PUBLIC HEARING 52ND STREET NE IMPROVEMENTS Mayor Peterson opened the public hearing at 7:08 p.m. Assistant City Engineer Nafstad reported that Resolution No. 2006-13 was approved on Monday, April 3, 2006 Accepting the Feasibility Study for Municipal Improvements proposed in the Barthel Industrial Park Development within the City of Albertville and to hold a public hearing for said improvements to be held on Monday, May 1, 2006 at 7:00 p.m. or soon thereafter at City Hall located at 5975 Main Avenue NE. The area pro osed to be special assessed for the cost of such improvements are the properties abutting 52' Street NE from approximately 500-feet east of Barthel Industrial Drive NE to Marlowe Avenue NE. The estimated cost of the improvement is $1,067,366. A reasonable estimate of the impact of the assessment will be available at the hearing. Such persons as desire • to be heard with reference to the proposed improvement will be heard at this meeting. 0 0 • City Administrator Kruse brought to the Council's attention this is a City Project; therefore, we would be assessing the cost to the City. Kruse has contacted the Financial Advisor Paul Donna regarding the potential of bonding such a project. Mayor Peterson closed the public hearing at 7:15 p.m. MOTION BY Council member Beming, seconded by Council member Klecker to approve the Public Hearing Assessment for 52" d Street NE Improvement Project. Motion carried unanimously. DEPARTMENT BUSINESS PUBLIC WORKS DEPARTMENT Request for Council Action to Approve the Purchase of new Playground Equipment and a 12- foot Gazebo for the Four Seasons Park within Albertville at a cost not to exceed $45 159 with funds from Park Dedication fees Public Works Supervisor Guimont reported that the Parks and Recreation Committee reviewed the status of the Four Seasons Park. The committee recommends updating the playground equipment to meet the Minnesota Safety Standards. Included with the playground equipment, they suggested installing a 12-foot gazebo, also. MOTION BY Council member Fay, seconded by Council member Klecker to approve the purchase of new playground equipment and a 12-foot gazebo for the Four Seasons Park within the Albertville city limits at a cost not to exceed $45,159 using Park Dedication funds. Motion carried unanimously. Request for Council Action to Approve Contract with Allied Blacktop Company to do the Crack filling Project throughout various streets within Albertville at a cost not to exceed $4.900 with funds from Streets Maintenance and Repair PW Supervisor Guimont stated that at the April 17, 2006 Council meeting he discussed contracting for crack filling on various streets throughout Albertville. Guimont contacted a number of companies and received one quote from Allied Blacktop Company in the amount of $4,900. Staff recommends contracting with Allied Blacktop Company to do some of the crack filling in Albertville at a cost not to exceed $4,900. MOTION BY Council member Berning, seconded by Council member Klecker to approve contracting with Allied Blacktop Company to conduct the crack filling project throughout Albertville on various streets at a cost not to exceed $4,900 using Streets Maintenance and Repair funds. Motion carried unanimously. 5 FINANCE DEPARTMENT • Monthly Accounts Receivable Update Finance Director Lannes reviewed the outstanding receivables with the Council and asked if there were any questions. Project Status Update Finance Director Lannes updated the Council on the status of outstanding or ongoing projects throughout Albertville. Again, Lannes asked if the Council had any questions regarding the report. PLANNING AND ZONING Zoning Ordinance Amendment — Model Homes City Planner Brixius reported that during development approval process, it is reviewed and approved for Model Homes. Staff feels there is a need to create greater stipulations to the approval of model homes to maintain a higher quality. Staff believes that model homes may still be approved as part of a subdivision; however, higher provisions need to be established. MOTION BY Council member Vetsch, seconded by Council member Fay to approve Ordinance No. 2006-07 entitled an Ordinance Amending Section 2200.0 Relating to Model Homes. Motion carried unanimously. ENGINEERING Albert Villas Flood Mitigation Assistant City Engineer Nafstad stated that based on the request, Bolton & Menk, Inc. prepared an estimate to a preliminary engineering report for a phased flood mitigation project to the west of the Albert Villas Development. Included in the proposal, staff will identify the total mitigation needs of the Albert Villas Development and a possible Phase 1 mitigation improvement with an approximate construction cost of $1,000,000. This will utilize the proposed high school site as a location to dispose of material and keep earthwork costs at a minimum, which may not be an option after the Spring of 