City Engineer Pete Carlson, City Attorney Mike Couri, City Administrator Linda Goeb, new City Administrator Larry Kruse, and City Clerk Bridget Miller Mayor Peterson called the regular meeting of the Albertville City Council to order. The agenda was amended as follows: • Add Item 6d(3) — Update on CSAH traffic light • Add Item 6b(3) - Discussion of STMA Ice Arena • Add Item 4(f) — Approve 2002 Audit Report • Remove Item 4c — Approve Resolution #2003-36 • Add Item 6f(4) — Discussion on City Hall Berning made a motion to approve the agenda as amended. Klecker seconded the motion. All voted aye. Klecker made a motion to approve the minutes of the November 3. 2003, regular meeting as amended. Rich seconded the motion. All voted ave. Mayor Peterson asked if anyone wished to address the Council under Citizen Forum. Tony Underwood. 10252 52"d Street NE, explained to the Council that the developer of the Albert Villas projects replaced his and his neighbor's mailboxes. No restoration of the landscaping completed has been done. The Council directed staff to check into what has happened Fav made a motion to approve the Consent Agenda as follows: • Approve payment of claims (Check # 18866—18910) • Approve Resolution 4200 3-35 (Resolution Closing Certain Funds) • Approve reduction in Letter of Credit for Kollcville Estates 3'd Addition to 8140.000 • Approve reduction in Letter of Crcdit for Outlets of Albertville. All voted ave. ;`Mayor Peterson opened the public hearing on the assessment of the Northwest Commercial Park, the Albertville Business Park and the additional of turn lanes on CSAH 19. City Attorney Couri explained that the assessments listed for the unplatted properties on the north side of 67`h Street NE were proposed to be dcfen-ed by the 0tv Council in prc:\ ious discussions. Albertville City Council I\linutes November 17, 2003 Page 2 of 4 Randy Stangler, owner of Vision Builders, is opposed to the assessment on one of two of his properties that does not actually abut 671h Street. The parcel is the one on which his business I s located. City Engineer Pete Carlson explained to the Council that during preliminary discussions with Mr. Stangler it was agreed that two sets of services were extended to the abutting property so that in the future the two lots could be subdivided into two buildable commercial lots. Stangler does not want the Council to assess the property that is not abutting the street. Mayor Peterson closed public hearing at 7:33 pin and opened up discussion of the assessments. The Council concurred that the assessment on unplatted properties will be deferred with no interest accrues until the property is connected to city services. Resolution #2003-34 was amended to provide deferral of the assessments on unplatted properties until the property owner requests services. The deferred assessment will not accrue interest during the deferral period. Fay made a motion to adopt RESOLUTION #2003-34 titled RESOLUTION ADOPTING ASSESSMENT FOR INIPROVIIENTS. Klecker seconded the motion. All voted aye The Council agreed to reschedule the meeting with the Fire Department officers to discuss policies on Wednesday, December 10 at 7:30PM. Klecker made a motion to approve the Public Works'Parks Maintenance Report as presented. Rich seconded the motion. All voted aye. Rich made a motion to approve the NVWTF/Water Department Report as presented. Fay seconded the motion. All voted ave. Mayor Peterson reported that the STMA Hockey Board is looking for funding for needed irprovements at the ice arena. The estimated cost of the improvements is S400,000. The Youth Hockey Association is now considering construction of the locker rooms along with the enclosure to provide a second sheet of ice at some point in the future. In order for that to be feasible, additional land must be acquired to the south of the existing arena. The Council discussed how the project could be funded. The City has loancd the arena board S216,666.66 earlier. Although the arena is currently meeting operating expenses, it is not likely that enough revenues %Nill be generated to repay those loans. One possibility discussed Was funding the ice arena through the Park Dedication Fund. City Attornev Coun a& Ised the Council that unless the arena was designated as a park by all entities involved; hark dedication funds could likely not be used for improvements to the existing arena. Since a final plan for improvements is not vet available, the Council tabled further discussion, but did direct the city cnsginecr to contact Don Barthcl about the sale of his property south of the arena. 