PRESENT: Mayor John Olson, Councilmembers Robert Gundersen, Gary
McCormack, Keith Franklin , and John Vetsch, City Engineer Pete Carlson, City
Attorney Mike Couri, City Planner Deb Garross, and Deputy Clerk Bridget Miller
Mayor Olson called the regular meeting of the Albertville City Council to
order.
The agenda was amended as follows:
• Add Item 5c(1) — Letter from Otsego Regarding Sewer Services Questionnaire
• Add Item 5e(2) — Technology Purchase for City of Albertville
Franklin made a motion to approve the agenda as amended. Gundersen seconded
the motion. All voted aye.
McCormack made a motion to approve the minutes of the February 22, 2000, as
presented. Vetsch seconded the motion. All voted aye.
Mayor Olson asked if anyone present wished to address the Council.
Paul Schumacher and Pat May addressed the Council in regards to the plans of the
land by the new Fire & Rec. Center. They wanted to know what the land was
going to be used for. They would like to see more baseball fields in the City.
Vetsch commented that the gentlemen were in last year and said the Leagues
would be willing to donate equipment as well as preparing the field.
Tim Guimont commented that it is proposed for a ball field, just not definite as to
what type of ball field. City Engineer Pete Carlson also confirmed that it is slated
for a baseball and/or soccer field. It was graded and seeded last fall and they
would like to give it another year to grow.
Mayor Olson asked what the Council's thoughts were on the matter of a baseball
verses softball. Vetsch commented that he liked the sense of a baseball team to
represent a community. Franklin was pleased about the Oakside Park having a
Little League Softball fields. McCormack also liked the idea of a baseball field -
which would be good for the businesses in the city.
Vetsch made a motion to make the ball field a baseball field. Franklin seconded
the motion. All voted aye.

Gundersen made a motion to approve payment of Check #'s 12814 — 12850 as
presented. McCormack seconded the motion. All voted aye.
Mayor Olson addressed Public Works Supervisor Tim Guimont to go over his
Public Works Report. Tim began with the report on the snowmobile tracks
throughout the city. Most of the trails that were damaged were asphalt. It was
sporadic around the city. Mayor asked Tim to bring it to the Council's attention in
September to get a message out to the public about the Ordinances on driving
snowmobiles in the City limits. He also asked to have a written report and note
were the areas of damage(s) are.
City Engineer reported that the road restrictions were on for Albertville. He was
concerned with the builders/developers in the city. He has noticed that in some
areas the street and sidewalks go in prior to the housing construction. Then when
the housing development is completed the sidewalks have damage (cracks)
because the builder or construction crew drive the cement trucks right over the
sidewalks. There should be some type of procedure written up to do a pre -
construction inspection and a final construction inspection. Possibly put together a
flowchart showing the steps involved. That way the city could defer the cost of
repairs to the developer or builder for repairs to the sidewalks or trails if damaged
during the construction. Also to make sure that the developer follows through
with getting sod and trees in the developments. This would take place with the
CO.
City Attorney Couri commented that some of the houses close during the winter
months and is not the timeframe for laying sod. We could however put it into
escrow and give them until June of the next year to comply with the developers
agreement. That would assure the developer would follow through with the sod
and trees. Tim could monitor or be responsible for the job getting done and
making sure it was done properly.
Gundersen commented that the Christian Development that was going up on 57th
Street had a sketch drawing of the area. It was noted on there that a senior housing
development was proposed. This is what they were informing prospective buyers.
City Attorney Couri stated that the City send certified letters to Christian Builders
and/or Christian Realty regarding this. The City has no preliminary plat for senior
housing in that area.
Gundersen made a motion to have the City Planner and City Attorney draft a
letter. Franklin seconded the motion. All voted aye.