2006. MOTION BY Council member Fay, seconded by Council member Klecker to approve payment of the engineering fee for preparing the report and presenting it to the City Council at a cost not to exceed $5,700 with Storm water Funds. Motion carried unanimously. I-94 Ramp Council member Vetsch inquired about the I-94 proposed ramp with the City of Otsego. Vetsch had concerns about the ability to bind the agreement with future Councils. • Lachman Avenue NE (between 571h Street NE to 60th Street NE) Council member Vetsch questioned the possibility to construct a low bridge for a portion of the construction from 57th Street NE to 601h Street NE of Lachman Avenue NE. The wetlands appear to be a problem for the construction of Lachman Avenue NE. • • City Engineer Kasma reported that the cost to construct a low bridge for a small section of Lachman Avenue NE would be approximately three times what Bolton & Menk, Inc. is estimating. City Clerk City Clerk Miller brought to the Council's attention regarding Friendly City Days playoff, which St. Michael has accepted the challenge. St. Michael would like to know what the rules or regulations for the 3-inning softball tournament will be. Council recommended changing it from a 3-inning game to a 1-inning plus game, where one team of nine (9) players each bat once, then switch places to allow the other team of nine (9) players each to bat once. CITY ADMINISTRATOR Burlington Northern Railroad Appraisal — Purchase Agreement City Administrator Kruse presented the Railroad Property appraisal looking for direction from the City Council. Council members would like to hold off on the Purchase Agreement at this time. Jim Franklin Propertv City Administrator Kruse brought to the Council's attention the hardship Mr. Franklin is having selling his property. Mr. Franklin has had a number of potential business owners interested in remodeling. The exception to bring it up to code, would be to hook up to City sewer and water. MOTION BY Council member Klecker, seconded by Council member Berning to accept the Agreement Relating to Cost of Utility Installation. Motion carried unanimously. St. Albert's Parish Festival Council member Berning informed the Council that he was notified by a Festival Committee member asking for approval to block off Lander Avenue NE from 57t Street NE to Gordy Berning's driveway. MOTION BY Mayor Peterson, seconded by Council member Vetsch to approve blocking off Lander Avenue NE from 57th Street NE to Mr. Berning's driveway located at 5794 Lander Avenue NE, during the St. Albert's Parish Festival to be held on July 16, 2006. Motion carried unanimously. • 7 LEGAL • Closed Session to discuss Edina Development litigation Mayor Peterson closed the City Council meeting at 7:58 p.m. to discuss the litigation between the City of Albertville and Edina Development. Mayor Peterson reconvened the regular City Council meeting at 8:27 p.m. MOTION BY Mayor Peterson, seconded by Council member Berning to proceed with the Edina Development Litigation. Motion carried unanimously. ADJOURNMENT MOTION BY Council member Klecker, seconded by Council member Fay to adjourn at 8:46 p.m. Motion carried unanimously. • 0 AIbertville ALBERTVILLE CITY COUNCIL BOARD OF REVIEW MINUTES May 3, 2006 Albertville City Hall 6:30 PM PRESENT: Mayor Don Peterson, Council members Tom Fay, Ron Klecker, LeRoy Berning and John Vetch and City Administrator Larry Kruse. Absent: None Present from the Wright County Assessor's Office: County Senior Assessor Tony Rasmuson and City Assessor Wally Peterson. The County Assessor's office shared the following information: CITY OF ALBERTVILLE 2006 ASSESSMENT There were 151 sales that were used in Minnesota Department of Revenue Sales Ratio Study conducted from October 1, 2004 to September 30, 2005. The State study indicated that the median sales price for a home in Albertville was $218,500 compared to $206,797 a year ago. This was about an eleven percent increase. If you divided the Estimated Market Value by the Actual Sales Price, the Median Sales Ratio for the City of Albertville was 90.34 percent with a coefficient of dispersion of 5.63. State law requires that this ratio must be between 90 and 105%. The state wants us at 100% of value. After reappraising a portion of the property in the City of Albertville and making adjustments to the remaining property, the total value increase for residential property is approximately 5.86% percent. (Area reappraised Plats 17, 20, 24, 29, 30, 36, 40, 41, 42, 48, & 50.) The increase brought the cities sales ratio to approximately 97.07 percent. The current sales study being conducted from October 1, 2005 to Present indicates 41 sales and the ratio is at 92.42%. The average residential property received an increase of 0 to 8,000 on the land and approximately three and one half percent on the buildings. E Commercial property values increased approximately 7.59% on average. • Agricultural property within the city limits increased approximately 21.25 percent. Ag property is currently valued from $40,000 per acre to $174,000 per acre. There were 943 permits issued for the city of Albertville. 