CALL TO ORDER - ROLL CALL - ADOPT AGENDA Mayor Peterson called the regular meeting of the Albertville City Council to order. PRESENT: Mayor Don Peterson, Councilmembers LeRoy Berning, Tom Fay, and Ron Klecker, City Engineer Pete Carlson, Assistant City Attorney Bob Ruppe, City Planner Al. Brixius and City Clerk Bridget Miller The agenda was amended as follows: Add Item 5.b.4. Crosswalk Add Item 5.b.5. Friendly City Days — storage Add Item 5.c.3. Request from Alpine Homes Fay made a motion to approve the agenda as amended. Klecker seconded the motion. All voted aye. 2. MINUTES Klecker made a motion to approve the minutes of the August 18, 2003, regular meeting as presented. Berning seconded the motion. All voted aye. 3. CITIZEN FORUM Mayor Peterson asked if anyone wished to address the Council under Citizen Forum. Jeff Lehn — trees issue for City Planner. Received a call regarding an alley in the area — there was to be access for a driveway on Business (Smackdown's) side of the fence and not the residential side of the fence. Resident at 11548 57t" Street was also wondering about the alley area. Gary Vetsch from Smackdown's, Shawn from Spectator's and a representative from Geez came before the City Council to inquire about the 2:00 am closing time for local bars. Mayor Peterson stated that it was put on the agenda on the Monday, June 16, 2003. And was again was put on the following agenda. Councilmember Berning agreed to the closing time until the issue came before the council from the business or resident end. Mayor Peterson stated we adopted the Ordinance to keep the closing time to 1:00 a.m. ALBERTVILLE CITY COUNCIL MINUTES September 2, 2003 Page 2 of 7 Councilmember Berning commented that it would have a Public Hearing Notice then schedule it for a City Council meeting. Councilmember Fay commented that he was not for changing the time to 2:00 a.m. for the residents' homes. Mayor Peterson asked the City Attorney to draft the Ordinance for the October 6ch City Council meeting. 4. CONSENT AGENDA Berning made a motion to approve the Consent Agenda as presented. Klecker seconded the motion. All voted aye. 5. DEPARTMENT BUSINESS a. FIRE DEPARTMENT There was nothing to report. b. PUBLIC WORKS Councilmember Berning asked to add the skateboard park under the Sheriff's Department supervision. He also asked if there was any way to put up signage at the park regarding littering codes that could be enforced by a fine. City Attorney Ruppe stated we would have to take a look at the current code regarding littering. He commented that it maybe a general littering on a residential property that is in the current code. Have one of the representatives from the Wright County for the next City Council meeting. Someone administratively — Dan or ask Gary Miller to suggest someone. City Clerk Miller will contact Wright County Administration office to have a representative attend. Public Works Supervisor Guimont would like to construct a Gazebo at Oakside Park. PW Supervisor Guimont priced it out and would cost around $6,800. He suggested having it come out of Park Dedication Fees. Klecker approved the gazebo for a limit of $7,000. Fay seconded the motion. All voted aye. Mayor Peterson limit of S7,000 plus tax. PW Supervisor Guimont inquired about the pond behind Casey's General Store. He would like to obtain some type of a metal railing that you find on highways. There is concern to keep it safe and/or clean? Something just needs something done to it. ALBERTVILLE CITY COUNCIL MINUTES September 2, 2003 Page 3 of 7 PW Supervisor would go out for bid. City Engineer Carlson was advised to look at other possible options. Mayor Peterson wants something that would look presentable in the community and would hold up to weather. There was discussion on a sidewalk on CR 19 to install a sidewalk for about 'I block'. PW Supervisor Guimont or City Engineer Carlson looks into going out for BID on this item. It would involve a sprinkler system located on CR 19. The City would be responsible for relocating / moving of the sprinkler head. PW Supervisor Guimont asked about snowplowing for the 2003-2004 winter season. Who would be responsible for maintaining the trails? City Planner Brixius commented that a few other communities plow trails and or sidewalks only in areas going to schools and leave the remainder of the areas to serve as cross country trails. It was then questioned what the city could do to keep snowmobilers to stay off the trails. It is an ongoing project on keeping Ditch 9 clean. There was talk about having the Public Works Department to continue work or something else done about keeping it clean. Councilmember Berning would like to see a cost estimate to keep Ditch 9 cleaned out. He would appreciate it put on the calendar on a yearly basis and decide is this the year we clean the ditch or wait until next year. Do we have funds in the budget to clean it up this year? Klecker made a motion to accept the public works report. Fay seconded the motion. All voted aye. Wastewater Treatment Superintendent Middendorf reviewed his report. The Request from Alpine Homes was then discussed. City Attorney Ruppe wanted to know if anyone from Alpine Homes or the homeowner contacted the City prior to repair. Did the owner begin repair or investigating