1. Call to Order. The regular meeting of the Joint Powers Water Board was called to
order by Chairperson Olson, on Monday, February 24, 2025 at 6:05 p.m. at the Joint Powers
Water Board Water Treatment Plant, 11100 50"" St NE, Albertville, MN 55301.
Board present: Mike Amery, Gretchen Barrett, Joe Hagerty, Rob Olson, Zach Schoen, Bob
Zagorski.
Board absent: None.
Staff present: John Seifert, General Manager; Jennifer Thomas, Office Manager.
Staff absent: Dustin Carlson, Water Department Supervisor / Facilities Manager.
Engineering present: Chris Larson, Short Elliott Hendrickson, Inc. (SEH).
Engineering absent: None.
City Administrator present: Adam Nafstad (City of Albertville).
2. Approve Agenda. Hagerty moved, Amery seconded, to adopt the Agenda as
presented. Motion carried 6-0.
3. Approve Consent Agenda. Barrett moved, Zagorski seconded, to approve the
Consent Agenda below. Motion carried 5-1 on 3.1 (Amery abstained from approving
Minutes due to absence) and 6-1 on 3.2 - 3.5 below.

5. Engineer.
5.1 SCADA Improvements Project. General Manager Seifert and Engineer Larson
have reported that Short Elliott Hendrickson contacted three qualified bidders
via written communication, inviting them to a pre -bid meeting at the Joint
Powers Water Board offices. All three bidders confirmed they received Bidding
Document Addendum Number 1, which addressed questions from the pre -bid
meeting. During the public bid opening on February 6, 2025, only one bid was
submitted by In Control, Inc. ($561,626). Following the bid opening, the two
non -responsive bidders provided the following explanations: One bidder cited
confusion about the bid date, believing it was the 26th instead of the 6th. The
other bidder reported difficulties in securing bonding in time to qualify as an
eligible prime contractor. Based on these findings, staff recommends accepting

the bid from In Control, Inc. ($581,626) for the SCADA Improvements Project.
Zagorski moved, Hagerty seconded, to accept In Control, Inc.'s bid of $581,626
for the SCADA Improvements Project. Motion carried 6-0.
5.2 Final GSR Design Sizing Recommendation. General Manager Seifert and
Engineer Larson reviewed the Joint Powers Water Board's existing water storage
capacities and locations. They also discussed the necessity for increased storage
to accommodate ongoing development and growth in the area. The current
ground storage reservoir (GSR) project includes budget evaluations for adding a
3 MG ($6.7M), 4MG ($7.5M), or 5MG ($8.OM) GSR. The Board discussed the
storage needs and the types of storage options available (tower versus GSR).
To avoid the need for additional planning shortly after the current GSR project is
finished, and given the relatively low additional cost, Staff recommends
constructing a 5MG GSR at a cost of $8.OM. Schoen moved, Zagorski seconded,
to approve the construction of a 5MG GSR at a cost of $8.OM. Motion carried 6-
0.
6. Operations.
6.1 2025 — Well # 2 VFD Replacement. During the investigation into the
operational issues of Well No. 2, General Manager Seifert informed the Board of
a critical failure in the well's Variable Frequency Drive (VFD), necessitating its
replacement. Staff, in collaboration with Joint Powers VFD contractor and
electrician, confirmed the failure of internal components. Given the age of the
current unit, replacement parts are either unavailable or priced unreasonably.
Staff secured two bids for the replacement of the Well No. 2 VFD: Malloy Electric
($10,239.54) and Ideal Services ($11,134.00). Staff recommends accepting the
bid from Malloy Electric for $10,239.54 to replace the VFD. Amery moved,
Barrett seconded, to approve the acceptance of Malloy Electric's bid
($10,239.54) for the replacement of the VFD for Well #2. Motion carried 6-0.
7. Other Business / Announcements / Correspondence.
7.1 Minnesota DNR Payment for Water Conservation Annual Permit. The
Board previously authorized Staff to approve payment of up to $25,000 for its
Minnesota DNR Water Conservation Annual Permit. The actual cost of filing was
$19,025.81.
8. Adjourn. Zagorski moved, Amery seconded, to adjourn the Joint Powers Water
Board meeting at 6:44 p.m. Motion carried 6-0.

Joint Powers effectively produced 72,529,000 gallons of water in the report month. All bacteriological samples were negative. The
average fluoride concentration was 0.72 mg/L (Limits are 0.5 & 0.9). The total production to the distribution system was 71.829,400
gallons and actual consumer use was 55.131,400 gallons, an average daily amount of 1.97 million gallons per day.