134 of which were for single or multi- family dwellings. There were also 9 new commercial industrial buildings in 2005. Residential new construction amounted to $22,380,500, and Commercial came in at $9,593,900. We are here tonight to discuss the 2006 assessment for taxes due and payable in 2007. The board does not have the authority to open prior year's assessments for taxes due and payable for 2006. Any questions or comments, if not, we will start with the first appointment. Some Council members stated it is very difficult for existing family businesses to continue to survive with huge increases in property tax values. Kruse, City Administrator RE: General Update I-94 INTERCHANGE PROJECT/COUNTY FUNDING: City Engineer Adam Nafstad and I visited with Wright County Engineer Wayne Fingalson about funding for the I-94 Interchange. If the Interchange Project does not happen in the near future, our professional consultants have stated CSAH 37 will begin to have serious traffic problems. I suggested to Mr. Fingalson that it would seem to make sense that Wright County invest a couple million into the I-94 Project to insure it happens, rather than have the pending liability of improving CSAH 37 to handle increased volumes of traffic. Acquisition of businesses along the way, partial and full takings, would be very expensive. Staff requests permission to approach the Wright County Board at an upcoming County Transportation Committee meeting and inform them of the pending situation. Mr. Fingalson stated that the County Board may baulk at a financial contribution; however, if it is the most cost effective route, it may be prudent to present it to them. Tentatively, we will have an opportunity to present this to the County Board on Thursday, May 25 or Friday, June 2. Staff looks forward to some feedback from the City Council regarding this matter. CSAH 19 NORTH PROJECT: Albertville staff has been working with Otsego staff on Boarder Road Agreements. CSAH 19 North is a joint project in which both Albertville and Otsego would complete the project in advance of the County funding their share. In other words, the two cities would provide interim financing for the County. Albertville staff would like to formally approach the Wright County Board to inform and get their support for the project. This would likely happen at the upcoming Wright County Transportation meeting scheduled for Thursday, May 25 or Friday, June 2. Staff would like some feedback from the Council about formally approaching Wright County on this matter. CSAH 19 SOUTH PROJECT: Albertville staff has met with the Wright County Highway Department and St. Michael about the 2007 Albertville CSAH 19 South Improvement Project and the 2008 St. Michael CSAH 19 North Improvement Project. A concept plan was reviewed and discussed. It was agreed that the Concept Plan for the entire 2007 and 2008 Project would be reviewed at the Wednesday, May 31 33 joint meeting with the school. This will give both cities the opportunity to review the project and • listen to each other's concern. CITY HALL: Staff will be reviewing a Concept Plan for the parking lot south of City Hall at the Tuesday, May 16 Consultant staff meeting. We anticipate being able to share a concept with the City Council at the first meeting in June. COMMUNITY SERVICE OFFICER: I hear more and more a need for increased enforcement of the Albertville City Code - Zoning Ordinances relating to general nuisances such as: uncovered dumpsters, illegal signs, unsightly garbage and or junk, unlicensed cars, long grass and or weeds, and much more. Although we try to do our best to respond to complaints, we do lack personnel time to pursue these issues. To successfully enforce these issues requires a trained employee with good human relation skills and adequate time to `bird dog' the non-compliance. Proper procedures must be followed and timelines tracked to insure due process is followed. Albertville has a very limited staff right now, so when I send an employee to focus on some of these issues or complaints, other important things go undone. St. Michael for example, has a full time person that focuses on these issues, whereas Albertville uses existing staff and sometimes our consulting attorney, planner and engineer to respond to complaints. I've talked to the Wright County Sheriff's Department about them hiring a Community Service Officer who might be shared amongst several communities. Perhaps we could use someone for 12 hours per week. I mentioned this to Otsego City Administrator Mike Robertson and his initial thoughts were that the idea had merit. Please think about how important these issues are to you and if you are willing to apply additional resources. 