ADJOURNMENT �(Y f- ALBERTVILLE CITY COUNCIL April 21, 2003 Albertville City Hall 7:00 PM PRESENT: Mayor Don Peterson, Councilmembers LeRoy Berning, Tim Sweeney, Tom Fay, and Ron Klecker, City Engineer Pete Carlson, City Planner Al Brixius, City Attorney Mike Couri, and City Administrator Linda Goeb Mayor Peterson called the regular meeting of the Albertville City Council to order. The agenda was amended as follows: • Move Item 6d(3) Resolution #2003-13 under Public Hearing • Add Item under Public Hearing - Resolution #2003-14 • Add Item under Public Hearing - Resolution #2003-15 • Add Item under Public Hearing — Approve Funding Agreement with Wright County • Add item 6d(3) — Maintenance Building • Add Item 6f(5) - Appoint Councilmember Klecker to fill the vacancies on committees vacated by John Vetsch • Add Item 6f(6) - Temporary Business Signs • Add Item 6c(2) — Zoning Steve Zachman property Sweeney made a motion to approve the agenda as amended. Berning seconded the motion. All voted aye. The minutes of the April 7, 2003, meeting were amended on Page 5, Paragraph 3, to reflect that the Council authorized the dumpster at the rear of the Public Works Building for residents to place tornado debris cleaned from the wetland areas. Klecker made a motion to approve the minutes of the April 7, 2003, regular meeting as amended. Fay seconded the motion. All voted aye. Mayor Peterson asked if anyone wished to address the Council under Citizen Forum. Gary Lenz, Marlowe Avenue NE, reported that the road is in terrible shape and asked to have it made passable. City Engineer Pete Carlson and Public Works Supervisor Tim Guimont were directed to check out the area and will be doing something temporary as soon as possible. They will contact Fehn Excavating about a more permanent solution. Elaine Engstrom and Sherry Schmidt requested that the Council consider vacating the roadway between their lots. The Council will require all costs associated with the vacation to be paid by the property owners. The Council will require curb and gutter to be added at an estimated cost of $10 per foot. City Engineer Pete Carlson will review the records of storm drainage and will report back to the Council. Kent Roessler, owner of the Cedar Creek Golf Course, requested the Council allow a 4'x 8' sign advertising the course and the restaurant at the corner of CSAH 18/19. According to Roessler, the sign is crucial to the business by directing traffic to golf course. He feels that golf course is a special, unique situation, as an amenity to the City. Special consideration is already Albertville City Council Minutes April 21, 2003 Page 2 of 5 given to schools and non-profit organizations in the City's ordinances. The economic feasibility of golf course without directional signs is in danger. Roessler has permission from landowner to lease the area for the sign. City Attorney Couri explained that the city cannot allow off -premise sign in residential zone. The requested sign is actually considered a billboard. Directional signs in right of way would be easier and would not have the impact of the off -premise sign. Couri said the Council could amend their ordinance making an exception for off -premise signs for golf courses. City Planner Al Brixius presented the Council with information on Community Directional Signs. The Council will continue to work with staff to try to figure out how the ordinances could be changed to allow the requested signage. Ross Johnson, the general manager of the golf course, told the Council that golf course residents have reported confusion with traffic in residential areas looking for golf course. Deb McCann, a resident of the golf course community, presented the Council with a petition with over 60 names from the neighborhood who support the sign. Don Anderson, another resident on the golf course, also supports signage for golf course. Councilmember Berning requested Check #'s 17869, 17875 and 17886 be removed from the Consent Agenda. All voted aye. Albertville City Council Minutes April 21, 2003 Page 3 of 5 Bernie Burke, Principal of Albertville Primary School, addressed the Council. He explained that several years ago the City sent a letter asking to lease the back portion of the school yard as a park. At that time, the School District was not in favor of the idea. However, Burke would now like to level off the land and put in seed to make the area more useable. Fehn Excavating has given Burke an estimated cost of grading and seeding the property at $1,000 per acre. Burke asked if the City would be interested in going in one-half with the school in making the land more useable. According to the City Engineer, the northeast corner would need to be a detention pond that could be fenced. Pete will research the original plan and present