PRESENT: Mayor John Olson, Councilmembers LeRoy Berning, Keith Franklin, Scott
Wallace, and John Vetsch, City Engineer Peter Carlson, City Attorney Mike Couri, and City
Administrator -Clerk Linda Goeb
Mayor Olson called the regular meeting of the Albertville City Council to order.
The agenda was amended by adding the following:

Wallace made a motion to adopt the agenda as amended. Berning seconded the motion.
All voted aye.
Franklin made a motion to approve the minutes of the July 2, 2001, meeting as submitted.
Wallace seconded the motion. All voted aye.
Mayor Olson asked if anyone wished to address the Council under Citizen Forum.
Judy Roden addressed the Council in regards to the cattails growing in the ditch along
CSAH 19 and 57`h Street. The Council informed Ms. Roden that the ditch clean-up would be the
responsibility of Wright County.
Sally Schmidt addressed the Council regarding 11415 54`h Street. Last week there was a
fire at the house. Schmidt and several other neighbors are concerned about the safety of the
home and the fact that cleanup has not yet been started. City Attorney Couri commented that the
city can condemn a house when there is a public health or safety hazard. That process can take
two or more years through the court system. The first step is to evaluate if there is a public
hazard. The second step is to send a letter to the property owner identifying the hazard. The
third step would be to allow time to repair the hazard. If the repairs are not made, a letter is sent
to the property owners to board open windows. The building inspector would go out to inspect.
Berning requested that Check # 14865 be removed from the Consent Agenda and placed
under the Administration Department.
Franklin made a motion to approve payment of Check #'s 14834 - 148164and Check #'s
14866 - 14875 as presented. Wallace seconded the motion. All voted aye.

Chief Kevin Roden, representing the Fire Department, was present to discuss the Aerial
Truck. The Finance Committee has met with the Truck Committee, regarding financing the
truck.. The general consensus is to sell Equipment Certificates, and Paul Donna will be putting
together several different financial scenarios for consideration at the next Council meeting
The Truck Committee request that the City consider a change order to the original bid to
construct a tandem axle chassis vs. the single axle at an additional cost of $3,493. Attorney
Couri indicated that the Council could approve a change order provided the basic chassis and
General Safety Equipment is still the low bidder.
Vetsch made a motion to approve RESOLUTION 2001-15 titled RESOLUTION
ACCEPTING LOW BID FOR AERIAL LADDER TRUCK awarding the bid for the aerial
ladder truck to General Safety Equipment. Co. in the amount of $474,656, less deductions of
$6,060 if the chassis upon completion and $2,460 if the ladder is paid upon completion, and
with a change order to add the tandem axle at an additional cost of $3,493. Franklin seconded
the motion. All voted aye.
Berning made a motion to table the purchase of a snow plow to the next City Council
meeting. Wallace seconded the motion. Bering, Franklin and Wallace voted aye. Vetsch, and
Olson voted no. The motion carried.
Franklin made a motion to approve the Public Works Report as presented. Berning
seconded the motion. All voted aye.
John Middendorf, Wastewater Department reported that the PCA is changing the sampling
requirements. pH and dissolved oxygen levels must now be recorded every day. Because
testing the levels manually requires a skill level that may be difficult for employees who are on
weekend call only once in four weeks, John is requesting a change order to the Wastewater
Expansion Project to add pH and DO meters to simplify recording those readings. Estimated
cost of the change is $6,000 - $8,000.
Vetsch made a motion to approve a change order to the Wastewater Expansion Project to
add a pH and a DO meter. Franklin seconded the motion. All voted aye.
Wallace made a motion to approve the Wastewater Treatment Facility Report. Berning
seconded the motion. All voted aye.
City Engineer requested authorization to advertise for bids the Commercial Park Project,
consisting of a 44-foot wide industrial road with curb and gutter, ten inch sanitary sewer from
Towne Lakes Lift Station across CSAH 19 through park to the Roden property, and a twelve
inch water main extending west from Outlet at Albertville and an eight inch water main to
CSAH 19. The project will include bypass and acceleration lanes ($75,000 estimate). Outlot A
will be used for mitigation. Outlot C could be used for mitigation or allow it to be attached to