Tim Guimont updated the City Council about the Wastewater Treatment Plant.
There were a few items there that Tim and John felt they did not need. Could they
go ahead and put in ad in the paper to sell them. Council would like Tim to get an
idea of the value of the items prior to putting the ad in the paper.
McCormack made a motion to approve putting an ad in the paper to sell the items.
Vetsch seconded the motion. All voted aye.
Tim reported that he was checking around for replacement parts for the tables at
the City Park Shelter. If he is able to find them should he go ahead and repair the
current tables that are there and see what happens down the road if the City wants
to purchase additional tables. Vetsch said to go with that for now.
Mayor Olson commented that Tim had a sketch drawn up to present to the Council
regarding the office at the Fire Hall. Tim said that they left plenty of room for the
fire exit building codes.
Gundersen made a motion to approve the offices at the Fire Hall. McCormack
seconded the motion. Olson, Gundersen, McCormack and Franklin voted aye.
Vetsch voted no. The motion carried.
City Planner Garross updated the City Council on the history on the Parkside
Commercial. She informed the Council as to what the developer's intentions were.
She went over the Findings of Fact for the Preliminary and Final Plat. The
Council questioned the berm in the rear/side of Outlot B. Would it remain or be
removed. City Attorney Couri pulled up the original Developer's Agreement for
the property and reported that the berm would remain with the possibility of
additional screening put in.
Mayor Olson asked if the Council had any further comments or concerns. Vetsch
asked about the street lighting? The intersection itself is not very well lighted.
City Engineer Carlson commented that with the gas station going in on the corner
it would create more lighting on the corner. Franklin questioned how far out are
we looking at traffic lights to be installed at the intersection on CSAH 19/57th
Street. Carlson replied that there are certain levels of warrants to go through. The
need has to be in place before the want. The County is going to be doing a speed
study on this area this coming year. There is the slight probability that it would be
reduced. Gundersen asked about the Developer's Agreement regarding the trees -
he would like the language worked into the new agreement.

City Planner Garross informed the Council that it was their decision as to whether
to go with a sidewalk or an asphalt trail, which is noted, on the plat.
McCormack made a motion to approve the sidewalk. Vetsch seconded the
motion. All voted aye.
City Attorney Couri brought to the Council attention the Park Dedication fees.
We could either do a Letter of Credit or put the amount in Escrow. We could do
an appraisal on the property this year or when a Preliminary Plat is brought before
the Council.
Mayor Olson asked if there were any further comments or concerns.
Vetsch made a motion to adopt the Findings of Fact and Decision approving the
preliminary and final plat for the Parkside Commercial Center. Franklin seconded
the motion. All voted aye.
City Attorney Couri described in more detail the Council's consideration to adopt
the Moratorium. He handed out a revised Ordinance and Resolution to include
R-5, R-6, R-7, and R-8 Zoning District. He said that any developments that were
in process as of to date would be exempt from the moratorium. This Ordinance
and Resolution would affect any developments in the future.
Mayor Olson asked if there were any comments or questions from the City
Council.
Vetsch made a motion to adopt the Ordinance No. 2000-2 and Resolution No.
2000-6. Gundersen seconded the motion. All voted aye.
Mayor Olson addressed the Firefighters present to go over their concerns with
developments in the City. Representatives present were Albert Barthel, Bill
Valerius, Chad Wade and Chad Cichos. Bill reported that he brought the Outlets
of Albertville building site plans to the State Fire Marshal. Bill gave a copy of the
Fire Marshal's reply to each Councilmember. It was concluded that a member of
the Fire Department draft up a list of what is expected from the developer and
tenants at the mall. The list along with a letter would be sent to the developer and
each tenant informing them of Ordinance No. 1989-9 and complying with the
Uniform Fire Code adopted by the City. Linda and/or Bridget would get a letter
and a copy of the list out to the Developer/Management firm and each tenant.