1 Albertville City Council Minutes November 17, 2003 Page 3 of 4 City Engineer Pete Carlson updated the Council on the NE Wright County Traffic Study. A joint meeting with the Albertville. St. Michael and Otsego City Councils has been scheduled for Tuesday, December 2, 2003, at 7:00 PM at the Otsego City Hall. Carlson reminded the Council that the ultimate decision will be made by the state and federal governments as to what if finally approved. Fay made a motion to accept the petition for Street and utility improvements from Bob Heuring and Finken Water Care Service, and directing the city engineer to prepare a Feasibility Study, contingent upon one or more of the owners front the money for the feasibility study. Klecker seconded the motion. All voted aye. Carlson reported that there has been a delay in the completion of the traffic light at the CSAH 37 ramp. Several reels of 14-2 Loop Lead -In Cable have failed to pass MNDOT's inspection. The cable provider is meeting with MNDOT in an effort to find out specifically %vhy the cable fails to pass inspection. The traffic light will not been up and operational by Nov. 20 as planned City Attorney Couri reviewed the Design Service Contract with S.E.H. for the wastewater plant expansion. The contract is virtually identical with the contract the city approved for the 1998 expansion. The contract price is 5296,900, based on the preliminary estimate of the entire project of 53.7 million. Court reviewed the draft of the lease with Franklin Outdoor Sign Company. Franklin is requesting a 1 5-year lease because the cost of the sign has gone up to 538,0000. The Council expressed concern that by agreeing to allow Franklin to construct the sign in exchange for the lease payments prevents the City from controlling who is allowed to rent space on the sign. The Council wants the spaces rented exclusively to the downtown businesses. The Council asked Franklin to prepare a cost proposal and a maintenance agreement for the sign for the Council to consider at the next meeting. Keith Franklin made a proposal to the Council regarding city-o�N ned land in the Barthel Industrial Park. Franklin would agree to pay for the completion of a cul-de-sac built in accordance with city standards in exchange for the ownership of three lots (Block 10, Lot 3; Block 2, Lots 9 and 10). The Council directed the city engineer to provide costs for completing, the street to Marlowe Avenue and tabled further discussion until the next meeting. The Council considered the request for alloNv ing the current administrator to use her unused sick leave as prepayment of her health and dental insurance plans. Klecker made a motion to pay for the administrator's health and dental insurance for six months in lieu of payment for 20 days of consulting sei_Vices after January 1, 2004. Rich seconded the motion. All voted aye. The Council directed Pete to begin looking into a plan for future expansion of City Hall, including a meeting room that could be used by local civic organizations. The City Council continued review from the November 3, 2003 meeting to allow the applicant the opportunity to revise and resubmit townhome plans. Towne Lakes 4"Addition consists of town home units to be located between West Laketowne Drive and Langford Drive south of Laketowne Drive. The Towne Lakes PUD and preliminary plat were approved in March 2003. This review is based upon the PUD approval, approved preliminary plat, and the Albertville Zoning and Subdivision ordinance regulations. The conditions of PUD approval include, without limitation, the following. - All town homes shall be owner occupied. Deed restrictions and the recorded PUD agreement shall prohibit rental units. 2. Each town home unit must have a separate utility connection to allow separate turn off and sewer connections through landscaped yards to the town homes. 3. Parking stalls must be provided for town homes in the southwestern portion of the plan. 4. Urban row town homes shall be of a design consistent with the Kingman plans. Building Plans. The applicant has indicated- that they are not able to construct the Kingman units and have requested the City Council to consider alternative building plans for the townhomes. In the event that the City Council finds the revised townhome and site plans acceptable, additional PUD flexibility will need to be granted to accommodate the proposal. The specific flexibility requests will be outlined later in this report. In general, the proposed units differ from the Kingman units in the following ways: The units proposed are two-story, slab on grade units as opposed to three-story units. The building pads for the proposed units are longer than the Kingman model. The balcony over the garages in the Kingman model have been replaced with ground level patios (about 8 x 10 feet) which are located outside of the rear door and adjacent to the garage. The units proposed contain uniform floor area consisting of 1,487 square feet as opposed to the Kingman models that provided a variety of unit sizes ranging from 1,405 to 1,780 square feet. The front entry of the Kingman models included a covered front entry with stairs to the front door. The proposed units are ground level units which also contain a covered front entry. The architectural detail of the Kingman model was distinctive containing varied window sizes, rooflines, planter boxes, decorative moldings, deep roof overhangs and planter boxes. The proposed units are more uniform and contain similar exterior materials as the Kingman model (combination cf shakes, lap siding and stone accents) but less architectural details. The front facade of the Kingman urban row houses was undulating and included varied materials (combination of shakes, brick, lap siding and wood trim with decorative accents including window boxes). Each unit had a separate elevated entrance. The rear facade of the Kingman urban row houses was undulating and included varied materials. Each unit had a two car tuck under garage and a balcony. 