future development. It is proposed to include in the bid documents the extensions into the
Darkenwald project to the west.
Carlson discussed looping the water main under I-94 to Karston Cove. Funding for this
portion of the project would be paid through Trunk Water fees. The Council agreed to loop the
water main as discussed.
Franklin made a motion to approve RESOLUTION 2001-16, titled RESOLUTION
APPROVING PLANS AND SPECIFICATIONS FOR INDUSTRIAL ROAD PROJECT
AND AUTHORIZING ADVERTISEMENT FOR BIDS, including looping water main under
I-94 to Karston Cove. Berning seconded the motion. All voted aye. Wallace stated for the
record that he is still uneasy with costs of the project.
Wallace made a motion to hold a special meeting on Wednesday, August 15`h at 7:00 p.m.
at City Hall in the Council Chamber to consider bids for the Commercial Park Project. Vetsch
seconded the motion. All voted aye.
The Council discussed Parking Restrictions in the Towne Lakes Addition. "No Parking"
signs will be placed on one side of the 28-foot streets. Berning suggested that parking be
allowed on one side only on all streets in the Towne Lakes Addition.
Carlson questioned how the Council wished to address checking rear yard elevations on
new home constructions. The City does not have the necessary equipment to have an employee
check the elevations and hiring an engineer or a surveyor to verify. the elevations would be
costly. The Council decided that no physical inspection on elevations would be necessary but
the as -built survey must be provided at final building inspection. Staff is directed to prepare and
issue a memo explaining the procedure with all new home building permit applications.
Carlson updated the Council on CSAH 18 trail. The bid to add a railing to the trail along
the south side of CSAH 18 area of wetlands came in at $21,000. Construction of the trail itself is
$35,000 (without the railing). MnDOT recommends a railing but does not require one.
Berning made a motion to delete railing because the cost is prohibitive and the rail could
create nuisance in skateboarding, etc. Franklin seconded the motion. All vote aye.
Bob Heuring is requesting a hold -harmless agreement from the City if tractors or cattle
cause damage to the CSAH 18 trail by crossing. It was the consensus of the Council to deny the
request for a hold- harmless agreement
Carlson explained that the stop signs on Barthel Industrial Drive have been delayed
because the overhead powerline had to be buried. The lines have been buried and those signs
will go up Wednesday.

Carlson explained that the City Park layout shows only a small parking lot by hockey rink
The Council asked to review the layout at the next regular City Council meeting.
Carlson recommended that the Savitski/Towne Lakes Lift Station project be re -bid as part
of Commercial Road Project because the Lametti and Sons low re -bid came in at . $497,883.00,
still higher than the engineer's estimate.
Berning made a motion to reject all bids for the Savitski/Towne Lakes Lift Station Project
and to add that project to the Commercial Road Project. Vetsch seconded the motion. Berning,
Vetsch, Olson and Franklin voted aye. Wallace voted no. The motion carried.
City Attorney Mike Couri reviewed the history of the water tower lot on 57th Street.
Campbell Abstract made an error in determining that the City only held a one -ninth interest in
the property. He has been in contact with the title company to recoup City expenses in
attempting to get a title on the property.
Donatus Vetsch approached the City Council. If the Council decides to sell the water
tower lot, he would like to purchase a 5-foot strip on the westerly edge. The City as the seller
would be responsible for re -platting the two lots.
Wallace made a motion to hire real estate appraiser to determine the fair market price not a
not -to -exceed cost of $300. Franklin seconded the motion. All voted aye.
Vetsch made a motion to approve RESOLUTION 2001-17, titled RESOLUTION
ACCEPTING BID FOR THE SALE OF CITY OWNED PROPERTY, selling the house at
to the high bidder, Laura Benson, effective at 12:00 noon on Friday, July 20. This allows Albert
and Pam Barthel the opportunity to match the bid price of $10,200, as earlier agreed. Wallace
seconded the motion. All voted aye.
The Council discussed Resolution 2001-19 (A Joint Resolution Requesting Concurrent
Detachment from Albertville and Annexation to St. Michael) pertaining to the Falbo property to
be developed by JMS. The Council feels that a potential trade in properties between the City of
Albertville and the City of St. Michael would be appropriate. The Council tabled further
discussion at this time.
The Council reviewed the Listing Agreement for the sale of the City's commercial land
north of the mall. Mayor Olson requested the Councilmembers to notify the administrator of any
requested changes.
It was brought to the Council's attention that hydro -seeding was done at 10465 51 st Court
NE. This is a new home constructed within the City limits. City ordinances require that sod be
laid in order to release the escrow deposit. Both Linda and Tim have visited the property and
Linda advised the property owner that the escrow deposit would not be released until turf is

established from the hydro -seeding. The Council agreed not to allow further hydro -seeding as an
alternative to sod.
Berning made motion to approve payment of check #14865. Franklin seconded the
motion. All voted aye.