The next concern the Fire Department had was regarding the floor at the new Fire
and Rec. Center. They were under the impression at the last Council meeting that
the depression in the floor would be filled in with more epoxy. When they went to
check on the progress a week later the floor was being torn up. City Engineer
reported that it doesn't look acceptable. He suggests that we should not comment
on how to fix it, but rather state that it is unacceptable.
Gundersen made a motion to not accept the repair work being done on the floor at
the new Fire and Rec. Center. They would like to see a meeting schedule with the
Builder to discuss the matter further. Franklin seconded the motion. All voted
aye.
The last item the Fire Department brought before the Council was the purchase of
emergency traffic light changers. Bill Valerius reported the cost is $1,000 each
and they would need a quantity of four. One for each of the traffic lights to be put
in on CSAH 19/37.
Gundersen made a motion to approve the purchase of the emergency traffic light
changers. McCormack seconded the motion. All voted aye.
Gundersen asked the Council to consider purchasing a digital camera. This would
allow the city to take pictures of damage or other concerns brought to the city's
attention. With the color printer and technologies progress we could see what they
would be talking about.
Gundersen made a motion to approve the purchase of the digital camera.
McCormack seconded the motion. All voted aye.
Vetsch made a motion to adjourn at 9:23 PM. McCormack seconded the motion.

SUBJECT: WASTEWATER TREATMENT PLANT REPORT
➢ Lift Stations Continuing to do maintenance and repairs on the lift stations.
➢ Got Pump #1 unplugged at the Main Lift Station.
➢ Changed the oil in both pumps.
➢ Replaced lifting chains on both pumps.
➢ Have noted that both pumps are in very poor condition.
➢ Had Alarm on Main Lift Station.
➢ Both pumps were tripped out - but reset the pumps.
➢ General Repairs
➢ Repaired the hydrant located on 57th Street and County Road 19 - it was hit in a
vehicle accident.
➢ Greased up the aerators.
)0- Increased discharge pumping from Pond #3.
➢ Have done some cleaning and organizing at the Waste Water Plant.
➢ Built some shelves for storage of equipment and other items at the plant.
➢ Repaired check valve on sludge pump - it was not working properly, replaced
key and roll pin.
➢ Inexpensive pump was purchased to pump down Pond #3 burned out.
➢ Replaced with high quality pump.
➢ Replaced seal on clarifier motor drive.
➢ Daily Duties
➢ Continuing to do weekly and monthly activities - Pond reading, purge bubbler,
add bacto-doce, clarifier and sludge pump maintenance, check alarms, test run
generator.
➢ Most of the activities were done with the assistance of Tim or Ken.
➢ Weekend coverage for the WWTP and Lift Stations is rotated between the three of us.

boom will fold into a traveling position to take up a minimum of bed and overhead space.
Capacity of the crane is 2000 lbs. at a 3 ft. load radius; 12001bs. at 5 ft. The standard
boom in the 200 position telescopes from 3 ft. to 5 ft. with an intermediate position
at 4 ft. An optional telescoping boom is available with length from 31" to 71"
Added versatility is built into this crane; the boom can be raised to a 450
position for setting taller objects into the truck bed. Maximum height
of the hook at the 450 position is 81" above the crane mounting plate.
Rotation of the crane is on tapered roller bearings for long life
life and easy movement. Full 3600 rotation is standard. A manual
band brake is used to control swing of the boom.
A remote pendant controls the lifting function.

During construction operations, it was discovered that the 4 existing 3" rigid steel conduits (RSC) located
under the 4 legs of the intersection roadway pass straight through the 4 existing raised concrete median
handholes without any openings. The RSC openings in the handholes are necessary in order to properly
connect the loop detector wires to the signal controller. The Engineer determined it necessary to cut,
grind, and fit the existing 3" RSC in the 4 existing median handholes as necessary to complete the above
project as designed.
The negotiated unit price listed below has been approved by MNDOT Estimating and is compensation in
full for this work.