it at the next Park Committee meeting. Mayor Peterson opened the public hearing to consider the improvements to CSAH 19 from 57th Street to the Outlets at Albertville entrance at 7:55 PM. City Engineer Pete Carlson reviewed the project consisting of widening CSAH to four through lanes from 57`h Street to Outlet Mall intersection with the transition area 500 ` south of 57`h Street and 500' north of mall. The project includes a center median, modification of the signals at CSAH 19/3 and the Outlet Mall entrance, and the addition of a traffic signal at 57`h Street. Don Savitski, owner of DJ's, questioned how the project will be funded. Carlson explained that the Outlet Mall and Cobom's have already agreed to be assessed for the traffic lights. In addition Casey's and the vacant lot in Parkside Commercial Park are likely to be assessed. The remaining expenses of the project will be paid by the city with general levy tax dollars, along with a $50,000 annual contribution from Wright County. Diane Sorenson, L & D Trucking, questioned whether her taxes would rise to pay for this improvement. The city anticipates that the taxes from new commercial properties will cover the cost of the improvements. Betty Barthel, Don's Bus Garage, stated they do not like the concrete median on 601h Street. Carlson explained that the permanent solution for bus traffic is the extension of Lachman Avenue to 57`h Street. There were no additional comments or questions, and May Peterson closed the public hearing at 8:30 PM. City Planner Al Brixius presented the site and building plan for Building D on Lot 1, Block 1 of the Albertville Crossings 2nd Addition. Berning made a motion to approve the Findings of Fact & Decision, granting site and building plan review for Building D as presented. Sweeney seconded the motion. All voted aye. x Albertville City Council Minutes April 21, 2003 Page 4 of 5 Berning made a motion to approve the quote from S.E.H. to prepare the Albert Villas Park layout plan suitable for a DNR grant application at a not to exceed cost of $2,200. Sweeney seconded the motion. All voted aye. Carlson presented the costs for extending the existing BNSR railroad crossing to accommodate the trail. The estimated cost is $15,570. Fay made a motion to fund the extension of the railroad crossing from the Park Dedication Fund in the amount of $15,570. Klecker seconded the motion. All voted aye. Berning made a motion to adopt RESOLUTION #2003-14 titled RESOLUTION ORDERING IMPROVEMENT, as amended by removing the trails portion of the CSAH 19 Improvement Project. Sweeney seconded the motion. All voted aye. Sweeney made a motion to adopt RESOLUTION #2003-13 titled RESOLUTION AWARDING CONTRACT CSAH 19 IMPROVEMETS, contingent upon Wright County entering into a funding agreement with the City. Beming seconded the motion. All voted aye. Sweeney made a motion to approve RESOLUTION NO. 2003-15 titled DECLARING THE OFFICIAL INTENT OF THE CITY OF ALBERTVILLE TO REIMBURSE CERTAIN EXPENDITURES FROM THE PROCEEDS OF BONDS TO BE ISSUED BY THE CITY. Klecker seconded the motion. All voted aye. Sweeney made a motion to approve Agreement No. 03-02 Between the County of Wright and the City of Albertville. Beming seconded the motion. All voted aye. Mayor Peterson and Councilmember Beming agreed to meet with representatives of Wright County to discuss a possible joint public works building at 10:00 AM on Friday, May 2°a at City Hall. Beming made a motion to adopt CITY OF ALBERTVILLE RESOLUTION #2003-16 titled JOINT RESOLUTION REQUESTING CONCURRENT DETACHMENT FROM ALBERTVILLE AND ANNEXATION TO ST. MICHAEL OF A PORTIONOF LAND PURSUANT TO MINNESOTA STAT. 414.061 (Greg Vetsch parcel). Klecker seconded the motion. All voted aye. The Council agreed to consider increasing the library budget, as requested by the City of St. Michael, in the 2004 budgeting process. Sweeney made a motion to approve the Assignment Agreements for Cedar Creek South 5th, 6th and 7th Additions as requested. Fay seconded the motion. All voted aye. Beming made a motion to purchase a new server for the Building Department from Computer Services & Repair in the amount of $1,370.25. Klecker seconded the motion. All voted aye. We will begin to scope out the areas that need patching, sealants and overlaying. Also look at repairing curb and catch basins. PARKS — We finished and painted the dugout and press box at the baseball field. The player's benches have been installed also. There have been some large sinkholes appearing in this field that we have been filling and re -seeding. This is the field is the one that Fehn's mined out clay and put other dirt back. New volleyball nets have been installed at the City Park and Four Season's Park. All of the parks have been aerated. We have begun mowing in all areas and