RE: Equipment Certificates of Indebtedness
Enclosed please find the analysis you requested regarding the issuance of Certificates of
Indebtedness for the purpose of financing a new fire truck. As you know, Certificates
of Indebtedness are limited to a term of five years. In addition, they are subject to a
"reverse referendum" process if the total amount borrowed exceeds .25% (.0025) of
the City's assessed market value or roughly $450,000. We have assumed the City
requires $500,000 for the acquisition of the fire truck and that the financing will take
place this December so that a 2001/2002 levy can be made.
Scenario A assumes the City finances 100% of the purchase. The total amount
borrowed to cover the fire truck and all financing costs would be $510,000. Page one
illustrates the sources and uses of funds. Page 2 shows the estimated annual payments.
Assuming an average interest rate of 4.03% the average annual payment would be
$114,641. The total interest cost equals $63,207.
Scenario B assumes the City contributes $60,000 of cash to reduce the borrowing to
maximum amount permitted without being subject to a "reverse referendum". The total
amount borrowed is reduced to $450,000. Page 3 illustrates the sources and uses of
funds. Page 4 shows the estimated annual payments. Assuming an average interest
rate of 4.03% the average annual payment would be $101,148. The total interest cost
equals $55,740.
Scenario C assumes the City contributes even more cash - $150,000 to reduce the
financing required. The total amount borrowed is $355,000. Page 5 illustrates the
sources and uses of funds. Page 6 shows the estimated annual payments. Assuming an
average interest rate of 4.03% the average annual payment would be $79,804. The
total interest cost equals $44,020.
The City will need to determine the amount of equity it wishes to contribute toward the
purchase. One must weigh the opportunity cost and future use of those funds among
other factors to arrive at an amount. I hope this information is helpful. Please do not

PARKS MAINTENANCE — The hockey rink has been painted. A drinking fountain
for Oakside Park has been purchased and will be installed soon.
A keystone block planter has been made around the Westwind Park sign.
New edging has been installed at the City Park — volleyball court.
WASTEWATER — As of July 31, 2001 we have jetted and cleaned 19,128 feet of
sewer mains.
SNOW PLOWING - Last year when we plowed we used two plow trucks, the loader
and the one -ton truck. On average with a 2" — 3" snow fall it usually takes six to seven
hours to plow and an additional two hours to clear the sidewalks, skating rink, and other
shoveling. On a large snowfall it can take us over eight hours just to do the plowing
then we still have the sidewalks and the shoveling to do, leaving the skating rink for the
next day. Last year we had one part time person driving the one -ton truck plowing
some cul de sac and parking lots. This Winter I would like to try to hire one additional
person to do the sidewalks, skating rink, and the shoveling. By the time the snow falls
this winter, we will have added an additional four miles of roads and three cul de sac.
Keep in mind we are trying to replace a truck, not add one.
I was able to find two used trucks with the equipment we need:

Chair Brown called the regular meeting of the Planning and Zoning Commission to order.
PRESENT: Chair Jim Brown, Commission members Ed Budde, Ray Meyer, and Ron
Klecker, City Planner Cindy Sherman, and Deputy Clerk Bridget Miller.
Budde made a motion to approve the agenda as submitted. Meyer seconded the motion.

3. PUBLIC HEARINGS
a) Zoning Request Application — Darkenwald Read Estate
Chair Brown opened the Public hearing at 7:03 p.m.
Chair Brown commented that they were before the Planning and Zoning Commission
with a concept plan. He asked the City Planner Sherman to go over the staff memo
and recommendations.
City Planner Sherman reviewed the staff report and went over the recommendations
with the Commission and others in the audience.
Chair Brown asked if there was anyone in the audience to represent the Darkenwald
Development.
John Kuusisto, of RLK-Kuusisto, Ltd. was present to represent the Development. He
is the site design and engineer who put the site plant together.
Chair Brown had a question about the outlots.
Commission member Budde asked about the access road from this development and
the Outlet Mall.

Klecker made a motion to approve the Zoning Request Application and Preliminary
Plat with the staff recommendations and keeping Item No. 2 as a safety net. Meyer
seconded the motion. All voted aye.
4. OTHERBUSINESS
a) Briefly Interview Commission Applicants
Chair Brown asked if the applicants were present in the audience. All four were
present.
He said he would ask each applicant in no specific order to go into a little more detail
about his or her interest in the Planning Commission.
First one was Charles Fritze who resides at 10302 Karston Avenue NE in Albertville.
He moved to Albertville in the fall of 2000. He looks forward to his children going to
the STMA schools and graduating from STMA. He went over his schooling he has
completed. He wants to get involved with the City and thought this would be a good
opportunity. He noticed that Albertville seems to be a blossoming city. He touched
on the work history and education. He has taken classes at St. Cloud College and
worked heavily with the Student Government Judiciary Committee. He asked what
type or types of projects the Commission has been up against.
Chair Brown briefly introduced the Commission members to Charles and the others in
the audience. He commented that they were involved in the reviewing of the Outlets
at Albertville, reviewing the Golf Course and numerous residential developments.
Next applicant was Tom Fay who resides at 10795 — 70t' Street NE in Albertville. He
has lived in area for 27 years and has seen the changes. He would like to help the
City continue to grow. He wants to become more involved in the planning of the
future growth and look out for the best interest of the residents of Albertville. His
employment background is in the Electrical Contracting business for 14-years.