COMMENTS:
The 2025 ASR cycle began on November 26th, 2024 with the injection phase. Test well 6 and ASR
well 9 were Flushed to waste and background testing & sampling was performed on both wells and
the injection source, the Joint Powers distribution system, before injection was begun.

Attached is a recommendation letter from the engineer of record Ursinio Puga With AE2S.
Along with a recommendation to accept the project as complete the contractor has supplied
necessary surety release, lien waivers and state required tax certification. Forthis reason,
the engineer is recommending release of the final retainage as demonstrated on the final
pay application. The final installed project quantities were slightly less than the initial bid
package and therefore the project was slightly under budget by the amount documented on
the pay application.
Recommended Motion:
Authorize final payment and release of retainage forthe JPWB ASR / 15th Street Watermain
Looping Project and accept the project as a completed asset.

This letter is to document that Minger Construction Companies, Inc. (Minger) has submitted the
necessary closeout documents and that AUS has found them to be in compliance with the
requirements of the Contract. In accordance with the Engineers Joint Contract Documents
Committee (EJCDC) General Conditions of the Contract Article 15.06.C, let this letter serve as
Notice of Acceptability of the Work.
Attached please find the signed Pay Application No. 4 (Final) along with the documents listed
below in compliance with the closeout procedures.
1. Operations Manuals (valves);
2. Record Drawings;
3. Certificate showing that Contractor has complied with the provisions of Minnesota
Statutes 290.92 requiring withholding of state income tax on wages (IC 134 forms);
4. Evidence in the form of an affidavit that all claims against the Contractor by reasons of
the Contract have been fully paid or satisfactory secured (lien waivers); and
5. Consent of surety to final payment certification from the Contractor's surety.
At this time, AE2S recommends proceeding with final payment to Minger. In accordance with SC-
15.08, the correction period length for this Contract shall be 2 years. As noted in Article 6.01.A of
the General Conditions, Performance, Payment, and other Bonds shall remain in effect until
completion of the correction period. Subject to Article 15.07 of the General Conditions, by making
final payment, Owner waives its claim or right to liquidated damages or other damages for late
completion by Minger, except as set forth in an outstanding Claim, appeal under the provisions
of Article 17, set-off, or express reservation of rights by Owner. Owner reserves all other claims
or rights after final payment.

Update on Water Treatment Plant Upgrade Project
Feasibilty Report Received from HR Green's Scope of Work
Mark Hardie with HR Green supplied the updated and completed feasibility report under the current
scope of services started in 2024. This feasibility report has provided water quality, treatment
methods considered and construction estimates for the proposed sizing of the Joint Powers Water
Board water treatment plant upgrade improvements.
As noted in the report, a significant level of manganese will need to be removed with this treatment
plant upgrade to meet the current health standards set by the Minnesota Department of Health.
The selected method in the report referenced by HR Green is to expand the plants treatment
capacity to meet current needs by use of additional pressure filters. In addition to the pressure
filters the report recommends improving the solids handling and backwash water recycling to meet
future water demands.
The 2024 construction estimate is $19,660,000. In updating the annual financial management plan,
Abdo has utilized an ENR index inflation rate for construction costs of 3%. This would equate to a
total budget estimate for the construction year of 2026 with construction, engineering and finance at
$21,218,000. Attached is the full feasibility report from HR Green.
Federal Congressional Spending Request
As part of the ongoing effort to secure additional funding for the water treatment plant upgrades,
the Board had previously directed efforts by staff and contract engineering to solicit timely
applications for federal and state funding. Recently the 6th District Federal Representative, Tom
Emmer, opened the 2026 fiscal year congressional spending request. The application was due prior
to the Board's monthly meeting on March 131h. Staff worked with the three member City TAC
members to update the congressional spending request based on the direction from Representative
Emmer's office. The portal submission was entered and confirmed to be received by Representative
Emmer, along with letters of support from the member Cities for this effort.

