PRESENT: Mayor John Olson, Councilmembers Robert Gundersen, Patti
Stalberger, Duane Berning and John Vetsch, City Administrator -Clerk Linda Goeb,
City Attorney Mike Couri and City Engineer Peter Carlson
Mayor Olson called the regular meeting of the Albertville City Council to
order.
The agenda was amended as follows:
• Add Piper Jaffrey representative to discuss financing the JPWB water
treatment plant
• Amend Item 4(a) to include approval of Check # 12062 in the amount of
$2,796.16 to Catellus Management
Berning made a motion to approve the agenda as amended. Vetsch seconded the
motion. All voted aye.
The minutes of the August 16, 1999, meeting were amended on Page 3,
Paragraph 5 to clarify that the sidewalks along Lachman Avenue to 57t' Street will be
installed at the developer's cost. Berning made a motion to approve the minutes of the
August 16, 1999, meeting as amended. Gundersen seconded the motion. Berning,
Olson, Gundersen and Vetsch voted aye. Stalberger abstained. The motion carried.
Mayor Olson asked if anyone present wished to address the Council under the
Citizen Forum portion of the agenda. No one wished to address the Council.
Stalberger made a motion to approve payment of Check No.'s 12118 - 12167
and Check No. 12062 as presented. Gundersen seconded the motion. All voted aye.
Stalberger made a motion to schedule a public hearing to consider a Business
Assistance/Subsidy Standards on Monday, October 4, 1999, at 7:00 PM. Gundersen
seconded the motion. All voted aye.
Stalberger made a motion to approve the WWTF Monthly Operations Report
for July 1999 as presented. Gundersen seconded the motion. All voted aye.
Stalberger made a motion to schedule the Truth in Taxation Hearing on
Wednesday, December 1, 1999, at 7:00 PM and the continuation hearing, if necessary,
on Wednesday, December 8, 1999, at 7:00 PM. Gundersen seconded the motion. All
voted aye.

Stalberger made a motion to approve the contract for the 1999 Audit Report
with Kern DeWenter Viere, Ltd. at a cost of $7,400. Gundersen seconded the motion.
All voted aye.
Stalberger made a motion to approve a reduction in the Letter of Credit for
Cedar Creek South 3rd Addition from $100,000 to $66,500. Gundersen seconded the
motion. All voted aye.
Stalberger made a motion to approve a minor variance for Paul Jocelyn to allow
a garage addition to be located fiver (5') feet from the property line. Gundersen
seconded the motion. All voted aye.
Vetsch made a motion to approve the Public Works Department Report as
presented. Stalberger seconded the motion. All voted aye.
City Engineer Carlson reported that 57`h Street is scheduled for curb and gutter
tomorrow and paving should be started by the end of next week. Nearly all the pipe
work has been installed along 62nd Street.
Carlson discussed whether the driveway and parking area at the wastewater
treatment plant should be paved when the plant is upgraded. He will get estimates on
the costs for the Council to consider at the next meeting.
Mayor Olson opened the public hearing to consider the vacation of a drainage
easement. The drainage ditch to be vacated was created and recorded in 1993 over
property which now has been platted as Psyk's 7d' Addition. The plat of Psyk's 7`h
Addition and an additional drainage easement, both completed and recorded in 1999,
created drainage easements basically over the same area covered by the 1993
easement.
Mayor Olson called for comment from the public. There was none.
Stalberger made a motion to close the public hearing at 7:18 PM. Berning
seconded the motion. All voted aye.
Vetsch made a motion to adopt RESOLUTION #1999-44 titled
RESOLUTION VACATING DRAINAGE EASEMENT. Stalberger seconded the
motion. All voted aye.

