ADJOURNM NT ALBERTVILLE CITY COUNCIL August 4, 2003 Albertville City Hall 7:00 PM PRESENT: Mayor Don Peterson, Councilmembers LeRoy Berning, Tim Sweeney, Tom Fay, and Ron Klecker, City Engineer Pete Carlson, City Planner Al Brixius, City Attorney Mike Couri, and City Administrator Linda Goeb Mayor Peterson called the regular meeting of the Albertville City Council to order. The agenda was amended as follows: • Kolleville Estates 3`d Addition trail • Trees & street repairs • Add Albertville Primary School • Street Lights • Move Citizen Forum item to the Public Works Department Klecker made a motion to approve the agenda as amended. Fay seconded the motion. All voted aye. Fay made a motion to approve the minutes of the July 17, 2003, Joint Albertville Otsego City Council Workshop, the minutes of the July 21, 2003, regular meeting, and the minutes of the July 23, 2003, Special Meeting as presented. Klecker seconded the motion. All voted aye. Mayor Peterson asked if anyone wished to address the Council under Citizen Forum. Judy Roden, 10941 57"' Street NE, questioned if the City had received the two benches that were gifted to the city from the Historical Society. Public Works Supervisor Tim Guimont reported that the benches had been received , but he has not located the benches as of yet. Mark Barthel, 11453 58`h Street NE, reported on problems he has observed at the Skateboard Park, especially after 9:00 PM. He has observed vandalism, foul language, underage drinking and smoking. Trash is being discarded on the ground. Park Supervisor Tim Guimont reported to the Council that the new fence around the Skateboard Park was damaged before it was even was completely installed. Tim called the Wright County Sheriff's Department and the suspect has been arrested. Staff was directed to contact the sheriff's department to enforce the park hour rules and to patrol the area more frequently. Check #'s 18356, 18371, 18375, and 18392 were removed from the Consent Agenda. All voted aye. Mayor Peterson presented Elaine Engstrom a plaque in recognition of her years as a volunteer on the Albertville Royalty Committee. Tate Mills, Chairman of the Albertville Fire Department Truck Committee, addressed the Council seeking approval to start looking for a new pumper truck. Mills reported that the Fire Department currently has three pumper trucks —the 2002 aerial ladder truck, a 1985 Chevy pumper and a 1979 pumper. The 1985 pumper truck has been removed from interior service. since July 19. That day the pumper truck was responding to a structure fire when the pumper quit and could not have been restarted. At the time several firefighters were inside the structure - The Fire Department's goal is to replace both the older pumper trucks. According to standards a pumper truck should be able to pump 2,200 gallons per minute. Neither of the older pumpers meet this requirement. The age of the vehicles needs to also be considered. Mills estimated that the cost to replace the pump on the existing rigs is in the $200,000 range. The Council agreed to set up a workshop meeting with the Fire Department on Thursday, August 141h at 6:00 PM to discuss the budget and the new truck. Under the Public Works Department agenda, Terry Felker. 5512 Lachman Avenue NE, responded to a neighbor's complaint regarding the board that he placed in front of a culvert to allow the pond area to get deeper. The neighbor, John Salen, believes the board inhibits water from properly draining his yard. Felker contends that the board does not prohibit storm water drainage, but rather the Salen's yard is graded too flat . The Council directed the engineer to have site elevations on Salen's yard taken o determine if the lot should be raised. City Engineer Pete Carlson also explained that the pond needs to be dredged out from the silt and debris that entered the pond during the Albertville Crossings development project. The City Attorney believes that the pond dredging should be done under the terms of the Developer's Agreement. The Salen's rear yard could be raised by the dredged materials. Councilmembers Fay and Sweeney believe that property owners should not be allowed to grade into detention ponds because it increases the liklihood of creating problems for other property owners. Fay questioned if the city would be liable for damages if someone is injured on the detention pond. City Attorney Couri responded that the City would likely be named in any lawsuit resulting from damages or injuries. Felker stated that he will remove the board blocking the culvert yet this evening. Zoning Administrator Jon Sutherland will inspect the property tomorrow. City Planner Al Brixius discussed the Kolleville Estates 3rd Addition trail. There is considerable opposition from residents to the extension of trail to the north through Kolleville 2 Albertville City Council Minutes August 4, 2003 Page 3 of 5 Estates 2"6 Addition. The developer is asking the City Council to reconsider the decision to require the trail between lots in Kollville Estates 3rd Berning made a motion to allow the trail to be remove d from the Kolleville Estates 3rd Addition plat with the stipulation that the existing driveway to Sylvester Kolles's farm be removed as soon as possible. Sweeney seconded the motion. All voted