getting the ball fields ready for the season. Gutwiller Construction has begun working on the gazebo at City Park. This concept plan attempts to respond to Council's past direction to provide single family lots that are generally consistent with the R-1 Zoning District standards. Mr. Johnson is looking for some feedback from Council prior to pursuing a preliminary plat application. The following is a review of the generalized concept plan. ISSUES ANALYSIS Land Use. The Heuring property is surrounded by the following land uses. North: R-1A, Single Family Subdivision East: County Road 19 and Commercial B-2 Zoning West: Cedar Creek Detached Townhomes South: County Road 18 and the Albert Villas Single Family Subdivision Site Condition. The site configuration is triangular in shape and in constrained by existing wetlands along the northern property boundaries. Access to the site will have to be achieved from County Roads 19 and 18. Access points have been established based on subdivisions of adjoining properties. Wright County will require proper spacing of any access onto County Road 18. This access point should align with Underwood Street right-of-way, which is being platted as part of Albert Villas 6th Addition. Access from the east will be provided by a service road that will connect with 53rd Street and pass through a commercially zoned area prior to moving into this residential subdivision. The service road configuration is intended to provide not only access to the subdivision, but to open up the County Road 19 commercial area for future development. The existing natural conditions, as well as surrounding development and access constraints, complicate the design of any subdivision in this area. In recognition of these constraints, the City Council, at their last meeting, indicated that they may be open to a residential subdivision design that embraced the R-1 Zoning District standards. Additionally, those lots which would back up to County Road 18 may be smaller in size to provide a little greater density along this major thoroughfare. Site Design. The site design attempts to respond to the Council's direction. The service road connection into the commercial area is illustrated. The access point in alignment with Underwood has not been provided and must be addressed. The applicant is proposing three cul-de-sacs extending north off of the service road to provide access to a subdivision design that is consistent with the R-1 District standards related to lot width, with lot areas being oversized in most cases. Lots along County Road 18 range in size from the smallest being 9,450 square feet to 21,000 square feet in area. Each of the lots are narrow in width, proposed to range between 64 and 67 feet at the street frontage. The plan has been submitted as a concept plan and the following issues relate to the overall concept plan. The single family lots located north of the service road appear to be all in excess of the R-1 A lot area standards, however, it should be demonstrated that these lot areas are exclusive of the wetlands. The only area of real concern exists on the west side of the westernmost cul-de-sac, where the wetland encroaches close to the public street. 2. The lot widths for the single family lots all appear to meet the R-1 District standards of 90 feet, with corner lots being 100 feet in width. 3. There is concern for the easternmost single family lots in that they abut a commercial zoning classification. The lot depth between the cul-de-sac and the commercial property appear to be approximately 134 feet in depth. This raises issue as far as building placement and providing appropriate screening along the commercial property line. 2 4. A western shift of all of the cul-de-sac lots may address the following: a. Street alignment with Underwood Avenue. b. Elimination of the western wetland encumbered lots. C. Add depth to the lots abutting the commercial zoning. 5. Lots located east of the entrance onto County Road 18 and south of the service road raise issue related to lot width. The narrowest lots appear to be approximately 67 feet in width with one triangular shaped lot that is narrower at the curve. The following suggestions might be appropriate for this area. a. Elimination of one of the lots and the combination of lot area and lot width with the adjoining properties may produce a little wider lot width and a lot area that would be more consistent with the R-1 District standard while still providing opportunity for shared driveways along property lines. b. The easternmost three lots south of the service road raise issue as far as lot area and lot depth. These lots are only 126 feet deep. It may be appropriate to include these three lots in the commercial zoning to provide adequate area and depth for future commercial development at the corner of County Roads 19 and 18. C. A landscaped buffer yard will be required along all the lots backing up to County Road 18. 