Keith MacDonald, representing Shingobee Builders, discussed with the Council
his concerns regarding the need for a concrete block walls around the bathroom areas
in the new fire hall. Although the block wall was shown in the bid specifications for
the project, MacDonald believes it is redundant and unnecessary to construct the walls
of concrete block and cover the block with ceramic tile. MacDonald also explained
that his subcontractor for the concrete tip -up panels is unable to provide sandblasted
panels as shown in the bid documents, but will provide exposed aggregate tip -up
panels instead. The cost of the exposed aggregate panels is approximately $5500
higher than the sandblasted panels.
Several members of the Fire Hall Building Committee were present and agreed
to meet separately with MacDonald and Duane Day to work out an agreeable solution
for the fire hall and return to the Council later to get final approval.
City Engineer Carlson reported that all bids for the County Road 19
improvements were higher than he had estimated. He has discussed the bid results
with JMJ personnel who indicated they wish to proceed with the bid award.
Gundersen made a motion to adopt RESOLUTION #1999-43 titled
RESOLUTION AWARDING CONTRACT FOR THE CSAH IMPROVEMENT
PROJECT. Stalberger seconded the motion. All voted aye.
Carlson reported on the Joint Powers Board TAC meeting. The engineers
agreed that the JPB would not be responsible for the cost of oversizing water mains
proposed for individual cities.
Vetsch made a motion directing the Planning Commission to schedule a public
hearing to consider an amendment to the subdivision ordinance requiring developers to
install sidewalks in developments in addition to paying the park dedication fee per lot.
The Commission should review street width requirements when? &onsidering the
sidewalk installation. Other minor zoning changes as recommended by staff will be
included for consideration at the public hearing. Gundersen seconded the motion. All
voted aye.
The Fire Hall Building Committee returned to the meeting and recommended
that the concrete block wall be replaced with steel studs and sheetrock. The wall will
be finished with ceramic tile. The committee also recommended approval of exposed
aggregate concrete panels at no additional cost to the City.

Stalberger made a motion to modify the fire hall plans to include a steel -
studded and sheetrocked bathroom walls and exposed aggregate concrete tip -up panels
as recommended by the Fire Hall Building Committee. Berning seconded the motion.
All voted aye.
George Eitelson of Piper Jaffrey explained that the City of St. Michael has
agreed to issue G.O. Water Revenue Bonds to finance the Joint Powers water
treatment plant. The reason for St. Michael to issue the bonds vs. having the Joint
Powers Board issue the bonds is to get a cheaper interest rate on the bonds. The City
of Albertville would be obligated to the City of St. Michael for $1.6 million, or
approximately 33%, of the total bond issuance. The City of Hanover would also be
obligated to St. Michael for a prorated portion of the bond, based on the percentage of
total services. The Council took no action on this issue.
Stalberger made a motion to approve the job description for the Maintenance
Worker II/Plant Operator position as presented. Gundersen seconded the motion. All
voted aye.
Gundersen made a motion to approve the employment advertisement for the
Maintenance Worker II/Plant Operator as amended and to authorize its publication.
Berning seconded the motion. All voted aye.
Berning made a motion to purchase Expanded Y2K Coverage from the LMCIT
at a cost of 3% of the city's annual liability premium. Olson seconded the motion.
Berning, Olson and Stalberger voted aye. Vetsch and Gundersen voted no. The
motion carried.
Gundersen made a motion to appoint Councilmembers Berning and Stalberger
to the committee to discuss joint issues with the City of Otsego_ representatives.
Vetsch seconded the motion. All voted aye.
Stalberger made a motion to approve the preliminary 2000 levy in the amount
of $886,217, consisting of $669,611 subject to levy limitations and $216,606 in special
levies. Berning seconded the motion. All voted aye.
City Administrator Goeb advised the Council that Otsego Tool & Engineering
may be seeking assistance in relocating within the City of Albertville. Staff will meet
with Russ Voght if needed.

salt shed.
•Public YgrU Albert Barthel is in the process of selling his house located
on 6& Street. When and if he does sell it, the City will be short three (3)
parking stalls for the maintenance vehicles (the one -ton pick-up, the new
water/wastewater department truck, and the plow truck) until the Fire
Department moves into their new building. Below are two options to
consider:
Option-1 is to rent a heated stall from Don's Bus Service that would house
these three (3) vehicles for about $2001month.

Option-2 is to squeeze the plow truck into our shop and each of the three (3)
maintenance workers drive a vehicle home until the Fire Hall on 57d' Street is
completed.
• Barthel Industrial Drive We have spent the summer hauling dirt and
regrading the ditch on the south side, working on it in when we had time.
Now it needs to be re -seeded and an erosion blanket laid down with the seed
to keep the seed from washing away. The total cost for this, if we do'it
ourselves, is about $1,200.

Dear Kelly:
Yesterday, you and I inspected the surfacing of the new tennis court and found numerous areas
why the surfacing has peeled away from the bituminous pavement. Where the surfacing has peeled
away from the bituminous, we found mulch material attached to the surfacing material. This mulch
material was used as part of the turf restoration portion of the project. Please inform your tennis
court stirfacing subcontractor of this problem. This is a warranty issue that needs to be corrected. The
City dafires to have a new tennis court with new surfacing. Laving a new tennis court with obvious
patching and repairs is unacceptable. Please keep this in mind when discussing the problem with
your subcontractor.