aye. Public Works Supervisor Tim Guimont has received a bid from Fehn Gravel & Excavating to gravel and improve Marlowe Avenue NE. Fehn's price to complete the upgrade is $20,976. City Engineer Pete Carlson estimated the cost of the Class 5 materials alone would be around $15,000. The Council requested that Pete contact Fehn's about the bid. Tim reported that installing a warning track on new softball field would cost around $1200. Mayor Peterson indicated that the Knights of Columbus may be willing to donate the funds for this project City Engineer Pete Carlson reported that Wright County will likely not be participating in a shared Public Works Facility building. He will revise the floor plan and present cost estimates at the next meeting. Council member Klecker reported that evergreens planted on two yards at the southwest corner of 57`h Street and Kalland Avenue create sight problem for drivers. Tim will measure to see if the trees are in the right-of-way and staff will work with the property owners to have the trees removed from the sight triangle. The street overlay project will be started next week and several areas of Kalland Drive will be patched at that time. A letter has been sent to RJ Marco regarding turf establishment on the Albertville Plaza site. The silt fencing should be removed after turf has been established Fay made a motion to approve the Public Works Report. Klecker seconded the motion. All voted aye. City Planner Al Brixius reviewed the request from Gold Key Development, Inc. for rezoning from R-IA to PUD and a preliminary plat to be known as Prairie Run, allowing the subdivision of a 33.5 acre site into 52 single family residential lots. The site is proposed to be developed under the R-1 district standards, with larger lots at the northern portion of the site and smaller single at the southern portion of the site, buffering County Road 18. The developer is opposed to Condition #2 of the Findings of Fact & Decision regarding the road extension to 53rd Street. The developer questions who will pay the costs for extending the 3 Albertville City Council Minutes August 4, 2003 Page 4 of 5 road into property that he does not intend to purchase. Some discussion occurred regarding assessing the cost of the road to benefited properties. No final decision was reached. The Council discussed the current agricultural operation at the proposed site and found that the proposed development will conflict and be inconsistent with the conduct of agricultural operations on or from any portion of the property. The Council added the following conditions of approval to the Findings of Fact and Decision: (1) Permanent demarcation of the wetland buffer must be installed. (2) All agricultural operations on for from any portion of the property ceases upon final plat approval. (3) The current farmstead shall be incorporated into the plat. (4) All street names within the development will be consistent with the Wright County grid. Berning made a motion to approve the Findings of Fact and Decision as amended. Klecker seconded the motion. Beming, Klecker, Fay and Peterson voted aye. Sweeney voted no. The motion carried. City Engineer Pete Carlson briefly reviewed the Storm Water Run -Off Review. He has found that an increase in the size of the storm sewer pipe to a 60" pipe would be required to control the drainage along Main Avenue. The other option is to add a detention pond in the area along Main Avenue. To consider this option, the City would need to acquire property. Additional catch basins could be also be added along Main Avenue. Pete will continue to explore other options and will report back to the Council at the next meeting. In the Albert Villas development, Pete modeled the effects of an 8" rainfall. Flood elevations were shown and the results were that the storm system worked as designed and is adequate for a 100 year rainfall (6" in 24 hours). Extra runoff comes from properties in St. Michael. Pete suggests creating a diversion channel to take excess water created from 8" rainfall along the rear property lines. The diversion channel would be a short term solution only until storm water detention ponds are built in the St. Michael area at the time development occurs in that area. Property owner next to County Ditch 9 at 4943 Kaiser Avenue told that Council that even small rainfalls create flooding of the street in front of her house. The water standing in the street is deep enough that she is unable to leave her home by car. Pete look into street flooding issues on Kaiser Avenue NE Pete was directed to begin discussions with the Primary School and the school board regarding establishing a joint park facility on the Primary School site. The Council asked Pete to research adding lights on the medians on CSAH 19 (between 67`h Street and 53rd Street). 