the problem before they contacted the City? City Attorney Ruppe stated that if they proceeded before contacting the City, then we, the City, might not be obligated to reimburse the owner and/or builder. The City could consider paying the bills they incurred after they notified the city of the problem. WWT Superintendent Middendorf informed the Council that they began some of the repair prior to contacting the city. ALBERTVILLE CITY COUNCIL MINUTES September 2, 2003 Page 4 of 7 From the consensus of what the City Engineer Carlson and the WWT Superintendent Middendorf were saying the city is not responsible for the first part of the bills enclosed in the packet. The builder and/or developer should be the responsible party. Alpine Homes took a video of the main and from what the City Engineer Carlson and the WWT Superintendent Middendorf heard the main was full of dirt or fill. The WWT Superintendent Middendorf wanted the Ordinance clarified at what point the city is responsible and where the homeowner is responsible. The Ordinance reads something like from the water main to the right-of-way is the City's and from the water main to the house is the homeowner's. Klecker made a motion to approve the Wastewater/Water Department Report. Berning seconded the motion. All voted aye. Councilmember Berning wanted to get permission from the City use the garage at the former Beatrice Praught's residence. Fay made a motion to approve to allow the Friendly City Days Royalty float to be stored in the garage at the former Beatrice Praught's residences. Klecker seconded the motion. All voted aye. Mayor Peterson addressed the issue of a crosswalk from the area of St. Albert's Parish to the restaurants on Main Avenue. PW Supervisor Guimont would look into stripping off a crosswalk at the intersection of 57`h Street and Main Avenue from St. Albert's Parish Center to Smackdown's area. PW Supervisor Guimont asked if the City wanted to go ahead with a curb cut for handicap accessibility from the Fire Station parking lot to St. Albert's Church. C. PLANNING AND ZONING City Planner Brixius reviewed the plan for the proposed pier for the Towne Lakes development. Councilmember Berning recalled that he did not want boat slips in the development. Mayor Peterson suggested continuing the Towne Lakes request to the September 151h City Council meeting. City Planner Brixius will review the ordinance and City Attorney Couri will be at the next meeting to review the Towne Lakes Developer's Agreement. Northwoods Custom Homes wanted to use a garage located at 10474 491h Street NE in the Albertville city limits as a temporary sales office and to use the home as a model home. ALBERTVILLE CITY COUNCIL MINUTES September 2, 2003 Page 5 of 7 Councilmember Berning made a motion to approve Temporary use of the garage as a sales office. It would be for a limited time frame only. Fay seconded the motion. All voted aye. Mayor Peterson wanted to know what the current Ordinance is for Peddlers or Solicitors states. He would like to see restricted hours of operation. City Attorney Couri and City Planner Brixius will look into the what other communities are doing and come back to the September 15th City Council meeting with a draft Ordinance for review. d. ENGINEERING City Engineer Carlson reviewed the storm sewer drainage improvements. City Engineer Carlson recalled that the city would leave it for now until the time of which the property becomes developed. Would the city council like to align the line at this point in time or not? Councilmember Berning would like to consider aligning the line, but he wants to know the cost involved before we would go ahead with the aligning. Mayor Peterson wanted to know the time frame involved and would it be completed this year 2003 or next spring 2004" City Engineer Carlson stated it could be completed this year. Mayor Peterson made a motion to complete the alignment with the report of the cost. Klecker seconded the motion. All voted aye. Update of Main Avenue, City Engineer Carlson then showed the council what could be done. One option was to put in a retention pond. He stated it would have to be one big pond that would possibly be 16 feet in depth. It just doesn't seem the practical solution. Another option would be to put an additional catch basin(s). It would be a considerable amount of storm sewer line replacement. City Engineer Carlson would like to look at it one storm at a time, one step at a time. Mayor Peterson, Councilmembers Berning and Fay all agreed to proceed with the catch basins at this point. Carlson reviewed another area that was brought to the council's attention since the flooding on June 2003. He pointed out the Swale in the area near Sylvester Kolles's driveway and the additional residential neighborhood. ALBERTVILLE CITY COUNCIL MINUTES September 2, 2003 Page 6 of 7 Councilmember Berning asked about the trail that was proposed at sometime to go along the area. City Engineer Carlson stated that if a trail were installed they could put in a pipe to direct some of the water to run off away from the homes. He added that at one time it was full of debris. Once that was taken care of it flowed rather nice. Mayor Peterson asked what's the cost involved. City Engineer Carlson stated around $5,000 or