ADJOURNMENT 11 ALBERTVILLE CITY COUNCIL February 19, 2002 Albertville City Hall 7:00 PM PRESENT: Mayor John Olson, Councilmembers LeRoy Berning, Scott Wallace, Keith Franklin and John Vetsch, City Engineer Scott Hedlund, and City Administrator Linda Goeb Mayor Olson called the regular meeting of the Albertville City Council to order. The agenda was amended as follows: • Delete Item 5d(3) • Delete Legal Department Items • Add Item 4c — Camp Courage Wagon Train • Add Item 5f(7) — Rezoning for gas stations • Add Item 5f(8) — Report on Otsego public (Councilmember Franklin) Franklin made a motion to approve the agenda as amended. voted aye. meeting re: wastewater plant Berning seconded the motion. All Wallace made a motion to approve the minutes of the February 4, 2002, meeting as presented. Berning seconded the motion. All voted aye. Mayor Olson asked if anyone wished to address the Council under Citizen Forum. Mark Knutson, who had asked to address the Council, was not present at the time. No one else requested to address the Council. Mayor Olson stated that if Mark Knutson arrived later in the meeting, he would allow Knutson the opportunity to speak. Councilmember Berning requested that Check #'s 15810, 15826, 15833 and 15843 be removed from the Consent Agenda. Removed items were placed under Administration for discussion. Franklin made a motion to approve payment of Check #'s 15806 — 15709, Check #'s 15811 — 15825, Check #'s 15827 — 15832, and Check's 15834 — 15842 as presented. Wallace seconded the motion. All voted aye. Franklin made a motion to schedule the 2002 local Board of Review meeting for Monday, May 13, 2002, at 6:30 PM. Wallace seconded the motion. All voted aye. Franklin made a motion to approve the Camp Courage Wagon Train traveling through the City of Albertville. Wallace seconded the motion. All voted aye. Tim Guimont reported that the Parks Committee had met and gathered some information about the construction of skateboard park. The Committee recommends that the existing horseshoe pit at City Park be converted to the skateboard park. Fencing is already in place at the horseshoe pit and could be utilized. The Committee found that the price of 3-foot ramping equipment is $14,700, plus the concrete work, estimated at $3,000. Guimont asked the Council Albertville City Council Minutes January 22, 2002 Page 2 of 3 for guidance in whether or not to continue with this project. Councilmember Berning told the Council that the Albertville Jaycees will consider a donation for the skateboard park. The Council expressed concern over the insurance liability, but staff assured the Council that LMCIT now covers skateboard parks that have ramps that do not exceed three feet. The Council's consensus is to proceed with getting more information and to proceed with solicitation of donations. Berning made a motion to accept the Public Works/Parks Department Report as presented. Wallace seconded the motion. All voted aye. Vetsch made a motion to accept the WWTF/Water Department Report as presented. Franklin seconded the motion. All voted aye. He Council reviewed the memo from City Planner Cindy Sherman regarding park dedication fees for commercial and industrial areas. Sherman provided a survey of the commercial park dedication requirements from surrounding communities. The Council directed staff to review the park dedication requirements for single family lots in the surrounding communities as well. The consensus of the Council is that the City's requirements should be more in line with surrounding communities, both commercially and residentially. The Council will further discuss the park dedication fees at the next meeting. Mark Knutson, 5517 Kahler Drive NE, addressed the Council relating to building construction issues on his newly constructed home. Knutson told the Council that he has been required to spend additional money to replace two large windows in this home because they were not tempered glass. The approved building plan does not show tempered glass windows in the house, other than the one in the bathroom. He also stated that he had been required to re -do the staircase twice to pass inspections. On the approved plans for the house, the attic access is shown to be 22.5" x 30". Knutson framed in the attic access at 22" x 22", and the framing inspection passed. On the final inspection, he was told that the attic access would have to be changed. His complaint is that now the ceiling has been finished after the framing was already approved. The Council will discuss the problem at the next meeting when the building inspector can attend. City Engineer Scott Hedlund presented an amended Feasibility Study for the Northwest Commercial Park that included the Darkenwald project to the west. The council will approve the amended study at the next meeting. Franklin made a motion to accept the petition to authorize the city engineer to prepare plans and specifications for the public street and utilities into the Albertville Crossings project and to authorize the city engineer to proceed with the plans and specs. Wallace seconded the motion. All voted aye. City Administrator Goeb reviewed the City's ordinance limiting the time that persons can be in licensed liquor establishments. The current ordinance allows customers to be in the Albertville City Council Minutes January 22, 2002 Page 3 of 3 premises 35 minutes after a sale can legally occur. The licensee's employees are allowed in the premises 75 minutes after a sale can legally occur. The consensus of the Council is that