Next applicant was Tim Sweeney who resides at 6111 Kahler Drive NE in Albertville.
Tim has always wanted to be more involved in the community. He has been with the
Lions in other communities he had resided in.
He has done a considerable amount of research on Albertville before he and his wife
decided to move here. He working in the Wayzata area and enjoys coming home to
the country scenery. He appreciates the hometown feeling Albertville has. He looks
forward to going to the local restaurants and recognizing the residents or neighbors.
He has children and likes the thought of them going to the St. Michael/Albertville
Schools.
What he feels the commission has some guidelines to go by, but to look at all of the
aspects of what is proposed before them.
Finalapplicant is Leslie Fessler who resides at 11191 Lachman Circle NE in
Albertville. She asked the commission what quality or qualifications they are looking
for in a commission member.
Commission member Meyer commented that it would be someone who would
represent the community. Look out for the best possible solution to meet the needs of
the community. Chair Brown agreed with his comments.
Commission member Budde commented that it is good to have a diversity of
representatives. That way all the possible areas would represent the community.
Commission member Klecker commented about how at times we have easy decisions
to make and other times we are up against some difficult ones. It is hard to please
everyone that comes in, but we try to think of the community and where it could
possible grow to.
Leslie then went into more detail of her work history. She has dealt with a number of
areas in her work history and felt she would be an asset to the Commission. She
would review the items that came across her desk from medical supplies to
construction concerns. She would make the best decision with the interest of the
residents in mind.
Chair Brown suggested that the commission members present goes through the
applicants and ranks them 1 to 4. 1 being their first choice and 4 being their last
choice. Chair Brown would add the scores up and let them know who got the highest
and lowest score.

information with the Commission. It is great to see some interest from the residents

BACKGROUND
Mr. John Darkenwald has submitted an application for preliminary plat for property
located to the west of the Outlets at Albertville site and on the north side of 1-94. The
request is to plat three building sites with related right-of-way and outlots to include
ponding and wetland areas.
While the site is zoned PUD the staff is using the B-3 regulations as a means to review
lot sizes and dimensions as well as permitted uses.
ANALYSIS
Preliminary Plat
The City Council and Planning Commission have reviewed concept plans for the entire
area as it relates to the City project as well as the surrounding property. The
preliminary plat itself only addresses the lots proposed to be platted at this time. Based
upon the concept reviews staff believes platting only the portion proposed for
development at this time is acceptable.
The preliminary plat creates three buildable lots. The lots are all just over 5 acres in
size. The plat provides right-of-way that will connect to the road through the City
property at the location determined by the City. Right-of-way also includes construction
of a cul-de-sac that provides access to two of the lots. The right-of-way is shown at 70
feet, the City Engineer will review if this is adequate.
Grading and drainage plans have been submitted along with wetland delineations and
mitigation plans for proposed areas of fill. The City Engineer will review and comment
on the plans.
Park Dedication
The City subdivision regulations require that park dedication be satisfied at the time of
platting property. In this case there is no land dedication proposed. Dedication will be
satisfied by cash fees in lieu of land. The amount of dedication is currently $7,385
per acre. Dedication will be paid at the rate in effect at the time of final plat.
Site Plans
No specific users have been identified at this time. Detailed individual site plans will be
submitted in the future for each lot.
RECOMMENDATION
The Planning Commission held a public hearing and reviewed this request at a meeting
on July 26, 2001. The Commission recommends approval of the preliminary plat
subject to the following conditions:
1. The preliminary plat shall not proceed to final plat unless the roadway projects
move forward concurrently.
2. The grading, drainage and wetland information is subject to the review and
approval of the City Engineer.
3. Each lot is subject to site plan review for the individual users identified in the
future.
4. Park dedication shall be paid based on the rates in effect at the time of
preliminary plat.
5. B-3 zoning regulations shall provide the basis for site development and permitted

