ADJOURNMENT ALBERTVILLE CITY COUNCIL aaae December 3, 2001 Albertville City Hall 7:00 PM PRESENT: Mayor John Olson, Councilmembers LeRoy Berning, Scott Wallace, Keith Franklin and John Vetsch, City Attorney Mike Couri, City Engineer Pete Carlson, City Planner Cindy Sherman and City Administrator Linda Goeb Mayor Olson called the regular meeting of the Albertville City Council to order. The agenda was amended as follows: ■ Add Item 6a(1) Aerial Fire Truck — Request to add foam system ■ Add Item 6a(2) Discuss operating pull tab sales at Geez' Sports Bar ■ Add Item 6d(4) I-94 Ramp ■ Add Item 6f(2) Street light at Lambert and 60th ■ Add Item 6f(3) Report on annual meeting of the Otsego Creek Authority Berning made a motion to adopt the agenda as amended. Wallace seconded the motion. All voted aye. Mayor Olson asked if anyone wished to address the Council under Citizen Forum. No one wished to address the Council. The minutes of the November 19, 2001, meeting were amended on Page 3, Paragraph 4, by changing "November 19" to "December 19". Wallace made a motion to approve the minutes of the November 19, 2001, meeting as amended. Franklin seconded the motion. All voted aye. Berning requested that Check #'s 15464 and 15468 be removed from the Consent Agenda and placed under Administration. Franklin made a motion to approve payment of check #'s 15461 — 15463, #'sl5465 — 15467, and #'s 15469 — 15490 as presented. Wallace seconded the motion. All voted aye. Franklin made a motion to approve the contract for the 2001 Audit Report with Kern, DeWenter & Viere as presented. Wallace seconded the motion. All voted aye. Franklin made a motion to approve the 2001 Fire Protection Agreements with the City of St. Michael and the City of Otsego. Wallace seconded the motion. All voted aye. Franklin made a motion to adopt RESOLUTION #2001-29 titled A RESOLUTION APPROVING WRIGHT COUNTY'S REQUEST TO RENUMBER CSAH 35 WITHIN THE CITY OF ALBERTVILLE TO CSAH 18. Wallace seconded the motion. All voted aye. Paul Heinen, Chad Wade, and Brian Lewis, representing the Albertville Fire Department, presented information regarding a Class A Foam System they would like to add as a change order to the aerial fire truck now under construction. The cost of the foam system is i r Albertville City Council Minutes December 3, 2001 Page 2 of 5 approximately $6,200, and the Fire Department is willing to pay the costs from their donations and the proceeds of their annual pork chop dinner. Vetsch made a motion to approve a change order for the aerial ladder truck to add a Class A Foam System at a not -to -exceed price of $6,500. The Fire Department will pay the cost of the change order from their donations and proceeds from the pork chop dinner. Franklin seconded the motion. All voted aye. Heinen indicated that the Fire Department is interested in securing a gambling to sell pulltabs at Geez' Sports Bar after the Albertville Jaycees' license expires at the end of the year. The Fire Department would not be likely to obtain a license and operate the pulltab booth until February. City Administrator Goeb told the Council that the Albertville Lions have also expressed the same interest. Lions member Donatus Vetsch stated, if the Fire Department were interested in operating the pulltabs at Geez' Sports Bar, the Lions would be willing to assist them in obtaining the license and helping them with reporting to the state. City Administrator Goeb was directed to contact Glen Groetsch and ask him to attend the next Council meeting to discuss the pulltab position. City Administrator Goeb reported on Tuesday, November 27, Michael Jenkins was injured while at work by having his foot run over by the bobcat operated by another employee. Michael was sent for medical treatment and will be unable to return to work for at least two weeks. A Workers' Comp First Report of Injury has been submitted to LMCIT. Councilman Vetsch questioned whether a report was placed in the bobcat operator's personnel file regarding this accident. Goeb indicated that she felt there was no need to do this, since it was an accident. The consensus of the remainder of the Council is that no notation in the personnel file is necessary. Planner Cindy Sherman reviewed the report on the Life in Christ Church's request to allow for the temporary parking of recreational vehicles at the church's construction site on the corner of 501h Street and Main Avenue. The recreational vehicles would house volunteer workers who would work for minimum wage to construct the church's new addition. The city may choose to accommodate the church's request and distinguish this use from other less desirable applications by ordinance. The important features of the ordinance include the following: • limit the use of the temporary structure to construction projects • allow the temporary use by administrative permit approved by staff • establish a specific time frame for the use • establish performance standards for the issues that are a concern for the