the current ordinance is fail and they will not consider amending the ordinance. Berning made a motion to adopt RESOLUTION #2002-4 titled A RESOLUTION APPOINTING TERRI 1. H EDQUIST TO THE POSITION OF RECEPTIONIST/SECRETARY. Wallace seconded the motion. All voted aye. Franklin made a motion to regretfully accept the resignation of Jim Brown from the Planning & Zoning Commission to present a $50 gift certificate to Russell's Of Course to Mr. Brown in recognition of his many years of service to the City. Wallace seconded the motion. All voted aye. City Administrator Goeb explained that the Planning and Zoning Commission is holding a public hearing on the zoning of the property north of the freeway to B-2A, which will not allow gas stations in the district. Councilmember Franklin gave the Council a brief update on the meeting conducted by the City of Otsego regarding the construction of a new wastewater treatment plant to be located north of 70`i' Street. Box 56 Albertville, MN 55301 The officers of the Albertville Fire Department would like to change our medical direction to Dr. Charles Lick through Allina hospital in buffalo. Medical direction is needed for the services we provide in rescue calls; specifically, defibrillation and life saving interventions that we participate in while on "ride alongs" with allina ALS ambulance. Both Hanover and St. Michael fire departments are changing to DR. Lick. Having us all under the same medical direction greatly enhances our mutual aid abilities as we are all being trained under the same techniques and rescue procedures. Joe Campbell Albertville Fire Training officer [763] 497-4874 I F, Agreement (Example) This Agreement is made and entered into this day of , 2000 by and between Allina Health System, a Minnesota non-profit corporation, dPola Allina Hospitals and Clinics CAllina Medical Transportation') located at 167 Grand Avenue, St. Paul, Minnesota 55102 and fire Department ("First Responder*) having principal offices at Witnesseth WHEREAS, First Responder is an entity engaged in providing emergency response, care and treatment services to patients within its geographical service area; and WHEREAS, Allina Medical Transportation is the ALS and/or BLS service provider in First Responder`s service area and has the personnel and resources to provide medical direction oversight to First Responder, and WHEREAS, First Responder wishes to utilize medical direction oversight in the manner and to the extant set forth in this Agreement and the attachments hereto; NOW, THEREFORE, the parties hereto hereby agree as follows: 1 MWical Dire on,,t?2r*ght. Allina Medical Transportation hereby agrees to provide medical dftclion oversight to First Responder throughout the term of this Agreement. For the purposes of this Agreement, medical direction oversight will Include: r a. approving standards for training and orientation of personnel that impact patient cue; b. approving standards for purchasing equipment and supplies that impact patient care; C. establishing standing orders for prehospital care; d. approving triage, trealtrnent, and transportation protocols; e. participating in the development and operation of continuous quality imprrvernient programs; f. establishing procedures for the administration of drugs; g. maintaining the quality of care according to the standards and procedures established under clauses (a) to (f); h. All areas will be bounded with concrete curb and gutter and bituminous pavement will be used for surfacing. The layout includes a surmountable curb design where the parking lot expansion is to occur. This will allow expansion of the parking area without removing the curb and gutter. The future expansion area also requires the installation of curb and gutter around the perimeter and paving. The parking provisions of the ordinance require that a buffer be provided for parking lots adjacent to residential areas and along street frontages. The screening or landscape buffer is to be 4 feet in height. The applicant is proposing the use of Isanti Dogwoods as plantings along the street frontages. There is no berm proposed since the change in elevation across the street and the plantings provides a buffer. Building type and construction: The proposed expansion and existing building will have an exterior appearance consisting of predominately stucco with "textured masonry finish" or rock face block on a portion of the north, east, and west facing elevations. The church has not established a specific color palate for the structure but it is anticipated that it will be some type of earth -tone color. Signage: The existing sign on the site is to be relocated on the site. There is no wall signage proposed. As required by ordinance, the sign is to be setback at least 10 feet from property lines and back from the intersection so as to be outside of the site distance triangle. The sign as shown meets the ordinance. Exterior Storage: No exterior storage is proposed as part of the application. The trash area shall be enclosed and is to be constructed of materials to match the building. Grading/Drainage/Utilities: Provisions for ponding on the site have been made. The final plans for grading, drainage and utilities are subject to the review and approval of the City Engineer. Landscaping Plan: A landscaping plan has been submitted that utilizes a combination of transplanted trees and new plantings. The bulk of the plantings are concentrated on the north side of the lot, which is adjacent to a house. The ordinance requires that parking