws, regulations, rules, policy and ordinances. Chair Larson opened the public hearing to consider the Preliminary Plat for Cottages of Albertville Two. City Planner Brixius had not prepared a formal planning report, but he had reviewed the preliminary plat and offered his recommendations. He stated the plat is consistent with the previous development and had not changed from the original preliminary plat approved for the first development. This addition was excluded from the final plat of Cottages of Albertville. The plat consists of twenty (20) for -sale units constructed for senior citizens only and is located directly west of Cottages of Albertville on Kalland Avenue NE. Brixius recommended the following conditions to be listed in the Findings of Fact: 1. The developer submits grading, landscaping, and utility plans for Cottages of Albertville Two. 2. The setbacks between Lots 2 and 3 of Block 1 be reviewed and adjusted if necessary. 3. Refuse collection will be the same as approved for the first addition. 4. The PUD agreement is amended to include this addition. 5. A property management agreement is approved. 6. The developer pays the park dedication requirements. PLANNING & ZONING COMMISSION November 10,1998 Page 2 of 3 Steve Feneis explained that Liz Stockman was aware that the grading, utility and landscape plans would be submitted with the final plat. Feneis will submitthose documents tomorrow. Chair Larson asked for comments from the public. Raymond Meyer would like to have more landscaping (trees, shrubbery, etc.) required on this plat. He currently lives in the Cottages of Albertville Addition and feels the plantings are inadequate. Feneis explained that the landscaping plan for the first development had been approved. However, he is willing to work with the planner and the tenant/owners on the landscaping plan. There were no other comments from the public and Chair Larson closed the public hearing at 7:25 PM. Stalberger made a motion to adopt the Findings of Fact & Recommendation as discussed, recommending the City Council grant preliminary plat approval for Cottages of Albertville Two. Bauer seconded the motion. All voted aye. The Commission discussed the ordinance changes recommended by Liz Stockman. The current ordinance does not define beauty shops as including personal services. Stockman recommends the ordinance be amended to define the services related to and allowed within beauty parlors, such as tanning, manicures, facials and therapeutic massages. The final question is whether massage therapists need to be licensed. Brown made a motion recommending the City Council direct the planner to prepare an ordinance amendment defining the services related to and allowed within beauty parlors, including therapeutic massages. The Commission will conduct a public hearing in January to discuss the ordinance amendment. Stalberger seconded the motion. All voted aye. The Commission reviewed the three applications ' for Robertus' - position on the Planning Commission. Robertus' term expires at the end of the year and he will be unable to serve. The agreement shall require that the Cottages of Albertville Two be limited as a senior only development, with the primary resident age 55 and older and no children allowed. In order to accomplish this, a deed restriction reeds to be filed with individual properties and some type of senior programming activities will need to be planned within the gathering room (State of Minnesota requirement). The properties will also be income restricted. The CityAttorney shall review and approve these and all otter legal documents. Property Maintenance AWeenienUProtectiVe Covenants. A property maintenance agreement or declaration of covenants, editions and restrictions must be prepared by the applicant and submitted to the City Attorney for his review and approval. It shall provide that an owner's association be formed and that all owners shall be members responsible for maaaintaining the properties and common areas in good repair. Individual owners may be assessed proportionate shares or joint or common costs. An original, signed copy must be filed with the Wright County Recorder's Office as a deed restriction against the title of each unit lot. The covenants shall include provisions which prohibit the storage of recreational vehicles or equipment which occupies designated garage or parking space. No on -street parking shall be permitted. CONCLUSION The proposed senior housing development, Cottages ofAlbedville Two, is the second and final phase in the Planned Unit Development approved in 1997. Cottages of Albertville Two is intended to serve a specific portion of the population in achievement of life -cycle housing opportunities in the City. It is generally a well -designed project proposed in a location which will benefit its resident community. While our ordinance does not define beauty parlors, they are allowed in all commercial zoning districts. It is our opinion that the services to be offered are all related and complementary to. the beauty parlor operation, but simply assuming that does not provide the City ample protection from future requests which may go beyond the generally accepted practices (such as adult use massages and tattoos). We have spoken with Mr. Couri on the topic who agrees that it is in our best interest to define the services related to and allowed within beauty parlors. I have attached some example ordinances demonstrating different ways the situation can be handled. Adult use massages are already defined in our ordinance and are limited to certain geographical areas prescribed by law (Ms. Gullickson has no intention of