6. Lots located west of the access point onto County Road 18 are intended to be serviced by a private street. These are very small lots, 64 feet in width, with lots areas approximately 9,858 square feet in area. This area of development raises the following concerns: a. Lots north of the private street raise the issue with regard to lot area exclusive of wetlands. The applicant should demonstrate that they have adequate building space. b. In looking at these undersized lots, there may be opportunity to remove one of the lots and expand the lot width and area of the adjoining lots within the block. C. The private street is a 600 foot long cul-de-sac. Cedar Creek Golf Course would assign to the City its long term sign lease thus making the directional sign owned/or controlled by the City. Albertville Sign Ordinance No. 1987-3, Section 3, as amended by Ordinance 1989-6, provides that "No advertising device or sign shall be erected, installed, constructed or painted in the City except in compliance with this Ordinance and unless it shall conform to and meet the requirements set forth herein; provided, however, that the provisions of this Ordinance shall not apply to any traffic sign or device nor to any City owned or controlled signs unless the terms of the applicable section specifically so states. Further, pursuant to Section 5, Subd. 1(a)(6) no permit fee is required if the sign is erected by the City. According to Ernest Peak, attorney for the Golf Course, he believes that Kent Roessler would be willing to assign to the City his company's rights to the assign their lease with Wayne Rains and Loretta Rains for the sign placed on their property located at 4953 La Beaux Avenue NE. The City would then place the sign on the property which would advise motorists along Highway 19 of the Golf Course and Restaurant. This option has the most benefits from the City's perspective. This option would be the quickest way to allow the golf course a directional sign. This option would not require amending the City's sign ordinance nor would it grant property rights in the sign to the Golf Course. Further, this option would not limit the City's actions should the Council later decide r+ r to install "community directional signs" within Albertville. Given the benefits, I would recommend this option as the best for the City. Attached to this memo is a proposed Assignment Agreement for the Council's consideration. This Assignment Agreement has not been approved by the Golf Course as of this writing. 2. The City could consider allowing "community directional signs". This option was discussed in the NAC memorandum dated April 21, 2003 a copy of which is attached. This option also has the benefit of not requiring the City to amend the sign ordinance. Because the sign would be owned by the City, design features could be dictated as it sees fit. However, as applied to the Golf Course, this option presents the following concerns: (1) this option would take time to develop as the City would need to amend the sign ordinance to allow for "community directional signs", decide on the color, size and configuration of the signs, decide on the locations for the signs, obtain permission to place the signs within the community, etc. and (2) the Cedar Creek Golf Course sign may not be unique to the golf course as determined by the City. 3. The City could amend its current sign ordinance to allow for an exception for the golf course. Possible language to allow for an exception for the golf course from the current sign ordinance: Albertville Sign Ordinance No. 1987-3, Section 9, Subd. 11. Obsolete and Off - Premises Signs could be amended to read as follows: No sign shall be permitted which advertises a business which is not being presently conducted on premises on which the sign is located, except advertising devices as provided for in Section 8 of this Ordinance; and except anYprivately owned recreational establishment having a gross open space area within the City of Albertville greater than 80 acres where such open space is an integral part of the business may have one directional sign not to exceed 32 square feet in size identifying the name of the establishment with one directional arrow. Said sign shall be in conformance with this Ordinance. Said directional sign shall not be erected or maintained in the Cityin 'n any area except on property abutting a county road. Said directional sign must be removed within ten years of installation. Please note that I have added a provision that requires that the directional sign must be removed within ten years of installation. This provision would allow the City some