City Council (i.e. setbacks, site security, utility availability, etc) Albertville City Council Minutes December 3, 2001 Page 3 of 5 Vetsch made a motion directing the planner to prepare such an ordinance for the Council to consider at the next meeting. Wallace seconded the motion. All voted aye. Planner Sherman explained that she has contacted the developer of the Albertville Plaza regarding the lighting plan. Some corrective measures have been already taken to adjust the parking lot lights, but she is continuing to work with the developer. Sherman reviewed the final plat for the Albert Villas 5`h Addition. The subject site is 3.35 acres in size and is located south of CSAH 18 and consists of three single-family lots within a single block. The site is proposed to be zoned R-lA with a PUD-CUP consistent with the surrounding area and adjacent development. Condition #5 of the Findings of Fact & Decision should be amended to state park dedication fees for the development are $4,500 ($1,500 for each of the three lots). Condition #8 will require that two 2.5 inch diameter trees will be planted on each lot. City Attorney Couri reviewed the Conditional Use/Planned Unit Development Agreement for the Albert Villas 5ch Addition. Franklin made a motion to adopt the Findings of Fact & Decision for the Albert Villas 5ch Addition as amended, approving the rezoning, PUD-CUP and final plat, the Conditional Use/Planned Unit Development Agreement, and ORDINANCE #2001-5 titled AN ORDINANCE CHANGING THE ZONING OF CERTAIN LAND IN THE CITY OF ALBERTVILLE, MINNESOTA. Wallace seconded the motion. All voted aye. The Council requested that Edina Development present landscaping plans for Albert Villas I'`, 2°d, and 3' Additions at the next meeting. Heidi Peeper, Economic Development Partnership of Wright County, reviewed the Wright County 2001 Labor Force Assessment report with the City Council. The Council scheduled a joint meeting with the Planning & Zoning Commission to consider zoning amendments in the City on Tuesday, January 8, 2002. City Engineer Carlson requested that the Savitski Lift Station Upgrade be pulled form the City's Commercial Project and bid separately. After discussion, the Council agreed to postpone a decision on the separate bid to the first meeting in January. Wallace made a motion to approve the Application for Withdrawal of Wetland Credits from the Minnesota Wetland Bank for the Albertville Crossings project as submitted. Beming seconded the motion. All voted aye. Carlson presented information on a comprehensive traffic study for the City of Albertville. The proposed study would cover 12 major intersections in the city at three different times a day. Albertville City Council Minutes December 3, 2001 Page 4 of 5 One benefit of the study is that City could project traffic impacts from new developments and estimate when and what road improvements would be necessary to accommodate the new development. Estimated cost to complete the initial study is $50,000. Those costs could be recouped through an ordinance, which requires each new development to provide a traffic impact study. Since purchasing the study from the City's software at an amount per developed acre would be more cost effective for the developer, the City's cost could potentially be recovered. Should the Council decide to have the comprehensive traffic modeling done, staff suggests that a moratorium on new development be considered until the modeling is completed. In order to facilitate developers who are now working on concept plans, staff recommends that developers would be allowed to continue with planning with staff. Carlson has spoken to Virgil Hawkins, Wright County Assistant Engineer, about the County preparing a Eastern Wright County traffic study, which would cover the Cities of St. Michael, Albertville and Otsego in a jointly funded study. City Administrator Goeb was directed to contact the Cities of St. Michael and Otsego for feedback on this idea prior to meeting with Wright County Engineer Wayne Fingalson on December 19th The Council will consider a moratorium on new development at their December 17th meeting. In the meantime, the engineer and attorney were directed to continue preparing information on costs and procedures. The Council agreed to send a letter to Senator Ourada regarding the City's position on an exit ramp off of I-94 at CSAH 19. City Attorney Couri presented the Amendment to Master Planned Unit Development Agreement for Towne Lakes. The agreement applies to Lot 1, Block 5, Towne Lakes and allows for the construction of a Communications Building limited exclusively to the storage and operation of equipment necessary to provide voice, data and video communications within the City of Albertville. Franklin made a motion to approve the Amendment to Master Planned Unit Development Agreement for Towne Lakes as presented. Berning seconded the motion. Franklin, Berning, Wallace and Olson voted aye. Vetsch voted no. The motion carried. Wallace made a