Once submitted as a collective community funded project for Representative Emmer, the
appropriations package for fiscal year 2026 will need to become legislation before any confirmation
of funding levels for the Joint Powers project can be secured. Staff will continue to work with
Representative Emmer's office on any follow up request for information on the project. In addition
Senator Klobuchar has notified that she will be accepting federal funding requests and staff is
working to apply for funding by March 33st.
State Bonding Bill HFIS41(Hudson)
As part of the LMC City Day on the Hill, area member City Administrators were able to make contact
with our representatives. As part of the conversation, Representatives Walter Hudson and Eric
Lucero requested information on any potential bonding projects. As part of a state bonding request,
Representative Hudson applied to House File 1541 which received a hearing on March 13th at 10:15
AM at the State Capitol. Staff and City Administrators had an opportunity to provide testimony for
the need of bonding funds for the JPWB water plant upgrades. The attached handout was made
available to all members in the Capitol Investment Subcommittee. The Committee had some good
follow up questions and the proposal was well received. Attached are pictures from that hearing.

Since 1977, the collective community served by Joint Powers has benefited from the efficiency in the
partnership providing adequate production, storage, and distribution of municipal drinking water for the
developing communities. The following is chronological fist of the Joint Powers collective success.
• 1978 - Completed the installation of a large diameter watermain trunk from Albertville through St Michael
to the southern limits of Hanover along with ground storage reservoir.
• 1989 to 2004 - Drilled 7 supply wells to provide water to the Cities.
• 1999 - Constructed first water treatment plant to supply treated water to the three communities.
• 2001 and 2005 - Constructed two elevated storage facilities.
• 2012 - Start-up of the first and only Aquifer Storage and Recovery facility in the State of Minnesota.
• 2022 - Rehab water treatment plant.
• 2025 - Start of construction on new 5 MG ground storage reservoir.
As demonstrated by the success of delivering, operating, and maintaining adequate production, storage,
and distribution, the Joint Powers agreement that benefits the three communities has shown its worth. The
challenge remains the treatment of the emerging contaminates found in the water supply. To this end, the
JPWB is requesting assistance in delivering this large critical infrastructure project. The following is a
projected timeline based on recent feasibility and preliminary design.
• 2021 - Purchased property expansion sufficient for treatment plant upgrade.
• 2023 - Updated capital improvements plan to account for the three communities utility service area.
• 2024 - Completed feasibility report for water plant upgrades that are needed.
• 2025 to 2026 - Secure funding and final design to proceed with construction commencement.
• 2027 - Goal of treatment plant start-up.
The emerging contaminates as identified have increased the dependence on water treatment to adequately
maintain safe drinking water standards. In 2018, the Minnesota Department of Health tested Joint Powers
Water Board's raw water manganese levels as part of the U.S. EPA Fourth Unregulated Contaminant
Monitoring Rule (UCMR4). This testing revealed that all seven municipal wells exceeded the maximum
recommended manganese levels for infants under one year of age, children, and adults. These wells have
been found to have manganese levels ranging from the lowest at 450 ug/L to the highest at 1500 ug/L,
giving us a system average of 900 ug/L.
• Currently, MDH has established the following Health Risk Limits (HRL)
0 100 ug/L for infants under 1 year of age
JPWB source water manganese at 1500 ug/L (15x the HRL)
0 300 ug/L for over the age of 1 (children and adults)
D JPWB source water manganese at 1500 ug/L (5x the HRL)
With your assistance, we can make the safe drinking water supply for the three communities served by
Joint Powers Water to be well below the manganese level of 100 ug/L. We appreciate your consideration
on this important project that will help assure we are providing safe drinking water to all of our
residents.

As part of the January TAC meeting, the 2025 Project Updates were identified for work
products throughout the upcoming year. As part of the Treatment Plant upgrade scope, floor
coatings, carpet replacement and furnishing updates were identified for the second quarter
of 2025. Staff has sourced an opportunity to acquire office cubicles for a greatly reduced
rate. The attached drawing and pictures demonstrate the proposed layout with flexible
arrangements for the office areas. The pricing provided for the used equipment would be
$900 per cubicle including electric standup desks and an additional $300 per cubicle for
delivery and installation fee for a total of $1,200 material and installation for each cubicle.
Recommended Motion:

The purpose of this memo is to request the authorization of the Joint Powers Water Board to proceed with
the advertisement and bidding for Ground Storage Reservoir and Pump Station project. Plans for this
project are included in the packet.
The Joint Powers water system needs additional storage. This project will add 5 million gallons of ground
storage at the ASR property on 15"l St. NE in St. Michael. The storage tank will be a 140-foot diameter,
45-foot tall, prestressed wire -wound concrete tank. The project will also include 3 submersible booster
pumps and a standby generator. The project will add fire flow and redundancy to the south side of the
water system.
The Engineer's Estimate for this project is $8,100,000. We request that the Board authorize the
advertisement and bidding of this project.