flexibility 0 Page 2 to remove the sign in the future without amending the ordinance. I felt that this was important given the potential future development of the Rain's property. The City will also need to amend Section 8, Subd. 2(a) to read as follows: No advertising device shall be erected or maintained on any lot or parcel of land unless the lot or parcel of land is within the area zoned as agricultural, commercial or industrial districts under the City of Albertville Zoning Ordinance except to allow for a directional sign permitted by Section 9, Subd. 11. Attached to this memo is a proposed draft Ordinance Amending the City's Sign Ordinance for the Council's consideration. This Ordinance will need to be finalized. 0 Page 3 ( ASSIGNMENT AGREEMENT WHEREAS, Pilot Land Development Company, Inc. ("Petitioner") are the owners of the Cedar Creek Golf Course located in Albertville, Minnesota which desires that a directional sign be placed on the property owned by Wayne Rains and Loretta Rains located at 4953 La Beaux Avenue NE. WHEREAS, Petitioner has entered in to a lease agreement dated with Wayne Rains and Loretta Rains for the placement of a sign on their property. A copy of the lease agreement is attached hereto as Exhibit A and incorporated herein by reference. WHEREAS, the City of Albertville has determined the sign proposed to be located on the Rains' property would be in violation of the current Albertville Sign Ordinance No. 1987-3 unless such sign is owned or controlled by the City; WHEREAS, the City of Albertville desires to place an off -premise directional sign to direct pedestrians or vehicle traffic to Cedar Creek Golf Course; WHEREAS, the City of Albertville desires that the Petitioner pay all costs associated with the City of Albertville in processing said sign request including, but not limited to, the City of Albertville's attorney fees, administrative costs, all costs of sign construction, installation and maintenance, payment of all rental costs, and such other professional and incidental costs deemed necessary by the City of Albertville; and WHEREAS, Petitioner has agreed to pay the costs incurred by the City of Albertville in processing the request for said sign request as outlined above; NOW, THEREFORE, for valuable consideration, receipt of which is hereby acknowledged, the City of Albertville and Petitioner hereby agree as follows: 7 +7 1. The City shall process said request for a directional sign to be placed on the property owned by Wayne Rains and Loretta Rains located at 4953 La Beaux Avenue NE; 2. Petitioner shall be allowed to place one directional sign identifying the "Cedar Creek Golf Course and Bar and Grill" with a directional arrow. Said sign shall not exceed 32 square feet and shall be in conformance with the City's Sign Ordinance; 3. Petitioner shall reimburse the City for all costs associated with the City of Albertville in processing said sign request including, but not limited to, the City of Albertville's attorney fees, administrative costs, all costs of sign construction, installation and maintenance, payment of all rental costs and such other professional and incidental costs deemed necessary by the City of Albertville; and 4. Petitioner shall pay in full all bills submitted to him by the City for obligations incurred under this agreement within thirty (30) days after receipt. If Petitioner fails to pay said bill within thirty (30) days, then the City may specially assess such costs against the Cedar Creek Golf Course property as legally described on attached Exhibit B and/or take necessary legal action to recover such costs and the Petitioner agrees that the City shall be entitled to attorneys fees incurred by the City as a result of such legal action. Petitioner knowingly and voluntarily waives all rights to appeal said special assessments under Minnesota Statutes section 429.081; 5. Petitioner shall hold the City and its officers and employees harmless from claims made by itself and third parties for damages sustained or costs incurred resulting the proposed sign. Further, Petitioner shall indemnify the City and its officers and employees for all costs, damages and expenses which the City may pay or incur in consequence of such claims, including attorney's fees. 6. Petitioner agrees to install and maintain the subject sign at its sole expense. 7. Petitioner shall assign to the City all of its rights in the a lease agreement dated , attached hereto as Exhibit A, with Wayne Rains and Loretta Rains for the placement of a sign on the Rains' property; 9. At such time as the City fails to use the property for a sign purposes for 60 consecutive days then the assignment shall revert back to Petitioner and Petitioner shall remove all remaining sign components from the Rains' property; and 10.