2 Two townhome plan options (Option A and Option B) have been submitted for consideration by the City Council. Both options are for two-story units versus the Kingman three-story units. To accommodate the new townhome design, the building pads for the units were elongated and as a result, some additional setback, garage size and building separation flexibility is requested. Both options A and B indicate a front fagade that contains a four -foot deep, front entry for each unit with roof canopy and columns. The end units have wrap -around porches. The front of the building is further enhanced with a front offset (for the exterior units with peaked rooflines) which project about one foot from the main front building facade). The rear of the units contain garages that project about 10 feet from the rear fagade, dormers on the end units and a canopy over each rear door. Each unit has a rear patio measuring approximately 8' x 10' feet. The proposed exterior materials for Option A consist of a mix of vinyl lap siding and stone accents along the bottom two feet of the front, sides and end units to the rear entry. Option B includes vinyl lap siding, stone accents and also shakes for all of the peak areas of the building including the two rear dormers. The stone accents are proposed to end at the bottom sill line of the first floor windows. Exterior lighting is also proposed at each rear entry and on both sides of the garage doors. Parking/Garage. The Kingman urban row houses included a 20.0 x 21'-4" (426 square foot), two -car tuck under garage proposed for each townhome unit. The revised plans presented with the final plat indicate that two -car garages are proposed measuring (18 x 21 feet = 378 square feet). The applicant was advised that the garage size of the proposed units must be consistent with the size of the Kingman model. The proposed townhomes have a garage size that is 48 square feet (11 %) smaller than the approved Kingman model. The reduction of garage size is partially due to the fact that the Kingman model contained a stairway from the garage to the first floor, the area of which approximates 27 square feet. The City granted PUD flexibility for garage size for the Kingman model allowing a reduction in area from the required 480 square foot garage size to the 426 square foot model. The proposed plans would require the Council to grant a further flexibility allowing a 378 square foot as opposed to 426 square foot garage size approved with the Kingman model. The PUD approval indicates that additional off -site parking stalls are, to be provided for the townhome units. The approved PUD plan indicated a total of 18 off -site parking spaces (7 of which were proposed within the central median of the private alley within Block 2). The proposed PUD plan has increased the width of the private alley from 20 to 24 feet, which caused the off -site parking spaces to be redistributed throughout Blocks 1 and 2 and increased the number of off -site parking spaces from 18 to 19. Garage Access. The preliminary plat indicates that the townhome units will be served by private drives, permitting the front of the townhome units to face the public street areas. The applicant requests that the City Council consider the grant of additional PUD flexibility to accommodate the proposed townhome units. The design change will result in decreasing the number of units within this phase of the PUD from 52 to 45 units, increasing off -site parking from 18 to 19 units and increasing the width of the private alleys from 20 to 24 feet. The wall-to-wall separation between the main parts of the building is 25 feet. 3 Unit 18 has a setback of 15 feet from the north corner of the garage to the private alley. 1 unit meets the 25-foot setback. 9 units have a 22-foot setback and 38 units have a 24-foot setback from the garage face to the private alleys. Landscape Plans. The proposed site and foundation landscaping plans provide generous and varied plant and tree materials that will result in an attractive development. Plant and tree sizes are in many cases in excess of size standards of the Zoning Ordinance. The developer (CPDC) will be responsible for installation of boulevard plantings and the applicant will be responsible for landscaping internal to the project site. The site will contain underground irrigation however, a specific irrigation plan has not yet been submitted. Final Plat Consistency with Preliminary Plat The design of the final plat is generally consistent with that of the approved preliminary plat for the same area. The preliminary plat indicates common lots for the town homes while the final plat number indicates individual unit lots. There will be 45 total town home units (14 units of Block 1 and 31 units on Block 2). The proposed number of units has been reduced by 7 units from the 52 units originally proposed. Boundary Adjustment and Vacation. To implement the plans as proposed, a boundary adjustment is proposed to increase the size of Block 1 (former Outlot B, Towne Lakes 31d Addition) by adding 12.16 feet to the southerly boundary of the block. The adjustment results in reducing the area of Outlot A, Towne Lakes 3,d Addition by about 3,040 square feet and is necessary to accommodate the longer units and El increased private alley widths proposed for this phase of the PUD. Outlot A is owned by CPDC and is intended to provide future private open space for the homeowners within the PUD. In addition to the boundary adjustment, drainage and utility easements