lots containing five or more stalls provide screening and landscaping adjacent to street frontages and residential areas. Plantings have been added adjacent to the street frontages that meet the landscape requirements. The applicant shall post the appropriate landscape guarantee as required by the Zoning Ordinance. Lighting: A lighting plan has been provided that shows nine light fixtures. Five are single head and four are double heads. The foot-candle measurements, as provided, do not meet the ordinance regulations. The maximum lighting level at the border with residential use is 0.4 foot-candles and 1 foot-candle at the center of a street. The lighting needs to be modified to meet this provision. The freestanding fixtures are shoebox style and should have a recessed lens. Cut -sheets, which depict the fixtures, should be provided. Any lighting on the building needs to be identified and is required to meet the ordinance. Recommendation The Planning Commission reviewed this request and they recommend approval of the site and building plan application for Life In Christ Lutheran Church subject to the following conditions: 1. The landscaping plan and grading plan shall be modified to meet the zoning ordinance requirements for landscaping and buffering. 2. Any transplanted trees that do not survive shall be replaced with trees that meet the ordinance for type and size. 3. The Site Plan and related grading, utility and access issues are subject to the review and approval of the City Engineer. 4. All lighting shall use a shielded light source and the lighting shall be modified to meet the ordinance regarding foot-candle levels at the site perimeter. 5. The recreational vehicles would be used to house volunteer workers who travel to various sites to help churches with construction projects wher-'they work,for minimum wage. � In review of the ordinance staff determined that the use was specifically prohibited. The Council directed staff to develop an ordinance that would allow temporary structures on a limited basis. The Planning Commission held a public hearing and recommends approval of the ordinance as attached. The important features of the ordinance include: 1. Limits the use of temporary structures to construction projects and to the Public/institutional or Commercial zoning districts. 2. The temporary use is an administrative permit approved by staff with a limit of one permit event per property per five (5) year period. 3. A specific time frame runs with the permit. 4. The ordinance outlines performance standards regarding setbacks, site security, etc. Recommendation Modifications to the -Zoning Ordinance are policy decisions to be made by the City Council with a recommendation from the Planning Commission. The Planning Commission recommends approval of the ordinance as attached. Temporary Structure Ordinance Page 2 of 2 CITY OF ALBERTVILLE WRIGHT COUNTY, MINNESOTA ORDINANCE NO.2002-4 AN ORDINANCE AMENDING SECTION 1000.2, DWELLING UNIT RESTRICTION, OF THE ALBERTVILLE ZONING ORDINANCE THE CITY COUNCIL OF THE CITY OF ALBERTVILLE, MINNESOTA ORDAINS: SECTION 1. PURPOSE. The purpose of this ordinance is to provide for the erection of temporary structures (not including model homes/temporary real estate offices or temporary classroom structures for use by a public or private institution) needed for emergency purposes or for temporary use during the construction of a permanent structure. SECTION 2. Section 1000.2 (a) is hereby amended to wit (underline indicates new language, strike through indicates delete): (a) No garage, tent, accessory building or travel trailer shall at any time be used as living quarters, temporarily or permanently except recreational vehicles as follows: (1) Structures: Temporary structures governed by this Section shall be allowed in Public/Institutional (P/1) or Commercial (B) zoning districts subject to the issuance of an administrative permit. (2) Site Plan Required: No administrative permit shall be issued fora temporary structure unless a site plan pursuant to Section 1500 of the Zoning Ordinance has also been approved if applicable, or unless a building permit has been issued fora new structure, addition or remodeling of an existing structure on the property. (3) Termination of Permit: The administrative permit shall terminate nine (9) months from its date of issuance, or within thirty (30) days after a certificate of occupancy has been issued by the Building Official for the permanent structure, whichever occurs first, unless a different time schedule is approved as part of the permit. The permit may be extended for one additional ninety (90) day period by the Zoning Administrator. Only one permit event per propertyper five (5) year period shall be allowed. (4) Setback: Temporary structures may be placed in a required building setback area, provided that no such structure may be placed within Twenty (20) feet of a public right of way or obstruct visibility at any street intersection or driveway access. (5) State Building Code: All requirements of the State Building Code shall be r, met, if applicable. (6) Water and Sewer: Provisions for water and sewer servicing the temQorary structures shall be subject to the review and approval of the Building Official. (7) Security Measures: Security measures such as lighting shall be implemented subject to the review and approval of the Zoning Administrator. This survey has been completed and the results are attached. In 2000, an issue was raised regarding the park dedication fees. At that time the