9 Albertville City Council Minutes August 4, 2003 Page 5 of 5 City Attorney Mike Couri told the Council that the owners of Welcome Furniture have requested that the berm behind the west side of the mall be removed. The berm was not included in the original grading plan approved for the mall site. Ray Wiley, co-owner of Welcome Furniture, stated the berm erodes onto their parking lot and into their holding pond at the east side. The berm is also unsightly and has noxious weeds growing. The berm further cuts visibility to his site. Sally Thompson, representing the outlet mall, was present at the meeting and indicated she is willing to discuss options with the Welcome Furniture owners. Couri reviewed the technical amendment to the Developers Agreements of Albert Villas 3Td, 4`h and 6th Additions. The Developers Agreements reference a homeowners association which was never required in the developments. The amendment to the agreements eliminates all references to a homeowner's association. Sweeney made a motion to approve the amended Developer Agreements as described. Berning seconded the motion. All voted aye. Couri reviewed the Escrow Fee Ordinance with the revised escrow amount at $3,000 to be deposited at the time of building permit issuance. Berning made a motion to adopt the ordinance as presented. Klecker seconded the motion. Berning, Klecker, Peterson and Sweeney voted aye. Fay voted no. The motion carried. The council set the following workshop meeting to discuss the 2004 budget: • Tuesday, August 5 at 7:00 PM • Thursday, August 14 at 6:00 PM • Thursday, August 28 at 6:00 PM Fay made a motion to approve RESOLUTION #2003-26 titled A RESOLUTION ACKNOWLEDGING RESIGNATION OF COUNCIKLMEMBER TIM SWEENEY AND DECLARING A VACANCY. The building is proposed to be constructed in two phases. The site is 3.2 acres in area and is zoned 1-1, Limited Industrial District. Attached for reference: Exhibit A: Location Map Exhibit B: Site Plan Exhibit C: Floor Plan Exhibit D: Building Elevation Exhibit E: Landscape Plan Exhibit F: Grading Plan ISSUES ANALYSIS Comprehensive Plan and Zoning The Zoning map classifies this site as 1-1, Limited Industrial District and the Comprehensive Plan designates this area for future Industrial development. As such, the proposed use is consistent with the Comprehensive Plan and designated zoning. The Zoning Ordinance defines warehousing as the storage of materials or equipment within an enclosed building. Warehousing is allowed in the 1-1 district as a permitted use. There is sufficient room for semi -trailer circulation within the northern parking lot. All parking stalls meet the dimension requirements of the Zoning K 18 Ordinance. It should also be noted that ail bituminous area on the site is to have a continuous perimeter concrete curbing barrier. The plans illustrate the location for 14 future stalls at the time of phase 11 development. At this time, floor plans for phase II have not been provided. As such, our office is unable to designate the required amount of parking for the building. If phase II is a duplicate or relatively similar to that of the building being constructed in phase I, there appears to be a parking deficiency of approximately 10 spaces. The applicant should be aware of need to properly plan for the needed phase II parking during the layout of the site. As currently designed, the phase II building will need to be reduced in size so as to have a sufficient amount of parking as required by code. Outdoor Storage It appears that a large area of the northern most parking lot may be used for outdoor storage of semi trailers. No other outdoor storage use is allowed for this site without approval of a conditional use permit. Building Requirements The applicant has submitted building elevation and floor plans for the building being constructed in phase I of the project. The exterior building material will consist of raked precast wall paneling with pre -finished metal capping, consistent with the requirements of Section 1100.4 of the Zoning Ordinance. Landscaping The applicant has submitted a landscape plan which includes a mixture of berming along Barthel drive, some larger Colorado Blue Spruce trees along both the west and south lot lines, and some smaller potted Isanti Dogwood and Taunton Yew along the south fagade of the building. Staff would like to see four additional Colorado Blue Spruce added along the south lot line, giving additional screening between the parking lot and the residential development to the south. Fencing The applicant is proposing to install a chain link perimeter fence with inserts around the rear parking lot area. The proposed fence is six feet in height, meeting the eight foot maximum height allowed for fences within the industrial district. Lighting The applicant has submitted details showing the design, type and location of proposed lighting. The submitted details appear appropriate for the subject site and staff is comfortable with the lighting plan subject to it meeting the illumination requirements as illustrated in Section 1000.10 of the Zoning Ordinance which state that light emitted from the shoebox lights illuminating the parking area must not exceed one foot candle lighting beyond the center line of the abutting streets. 