less. Councilmember Berning wanted to confine that the homeowners would be notified that this would be done. The next item for discussion was in regards to County Road 19 Ditch. On the east side of 19 the flow seems slow. What may need to be done is some clean up. City Engineer Carlson stated that the restoration project is beginning. He will try to monitor the progress. The next item that was discussed was the trails throughout Albertville. Councilmember Berning had a number of issues and concerns with the trails. Mayor approved for the City Engineer Carlson to get the easement from Finken to complete the trail from `Point A to Point B.' They moved on to the School District Parks issues. It was decided that the Council will discuss the school parks at the joint meeting to be held with the STMA School Board and St. Michael City Council. Mayor Peterson and Councilmember Berning would consider sharing the cost with St. Michael and the school would be responsible for the maintenance of the parks. Councilmember Berning also brought up the irrigation system. He would like that on the agenda for discussion at the joint meeting regarding the Elementary School. e. LEGAL City Attorney Ruppe went over the legal documentation enclosed in the Council Packet. It is basically to cover the city should the developer go ahead with the construction of Karston Cove 3d Addition. City Engineer Carlson commented that it is the only way to connect 64th Street from Karston Cove Is'Addition to Kollville V' Addition. Councilmember Beming made a motion to approve the Municipal Improvements for Karston Cove 3rd Addition. Councilmember Fay seconded to motion. All voted aye. f. ADMINISTRATION Councilmember Berning suggested a workshop date of September 15 at 5:00 p.m. with the City Engineer, City Planner, City Attorney, and City Administrator. ALBERTVILLE CITY COUNCIL MINUTES September 2, 2003 Page 7 of 7 Councilmember Berning made a motion to approve the Preliminary Tax Levy. Fay seconded the motion. All voted aye. City Engineer Carlson asked if there was a joint meeting regarding the trail/sidewalk agreement. Councilmember Berning commented that they had a joint meeting on Thursday, August 21 sc Mayor Peterson would like to see in the agreement that Albertville maintain it on odd years and St. Michael maintains it on even years or vice -versa. So that whichever city maintains it — it would be cleared all the down the trail/sidewalk at the same time. Councilmember Berning wanted this to be added to the agenda for more discuss at the Joint meeting. Mayor Peterson confinned the meeting set for Monday, September 29. He wanted it to be at 6:00 p.m. and to be held at the School Board Room. City Clerk Miller will contact St. Michael and the School Board Secretary to inform them of the time and location set. Councilmember Berning noticed the Follow-up sheet was not included in the packet. Please include in the next packet. 6. ADJOURNMENT Klecker made a motion to adjourn at 9:13 p.m. Berning seconded the motion. All voted aye. While in Sandstone I was in all types of lending, and became a experience lender. 2001 Was called by State Bank of Rogers, to see if I would be interested in a job position, as Assistant Vice -President of Lending, I accepted this job offer as a commercial lender, and we were able to return to our families, and friends, we then moved to our present home in Albertville. 11 Currently am a Albertville Fire Dept, member. Qualifications: Feel that with my lending experience it could help. While in Sandstone I was Fire Chief for the Askov Fire Dept for 5 years, went to many counsel meetings, talked to counsel member about Fire Dept, and some city issues connected with the fire Dept. An arterial system plan was developed to promote better east -west and north -south movement throughout the area, and provide altem atives or options to 1-94 for shorter local trips. However, this system plan can't be complete without developing consensus on the future long-term access locations to 1-94 (access to TH 101 the other major regional highway in the area was determined as part of the TH 101 IRC CMP). Access to 1-94 has a significant impact to the local supporting system and will affect how connections are made as well as the size and type of interchanges that should be. planned. The local agencies in the area would like to resolve the access and system issues so that proper space can be reserved for the needed infrastructure. Based on input from the TAC members, six access alternatives along I-94 were selected for analysis and evaluation. These six access alternatives are shown below and are referred to in the report by the following letter designation: Alternative DesLnption A This alternative represents the "Base Condition" because it maintains the current access configuration to I-94 while constructing additional overpasses at Jamison/Kadler Avenue: and at Naber Avenue. All of the other access alternatives were compared to this alternative. The initial evaluation factors shown below support the overall transportation principles of: • providing a good overall local supporting arterial network, • equitably distributing existing and future transportation demand to the arterial system, • supporting the designated highway system functions (arterial, collector, local) promoting safety, • promoting system efficiency, and • minimizing the operations impact to I-94, Based on these principles the following evaluation factors were developed to evaluate the different access alternatives: I. Impacts to I-94 capacity and operations Information for this analysis was derived from a regional transportation forecasting model that was developed to analyze Mn/DOT's I-941TH 10 Regional River Crossing, and ,Mississippi River Cumulative Impacr study. This model was updated to reflect greater zone density and land use changes that had been identified by the cities of Albertville, Otsego, and St. Michael. In addition. network modifications were made to include more local collector and arterial roadways. Calibration runs were made to verify accuracy of model in the study area. In addition to the mo el, several meetings were held with local agencies to develop a local arterial and major colector grid system plan. This plan was used as a base network in all of the forecasting and evaluation work. As -)resiously explained, the alternatives were first evaluated on seven different criteria using a rat:g of "good", "fair' or "poor". Alternatives that promoted connections to arterials versus collectors, and promoted higher volumes and use of the arterial grid system were evaluated more favorably than alternatives t.".at pushed volumes on to collector or local roadways. Based on this criterion, Alternatives A and B were rated "poor" because they provide restricted access to future arterial system (Jamison/Kadler and Naber) and they continue to provide access to CSAH 37 a collector route. Alternatives C2 and D1. provided improved connectivity to the arterial grid system, (better utility of CSAH 19 and new Naber interchange), but had continued connections to CSAH 37 (a collector), and no connections to kadler/Jamison. These were rated "fair". Alternative E while providing complete access to the four minor arterials, it also continues to Provide access to a collector (CSAH 37). Therefore it was rated as "fair". Alternative D provides connections to three of the four arterial grid routes and no collector routes. When compared to the other alternatives, the group felt that this was a balanced approach to providing good system connectivity and continuity through balanced system of overpasses and interchanges. As a result, a key objective of the study is to reduce interchange and ramp merge/diverge problems by better distributing traffic to the various access points along I-94. An analysis of 2040 volumes on interchange ramps was conducted to see how well each alternative balanced P.M. peak hour traffic volumes on the different ramps throughout the corridor. Alternatives that had any ramp exceeding a volume of 1700 vph were rated as "poor", and volumes between 1,300 and 1,700 were rated as "fair" and volumes less than 1,300 were rated as "good' . Alternative A shows volumes over 1,700 on TH 241 and at CSAH 37; Alternative C2 shows volumes over 1,700 at the CD system. Alternative B shows volumes approaching 1,600 at TH 241. These short trips should be accommodated on the local arterial, and collector systems. While any additional 1-94 access will account for some increase in local activity on the freeway, an analysis was done to identify the quantity of short trips using I-94 as compared to the "Base Condition" Alternative A. The number of short trips was captured by using the regional model. A short trip was considered to be a trip that accessed 1-94 and then get off I-94 between TH 241 and one of the other interchanges (Naber, Kadler, CSAH 37, CSAH 19 and/or Jarnison/Kadler). Alternatives A and B show the fewest number of new short trips on I-94 and are rated as "good". Alternatives C2, D and DI were higher than A and B. All were in similar magnitude and were rated as "fair". Alternative E showed the highest number of short trips on I-94 (more than double the .magnitude of the group rated fair). Information for VHT and VMT was obtained from the regional travel forecasting model, The VHT and VMT values for the alternatives were compared to the "Base Condition" Alternative A. Alternatives were rated based on their ability to reduce the VHT and VMT. Thresholds for the three ratings were established using natural breaks in the data. Alternative E, which reduces ANT and VHT the most over the Base Alternative, is rated as "good". Alternatives C2, D and DI which show significant reduction in VNIT and VHT are rated as "fair". Alternatives A and B show the lowest reduction in VIVIT and VHT compared to the other alternatives and are rated as "poor". Based on access modifications, trip patterns change to reflect shorter paths and more convenient access. Based on current average crash rates for the different systems (freeway, divided arterial, undivided arterial, and two-lane) and VMT changes to these systems, net crash reductions were calculated for each alternative as compared to the "Base Condition" Alternative A. The net reduction in crash rates for each alternative show that Alternatives E has the highest reduction. in crash rates. Good O Fair O Poor Analysis Another important consideration in evaluating the different access alternatives is their impact on the local supporting