utilizing this type of activity). Tattoo parlors can be treated as a separate, more physically invasive type of personal service and can be left as a prohibited (not expressly permitted) use as is the case presently, or they can be treated as one of many personal services which you may want to allow. The final question is whether or not you feel that massage therapists need to be licensed in the City. Again, an example ordinance has been attached for your reference. Please be prepared to discuss this topic at the 8 December 1998 Planning Commission meeting whereupon you may wish to direct our office to prepare a formal ordinance amendment to accommodate Ms. Gullickson and future, similar requests. Massage therapy shall not include techniques traditionally practiced by chiropractors. Statement disclosing whether the applicant has ever been convicted of a crime or offense and, if so, information as to the time, place and nature of such crime or offense. 6. Licenses shall be issued by the City Administrator. If the City Administrator refuses to issue a license, the decision may be appealed to the City Council. B. Term Of License: A license permitting the holder thereof to practice or administer massage commercially is nonrenewable and nontransferable and application must be made each year for a license permitting and allowing the holder thereof to administer or practice massage for the succeeding year. All licenses shall be Issued for a term expiring on December 31 following its issuance. Prior Offenses: Licenses may be issued only to persons free from convictions or offenses which involve moral turpitude or which relate directly to the person's ability, capacity or fitness to perform the duties and discharge the responsibilities of the occupation. Prior Revocation: Licenses may not be issued to persons who, within one year prior to the date of application, have been denied licensing or who have had their license revoked or suspended by any community, political entity or by the State of Minnesota. Cooperation Of Applicant: Licenses may be issued only to persons who have fully and truthfully answered all of the information requested in the application and have paid the full license fee and investigation fee. F. Age: Licenses may be issued only to persons eighteen (18) years of age or older. Habitual drunkenness or intemperance in the use of drugs, including, but not limited to, the use of drugs defined in either 26 U.S.C. section 4731 or Minnesota Statutes section 152.02, barbiturates, hallucinogenic drugs, amphetamines, benzedrine, dexedrine, or other sedatives, depressants, stimulants or tranquilizers. The City Council finds that the experience of other cities indicates that there is a connection between tattooing/body piercing, and hepatitis and other health problems. The City Council finds that the stringent regulations governing tattooing and body piercing can minimize the hepatitis and disease risk, and therefore protect the general health and welfare of the community. (Ord. 596, sec. 1, 2-18-1997) 3-18-2: DEFINITIONS: The following words and terms, when used in this Chapter, shall have the following meanings unless the context clearly indicates otherwise: 797 City of Lakeuille 3-18-2 3-18-2 BODY PIERCING: Penetrating or making a hole in or through the human body to place jewelry or objects of metal, plastic, wood, bone, or other foreign material on any area for cosmetic purposes. CERTIFICATE OF Written approval from the designated City INSPECTION: representative that the tattooing and/or body piercing establishment has been inspected and meets all the requirements of the chapter relating to physical facilities, equipment and layout for the operation of the establishment. CLEAN: The absence of dirt, grease, rubbish, garbage, and other offensive, unsightly or extraneous matter. EMPLOYEE: Any person over twenty one (21) years of age other than an operator who renders any service in connection with the operation of a tattoo and/or body piercing establishment and receives compensation from the operator of the business or its patrons. GOOD REPAIR: Free of corrosion, breaks, cracks, chips, pitting, excessive wear and tear, leaks, obstructions, and similar defects so as to constitute a sanitary, workable and sound condition. ISSUING The City Administrator or his/her designee. AUTHORITY: OPERATOR: Any individual, firm, company, corporation or association that owns or. operates an establishment where tattooing and/or body piercing is performed and any individual or any employee who performs or practices the art of tattooing/body piercing on another person. TATTOO, Any method of placing designs, letters, scrolls, TATTOOING: figures, symbols or any other marks upon, under or in the skin with ink or any other substance resulting in the coloration of the skin 797 - City of Lakeville 3-18-2 3-18-4 by the aid of needles or any other instruments which puncture any portion of the skin to any degree. (Ord. 596, sec. 1, 2-18-1997) 3-18-3: LICENSE REQUIRED: No person shall operate any establishment where tattooing and/or body piercing is t practiced, nor engage in the practice of tattooing and/or body piercing without being licensed pursuant to this Chapter. A state licensed physician who engages in the practice of tattooing and/or body piercing shall be exempt from the license requirement. Jewelry stores and accessory stores that provide exclusively ear piercing services using piercing guns shall be exempt from this license requirement. Whether the applicant is a citizen of the United States, a resident alien, or is able to legally be employed in the United States. .3. Whether the applicant has ever used or has been known by a name other than the applicant's name, and if so, the name or names used and information concerning dates and places where used. 4. The name of the business if it is to be conducted under a designating name, or style other than the name of the applicant and a certified copy of the certificate as required by Minnesota Statutes section 333.01. 