A RESOLUTION APPROVING THE WETLAND REPLACEMENT PLAN FOR THE
ALBERTVILLE VILLAS PROJECT TO FILL 2.94 ACRES OF WETLAND TO
FACILITATE THE CONSTRUCTION OF CITY STREETS
BE IT RESOLVED by the City Council of the City of Albertville, Minnesota, as follows:
1. That the City of Albertville is the Local Government Unit (ALGU-) responsible for making
exemptions and approving replacement plans.
2. That the City of Albertville, by and through its City Council, sitting as the Local Government
Unit (ALGU=), adopts the following finds of fact regarding the application by the City of Albertville
to fill 2.94 acres of wetland to facilitate the construction of Kahl Avenue, Kagan Avenue, 53`d Street
and 52°d Street.
That the application submitted to fill wetlands on the described site satisfies the Minnesota
Wetland Conservation Act procedural guidelines for:
1. Pre -Application Communications (Minnesota Rules 8420.0510)
2. Sequencing (Minnesota Rules 8420.0520)
3. Replacement Plan Components (Minnesota Rules 8420.0530)
4. Wetland Replacement Standards (Minnesota Rules 8420.0550)
3. That the City of Albertville, as ALGU= has fully exercised its responsibilities in ensuring

GRADING CONTRACT
City of Albertville
Albert Villas Grading Agreement
THIS AGREEMENT, dated March , 2000 by and between the CITY OF
ALBERTVILLE, a municipal corporation ("City"), and Edina Development Corporation,
('Developer").
1. REQUEST FOR GRADING APPROVAL. The Developer has asked the City
to approve the grading for the first phase of that property proposed to be platted as Albert
Villas ("Property").
2. CONDITIONS OF APPROVAL. The City hereby approves the grading on
the condition the Developer enter into this Contract, abide by its terms and furnish the
security required by it.
3. GRADING AND DRAINAGE PLAN. The Property shall be graded in
accordance wi h the Grading and Drainage plan for phase one of Albert Villas as prepared
by F 2 / /( sue, and dated , 2000 and on file with
the City of Albertville.
4. TIME OF PERFORMANCE. The Developer shall complete the grading by
July 15, 2000, weather permitting. The Developer may, however, request an extension of
time from the City. If an extension is granted, it shall be conditioned upon updating the
security posted by the Developer to reflect cost increases (if any) and the extended
completion date.
5. EROSION CONTROL. Developer shall implement all erosion control
measures detailed on the Grading and Drainage plan (including construction of all ponds) in
the order required by the City Engineer. Developer shall also implement any additional
erosion control measures required by the City Engineer or the Wright County Soil and
Water Conservation District, and shall abide by all erosion control requirements contained
in the Albertville Subdivision ordinance. All areas disturbed by the excavation and
backfiling operations shall be reseeded forthwith after the completion of the work in that
area. Except as otherwise provided in the erosion control plan, seed shall be rye grass or
other fast-growing seed suitable to the existing soil to provide a temporary ground cover as
rapidly as possible. All seeded areas shall be mulched and disc anchored as necessary for
seed retention. The parties recognize that time is of the essence in controlling erosion. If
the Developer does not comply with the erosion control plan and/or the requirements of the
City Engineer or Wright County Soil and Water Conservation District, the City may take
such action as it deems appropriate to control erosion, and the landowner hereby grants the
City permission to enter upon the land and take such necessary erosion control actions..
The City will endeavor to notify the Developer in advance of any proposed action, but
failure of the City to do so will not affect the Developer's and City's rights or obligations
hereunder. If the Developer does not reimburse the City for any cost the City incurred for
such work within thirty (30) days, the City may draw down the letter of credit to pay any
costs or may specially assess Developer's land for the costs not covered by the letter of
credit. No development will be allowed and no building permits will be issued unless the
Golf Course is in full compliance with the erosion control requirements.
6. "AS BUILT" GRADING PLAN. Within thirty (30) days after completion of
the grading and before the City releases the security, the Developer shall provide the City
with an "as constructed" grading plan, unless the City Engineer waives this requirement..
7. CLEAN UP. The Developer shall promptly clean dirt and debris from streets
that has resulted from construction work by the Developer, its agents or assigns.
8. SECURITY. To guarantee compliance with the terms of this permit and to
reimburse the City for any damage to public property as a result of the grading permitted
herein, the Developer shall furnish the City with a cash escrow or irrevocable letter of credit
from a bank ("security") in the amount of $1,000 for each acre of land included within the
phase one grading plan. The bank and form of the letter of credit shall be subject to the
approval of the City Attorney. The letter of credit shall be for a term ending not earlier than
one year from the date of this agreement, and shall be renewed annually by the Developer
until all grading is complete as specified herein. The City reserves the right to draw on the
letter of credit anytime within 45 days of its expiration if the Developer does not provide the
City with a renewal or an acceptable substitute letter of credit.
9. RESPONSIBILITY FOR COSTS.
A. Except as otherwise specified herein, the Developer shall pay all costs
incurred by it or the City in conjunction with the grading and erosion control, including but
not limited to Soil and Water Conservation District charges, legal, planning, engineering
and inspection expenses incurred in connection with approval and acceptance of the permit,
the preparation of this permit, and all costs and expenses incurred by the City in monitoring
and inspecting the grading and erosion control.
B. The Developer shall hold the City and its officers and employees
harmless from claims made by itself and third parties for damages sustained or costs
incurred resulting from permit approval and work done in conjunction with it. The
Developer shall indemnify the City and its officers and employees for all costs, damages
and expenses which the City may pay or incur in consequence of such claims, including
attorney's fees.