platted in the underlying Outlots B and C, Towne Lakes 3`d Addition are proposed to be vacated. The vacation sites approximate the location of the proposed private alleys within the 4th Addition final plat (see Exhibit M for reference). The underlying easements need to be vacated because some of the proposed townhome units encroach within the previously platted drainage and utility easements. New drainage and utility easements will be platted outside of the unit lots for the townhomes as part of the Towne Lakes 4tn Addition plat. The applicant did not file a vacation petition with the final plat and as such, it will be necessary for the City Council to continue the PUD and final plat reviews until such a time as the applicant files an application for vacation and the appropriate public hearing is held to consider vacation of the drainage and utility easements. The applicant will also need to provide the City with the legal descriptions of the vacation sites so that public hearing notices can be published and posted. Parks and Trails. Park land dedication for the subdivision should be consistent with previous agreements. Grading, Drainage and Utilities. Issues related to grading, drainage and utilities should be subject to comment and recommendation by the City Engineer. Lot 15, Block 1 and Lot 32, Block 2 are completely encumbered by a drainage and utility easement. As such, it will be necessary for all private improvements including porches, patios and the like, to be included within the unit lot as opposed to the common area. The plans indicate that drainage and utility easements which were platted as part of Towne Lakes 3`d Addition need to be vacated in order to approve the plat as proposed. In order to accommodate front yard setbacks of 15 feet and maximize driveway lengths, Block 1 was shifted easterly 10 feet into Outlot A, Town Lakes 3`d Addition. The vacation matter will need to decided via public hearing before the City Council can take action to approve the final plat. Development Agreement. As part of final plat approval, the applicant will be required to enter into a development agreement with the City. RECOMMENDATION The City Council will need to determine if the proposed townhome unit design and PUD flexibility is consistent with the intent of the approved PUD. In the event that the City Council determines that the proposed townhome design and flexibility is acceptable, the hearings should be continued to the second Council meeting in January to allow the applicant to submit revised plans, vacation application, legal descriptions of the vacation site, and to allow staff to prepare a development agreement. It is the recommendation of Staff that the vacation public hearing, final plan PUD, final plat, and consideration of the 5 development agreement should all occur at one time. In the event that the City Council finds the proposal to be acceptable the following conditions of approval are suggested in addition to any changes identified by the City Council: Planned Unit Development: 1. The Urban Vida Townhome is a row product that is geared toward single professionals and couples typically without children. The unique quality of these townhomes is the ability to offer a private garage with direct access to the unit, a private front entrance and no unit stacked above another all %vithin an association maintained community. Emphasis on the front entrances and rear garage access gives this slab -on -grade product an urban appeal. Each unit has its own private front entrance with covered stoop, a patio off the back and 2-car garage. Even though this is a slab -on -grade product, the building pad is elevated from the public sidewalk where approximately 1 to 3 steps between the sidewalk and front stoop will be required. This report details my review of these plans to determine if they are reasonably in compliance with Chapter 5 of the 2003 Minnesota State Fire Code (MSFC) for fire service features including fire department access and water supplies. Futrell Fire Consult and Design Inc. (FFCDI) is involved in the review based on your city's contract with us to provide plan review services to the City of Albertville. Any comments in this review should be considered recommendations for your consideration, since FFCDI is not the Authority Having Jurisdiction for fire protection issues in the City of Albertville, nor is FFCDI the engineer or designer of record for this project. The scope of this review is limited to the fire service features and related site water supply for firefighting purposes. Any opinion of compliance should in no way be construed as approval or acceptance of the plans submitted by this contractor until they have received approval from the City of Albertville_ This letter does not authorize the contractor to purchase materials or begin installation on the project. STANDARDS USED TO CONDUCT THIS REVIEW This plan review is based on the following standards as adopted in Minnesota: • Minnesota State Fire Code (2003) comprised of the 2000 International Fire Code plus state amendments (SFC). • Minnesota State Fire Code (2003) optional Appendix Chapters B, C and D. • NFPA 13 (1999) edition. ADDITIONAL INFORMATION USED TO CONDUCT THIS REVIEW Based on a review of the plans, it appears these buildings most nearly resemble: 1. These buildings appear to be Type III-B construction, although the plans show insufficient information to verify the actual construction type. If they were not Type ill-B construction. we would need to modify our conclusions. 