5. A true copy of the Certificate of Incorporation and Certificate of Good Standing. Articles of incorporation or association agreement, and bylaws, shall be attached to the application, in addition to a current Certification of Good Standing from the Minnesota Secretary of State's office. 3. The name of the manager(s), proprietor(s), or other agent(s) in charge of the business and all information concerning each manager, proprietor, or agent required in subsection A of this Section. Whenever the application is for premises either planned or under construction or undergoing substantial alterations, the application shall be accompanied by a set of preliminary site and building plans, if not already on file with the City, showing the design of the proposed premises to be licensed. 6. Such other information the City Council or the issuing authority may require. (Ord. 596, sec. 1, 2-18-1997) 3-18-5: APPLICATION EXECUTION: All applications for a license under this Chapter shall be signed and sworn to. If the application is that of a natural person, it shall be signed and sworn to by such person; if that of a corporation, by an officer thereof; if that of a partnership, by one of the general partners; and if that of an unincorporated association, by the manager or managing officer thereof. Any falsification on a license application shall result in the denial of a license. (Ord. 596, sec. 1, 2-18-1997) 3-18-6: APPLICATION VERIFICATION: All applications shall be referred to the issuing authority for verification and investigation of the facts set forth in the application, including any necessary criminal background checks to assure compliance with this Chapter. The application shall be issued or denied by the issuing authority in accordance with Sections 3-18-8 and 3-18-9 of this Chapter. 797 City of Lakeville 3-18-6 3-18-7 The City Administrator shall Issue a tattoo and/or body piercing establishment permit within thirty (30) days of receipt of the application, unless the Administrator finds that: A. The correct license fee has not been tendered to the City and, in the case of a check or bank draft, honored with payment upon presentation. B. The operation, as proposed by the applicant, if permitted, would not comply with all applicable laws, including, but not limited to, the City's business, zoning and health regulations. C. The applicant has knowingly made any false, misleading or fraudulent statement of fact in the application for the permit or in any document required by the City in connection therewith. D. The applicant has operated a tattoo establishment and has had a license denied, revoked or suspended for any of the above cases by the City or any other state or local agency within two (2) years prior to the date of the application. E. The applicant If an individual, or any of the officers and directors If the applicant is a corporation, or any of the partners, including limited partners, if the applicant is a partnership, and the manager or other person principally in charge of the operation of the business is not over the age of twenty one (21) years. (Ord. 596, sec. 1, 2-18-1997) 3-18-7: FEES: A. Application Fee: 1. The application fee shall be set by resolution of the City Council. 2. The license application fee shall be paid in full before the application for a license shall be accepted. Upon rejection of any application, the license fee shall be refunded in full to the applicant except where rejection is for a wilful misstatement in the license application. 797 City of Lakeville 3-18-7 3-18-8 3. Separate application fee shall be paid for establishments providing both tattooing and body piercing services. S. Investigation Fee: An applicant for any license under this Chapter shall pay the City, at the time an original application is submitted, a nonrefundable fee at a ' rate set by City Council resolution to cover the costs involved in verifying the license application and to cover the expense of any investigation needed to assure compliance with this Chapter. In the event an establishment is adding more than one service at a different time, additional investigation fee shall be paid for Investigation needed to assure compliance with this Chapter. C. License Fee: 1. Separate license fees shall be paid for each process of tattooing and body piercing service. This fee shall be paid annually, to be determined from the date of issuance of the license. 2. The license fee shall include the cost of inspections conducted by the issuing authority or designated health professional. 3. The annual license fee shall be set by City Council resolution. No license under this Chapter shall be issued to a corporation or other organization if such applicant has any manager, proprietor, or agent in charge of the business to be licensed: 797 1. Who is a minor at the time the application is filed. 2. Who has been convicted of any crime directly related to the occupation licensed as prescribed by Minnesota Statutes section 364.03, subd. 2, and who has not shown competent evidence of sufficient rehabilitation and present fitness to perform the duties of the licensed occupation as prescribed by Minnesota Statutes section 364.03, subd. 3. 3. Who is not a citizen of the United States, a resident alien, or does not have the legal authority to be employed in the United States. 