RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLAT FOR A MINOR
SUBDIVISION TO BE KNOWN AS FIELD PLAZA SECOND ADDITION, LOCATED
AT THE CORNER OF CSAH 37 AND 601h STREET NE, WITHIN THE CITY OF
ALBERTVILLE
WHEREAS, Blaine Rentals has submitted a preliminary and final plat and
easement agreement for the subdivision of a site legally described as follows; and
Lot 1, Block 1 of Field Plaza
WHEREAS, City staff has reviewed submitted plans and prepared a planning
report dated January 3, 2007; and
WHEREAS, the Albertville Planning Commission met and held a public hearing
on January 9, 2007 to consider the Field Plaza Second Addition application; and
WHEREAS, upon review of the staff reports and hearing public testimony, the
Planning Commission closed the public hearing and recommended that the City Council
approve the application for preliminary and final plat with the condition outlined in the
January 3, 2007 planning report and with additional conditions recommended by the
Planning Commission; and
WHEREAS, the Albertville City Council has received the Blaine Rentals
application, staff review documents, including the memo of Bolton & Menk, Inc., dated
February 23, 2007, and the Planning Commission recommendation.
NOW, THEREFORE BE IT RESOLVED, that the City Council of Albertville,
Minnesota hereby approves the Preliminary and Final Plat, subject to the attached
Findings of Facts and Decisions.
Findings of Fact: Based on review of the evidence received, the City Council now
makes the following finding of fact and decision:
A. The site is legally described as Lot 1, Block 1 of Field Plaza.
B. The planning report dated January 3, 2007 from Northwest Associated
Consultants is incorporated herein.
C. The site will be platted as Lot 1, Block 1 of Field Plaza Second Addition.
D. With the exception of road access, the proposed lot can be accommodated with
existing public services and will not overburden the City's service capacity.
E. The existing 601h Street bordering the proposed Lot 1, Block 2 of Field Plaza
Second Addition has a road surface width of 24 feet, the existing pavement
shows sever/signs of distress and has failed to the point where the road cannot
support an overlay but will need to be reconstructed, and the soils beneath the
pavement surface are believed to be unstable.
F. The existing 60th Street bordering the proposed Lot 1, Block 2 of Field Plaza
Second Addition is too narrow, the pavement is not in sufficient condition and
the subsurface soils are believed to be too unstable to support -traffic that a
second deve ope commercial building on the plat would need.
G. Without the improvement of 601h Street abutting the proposed Lot 1, Block 2 of
Field Plaza Second Addition, the proposed plat would be premature.
H. The requirements of the Albertville Zoning Ordinance have been reviewed in
relation to the proposed subdivision.
The proposed actions have been considered in relation to the specific policies
and provisions of and have been found to be consistent with the
Comprehensive Plan.
J. The proposed subdivision conforms to applicable Zoning Ordinance and
Subdivision Ordinance performance standards, except as noted in these
findings above.
K. The proposed subdivision will not tend to or actually depreciate the area in
which it is proposed.
Decision: Based on the foregoing information and applicable ordinances, the City
Council APPROVES the Preliminary and Final Plat based on the most current plans
dated September 15, 2006 and revised November 9, 2006, and information received to
date subject to the following condition:
1. The applicant shall enter into a development agreement with the City of
Albertville as approved by the City Council at its March 5, 2007 meeting.
2. Developer shall reconstruct 60th street to a 7-ton roadway with a minimum
pavement width of 28 feet, said improvement to run from the east end of the plat
to the western edge of the proposed plat and be consistent with the design
criteria set out in the "City Standard Detail Plates."
Adopted by the Albertville City Council this 5th day of February, 2007.