34 •AIbcrtville REQUEST FOR COUNCIL ACTION DATE: May 12, 2006 TO: City Council FROM: Larry R. Kruse, City Administrator RE: I-94 Albertville/Otsego Special Funding Legislation I-94 Interchange Funding BACKGROUND: I visited with Otsego City Administrator Mike Robertson and presented the concept of Otsego investing funds in the CSAH 19/37 I-94 project and at some point in the future Albertville • investing a similar amount in the Kadler Avenue NE Interchange. Mr. Robertson found the concept intriguing. We discussed how we could execute an agreement, which would be binding on the future council years from now. In most cases current Minnesota law does not allow the current council bind future councils other than through department instruments. In doing some research it appears the only way to accomplish a collaborative effort like this is to have the Legislature pass Special Legislation specifically authorizing it. I have been in contact with both Senator Koch and Representative Emmer requesting their assistance in evaluating this concept. Dave Kennedy, of Kennedy and Graven has stated their firm could develop the draft language for the bill, which we can then use as a tool to see if we can reach agreement with Otsego on their contribution. Dave Kennedy stated the language need not be complex and can be accomplished with minimal effort. Existing Parcels A and B are zoned B-2, Limited Business District. The B-2 • District allows for medical clinics and office buildings. Parcel C is currently zoning R-1A, Residential Low Density Single Family District. Parcel C (Exhibit A) will be rezoned to B-2 to match the other two parcels. The applicant has been working with the City to rezoning this property, and feels that rezoning this parcel is a great fit to complete this corner of the City. Preliminary Plat. (Exhibit B) The preliminary plat illustrates that the three existing parcels will be platted into two lots and two outlots. Outlot A will be a 4,747 square foot triangular parcel located northwest of the entrance drive off of CR 18. In the future Outlot A should be incorporated into the adjacent property to the west when development occurs. Outlot B is a 58,483 square foot parcel, whose future use for a commercial/office building and parking. Outlot B should be preliminary platted as Lot 3, due to the future use of this parcel. Outlot B meets all of the requirements of a Lot in the B-2 District. If this parcel remains Outlot B the applicant will need to apply for another preliminary plat when Building 3 is reviewed. Lot 1 is a 62,977 square foot parcel and Lot 2 is a 60,979 square foot parcel. The west property line of Lot 1 should be moved 30 feet to the west to accommodate the rear yard setback of Building 1. The 10 foot drainage and utility easement shall be placed around the entire site and five feet along interior property lines. Access to site will include a right -in -only drive off CR 19, and a full entrance from CR 18. Internal access off of City roads will be a full entrance at the corner of 51St Street NE and Kyler Avenue NE. Access to the site must be reviewed and approved by Wright County. The County is requiring a 70 foot right-of-way from the center line of CR 18 and CR 19; this right-of-way should approved by the County prior to construction. Final Plat. (Exhibit C) The final plat should show drainage and utility easements of 10 feet around the perimeter of the site and five feet along interior property lines. Outlot B may remain on the final plat for future replatting. The final plat shall also show the west property line of Lot 1 shifted 30 feet to the west to accommodate the rear yard setback of Building 1. A park dedication fee in the amount of $21,375.00 shall be made to the City of Albertville. 2.85 gross acres * $7,500 per acre = $21,375.00 Conditional Use Permit/Planned Unit Development (CUP/PUD). The CUP/PUD is proposed for this site as a an overlay of the B-2 District to allow for private street with cross easements for shared access within the site and shared parking. The medical clinic with be developed in two phases. Phase 1, which is the main focus of this report, includes the rezoning of Parcel C, on the west side of the site , from R-1 A to B-2; the platting of two lots and two outlots; the master site plan for the property; the VA site plan for Phase 1, and Building 1 (first story and second story). Although Building 2 • is an element of Phase 1, the building review will be separate from this review due to the applicants wait for a buyer. is Phase 2 would then include final platting Outlot B into Lot 3 with a third commercial/ office building and required parking proposed in Phase 1. Lot Requirements. The site will be platted into four parcels, two outlots and two lots. Outlot A will be a triangular lot of 4,747 square feet and