4. Is not of good moral character or repute. (Ord. 596, sec. 1, 2-18-1997) City of Lakeuille 3-18-9 3-18-10 3-18-9: LOCATIONS INELIGIBLE FOR A LICENSE: The following locations shall be ineligible for a license under this Chapter: A. Taxes Due On Property: No license shall be granted or renewed for operation on any property on which taxes, assessments, or other financial claims of the State, County, school district, or City are due, delinquent, or unpaid. In the event a suit has been commenced under Minnesota Statutes sections 278.01 through 278.03, questioning the amount of validity or taxes, the City Council may on application waive strict compliance with this provision; no waiver may be granted, however, for taxes or any portion thereof which remain unpaid for a period exceeding one year after becoming due. B. improper Zoning: No license shall be granted or renewed if the property is not properly zoned or does not qualify as a legal nonconforming use for tattooing and/or body piercing establishments under Title 11 of this Code. C. Premises Licensed For Alcoholic Beverages: No license shall be granted or renewed if the premises is licensed for the furnishing of alcoholic beverages pursuant to Title 3, Chapter 1 of this Code or is licensed as a sexually oriented business pursuant to Title 3, Chapter 10 of this Code. (Ord. 596, sec. 1, 2-18-1997) 3-18-10: GENERAL LICENSE REQUIREMENTS: A. Tattoos On Minors: No person shall tattoo any person under the age of eighteen (18) except in the presence of, and with the written permission of, the parent or legal guardian of such minor. The consent must include both the custodial and noncustodial parents, where applicable. B. Prohibition On License Transfer: The license granted under this Chapter is for the operator and the premises named on the approved license application. No transfer of a license shall be permitted from place to place or from person to person without first complying with the requirements of an original application, except in the case in which an existing noncorporate licensee is incorporated and incorporation does not affect the ownership, control, and interest of the existing licensed establishment. 797 City of Lakeville 30 8-10 3-18-10 C. Hours Of Operation: A licensee under this Chapter shall not be open for business for tattooing and/or body piercing before seven o'clock (7:00) A.M. nor after nine o'clock (9:00) P.M. D. Licensed Premises: The tattoo and/or body piercing establishment license is only effective for the compact and contiguous space specified in the approved license application. If the licensed premises is enlarged, altered, or extended, the licensee shall .inform the issuing authority. No person shall engage in the practice of tattooing at any place other than the place or location named or described in the application and license. A separate room shall be required for body piercing and tattooing services. The applicant shall submit a drawing to scale of the tattoo/body piercing facilities. E. Effect Of License Suspension Or Revocation: No person shall solicit businesses or offer to perform tattooing services while under license suspension or revocation by the City. F. Maintenance Of Order: The licensee shall be responsible for the conduct of the business being operated and shalt at all times maintain conditions of order. G. Employee Lists: The licensee shall provide to the issuing authority a list of employees including operators who perform tattooing at the licensed establishment and shall verify that each employee has received a copy of Sections 3-18-10 and 3-18-11 of this Chapter. Each operator shall submit evidence of apprenticeship of at least thirty (30) days under a licensed tattoo artist or equivalent training acceptable to the issuing authority. H. Liability Insurance: All licensees shall have at all times a valid certificate of insurance issued by an insurance company licensed to do business in the State indicating that the licensee is currently covered in the tattoo business by a liability insurance policy. The minimum limits of coverage for such insurance shall be: 1. Each claim, at least two hundred thousand dollars ($200,000.00). 2. Each group of claims, at least five hundred thousand dollars ($500,000.00). 797 City of Lakeuille 6-18-10 3-18-11 Such insurance- shall be kept in force during the term of the license and shall provide for notification to the City prior to terminating or cancellation. A certificate. of insurance shall be filed with the City. I. Inspections: 1. City Initiated: The issuing authority or designated health professional shall, at minimum, conduct one randomly scheduled inspection of each licensed facility each year to determine compliance with City requirements. 2. Compliance Certification: A health professional who is retained by the licensed operator and acceptable to the issuing authority shall inspect the licensed premises in the month of November of each calendar year. Said inspection is to determine compliance with City requirements and a written report documenting findings shall be submitted to the issuing authority within fifteen (15) days from the date on which the inspection took place. (Ord. 596, sec. 1, 2-18-1997) 3-18-11 HEALTH AND SANITATION REQUIREMENTS: No person shall engage in the practice of tattooing and/or body piercing at any place in the City without complying with the following regulations: A. Lavatory Requirement: Every place where tattooing and/or body piercing is practiced shall be equipped with an adequate and conveniently located toilet room and hand lavatory for the accommodation of employees and patrons. The hand lavatory shall be supplied with hot and cold running water under pressure; shall be maintained in good repair at all times; and shall be kept in a clean and sanitary condition. Toilet fixtures and seats shall be of a sanitary open front design and readily cleanable. Easily cleanable, covered receptacles shall be provided for waste materials. Every lavatory facility shall be provided with an adequate supply of hand -cleansing compound and single -service sanitary towels or hand -drying devices. B. Infections/Disease: No person having any communicable blood or skin infection or other communicable diseases of the blood or 797 City of Lakeville . 