It has come to my attention the select gramilw borrow used for the tennis courts will exceed the bid
guaotityGranulm borrow is typically bid me of two ways, either as a placed volume or as a loose
volume. Placed volume is mopused by multiplying the length times the width times the depth of the fill
area. Loose volume accounts for compaction of die granular barrow and is computed the same as placed
volume and then multiplied by a compaction bow, typically 1.3.
Tha bid proposal was sat up as lase volmne, however, the bid quantity, 1400 cubic yards, was computed
as a placed volume. The tennis coed an 114' wide by 108' long and the granular borrow is Y thick. If
you mulitpiy diese dimensions out aid then divide by 27 you get 1368 cubic yards. I rounded this up to
1400 cubic
If the bid was set up as &placed volume, we would have received a higher bid wait price from the
conuutor. By comparison, die select pranular borrow for CSAH 19 was bid as a placed volume:. The
unit price bid was $9.00 per cubic yard. The bid received for the tennis courts was $6.98 per cubic yard.
The differonce in to two bids is 30%.
Please place this issue on the next Council agenda so that I may discuss this discrepancy with the City
Council.

Dear Ms. Goeb:
We are providing this letter as our proposal for analyzing the benefit of a full diamond interchange
for I-94 at Wright County Highway 19. The interchange currently has a westbound entrance tamp
and an eastbound exit ramp. The study would look at the benefit of adding the eastbound entrance
ramp and the westbound exit ramp.
Five interchanges will be included in the study. These are the intersections of Highway 37 and the
I-94 north ramps, Highway 37 and the I 94 south ramps, Highway 19 and Highway 37, Highway 19
and the I-94 north ramp, and Highway 19 and the I-94 south ramp. Following is our work plan to
provide the City with this analysis,
Work Plan
1. Review prior traffic studies done in the vicinity of the interchange.
2. Reroute the year 2000 P.M. Peak Hour turning movement traffic volumes (from the Minneapolis
Factory Shoppes study) which would use the proposed ramps of the interchange.
3. Evaluate the traffic operations of five intersections with the year 2000 P.M. Peak Hour turning
movement traffic volumes and the existing interchange.
4. Evaluate the traffic operations of five intersections with the rerouted year 2000 P.M. Peak Hour
turning movement traffic volumes and the proposed changes to the interchange.
5. Analyze the benefits of the proposed ramp changes to the interchange.
6. A letter report of our analysis and findings will be prepared for the City.

completion in three weeks. If any meetings are required, our attendance will be billed as an
additional service.

We estimate the cost of the services outlined in our Work Program at $3,000.

Dear Mr. Carlson:
This last week, the pedestrian trail was placed through the project. In addition, the final lift was
placed over 4 weeks ago. Per die development agreement for Cedar Creek South, this concludes
our municipal obligations for surety. Please process a reduction from $24,000 to the final
warranty dumber. All infrastructure has been in place for over one year. The surety for this -phase
covered 11 hots and pipe to the clubhouse and Townhome s, all water quality ponds and the golf
course.
As we discussed, Kenco requested Pilot to amend the construction of an 8' bituminous path to a 5'
concrete pate to better blend with the number of concrete driveways. The 5' path will always be
able to maintain its width, whereas the bituminous path will have some edge erosion ion over tints. In
addition, this cost was within 10% of the asphalt cast for frill park dedication credit: we agreed
that this created a more desirable look for the project.

ORDINANCE # 1999-6
AN ORDINANCE AMENDING ORDINANCE NO.
1982-1
The City Council of the City of Albertville ordains:
Ordinance # 1982-1 titled AN ORDINANCE PROHIBITING HUNTING AND
DISCHARGE OF FIREARMS WITH THE CITY LIMITS is amended by deleting
the strikethrough text and adding the text in italics.
Section 1. Prohibition Against Hunting: No persons shall hunt, take,
capture, shoot or trap any animals or birds within the corporate limits of
Albertville, unless excepted from this ordinance within Section 3.
Section 2. Prohibition Against Discharge of Firearms. €-meept-€ef the
pese-of hunting -within the area designated in Sec4ien-3 herein,, No person,
except a police officer in the performance of duty, shall, within the City, discharge
any gun, pistol, or firearm of any description or carry any such weapon, unless it is
dismounted or broken apart, or carried in a case in such manner that it cannot be
discharged. This section does not prevent the carrying of a hand gun within the
City under a permit subject to the restrictions imposed by law.
Section 3. Exce tions. The City Council or the Chief Security Officer of
the City may specifically authorize any person or persons to destroy diseased,
injured or dangerous birds, animals or reptiles.
Section 4, Violation. Violation of this ordinance shall be punishable as a
misdemeanor.
Section S. Effective Date. This ordinance shall be in full force and effective
immediately following its passage and publication.
ADOPTED BY THE CITY COUNCIL OF THE CITY OF ALBERTVILLE