remain vacant. The west property line should be moved 30 feet to the west to accommodate the rear yard setback of the B-2 District. Architectural Standards. The applicant has submitted colored elevations, one for the single story Building 1 and one for the two story Building 1. The building in both drawings is almost completely surfaced with faced brick. Details of the building include a rock faced concrete block base on three sides of the building, and strip of faced brick in a light tone above the windows. These building materials are compliant with the requirements of B-2 Architectural Standards. Buildings 2 and 3 (Exhibit F) should be composed of similar materials. Individual site and building plan reviews will be required for Buildings 2 and 3. Landscaping and Screening. The landscape plan shows a variety of the plants used in rows and in groupings across the site. The deciduous, evergreen, and ornamental trees are proposed at the proper size required by the Zoning Ordinance. The size of the low shrubs shall be increased to 24 inch plantings to meet the requirements of the ordinance. The larger sized shrubs are very important to screen the headlights of the parking lot from traffic on CR 18 and CR 19. Also low shrubs shall be planted west of Building 2 in front of the parking lot to provide screening of headlights from the street until the Future Addition has been built. The review of this landscape plan only covers Lot 1, Lot 2, and Outlot A. No landscaping has been proposed for Outlot B and Building 3; therefore, a landscape plan shall be submitted for Building 3 at the time of the site and building plan review. Vehicular Circulation and Cross Easements. Access to the site occurs at the right -in - only point along CR 18 and at a full entry/exit along CR 19. A full boulevard entrance also occurs along the north boundary of the site at the corner of 51 st Street NE and Kyler Avenue NE. A cross easement (Exhibit D) begins at the entrance off of CR 18 and follows the arcing drive to the northern entrance to allow for circulation between the site. A cross easement has also been established at the northwest corner of Lot 1 with the Shoppes of Prairie Run. All drive lanes are adequate for smooth vehicular and delivery circulation. Entrances off of CR 18 and CR 19 should be reviewed by the County. Parking. The master plan shows parking for the entire site. Total, Building 1 (as two stories), Building 2 (with addition) and Building 3 require 216 stalls. The applicants are proposing 224 stalls. Building 1 — (30,000 square feet * 10%)/200 + 3 = 138 stalls Building 2 — (10,000 square feet * 10%)/200 + 3 = 48 stalls Building 3 — (6,000 square feet * 10%) + 3 = 30 stalls Total = 216 stalls Phase 1, for Building 1 and Building 2, will require 186 stalls. Parking around the buildings includes 180 stalls with 12 more stalls shown in Outlot B to the north as proof - of -parking. We are requiring all 180 stalls be constructed with Building 1 and Building 2, and if there is need for extra parking before Phase 2 is complete than those 12 lots to the north should be constructed. Parking illustrated for Phase 1 and Phase 2 exceeds the requirements of the Zoning Ordinance. 0 9 • Pedestrian Circulation. Pedestrian circulation moves easily through the site and around the site. A trail runs to the east along Labeaux Avenue. This trail should be connected with the sidewalk to the north of Lot 1. The north sidewalk along 51st Street NE should be extended across the entrance drive with a cross walk to provide a safe and continuous path north of the site. Drainage, Gradinq and Utilities. Drainage, grading, and utility plan are subject to review and comment of the City Engineer (Exhibit R). Li htin . Sixteen lights have been proposed for Phase 1 of the site. These proposed lights will be 22 feet tall with 90 degree cutoffs. The foot candles along the right-of-way lines and property lines meet the maximum allowed by the Zoning Ordinance. A separate photometric plan shall be submitted for Phase 2. Si na e. Four ground signs and two building signs are proposed for the entire site. Two of the four ground signs are located on Lot 1, one is on Outlot A and the other is on Outlot B. Three of the four signs are located at the entry drives and the other is located at the corner of CR 18 and CR 19. The Zoning Ordinance for business signs permits one freestanding sign not to exceed 60 square feet per 100 feet of frontage width. The comprehensive sign plan is asking for less sign area but one more sign for Lot 1, which exceed to requirements (Exhibit L). In past CUP/PUD approvals of comprehensive sign plans, an extra freestanding sign has been allowed, therefore we will allow the extra free standing sign on Lot 1 under the conditions of the sign details. Sign details have been submitted for three of the four signs (Exhibit S). Corner of CR 19 & CR 18 Sign — Sign