1 1 ( . 3-18-11 3-18-11 skin shall practice tattooing or body piercing or shall be tattooed or body pierced. C. Sterilization And Disposal Of Biohaza'rdous Materials: All disposable needles, razor blades, sharps or other equipment utilized for penetrating the skin shall be individually prepackaged and presterilized. No such equipment shall be used on more than one customer. All biohazardous waste shall be disposed of in accordance with law, and disposal procedures shall be approved by the issuing authority. Sterilizing solutions and methods may be used for the purpose of sterilizing instruments other than needles, razor blades, sharps or other equipment utilized for penetrating the skin when such sterilizing solutions and methods are approved by the issuing authority. D. Skin Preparation Procedures: The following procedures shall be used for skin preparation: 1. Each operator shall wash his or her hands thoroughly with soap and water and then dry them with a clean towel before and after each tattoo and/or body piercing. Operators with skin infections of the hand shall not perform any tattooing and/or body piercing services. 2. Whenever it is necessary to shave the skin, prepackaged, presterilized, disposable razor blades shall be used. 3. The skin area to be tattooed and/or body pierced shall be thoroughly cleaned with germicidal soap, rinsed thoroughly with water, and sterilized with an antiseptic solution approved by the issuing authority. Only single -service towels and wipes shall be used In the skin cleaning process. E. Operating Furniture: All tables, chairs, furniture, or area on which a patron receives a tattoo and/or body pierce shall be covered by single -service disposal paper or clean linens, or in the alternative, the table, chair or furniture on which the patron receives a tattoo and/or body pierce shall be impervious to moisture and shall be properly sanitized after each tattoo and/or body pierce. F. Towels: Every operator shall provide single -service towels or wipes for each customer or person and such towels or wipes 797 City of Lakeuille 3.18-11 3-18-11 shall be stored and disposed of in a manner acceptable to the issuing authority. G. Garments Of Operator: Every operator shall wear clean, washable garments when engaged in the practice of tattooing and/or body piercing. If garments are contaminated with blood or body fluids, such garment shall be removed and changed and cleaned or disposed of in a manner acceptable to the issuing authority. H. Pigments: Pigments used in tattooing shall be sterile and free from bacteria and noxious agents and substances including mercury. The pigments used from stock solutions for each customer shall be placed in a single -service receptacle, and such receptacle and remaining solution shall be discarded after use on each customer in accordance with procedures approved by the issuing authority. i. Jewelry: Jewelry for the other parts of the body shall be made of implant grade, high -quality stainless steel (300 series), solid 14K or 18K gold, niobium, titanium, platinum, or a dense, low - porosity plastic such as monofilament nylon, acrylic, or Lucite. Ear studs or other jewelry designed for earlobe piercing are not appropriate jewelry for other body parts. Jewelry shall have no nicks, scratches, or irregular surfaces which might endanger the tissues. J. Minimum Floor Space: There shall not be less than one hundred fifty (150) square feet of floor space at the place where the practice of tattooing and/or body piercing is conducted, and said place shall be so lighted and ventilated as to comply with the standards approved by the issuing authority. K. Influence Of Alcohol And Drugs: No person shall practice tattooing and/or body piercing while under the influence of alcoholic beverages or illicit drugs. No customer shall be tattooed and/or body pierced while under the influence of alcoholic beverages or illicit drugs. L. Written Instructions: The operator shall provide the person tattooed and/or body pierced with printed instructions on the approved care of the tattoo and/or body pierce during the healing process. 797 City of Lakeville " , ' * �-18-11 3-18-14 M. Living Quarters: No place licensed as a tattoo and/or body piercing establishment shall be used or occupied as living or sleeping quarters. (Ord. 596, sec. 1, 2-18-1997) . 3-18-12: SANCTIONS FOR LICENSE VIOLATIONS: A. The City Council may revoke the license or suspend the license for a violation of: 1. Any provision of this Chapter or any other local law governing the same activity during the license period. 2. Any criminal law during the license period which adversely affects the ability to honestly, safely, or lawfully conduct a tattooing and/or body piercing business. B. The City Council may, upon ten (10) days' written notice to the operator and following a public hearing, revoke the license or suspend the license if the licensee submitted false information or omitted material information In the license process required by this Chapter.