highway network. Interchange access points focus traffic on facilities going to and from interchange locations. The fewer the number of access points the greater potential there is in concentrating traffic and overloading linkages. An analysis was done by comparing 2040 ADTs to threshold capacities on the local supporting arterial and collector system. This was done at roughly a dozen key points throughout the network (Table 1). Based on this analysis, volume to capacity problems were noted (bold numbers). If more than three locations were noted to have volume to capacity problems a "poor" rating was given. If one to two areas were found then a "fair" rating was given, and if none were found a "good" rating was given. Based on this criteria, Alternative A showed three areas for potential capacity problems and was rated '`poor". Alternative B showed two areas for potential capacity problems and was rated "fair". The remaining alternatives showed none and were rated "good''. This rating does not include evaluation of I-94. As part of the analysis, improvements of I-94 were assumed (consistent with I-94 IRC CMP). The I-94 C'MP assumed that 1-94 would be improved to four travel lanes in each direction in this section of the corridor. As part of an initial analysis, a HCM planning -level, level of service analysis was completed for the 2040 P.M. peak hour (Table 2 and 4). Based on this planning level analysis the mainline and most ramps operate at LOS D or better. However, the analysis showed a problem with all alternatives for the mainline east of TH 241 and for the TH 241 off -ramp. However, there were significant differences between the magnitude of failure at the off -ramp location, and this difference was used to rate the alternatives. The TH 241 off -ramp for Alternatives A and B exceeded the threshold of 4400 by 300 passenger cars per hour, where the other alternatives failed by 20 to 40 passenger cars per hour. This matrix shows that Alternatives A and B are the lowest rated alternatives (fewest good and fair ratings). Alternative C2 has an average rating (only one good, one poor and the rest fair). The remaining three alternatives, alternatives D, D1, and E rate the highest (highest number of good and fair ratings). Eowever, there are a couple of caveats to two of these alternatives that should be considered. These are as follows: • Alternative D1 includes a non-standard interchange type (half -diamond at CSAH 37). This may not be acceptable to FHNVA. Alternative E, based on the analysis methodology, has the highest number of local trips on I-94. This factor was rated "poor" for Alternative E. This factor may be considered by MnMOT and FHWA as a higher weighted factor due to the function of 1-94. Role of I-94 is to serve primarily longer regional trips. Alternatives that are inconsistent with this role may be undesirable to these agencies. Additional analysis has been done by SRF with respect to these local trips and will be presented at the August 26"' meeting. A forecast of that scenario for the year 2040 in conjunction with a Kadler Avenue interchange shows a daily volume of 32,000 on the Kadler Avenue river crossing. WHEREAS: The St. Michael — Albertville (STMA) School district asked both Cities to construct a trail/sidewalk system along 50th Street NE to connect from the STMA High School Campus in Albertville to the STMA Middle School Campus in St. Michael; and WHEREAS: 50th Street is a bordering street between the two cities and a trail along this street would serve residents of both Albertville and St. Michael; and WHEREAS: Albertville and St. Michael feel that construction of this trail/sidewalk segment will be an improved enhancement benefit for the residents of both communities; and WHEREAS: The City Engineers from both Albertville and St. Michael have studied the feasibility of constructing this trail/sidewalk segment and have determined that constructing a trail/sidewalk system along 501h Street is most feasible on the north side of 50"' Street between the two school campuses; and WHEREAS: It is in the interest of both parties to construct, regulate, maintain, and repair a trail/sidewalk system along 50th Street, NOW, THEREFORE, the parties hereto agree as follows: Purpose and Plan. The purpose of this Agreement is to develop a cooperative agreement for St. Michael and Albertville to prepare a plan and construct a trail/sidewalk segment along 501h Street NE to connect from the STMA High School Campus in Albertville to the STMA Middle School Campus in St. Michael. 2. Plan Preparation. In conjunction with the effective date of this Agreement, City of Albertville will authorize their City Engineer to begin preparation of plans, specifications, and easement descriptions for the construction of the trail/sidewalk segment along 50th Street N.E. The 50th Street N.E. Trail/Sidewalk Plan shall include the following: 2.1 Constriction plans and details for construction of the project from the STMA High School to Naber Avenue NE. Grading, drainage, and erosion control shall be considered, evaluated, and addressed in these plans. 2.2 Cost estimates for construction of the project. The cost estimate shall include all construction costs plus all overhead costs such as legal, engineering, and administration costs. 