3 19 Signage The applicant has not submitted signage plans at this time. A site plan showing the location of any proposed signage and detailed plans illustrating dimension and material, meeting the general standards of Section 9 of the Sign Ordinance must be submitted and reviewed by City Staff. Trash Enclosure / Snow Removal The submitted site plans show a trash enclosure located within the structure. In regards to snow storage, staff has concerns as to the ability to adequately remove snow from the site. The site currently shows a 12" swing gate at the northern section of the site. The applicant is aware that this is an error and needs to be shown as a 12 foot swing gate. The applicant must submit a detailed description explaining how snow will be adequately removed from the site. Grading / Drainage The applicant has submitted a grading plan for the subject site. It appears that the entire site will be drained to a pond located at the northeastern end of the site. The grading and drainage plans are subject to the review of the City Engineer. Mr. Brecke requests consideration by the Planning Commission and City Council of the land use/zoning concept to develop a commercial site for a dental clinic. In the event that the concept is determined to be favorable by the Planning Commission and City Council, Mr. Brecke will pursue a formal development application. It is important to note that this item is a concept only and the recommendations and decisions of the City are not binding. See attached Exhibits for further reference to the proposal and for background information regarding the Comprehensive Plan and Zoning District uses planned and contemplated for the site. The site contains .84 acres (36, 612 square feet) of lot area and is about 328 feet long and 112 feet deep. When CSAH 18 was improved, the County required dedication of approximately 24 feet of additional right-of-way which reduced the depth of the lots from Albertville Dental Page 1 136 feet to the current 112 feet. The site is contains a single family home on one of the parcels and is surrounded by generally large tracts of open land and farming operations with the exception of Swamp Lake which is a Natural Environment Lake located to the southeast of the site. Adjacent lands are anticipated to develop with low -density single family uses. Comprehensive Plan and Zoning The Comprehensive Plan designates the subject site and adjacent properties as Low Density Residential land use. The corresponding zoning classification is R-1A, Low Density Single Family and the subject site is located within the S-1, Shoreland District of Swamp Lake. About 1/3 of the site is located within the Shoreland setback however, a survey showing the ordinary - high -watermark of Swamp Lake will be needed to verify the actual area affected by the lakeshore setback. Assuming the ordinary -high -watermark is at approximately the Albertville Dental Page 2 southeast corner of the site or there about, the underling Lot 3. Heuring Addition may not be buildable without a variance under the existing R-1A or proposed B-1 or B-2 zoning classifications as the entire lot is located within the 150-foot lakeshore setback. The setbacks applicable to the lot result in a building envelope of about 35 feet deep by 115 feet long. In the event that the site were rezoned to B-1, the building would need to be moved to the southwest to meet the 50' County Road setback and reduced in depth to meet the 25' rear yard setback. In the event that the site is zoned B-2, the building depth as proposed could meet all setbacks provided the building is moved to the southwest to meet the County Road setback. Additional considerations for the site include screening that would be required to screen the commercial site from adjacent residential lands and additional Shoreland screening would be required between the building/parking lot and Lakeshore. DISCUSSION When Mr. Brecke first approached staff with the proposal to change the land use/zoning to commercial, the initial reaction was to advise him that the land use plan and Zoning Ordinance for the area established a consistent low density residential land use pattern and that recent amendments have resulted in an ample supply of commercial land within the City. Furthermore, the site is located about Y4 mile west of the intersection of CSAH 19 and CSAH 18 and separated by Swamp Lake. Mr. Brecke then prepared the site plan for the dental office (Exhibit A) and indicated that the site was no longer conducive to single-family residential development due to the expansion of the County Road right-of-way and resulting shallow depth of the lots of record. Individual development of each of the lots would result in the potential of 4 direct driveway accesses to CSAH 18 and the homes would all need to fit within a 35' deep building envelope, aligned along the County Road. Staff has re-evaluated the plan and concurs that there may be some merit to changing the land use/zoning designation of the site for a neighborhood commercial type use. Recommendation The request is for the Planning Commission to review the concept and provide guidance to Mr. Brecke as to whether or not the concept is acceptable and whether he should/should not pursue submittal of a formal development application. Staff has not conducted a formal review of the concept or site plan and as such, additional requirements of the Zoning Ordinance will apply. If the Planning Commission supports the concept of changing the land use/zoning the following suggestions are provided. - The subject site should be expanded to include the outlot, and vacant lot located west of Lot 1, Heuring Addition and the irregular parcel(s) located directly south of the subject site. See Zoning Map for reference. 