area 112 square feet for single face sign panel. The sign proposed for the corner of CR 19 and CR 18 shows too many tenant names for the sign to be legible. We recommend the number of tenant names be reduced and the text sized enlarged. Entrance from CR 18 and CR 19 Signs — Sign area 53 square feet per side of sign. The entrance from CR 19 sign is of adequate size for the site and will be located at each County road entrance. Internal Directional Monument — Sign Area 27 square feet per side of sign. The Internal Directional Monument will be locate at the entrance at the corner of 51St Street NE and Kyler Avenue NE. The materials of the ground sign match those used in the building and will fit nicely with the site. Further details of the building signs should be submitted to illustrate dimensions of the signs and will be reviewed as a separate sign permit. Under the PUD, building sign not exceeding 15% of the building face will be allowed on the front and rear of the buildings, • or the side in lieu of a rear building sign. 10 Trash Enclosures. Each building provides its own trash enclosure and adequate access to the enclosure. The colored elevations show the walls of the trash enclosure; however, no gate details are shown. Elevations of the gates are needed to ensure they • are of a sturdy, attractive material. Snow Storage. Snow storage shall be labeled on the site plan. RECOMMENDATION Rezoning Staff recommends approval of rezoning Parcel C of the St. Michael -Albertville Medical Clinic site, located on the west side of the site, from R-1A to B-2. Preliminary Plat Based upon the review of the submitted plans, we recommend approval of the St. Michael -Albertville Medical Clinic Preliminary Plat with the following conditions: 1. The applicant shall enter to a Development Agreement with the City. 2. The applicant shall seek approval from Wright County for the access points along CR18 and CR19. 3. Outlot B shall be changed to Lot 3 on the Preliminary Plat. 4. Drainage and utility easements shall be placed over all property lines. 5. The west property line of Lot 1 shall be shifted 30 feet to the west to accommodate the rear yard setback of Building 1. 6. Individual site and building plan reviews shall be required for Building 2 and Building 3. 7. Outlot B proof -of -parking for Phase 1, shall be paved if necessary before Phase 2 is complete. 8. The plans and plat shall be submitted to the Wright County Highway Department for review and approval. An entrance permit and/or work within the right-of-way permit will be required. 9. The Developer will be responsible for all construction permits required for the improvements (sanitary, water, storm water, etc.) 10. Include benchmark descriptions on plan sheets. 11. All pertinent standard City engineering details shall be included in the plan set. • 11 • 12. Plan sheets reviewed are currently not signed. Approval of plans will require the signatures of the appropriate licensed professional. 13. Show extents of improvements (turn lanes, striping, etc,) along CSAH 18 and CSAH 19, as required by County. 14. The eight inch sanitary sewer main shall be extended approximately 190 feet, at minimum grade (0.4%), from MH "A" to the northern right-of-way line of CSAH 18 (70 feet north of the centerline) and terminated with a manhole structure and casting. A 30 foot easement over the sewer extension will also be required. This extension will provide sanitary sewer service to the parcels located at the southwest corner of CSAH 18 and CSAH 19. 15. The minimum grade on the sewer services shall be one inch per four feet (approximately 2%). 16. A inside drop shall be constructed in the existing manhole at the intersection of Kyler Avenue and 51 st Street NE (as noted on plans). The inside drop shall consist of a Reliner brand Drop Bowl (model A6 with a 6" outlet), 6" PVC drop, 90 —degree bend, and required stainless steel fasteners. 17. Sanitary sewer main shall be SDR 35 or greater. 18. All sanitary sewer service pipe and fittings shall be SDR 26. 19. The easement over the sanitary sewer and watermain shall be a minimum of 35 feet in width and extend a minimum of 15 feet from the sanitary and a minimum of 10 feet from the watermain. 20. A gate valve and plug shall be added at the end of the stub to the west. 21. A gave valve shall be added just to the west of the tee for the east -west watermain. 22. Add gate valves to all services. Valves will have to be within the easement. 23. If the building will have sprinkling type fire protection, separate water shutoffs and services for the fire line and for the domestic line will be required, as well as, easement over services and their shutoffs. 24. Hydrant spacing and water supply shall meet the requirements of the latest version of the Minnesota State Fire Code and that of Albertville's Fire Chief (see Futrell Fire review). 