2.3 Easement needs shall be determined and described for the trail/sidewalk. Plan Adoption and Amendment. The 50th Street N.E. Trail/Sidewalk Plan shall be prepared by the Albertville City Engineer and approved by the St. Michael City Engineer prior to approval by City Council"s of both Cities. The City Engineers must jointly agree on the 501h Street N.E. Trail/Sidewalk Plan before submitting it to the Cities of Albertville and St. Michael for review and approval. A neighborhood meeting with the residents who abut the project shall be held prior to submission of the final plans to the Council's. Information gathered at this meeting will be given consideration in the development of the final plans. The 50th Street N.E. Trail/Sidewalk Plan shall be adopted by a majority vote of the members of the Cities of Albertville and St. Michael. 4. Plan Implementation and Maintenance. Following 50th Street N.E. Trail/Sidewalk Plan review and adoption by the Cities of Albertville and St. Michael, the City of Albertville shall arrange for and administer the implementation of the 50th Street N.E. Trail/Sidewalk Plan. Each City will acquire necessary easements in their respective jurisdiction. Any payment for easements in each City shall be paid for exclusively by the respective City. All contracts for the project shall be noticed and awarded by the City of Albertville in accordance with applicable statutory requirements. Any member of the Cities of Albertville and St. Michael may review and inspect any and all work, services, and activities undertaken pursuant to the 50th Street N.E. Trail/Sidewalk Plan, and may inspect and audit books and records relating to plan implementation. If any discrepancies or inefficiencies are noted, the Cities of Albertville and St. Michael shall work out their differences. 6. Cost Allocation and Reimbursement. The costs for preparing and implementing the 50th Street N.E. Trail/Sidewalk Plan shall be allocated to and paid by the respective City on the basis of the following:•)«� 6.1 All project construction costs (including E.ngineering�be split evenly (50%/50%) between the Cities of Albertville and St. Michael. 6.2 Albertville and their Engineer (SEH) will design and administer the project contract and construction subject to the review and approval of the St. Michael Engineer and Council in a timely manner. St. Michael will reimburse Albertville for 50% of all project construction and engineering costs within 30 days of invoicing (detailing the costs) by Albertville. 6.3 Any payment for easements in each City shall be paid for exclusively by the respective City. 7. Final Project Ins ep ction. A final inspection of the project will be made by the City Engineers prior to acceptance of the project and start of the warranty period. The City Engineers shall inspect the project again prior to release of the warranty. 8. Insurance. The Cities of Albertville as administrator for the 50th Street Trail Project shall require the project contractor to name both Albertville and St. Michael as additional insured parties on the contractor's insurance policy for the project. 9. Gifts, Grants, and Loans. The Cities of Albertville and St. Michael may within the scope of this Agreement, accept gifts, apply for and use grants or loans or other property from the United States, the State of Minnesota, or its departments or agencies, Wright County, or any person or entity for the purposes described herein. The Cities of Albertville and St. Michael may enter into any reasonable agreement required in connection therewith. The Cities of Albertville and St. Michael shall comply with all laws and regulations applicable thereto, and may hold, use and dispose of such money or property in accordance with the terms of the gift, grant, loan, or agreement relating thereto. 10. Accounting. St. Michael will reimburse Albertville for 50% of all project construction and engineering costs related to the 50th Street Trail within 30 days of invoicing by Albertville Prior to closing out the trail project contract, the Cities of Albertville and St. Michael shall submit an accounting of the monies expended for administration of the 50th Street Trail Plan to each City for review. This report shall include the following: 13.a The financial activities of the Cities of Albertville and St. Michael in regards to the 50th Street Trail Project 13.b The status of all projects and work pursuant to the 50th Street Trail Plan; 13.c Any other matters which affect the interests of the City in the 50th Street Trail Plan. 14. Disputes. In the event of any dispute, claim, question or disagreement arising from or relating to this Agreement, the parties hereto shall use their best efforts to settle the dispute, claim, question or disagreement. To this effect, they should consult or negotiate with the other party in good faith and attempt to reach a just and equitable solution satisfactory to both Cities. If they do not reach such solution within a period of sixty days, then the engineer for each City shall jointly select a third engineer to review and act as arbitrator with regard to such dispute, claim, question or disagreement. The decision of the arbitrator so selected shall be final and binding upon each City. 15. Amendments. Amendments to this Agreement may be made only by written instrument executed by the parties hereto. 