2. Access to the site should be restricted to one driveway, meeting County Road spacing requirements. Albertville Dental Page 3 3. A development plan for all of the parcels should be submitted with a future Comprehensive Plan amendment and rezoning application. 4. Special attention should be given to screening, landscaping, lighting and architecture to ensure that the commercial property will be compatible with adjacent residential guided properties. 5. This site is currently vacant and zoned B-3, Highway Commercial. The applicant is seeking general concept plan planned , unit development conditional use approval to allow for a commercial development that would include a family restaurant, a convenience store with gas sales, and a hotel or retail development. While the hotel concept is expressed as being desirable, the applicant indicates that if the market dictates, the hotel will not work and he would change the hotel to a retail use. The concept plan shows the proposed uses situated on the site with a three lot subdivision. In examining the concept, the Planning Commission and City Council are asked to provide opinions as to land use and overall site design. In formulating your opinions and recommendations, we offer the following comments. Recommendations for this area of the City include "commercial development which is highway oriented and portrays high quality in design and construction." The proposed concept plan for business and commercial is consistent with the Comprehensive Plan recommendations. Zoning B-3 District. The purpose of the B-3, Highway Commercial District is to provide for and limit the establishment of motor vehicles oriented or dependent high intensity commercial and service activities. The proposed uses (restaurant, hotel, or retail) are permitted uses in the B-3 District. Gas sales and the car wash are a conditional use within this district. The City Council, in recent discussions, has raised concern regarding the number of motor vehicle fuel stations that have been established within the community and question the need for additional development of a similar type. The applicant has proposed a convenience store with gas sales and car wash, recognizing that the site's location falls in close proximity of County Road 37 and 1-94. In this regard, it appears that this auto oriented use would be well sited. However, the City would not want to see the convenience store with gas sales as the exclusive use of this site. In this regard, the City should condition any PUD approval with the requirement that the gas sales would not be established unless the convenience store is built in conjunction with one of the other uses (restaurant, hotel or retail). This would assure the City that it would not end up with just a gas station at another location in the community. PUD. The PUD process allows a deviation from the strict provisions of the Zoning Ordinance related to setbacks, height, lot area, lot width, and lot depth. Through the conditional use permit, PUD is intended to encourage innovations in development, higher standards in design, more convenience in location, and a more desirable and creative environments through the flexibility that would not be accomplished through the strict application of the Zoning and Subdivision Ordinances. The applicant is requesting a planned unit development to establish an integrated commercial site that is reliant on a single access off of County Road 37. Cross access easements would be necessary as well as shared parking. In exchange for the flexibility to create the three lot subdivision, the City's expectations will be that we establish high performance standards in building architecture, site landscaping, and effective site circulation. 2 Performance Standards. The applicant's total site area is 11.89 acres. Wetland and ponding consume approximately 5.81 acres and the applicant is proposing approximately .65 acres for dedication for the new off -ramp from 1-94. The balance of the property will be used in three lots for commercial development. Because there is no proposed direct access to the restaurant, flexibility in this standard is being sought. The applicant's proposed subdivision illustrates lots with irregular lot lines. These irregular lot lines may produce issues related to boundary line disputes in the future with multiple owners within this subdivision. In examination of the B-3 performance standards, it appears that all lots exceed the area requirements. The restaurant lot does not have access to a public local street and thus needs flexibility through the PUD. The buildings appear to comply with setbacks with the exception of the proposed hotel, which has a 10 foot rear yard setback on the south property line. This can be corrected 3 with a lot line adjustment to provide the necessary 20 foot rear yard setback. If the retail center replaces the hotel, it appears that all building setbacks have been complied with. Lot Coverage. Within the B-3 District, a maximum of 80 percent of total lot coverage is permitted. It appears that both the convenience store and the hotel meet this requirement, however, lot coverage calculations should be provided for the restaurant in that it appears to be in excess of the 85 percent standard. If this is the case, the City