motion to close all City offices on Monday, December 24, 2001. Franklin seconded the motion. All voted aye. The Public Works Department is directed to secure costs for installing a street light at 60th and Lambert (by the hockey arena). Councilmember Vetsch reported on the Otsego Creek Authority annual meeting. Landowners along Otsego Creek will be contacted and asked to remove fallen trees from the creek. The final plat consists of 64 lots within four blocks and one outlot. This final plat is the first phase of what will be a multiple phase build -out. A Comprehensive Plan amendment guiding the site for low density residential uses, rezoning to R-1A District, PUD-CUP for development within a Shoreland District, and preliminary plat applications were previously approved by the City Council on March 5, 2001. The City Council's approval was subject to 20 conditions, which included the rezoning and comprehensive plan amendment to be completed with the final plat. ANALYSIS Preliminary Plat Consistency. The layout of the proposed final plat is generally consistent with the approved preliminary plat. The final plat has the same number of lots with similar dimensions as those presented on the preliminary plat. The final plat includes connection of both Kagen and Kaiser Avenue with existing streets in the adjacent Albert Villas 3rd Addition. A temporary cul-de-sac should be provided at the end of Kagen Avenue, where a future extension will be provided. Outlot A. Outlot A is provided over the portions of the approved preliminary plat to be developed as part of a future phase or phases. Included in this outlot is land adjacent to Swamp Lake that is to be conveyed to the City at the time of final platting with a trail to be constructed by the developer. The City may choose to divide this parcel as a separate outlot and have it conveyed with this final plat, with a security for future construction of the trail or delay conveyance of the parcel until the adjacent lots and streets are final platted. Landscape Plan. The developer has submitted a landscape plan for plantings along public streets, trails and ponding areas. The species and quantities are generally appropriate and will provide for an attractive neighborhood. Consistent with preliminary plat approvals, proposed coniferous trees are six feet tall and deciduous trees are 3.5 Albert Villas 4t" Addition Page 1 of 2 caliper inches. The developer will be required to provide a security guaranteeing installation of the landscape plan as part of the development contract. The applicant was also to provide enhanced streetscape and landscape plans for phases 1-3 of Albert Villas. This plan was not provided with the submittals but will be required prior to recording the final plat. Park Dedication. No parkland is to be dedicated as part of the final plat. As such, park dedication requirements will be satisfied through a cash fee in lieu of land equal to $1,500 per lot. Based upon 64 lots, the total cash fee in lieu of land for this first phase is $96,000.00. Engineering. All grading, drainage and utility issues are subject to review and approval of the City Engineer. Development Contract. The applicant is required to enter into a development contract with the City stipulating plans and conditions of approval. With the development contract, the developer must pay all required securities and fees. The development contract should be subject to review of the City Attorney and approval of the City Council. CONCLUSION AND RECOMMENDATION The proposed Albert Villas 4th Addition Final Plat is consistent with the City's Comprehensive Plan and Zoning and Subdivision Ordinances. The final plat is also consistent with applicable conditions of the preliminary plat approval. As such, our office recommends approval of the final plat, subject to the following conditions. 1. A temporary cul-de-sac is provided at the terminus of Kagen Avenue, subject to review and approval of the City Engineer. 2. Land identified as "Outlot A' on the approved preliminary plat is final platted as Outlot B and conveyed to the City. WHEREAS, the Albertville City Council believes that due to the impacts on traffic levels in the City from residential, commercial and industrial development, changes may be warranted in the City's zoning ordinances to facilitate the development of the street and highway infrastructure; and WHEREAS, the Albertville City Council has determined that in order to protect the planning process and insure the health, safety, and welfare of the citizens of Albertville that the presently existing ordinances and controls need to be reevaluated to determine what, if any, changes should be made which would impact the development of the City's street and highway infrastructure; and • WHEREAS, the City Council desires that the City Planning commission and City Council study the City's zoning and subdivision ordinances and report to the City Council regarding any proposals for change in local controls that the Planning