16. Effective Date. This Agreement shall be in force and effect following its execution by authorized representatives of both of the members hereto. A certified copy of the Agreement shall be maintained by the Clerks of both Cities. Every permit issued by the building official under the provisions of this code shall expire by limitation and be- come null and void if the building or work authorized by such per- mit is not commenced within 180 days from the date of such permit, or if the building or work authorized by such permit is sus- pended or abandoned at any time after the work is commenced for a period of 180 days. Before such work can be recommenced, a new permit shall be first obtained to do so, and the fee therefor shall be one half the amount required for a new permit for such work, provided no changes have been made or will be made in the original plans and specifications for such work, and provided fur- ther that such suspension or abandonment has not exceeded one year. In order to renew action on a permit after expiration, the per- mittee shall pay a new full permit fee. Any permittee holding an unexpired permit may apply for an extension of the time within which work may commence under that permit when the permittee is unable to commence work with- in the lime required by this section for good and satisfactory rea- sons. The building official may extend the time for action by the permittee for a period not exceeding 180 days on written request by the permittee showing that circumstances beyond the control of the permittee have prevented action from being taken. No permit shall be extended more than once. 106.4.5 Suspension or revocation. The building official may, in writing, suspend or revoke a permit issued under the provisions of this code whenever the permit is issued in error or on the basis of 1-4 1997 UNIFORM BUILDING CODE permit for which a plan review fee has been paid is withdrawn or canceled before any plan reviewing is done. The building official shall not authorize refunding of any fee paid except on written application filed by the original permittee not later than 180 days after the date of fee payment. SECTION 108 — INSPECTIONS 108.1 General. All construction or work for which a permit is required shall be subject to inspection by the building official and all such construction or work shall remain accessible and exposed for inspection purposes until approved by the building official. In addition, certain types of construction shall have continuous in- spection, as specified in Section 1701.5. Approval as a result of an inspection shall not be construed to be an approval of a violation of the provisions of this code or of other ordinances of the jurisdiction. Inspections presuming to give au- thority to violate or cancel the provisions of this code or of other ordinances of the jurisdiction shall not be valid. It shall be the duty of the permit applicant to cause the work to remain accessible and exposed for inspection purposes. Neither the building official nor the jurisdiction shall be liable for expense entailed in the removal or replacement of any material required to allow inspection. Whenever any work for which a permit is required by this code has been commenced without first obtain- ing said permit, a special investigation shall be made before a per- mit may be issued for such work. 107.5.2 Fee. An investigation fee, in addition to the permit fee, shall be collected whether or not a permit is then or subsequently issued. The investigation fee shall be equal to the amount of the permit fee required by this code. The minimum investigation fee shall be the same as the minimum fee set forth in Tahle (-A. The payment of .such investigation fee shall not exempt any person from compliance with all other provisions of this code nor from any penalt prescrihcd by law. 107.6 Fee Refunds. The building official may authorize r und- ing of any fee paid hereunder which was erroneously paid or collected. The building official may authorize refunding of not more than 80 percent of the permit fee paid when no work has been done un- der a permit issued in accordance with this code. To be made after excavations for footings are complete and any required reinforcing steel is in place. For concrete foundations, any required forms shall be in place prior to inspection. All materials for the foundation shall be on the job, except where concrete is ready mixed in accordance with approved nationally recognized standards, the concrete need not be on the job. Where the foundation is to be constructed of ap- proved treated wood, additional inspections may be required by the building official. 108.5.3 Concrete slab or under -floor inspection. To be made after all in -slab or under -floor building service equipment, con- duit, piping accessories and other ancillary equipment items are in place, but before any concrete is placed or floor sheathing installed, including the subfloor. 108.5.4 Frame inspection. To be made after the roof, all fram- ing, fire blocking and bracing are in place and all pipes, chimneys and vents are complete and the rough electrical, plumbing, and heating wires, pipes and ducts are approved.