may consider averaging the total impervious surface of the development site against the entire lot. With the available green space and ponding areas and wetlands that would be included in the outlot to the south, the impervious surface is well below the B-3 District standard. Outlots. The subdivision has the potential for three outlots. The first outlot is the area west of the property which would be dedicated for a future off ramp from 1-94. This additional right-of-way dedication would provide the City, State and County the opportunity to plan the most appropriate location for the new off ramp with any future redesign of the County Road 37/1-94 interchange. The City Engineer should provide a more detailed review as to whether the dedication is sufficient to accommodate the City, State, or County needs in any future redesign. This may occur at the time of development stage. The second outlot lies south of the proposed development area and contains approximately 5.81 acres of land used for wetland and ponding. The site plan clusters the development on the buildable area in the north, retaining the wetland area and providing ponding in close proximity to the wetland as a storm water measure related to the overall development. It should be noted that the City has adopted regulations of a 30 foot buffer zone to be maintained with natural ply the ordinary high water mark of the wetland. It appears that the double loaded parking areas have a 60 foot dimension. By City regulation, these must be 64 feet. The adjustment to City standards will be required as part of development stage approval. This could have an influence on overall site design in that there is already issue with the restaurant parking falling within the wetland buffer zone. As we proceed to development and final stage PUD, documents must be provided that illustrate cross access easements between the lots so that the shared driveways can be identified. In conjunction with that, we would also like to see the long term maintenance agreements for the private streets that will be owned in corjnmon by the three lots. Landscaping. The site plan illustrates a generalized ''landscape plan that is fairly attractive. Greater detail will be given as we move to development stage based on anticipated sight lines into the site and areas that require) additional screening. At the time of development stage, we will require a more detailed landscape plan that identifies plants by species, size, and number. 5 Building Design Criteria. No building design features have been submitted with this concept stage review. As we move to development stage, the City will have expectations that as part of the PUD, architectural guidelines will be established for the overall site plan and will be used to control the architectural appearance of the restaurant, convenience store, hotel or retail center. The site's location at the entryway of Albertville will mandate that the buildings be build of premium materials and design. As such, as a condition of moving to development stage, we will ask that the architectural guidelines and colored building elevations be submitted for City approval of the overall PUD process. Trash Enclosures. With the exception of the convenience store, the other sites do not illustrate location for trash equipment. The City will mandate that these be identified on the development stage plans in conjunction with any building development and that the trash enclosures be designed in a manner that is consistent with the architectural exterior finishes. of the buildings. Signage. Within the concept plan, the applicant has identified sign locations near the off ramp of 1-94 and at the entrance off of County Road 37. The applicant should demonstrate their expectations for signage and how it will be used or shared amongst the three parcels. Any signage shall be reviewed against !the City's Sign Regulations, Lighting. As noted in the Architectural Design Guidelines, this is a dominant gateway area for Albertville. The exterior fascia of the canopy will not be allowed to be illuminated except for approved signage. An overall photometric plan will be required for the site that demonstrates that the site will not exceed the City standards for glare at the property lines. CONCLUSION The proposed concept plan is consistent with the Comprehensive Plan. The City must make a determination as to the appropriateness of the uses and site design that are being offered by the applicant. In general, we believe th',at the overall concept is well designed as each of the uses are well related to one another. Concern was expressed over both the height and placement of fences. In our review of the fence regulations, we believe that the current language is confusing and hard to understand with regard to fence location. Additionally, pursuant to the Planning Commission recommendation, we have reduced the residential fence height from 8 feet to 6 feet. Attached please find two options for addressing residential fences. Option 1 Within Option 1, we have removed language that we felt to be confusing pertaining to the location of boundary line fences on residential lots and replaced it with new language. The new language is illustrated in Provisions 1 and 2 underlined. In provision 1 we attempt to