25. All watermain shall be PVC C9000 and fittings shall be protected with • polyethylene encasement material. 12 26. Eight gauge solid coated copper tracer wire shall be installed along water service line and noted on plans. . 27. Gate valve adaptors for valve boxes and nut extensions shall be required and noted on plans. 28. Note on plans that all watermain shall have a minimum of 7.5 feet of cover. 29. Storm sewer design calculations where received on March 30, 2006 and are currently being reviewed. 30. Pre- and post -development drainage area maps, that include pre- and post - development impervious calculations, shall be submitted for review. Post development runoff volume and rate to the CSAH 18 ditch shall not exceed that of pre -development. 31. A revised grading and erosion control plan was received and March 30, 2006 and is currently being reviewed. 32. The old access approach at the intersection of CSAH 18 and CSAH 19 off of CSAH 18 shall be removed and the ditch shall be graded and restored. 33. Slopes between the existing trail along CSAH 19 and the back of the proposed curb shall not exceed a 4:1 grade. 34. All sidewalks and pedestrian ramps shall meet the requirements of ADA and • MnDOT (truncated domes). 35. All sidewalk pedestrian ramps shall be aligned with opposing pedestrian ramps (intersection of Kyler Avenue and 51 st Street). 36. A street signage and striping (traffic, no parking, etc.) plan shall be submitted for review. Signing and striping of the access roads and parking lots shall be in accordance with the latest edition of the MMUTCD and as required by fire regulations. 37. Cross easements shall be required over the access roads off of CSAH 18 and CSAH 19 to allow access to adjacent properties. A 30-foot easement over the sewer extension will also be required. This extension will provide sanitary sewer service to the parcels located at the southwest corner of CSAH 18 and CSAH 19. 2. The minimum grade on the sewer services shall be 1-inch per 4-feet (approx. 2%). 3. A inside drop shall be constructed in the existing manhole at the intersection of Kyler Avenue and 51" Street N.E. (as noted on plans). The inside drop shall consist of a Reliner brand Drop Bowl (model A6 with a 6" outlet), 6" PVC drop, 90 —degree bend, and required stainless steel fasteners. 4. Sanitary sewer main shall be SDR 35 or greater. 5. All sanitary sewer service pipe and fittings shall be SDR 26. 6. The easement over the sanitary sewer and watermain shall be a minimum of 35-feet in width and extend a minimum of 15' from the sanitary and a minimum of 10' from the watermain. Watermain 1. A gate valve and plug shall be added at the end of the stub to the west. 2. Agave valve shall be added just to the west of the tee for the east -west watermain. 3. Add gate valves to all services. Valves will have to be within the easement. 4. If the building will have sprinkling type fire protection, separate water shutoffs and services for the fire line and for the domestic line will be required, as well as, easement over services and their shutoffs. 5. License Required: No person shall operate a rental dwelling without first having obtained a license to do so from the city as hereinafter provided. (Ord. 1998-1, 3-2-1998) B. Expiration And Renewal Of License: Each such operating license shall be issued annually and shall expire on December 31. License renewals shall be filed at least ninety (90) days prior to license expiration date. (Ord. 1998-1, 3-2-1998; amd. 2005 Code) C. Inspection Required Prior To Application Submittal: No application for an initial or renewal license shall be submitted to the city council until the compliance official has verified that the required biennial inspection has been completed and that all life, health and safety violations or discrepancies have been corrected. D. Fees: 1. License Fees: a. License fees, as set forth by city council resolution, shall be due ninety (90) days prior to the license application date; in the cases of new, unlicensed dwellings, license fees shall be due upon issuance of the certificate of occupancy. b. A delinquency penalty of five percent (5%) of the license fee for each day of operation without a valid license shall be charged operators of rental dwellings. Conduct On Licensed Premises: 1. Prohibited, Conduct: It shall be the responsibility of the licensee to see that persons occupying the licensed premises conduct themselves in such a manner as not to cause the premises to be disorderly. For purposes of this subsection, a premises is disorderly at which any of the following activities occur: a. Violation of title 5, chapter 5 of this code (noise). b. Violation of laws relating to the possession of controlled substances as defined in Minnesota statutes section 152.01 , subdivision 4. (Ord. 1988-1, 3-2 1998) c. The unlawful sale of intoxicating liquor or 3.2 percent malt liquor'. d. Violation of laws relating to gambling. 