2. Maximum building size: 20,000 square feet for building B and 4,800 square feet foi building A. 3. Type `M" Mercantile Occupancy with a dedicated portion of building B indicated as storage. 4. Single story buildings. Gc+ober 29. 200'3 Seasonal Concepis Page 2 of 6 5. Not enough information is provided to determine if the buildings will be protected with automatic sprinklers. 6. Water flow test information from the Albertville water department: Static: 65 psig, residual: 35 psig with 1036 gpm flowing on the main at County Road 19 and 671h Street. This is based on information we received for a previous project, so if this data were not applicable to this site, we would need to revise our analysis. Listed below you will find the items included in the review and whether or not they appear to comply with the provision in the Minnesota State Fire Code, the NFPA Standards, or other nationally recognized standards: General: 1. Fire apparatus access roads and water supplies for fire protection shall be installed and made serviceable prior to and during the time of construction [MSFC (2003) Section 501.4]. 2. Premises identification is required as indicated in MSFC (2003) Section 505. 3. The buildings will require a key (Knox) box located as approved by the Fire Chief [MSFC (2003) Section 506]. 4. Fire Department access to equipment and labeling of rooms is required [MSFC (2003) Section 510]. 5. If high -piled storage is anticipated (greater than 12 foot high storage of class I through IV commodities or greater than 6 foot high storage of high hazard or plastic commodities), the requirements of MSFC Chapter 23 will apply [MSFC (2003) Section 503.1.3]. Fire department access doors are required around all sides of a building containing high piled combustible storage and include doors at least every 100 lineal feet around the perimeter with approved locking arrangements [MSFC (2003) Section 2306.6.1]. 6. If sprinklered, a horn and strobe is recommended above each fire department connection for the sprinkler systems [State Fire Marshal Division policy and MSFC (2003) Section 9121. Fire Department Access Roads: Based on the current layout, portions of buildings A and B are over 150 feet from the road providing access to the building (Linwood Drive). Given that this exceeds the 150 feet permitted by MSFC (2003) Section 503.1.1, it appears that access to and the parking lot must meet the specifications for a fire apparatus access road in MSFC (2003) Section 503: a. This selection of roads would thus create a road though the property that would be considered the fire department apparatus road. b. Dimensions, construction, surface, turning radius, and grade shall comply with MSFC (2003) Section 503.2. Based on MSFC Appendix Chapter D, nationally recognized standards of good practice. and data �ctobei � 200� Seasonal Concepts Page 3 or applicable to typical fire department ladder apparatus, we recommend a minimum 33-foot inside turning radius and 48 foot outside turning radius for the access road around the building, with a minimum clear unobstructed width of 20 feet. This could be larger based on any special apparatus in your fire department. c. It appears that dimensions within the apparatus road are in compliance with the MSFC however these requirements should be verified. d. We recommend posting of the parking lots and access road for no parking or signage to indicate that the apparatus road should not be obstructed at any time [MSFC (2003) Section 503.3 and 503.4]. MSFC (2003) Appendix D recommends posting "no parking' on at least one side for roads between 20 feet and 26 feet wide such as is provided here. Fire Department Water Supplies: 1. Fire protection water requirements shall be in accordance with MSFC (2003) Section 508 -and MSFC Appendix B (a nationally recognized standard). For a non-sprinklered structure of 20,000 square feet total floor area, the minimum fire flow is required to be 3,000 gpm for 3 hours with a minimum residual pressure of 20 psig. If these buildings are greater than one story in height the fire flow requirements must be reevaluated. 2. It would appear, by extrapolating the water flow test results that the minimum, or 3,000 gpm may not be available at a residual pressure greater than 20 psig. It is strongly recommend that a water flow test should be taken at the site to verify the maximum flow at 20 psi, since the water flow test was conducted with a maximum flow rate of 1,036 gpm. If the buildings are sprinklered then the required fire flow can be reduced significantly. Since information on the water supply capacities was not provided, the three-hour duration for minimum flow rate requirement has not been verified. 3. Fire hydrant locations shall be in accordance with MSFC Appendix C (nationally recognized standard). The minimum number of hydrants (three) appears to be provided with adequate average spacing between hydrants of 400 feet. Although not indicated on this plan it appears that additional hydrants will be installed in Linwood Drive. The required distance between hydrants is 400 feet from MSFC (2003) Table C105.1. 4. Because they are subject to damage by vehicles, we recommend that any fire hydrants located in the property be protected from vehicle impact according the MSFC (2003) Sections 508.5.6 and 312. 