clarify where a 6 foot high boundary line fence maybe located. In this case we allow for 6 foot high boundary line fences along all side and rear line, provided it will not extend forward of the principal structure. However, in the case of a corner lot abutting a street, we require a minimum fence setback of 20 feet. Comment: Provision 1 is intended to provide greater clarity for the placement of the fences, and is intended to reduce the fence height from 8 feet to 6 feet in residential areas and is intended to maintain a side yard setback where the fence abuts up a side yard abutting a street. Provision 2. This language is intended to provide greater clarity where a rear lot abuts a side lot line of an adjoining lot. In this case, the fence may follow the rear lot line to a point equal to the required front yard setback of the abutting lot. At that point no fence greater than 42 inches may be allowed. Option 1 is illustrated in the attached exhibits. Option 2 Replicates Option 1 with one exception. In Option 2, provision 1 states that fences no more than 6 feet in height may be erected along the side or rear property lines provided such fences do not extend forward of the principal structure. In this provision, we did not include the 20 foot setback for side yard abutting a public right-of-way. Basically, the intent of this is to provide more yard within the fenced area by allowing the boundary line fence to extend to the property line. The Planning Commission must make a determination as to whether a minimum setback should be established for the 6 foot fence or whether this option would be more preferred. The amendments have associated diagrams that display corner lots within residential neighborhoods. We would intend to include the diagrams in the Zoning Ordinance to provide a clear description of fence location requirements. RECOMMENDATION The revised zoning amendments regarding residential fences have been directed by the Planning Commission. The amendments have been reviewed based on requirements of the Zoning Ordnance with the intent of providing greater clarity and understanding on how the fence location requirements are applied. Two options are offered for Planning Commission review and recommendation to Council. We ask that the Planning Commission review and discuss both options and make a determination as to which ordinance amendment is the most appropriate for the City of Albertville. Specific concern was the type and height of fences that secure private swimming pools. After investigating the specific application with Jon Sutherland, other issues arose related to deck extension, as well as location of pool filtering and heating systems in close proximity to adjoining property lines. This being the case, we have re-evaluated Section 1000.5 of the Albertville City Code and offer the attached ordinance change. Specifically, the ordinance change is consistent with the current language in that it requires a permit for all swimming pools, but spells out the requirements for site plan and construction drawings so that the Building Inspector will have an opportunity to review all elements of the pool prior to permit approval. Secondly, we have established a more specific list of setbacks for the swimming pool and fences. The next part of the ordinance relates to securing of the pool with appropriate fences or security enclosures. Specifically, we have increased the required fence height to five feet. We have prohibited the use of chain link fences, security fences for swimming pools. We have still maintained a requirement for latch gates and we have spelled out the requirements for the proper setbacks of these fences. The new ordinance also provides some standards for commercial or public swimming pools that may be associated with a hotel or an apartment building. Pools shall be set back at least six (6) feet from the principal building or frost footing. (2) Lighting for the pool shall be designed with (90) degree cut off and hooded to direct lighting toward the pool and not toward adjacent property. (3) All swimming pools for which a building permit is required shall be provided with safeguards to prevent children from gaining uncontrolled E access. This can be accomplished with fencing, or other enclosure, or any combination thereof, of sufficient density as to be impenetrable. a. If fences are employed, they shall be at least five (5) feet in height. The bottoms of the fences shall not be more than four (4) inches from the ground. Fences shall be of a non -corrosive material and shall be constructed as to be not easily climbable (chain link fences must be vinyl coated with slats for screening) All fence openings or points of entry into the pool enclosure shall be equipped with gates or doors. All gates or doors to swimming pools shall be equipped with self -closing and self -latching devices placed at a height not lower than (48) inches so as to be inaccessible to all small children. Prior to filling the pool, the approved fence or enclosure must be completely in place and inspected and approved by the City Building Inspector. b. Swimming pool fences shall comply with fence setback standards of Section 1000.6 of this Chapter. C. Required structure or safety fencing shall be completely installed within