1. See title 4, chapter 1 of this code. 0 City of Albertville e. Violation of laws relating to "prostitution" as defined in Minnesota statutes section 609.321, subdivision 9, or acts relating to prostitution. f. Unlawful use or possession of a firearm in violation of Minnesota statutes section 609.66, subdivision la, 609.67 or 624.713. g. Violation of section 3-5-1 of this code (burglary and safety alarms fees and administration). 2. Consequences Of Violations: a. Upon determination by the zoning administrator that a licensed premises was used in a disorderly manner, as described in subsection L1 of this section, the zoning administrator shall give notice to the licensee of the violation and direct the licensee to take steps to prevent further violations. b. If another instance of disorderly use of the licensed premises occurs within three (3) months of an incident for which a notice in subsection 1-2a of this section was given, the zoning administrator shall notify the licensee of the violation and shall also require the licensee to submit a written report of the actions taken, and proposed to be taken, by the licensee to prevent further disorderly use of the premises. This written report shall be submitted to the zoning administrator within five (5) days of receipt of the notice of disorderly use of the premises and shall detail all actions taken by the licensee in response to all notices of disorderly use of the premises within the preceding three (3) months. c. If another instance of disorderly use of the licensed premises occurs within three (3) months after any two (2) previous instances of disorderly use for which notices were given to the licensee pursuant to this subsection, the rental dwelling license for the premises may be denied, revoked, suspended, or not renewed. An action to deny, revoke, suspend, or not renew a license under this subsection shall be initiated by the zoning administrator, who shall give to the licensee written notice of a hearing before the city council to consider such denial, revocation, suspension, or nonrenewal. Such written notice shall specify all violations of this subsection, and shall state the date, time, place and purpose of the hearing. The hearing shall be held no less than ten (10) days and no more than thirty (30) days after giving such notice. Following the hearing, the council may deny, revoke, suspend or decline to renew the license 0 City of Albertuille 10-4-10 10-4-10 for all or any part of the licensed premises or may grant a license upon such terms and conditions as it deems necessary to accomplish the purposes of this subsection. 3. Adverse License Action During Eviction Proceedings: No adverse license action shall be imposed where the instance of disorderly use of the licensed premises occurred during the pendency of eviction proceedings (unlawful detailer) or within thirty (30) days of notice given by the licensee to a tenant to vacate the premises where the disorderly use was related to conduct by that tenant or by other occupants or guests of the tenant's unit. Eviction proceedings shall not be a bar to adverse license action however, unless they are diligently pursued by the licensee. Further, an action to deny, revoke, suspend, or not renew a license based upon violations of this subsection may be postponed or discontinued at any time if it appears that the licensee has taken appropriate measures which will prevent further instances of disorderly conduct. 4. Determination Of Disorderly Conduct: A determination that the licensed premises have been used in a disorderly manner as described in subsection L1 of this section shall be made upon substantial evidence to support such a determination. It shall not be necessary that criminal charges be brought in order to support a determination of disorderly use, nor shall the fact of dismissal or acquittal of such a criminal charge operate as a bar to adverse license action under this subsection. 5. Notices: All notices given by the city under this subsection shall be personally served on the licensee, sent by registered mail to the licensee's last known address or, if neither method of service effects notice, by posting on a conspicuous place on the licensed premises. 6. Enforcement Actions Not Exclusive: Enforcement actions provided in this subsection shall not be exclusive, and the city council may take any action with respect to a licensee, a tenant, or the licensed premises as is authorized by this code or state law. M. Suspension Or Revocation Of License: Every operating license issued under the provisions of this chapter is subject to suspension or revocation by the city council should the licensed owner or his duly authorized resident agent fail to operate or maintain licensed rental dwellings and units therein consistent with the provisions of the ordinances of the city and the laws of the state.