5 The fire department connection for a sprinkler system should be located within 50 to 100 feet of a fire hydrant. A proposed fire department connection is not shown on the plans, so this distance could not be verified. Fire apparatus access roads and water supplies for fire protection shall be installed and made serviceable prior to and during the time of construction [MSFC (2003) Section 501.4]. 2. Fire Department Access Roads: 7. Based on the current layout, proposed buildings 1, 2 and 3 are over 250 feet from the road providing access to the building (Jason Avenue). Given that this exceeds the 150 feet permitted by MSFC (2003) Section 503.1.1, it appears the following components, at a minimum, must meet the specifications for a fire apparatus access road in MSFC (2003) Section 503: • The parking lot for these buildings. 8. This use of the parking lot road would thus create a Loop though the property that would be considered the fire department apparatus road. 9. Dimensions, construction, surface, turning radius, and grade shall comply with MSFC (2003) Section 503.2. We recommend posting of the fire apparatus access road around the building for no parking or signage to indicate that the apparatus road should not be obstructed at any time [MSFC (2003) Section 503.3 a,,d 503.4]. MSFC (2003) Appendix D recommends posting "no parking" on at least one side for roads between 20 feet and 26 feet wide such as is provided here. Fire Department Water Supplies: 12. Fire protection water requirements shall be in accordance with MSFC (2003) Section 508 and MSFC Appendix B (a nationally recognized standard). For a non- sprinklered structure of 2.960 square feet total floor area, the minimum fire flow is required to be 1,500 gpm for 2 hours with a minimum residual pressure of 20 psig. If these buildings are greater than one story in height the fire flow requirements must be reevaluated. 13. We do not have information on the available water supply at this time, so this portion of the plans could not be verified. According to the City of Albertville Water Department no hydrant flow test was available. 14. Fire hydrant locations shall be in accordance with MSFC Appendix C (nationally recognized standard). In our review of this ordinance, it was determined that the City would delay action on approving these regulations to allow some modifications to Section 1000.10.F(2).f.1 which dealt with the hours of operation for commercial and industrial land uses. This provision stated that all illuminated window signs for advertising purposes shall be turned off between 12:00 AM and sunrise, except that said signs may be illuminated while the business facility on the premises is open for service. In the Council discussion, questions arose as to whether the commercial ground signs should be allowed to continue to be illuminated during these hours of operation if the business operation was closed. In considering the City Council's concerns, we offer the following language that can be incorporated into the proposed text amendment. 2. All illuminated ground signs and window signs for business identification or advertising purposes shall be turned off between 12:00 AM and sunrise; except that said sign may be illuminated while the business facility on the premises is open for service.. If this language is acceptable; then the ordinance as proposed along vwith this amendment may be adopted and we can make the final change in the text prier to the Mayor's signature. The Council raised issue with glare that may be produced from internally illuminated ground signs and asked for possible ordinance language that could address this issue. In examining the Sign Ordinance, under Section 10, permitted business signs, Section 10, Subd. 1.13 addresses ground signs for commercial and industrial operations. We offer the following language that attempts to respond to the Council's concern. 9. To avoid glare from internally illuminated ground signs, said sign faces shall have dark colored background with light colored lettering or symbols. Sign faces with white or light colored background shall be prohibited on internally illuminated ground signs. 10. Illuminated signs shall not produce more than one (1) foot candle illumination at the center line of any public street nor more than 0.4 (four - tenths) foot candle at the property line of any adjoining residential lot or parcel. The City Council is requested to act on the lighting ordinance amendment that was presented on November 3`d with the adjusted language. If the Council agrees with the proposed changes to the sign ordinance, this will be processed through the Planning Commission and brought back to the Council at a future date. The source of lights shall be hooded or controlled in some manner so as not to light adjacent property. Bare incandescent light bulbs shall not be permitted in view of adjacent property or public right-of-way. Any light or combination of lights which cast light on a public street shall not exceed one (1) foot candle (meter reading) as measured from the right-of-way line of said street. Any light or combination of lights which cast light on residential property shall not exceed four -tenths (0.4) foot candles (meter reading) as measured from said property. (2) New Fixtures.