requirement was that park dedication was 10% land or a cash equivalent based upon fair market value of the property at the time of sale. When the policy was established in 1997, commercial land values were estimated to be approximately $20,000/acre. The development of the Albertville Outlet Mall along with other economic conditions resulted in land values that were substantially higher then anticipated in 1997. These factors resulted in dedication fees that were extremely high; in one case the fee would have been $30,000 per acre based on the purchase price of the site. The City Council modified the policy and set a flat rate of $7,385 per acre. The fee was established by calculating the anticipated Park and Trail improvements and their costs and subtracting the estimated fees to be collected from future residential developments. The remaining balance of the cost to implement the park plan was then divided by the number of acres remaining to be developed for commercial and industrial uses. The City Council chose to spread 100% of these remaining costs against undeveloped commercial and industrial properties and thus, adopted the fee at $7,385 per acre. Other options presented to the Council for the unfunded portion of the park plan were as follows: 70% = $4,472/acre 75% = $4,958/acre 80% = $5,443/acre Adopting a fee that did not totally fund the park plan would have required the city to budget for some of the improvements anticipated. The City Council was reluctant to do so in 2000. This information is provided to give the Council the history on how the current fee was established. Supporting data from the 2000 study is available. The project has since been renamed the Northwest Commercial Park. This addendum outlines municipal improvements on a 25 acre site west of and adjacent to the original commercial park. Financial and technical feasibility of the proposed improvements and assessment of benefits are discussed below. Feasibility and Recommendations This project is necessary to provide municipal services to the proposed developme4t and allow commercial lots tol be created. The project is feasible, cost effective, and can best be accomplished as proposed. Existing Conditions Currently, the site is undeveloped and had been farmed. The site is bounded by Interstate 94 (I-94) to the south and the Outlet Mall and the city's proposed commercial park to the east. The site slopes from northwest to southeast, and drains into the Westland complex on the south side of the Outlet Mall. Improvements Proposed Commercial Subdivision Three 5+ acre lots will be created as shown on Figure No. 1. These lots would be platted in accordance with the city's zoning ordinance. snit Eli ins ' . Storm Sewer The majority of runoff from lots would be collected into the proposed storm sewer. The storm sewer would drain to proposed detention ponds located as shown on Figure No.2. The storm sewer would be designed for a 10-year storm, and the storm water detention pond would be designed for a 100-year storm. The ponds would outlet into the wetland ' complex on the south side of the Outlet Mail. This wetland complex drains easterly to School Lake. Sanitary Sewer New sanitary sewer would consist of 10-inch polyvinyl chloride (PVC) pipe, and the services would be 6-inch PVC pipe. The sanitary sewer would drain easterly through the city's_commercial park to a new lift'station recently constructed in the Towne Lakes development. Water Main New water main would consist of 12-inch PVC pipe and the services would be 6-inch PVC pipe. The new water main is part of the city's trunk water main system;. As part of this project, the 12-inch water main will be extended southerly across I-94 and connect to existing 12-inch water main in the Karston Kove development. Cost Summary The total estimated cost for this addendum is $539,370. Table 1 summarizes the probable cost of this project. Any legal or procedural issues are addressed at this point. NON -CONTESTED PROCEEDINGS Non -contested proceedings include any proposed boundary adjustment filed under a section of Minnesota Statutes Chapter 414 that does not require a hearing, or where a hearing is not necessary due to a waiver of a right to object or a joint filing, as provided for by law. The director of Minnesota Planning reviews non -contested proceedings for approval on a monthly basis or bi-monthly as needed. Expedited review i available when requested for good cause. CONTESTED PROCEEDINGS Contested proceedings include proposed boundary adjustments filed under any section of Minnesota Statutes Chapter 414 that requires a hearing or where a hearing is triggered on receipt of a timely objection as provided for by law. The statute requires a hearing date be scheduled within 30 to 60 days after receipt of initiating documents or a timely objection. A decision on the matt must be made one year from the date of the first hearing. Legal notice must published for two consecutive weeks prior to the hearing (Minnesota Statut Section 414.09 Subdivision 1) . Prior to the first hearing, the director of Minnesota Planning reviews the file and considers whether to send the matter straight to hearing or invoke eithe ■ Minnesota Statutes Section 414.01, Subdivision 16, which requires parties to meet locally at least three times during a 60-day period and report back to the director the results of those meetings. The director may grant extensions of this time period if circumstances warrant; or ■ Mediation, in which a neutral third party facilitates a compromise settlement.