three (3) weeks following the installation of the pool, before any water is allowed in the pool, and prior to final inspection. (4) Water Quality/Drainage. a. Water in the pool shall be maintained in a suitable manner to avoid health hazard of any type. b. Back flush or pool drainage water shall be directed onto the property on which the swimming pool is located and ultimately to public storm sewer, if available. C. Drainage of pools directly into public streets or other public drainageways shall require written permission of the Zoning Administrator and/or Public Works Director. Draining pool into the sanitary sewer is prohibited. (d) For private swimming pools which are intended for and used by the occupants of a multiple family dwelling and the guests of the occupants, or for private and public clubs and organizations, the following regulations shall be met in addition to those listed for single and two family dwellings provided in Section 1000.5(c) above. (1) No part of the water surface of the swimming pool shall be less than fifty (50) feet from any lot line. 3 (2) No pumps, filter or other apparatus used in connection with or to service a swimming pool shall be located less than fifty (50) feet from any lot line and must be contained within an insulated building. (3) The pool area shall be adequately fenced to prevent uncontrolled access from the street or adjacent property. Fences shall be at least five f5) feet in height. (5) To the extent possible, back flush water or water from pool drainage shall be directed onto the owner's property and -to the nearest public storm sewer or drainage easement. Draining pools into the sanitary sewer is prohibited. Section 3. Effective Date. This amendment shall be in full force and effect immediately following its passage and publication. Definitions. The following terms shall have the following meanings: A. Debris shall mean all excess construction materials, construction material shipping cartons, construction material packaging, and used construction materials which are present at a construction site and which are not secured in a Construction Debris Container as defined herein. B. Construction Materials shall mean all materials of any type which are used in the construction of a house, building, or other structure, including, but not limited to, lumber, plastics, metal, asphalt and fiberglass shingles, fiberglass, vinyl, glass, ceramic, and other composite building materials. C. Construction Site shall mean a property in the City of Albertville on which a structure is being constructed upon which a temporary or final occupancy permit has not yet been issued. D. City shall mean the City of Albertville. E. Construction Debris Container shall mean a rigid, free-standing enclosure consisting of a solid metal bottom and solid metal sides constructed in such a manner that no gaps, holes or other spaces exist between the sides or between the bottom and sides, and which has a cover made of netting or a solid, rigid material which covers the entire top of the enclosure and does not allow materials from inside the enclosure to exit the enclosure when the cover is closed. Section 2. Prohibition. All construction sites shall be free of debris at all times. Section 3. Use of Construction Debris Containers. All construction sites shall have a Construction Debris Container located on site, and all construction debris shall be contained within such container at all times. All Construction Debris Containers shall be securely covered at all times (the cover may be removed only for such time as is necessary to deposit or remove construction debris from the container) such that no debris is able to leave the enclosure by force of wind, gravity or other event. Section 4. Inspection. The City's Building Inspector may refuse to inspect any property and may issue a stop work order on any property which: A. Contains debris that is not in a fully enclosed Construction Debris Container; B. Does not have a Construction Debris Container located on site; or C. Has a Construction Debris Container which does not meet the requirements of this ordinance or which is not securely covered. Upon compliance with this ordinance, any stop work order so issued may be rescinded and inspections may resume. Section 5. Violation. Any person or entity in violation of this ordinance shall be guilty of a misdemeanor punishable by a fine of up to 51,000.00, plus the City's costs of prosecution. Section 6. Repealer: Albertville City Ordinance 2003-01 is hereby repealed. This ordinance shall be effective upon its passage and publication in the official newspaper of the City. We would commit to leasing space immediately and would be willing to look into participation of the construction of the sign. Our tenants have expressed extreme interest on having signage near the outlet mall. One restaurant actually put a sign on a truck, which we do not approve of, but his business increased that day by 50%. We have also been in contact with Hoey Outdoor Advertising about the billboard sign they have on 19 near the bridge. The Lion's Tap restaurant is presently on that sign. They said they could expand it by 14 x 48 feet but would need a variance by the council. We could also live with this signage if the council so permitted.