PROJECT DESCRIPTION
Site and Utility Improvements:
The development includes three rough graded commercial lots and the construction of three
stormwater ponds. Separate building/ final site plan applications are anticipated to be submitted
by the future lot developers for each of the three lots for concurrent approval with the subject
project. The final plans will include site plans, parking lot, grading, utility, landscape plans and
building plans.
The project has been designed in conjunction with the city roadway and utility project extending
westward from County Road 19 on the east of the subject project. The city project includes a
public roadway, sanitary sewer trunk and water main that will serve the new development.
Additionally, there are a number of wetlands within the project limits that will be incorporated
into the project. An area of new wetland creation is proposed along the existing large wetland on
the east side of the property, to provide mitigation for wetland impacts primarily along the I-94

frontage, where the construction of I-94 and associated grading resulted in drainage ditches that
route stormwater runoff from the highway across the subject property, which have been
delineated as wetlands. Detailed plans identifying specific proposed wetland impacts and
mitigation will be submitted with the wetland permit application in the near future.
Construction Coordination:
Construction of the project will most likely occur concurrently with the city project and with the
individual lot developers. Project specifications will clearly outline the contractor's
responsibility for coordination of construction and regular communications with the other
contractors and city officials during the course of the project.
Property Acquisition/ Platting:
Darkenwald Real. Estate has an exclusive long term option to purchase the Roden property
located in Section 35-122-24. The Applicant is currently completing agreements to sell two of
the lots shown on the preliminary plat to "big box" retailers. When all necessary permits and
approvals have been obtained for the subject project, Darkenwald Real Estate will exercise the
option, file the plat and complete the sales to the "big box" retailers. The preliminary plat also
illustrates proposed public right of way and drainage and utility easements to be dedicated.

A 24" diameter culvert with an invert elevation of 945.68 controls the normal water elevation
within the large wetland in the Albert Villas development. The City's public works staff will
ultimately maintain this culvert and all storm drainage improvements. Staff from the Wright Soil
and Water Conservation District has requested the City pass a motion that states the City
understands its responsibilities related to maintenance of this culvert and the wetland. This issue
is spelled out in the developers agreement, the Conservation District insisted on this issue being
brought forward to the City Council.

5020 Jason Aveeue has an existing pressurized mound system which was designed for
a four bedroom home with a 10' x 60' rockbed.
5010 Jason Avenue has an existing cesspool which is surface discharging and classified
as an imminent heath hazard and must be repaired or disconnected within 10 months.
The proposal is too add an additional 2 bedrooms - 300 gal/day to the existing mound
System at 5020 Jason Ave. This will require an easement agreement which must be
approved by the City of Albertville. The addition will be a 10' x 30' rock bed with a 14'
side slope. The existing pumping chamber (#1) will need a timer added to the controls
and the pump will need to handle 67 gal/min at 20' of head pressure.
The existing tank at 5010 Jason Avenue will need to be abandoned, pumped and filled
with soil. 21000 gallon tanks will need to be installed. A 1000 gallon pumping chamber
(#2) will pump to pumping chamber #1, 100 gallons 3 cycles/day. The supply line will
cross the water supply from the well and will require a minimum 20' section of pipe, no

Nothing other than human waste, toilet tissue, laundry, showers, water softener etc.
should be disposed of into the septic tanks. Iron filters must be diverted out of the
system. Recommend to divert the water softner also. Garbage disposals are not
recommended, due to adding more solids & fine solids passing through to the system.

Excessive amounts of soaps, antibacterial soaps, cleaning agents, shower cleaners
used every shower & chk' im agents may kill the bacteria needed to treat septic
effluent. Additives are not recomntiended. Recommend to pump & dean your tanks
through the manhole by a certified pumper every 2 years. Check with your pumper to
set up a schedule.

We anticipate additional trial preparation (meet with witnesses to review facts to
be testified to at trial), a deposition of their appraiser to determine what changes to
expect in his testimony based upon what we expect will be his new conclusions,
and three more days of trial beginning September I Oth. This will likely cost an
additional $8,750 in legal fees. The judge may or may not ask us to draft and file
a post -trial brief. If one is required, the cost of this could easily run an additional
$3,000. In addition, we will need to order at least a partial trial transcript for
selected witnesses and order the appraiser's deposition, which together may run
around $1,500 or so. Estimated additional legal expense is $14,250 through the
completion of trial if a brief is required, $11,250 if one is not required:

At this point, we are waiting for the revised report from the Peterson's appraiser.
That report is due August l Ph. We will then depose their appraiser and prepare
for trial. If any settlement negotiations take place, they will likely take place after
the deposition. I will keep you informed of any settlement negotiations which