Commission might arrive at with regard to said zoning and subdivision regulations; and WHEREAS, the City needs a period of time within which to conduct these studies and to implement any needed changes; NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALBERTVILLE: 1. Stat. 462.355, Subd. 4 to pass an interim ordinance, applicable to all or a portion of its • jurisdiction, for the purpose of protecting the planning process and the health, safety, and welfare of its citizens. Section 3. Temporary Prohibition. For three months after the effective date of this ordinance, or until such earlier time as the Albertville City Council determines by resolution that the reasons for the moratorium no longer exist, no plats shall issue for property located within the City except for properties sought to be final platted which have received preliminary plat approval prior to the effective date of this ordinance, nor shall the City receive, consider, and/or approve, any application, of any type, which proposes to preliminarily or final plat property located in the City except for properties sought to be final platted which have received preliminary plat approval prior to the effective date of this ordinance. Section 4. Misdemeanor. Any person, persons, firm or corporation violating any provisions of this ordinance shall be guilty of a misdemeanor, and upon conviction thereof, shall be punished pursuant to Minn. Stat. 609.02, Subd. 3, or as subsequently amended, plus costs of prosecution. Section 5. Injunctive Relief. In the event of a violation of this ordinance, the City may institute appropriate actions or proceedings, including requesting injunctive relief to prevent, restrain, correct, or abate such violations. • 1 • Section 6. Separability. It is hereby declared to be the intention that the several provisions of this ordinance are separable in accordance with the following: if any court of competent jurisdiction shall adjudge any provision of this ordinance to be invalid, such judgment shall not affect any other provisions of this ordinance not specifically included in said judgment. 0 Section 7. Administrator CITY OF ALBERTVILLE Mayor 0 MEMORANDUM TO: ALBERTVILLE CITY COUNCIL; LINDA GOEB, CITY ADMINISTRATOR FROM: MIKE COURI, CITY ATTORNEY SUBJECT: PAYMENT OF PETERSON JUDGMENT DATE: DECEMBER 13, 2001. I have spoken with Dan Rosen, the Attorney for Shirley Peterson. He has indicated that the Petersons will forego any post trial motions they may have a right to make (this does not include giving up their right to appeal to the Appellate Court) if the City gets the money back from the Court (with interest) which it deposited in 1997 as compensation for the Peterson land taking, and pays the additional amount of the judgment (difference between 1997 deposit and Court's award of $60,953), plus interest directly to the Petersons. That amount is the $44,332.00 deposited by the City in 1997, along with • interest earned by the Court (this number is not yet known), plus an additional $16,621.00 (the difference between the $60,953 Court verdict and the $44,332.00 originally paid), plus interest on the $16,621.00 from June 20, 1997 (the date of taking) to December 7, 2001 (date of last calculation of interest) in the amount of $3,719.46. Interest per diem after December 71h is $2.73, and will continue until the date the City pays Peterson. 0 I have prepared a stipulation to this effect and sent it to Dan Rosen for'his signature. He will send it on to the Court, which will then enter judgment and order the Court Administrator to send back to the City the original deposit plus interest. Once this occurs, we will pay Peterson everything the Court sends us, plus the additional amount of the award and interest described above. The additional amount the City will need to pay is approximately $20,400.00 (the exact amount will depend upon when the Court sends us the money it has on deposit) The City will send Peterson a check in the area of $68,000.00 (the exact amount will not be known until the Court sends us the money on deposit), consisting of the $20,400.00 in new City money and approximately $47,600.00 in funds the Court now has. 1 • • I am asking that the City Council authorize the payment of the Peterson judgment (plus interest) upon return of the deposit from the Court. I expect the check to be sent before the end of the year. 2 CITY OF ALBERTVILLE RESOLUTION #2001-34 A RESOLUTION APPROVING RENEWAL OF THE GAMBLING LICENSE FOR THE HANOVER ATHLETIC ASSOCIATION AT GEEZ' SPORTS BAR & GRILL WHEREAS, the Hanover Athletic Association has made application with the Minnesota Charitable Gambling Control Board for renewal of its gambling license at Geez' Sports Bar & Grill located at 5788 Main Avenue NE, Albertville, Minnesota; and WHEREAS, the Hanover Athletic Association has submitted said application to the City Council of the City of Albertville, and the application was reviewed by the City Council at a public meeting conducted December 17, 2001.