C. The Developer shall reimburse the City for costs incurred in the
enforcement of this permit, including engineering and attorney's fees.
D. The Developer shall pay in full all bills submitted to it by the City for
obligations incurred under this permit within thirty (30) days after receipt. If the bills are
not paid on time, the City may halt all work and construction.
10. DEVELOPER'S DEFAULT. In the event of default by the Developer as to any of
the work to be performed by it hereunder, the City may, at its option, perform the work and
Developer shall promptly reimburse the City for any expense incurred by the City, provided
the Developer is first given notice of the work in default not less than 48 hours in advance.
This permit is a license for the City to act, and it shall not be necessary for the City to seek a
court order for permission to enter the land. When the City does any such work, the City
may, in addition to its other remedies, assess the cost of such in whole or in part to the
property under this agreement.
11. PLAT APPROVAL. The City's approval to grade the property is given without
prejudice to the City's right to approve or deny the final plat for any portion of Albert Villas.
Developer understands that final City approval of the Albert Villas project may materially
differ from the grading plan for phase one, and Developer assumes any risk and expense
which Developer may incur as a result of commencing grading prior to final plat approval.

I am concerned about the City of Albertville's park dedication fee proposed for our recent Mooney
Addiction Final Plat approval. The fee would be 10% of the purchase price we pay for the property.
Based on that formula, we would pay over $30,000/acre or in excess of 10 times the posted park
dedication fees for St Michael ($3,000/acre commercial) and Elk River ($3,000/acre commercial). My
research of park dedication fees for other nearby cites found the following for commercial property
Rogers ($4,000/acre), Monticello (None), Maple Grove ($3,600/acre), and Plymouth ($5,200 acre).
Enclosed is a partial copy of the Albertville Comprehensive Park &Trail System Plan adopted on Sept.
8, 1997. This plan includes an analysis of commercial and industrial land on page 48 which includes a
table for calculating park and trails fees based on an estimate of land values. The estimates used for
commercial land are $20,000/acre for value and therefore $2,000/acre for the fee. The plan also
recommended a $1,300 fee per residential lot which is what I believe Albertville uses for it's park and
trail fees. The $1,300 per lot fee for residential is approximately the same amount used by St. Michael
and Elk River.
Based on land values used in Albertville's Park and Trail Comprehensive Plan and other nearby city
park dedication fees, I hope you will consider amending your current commercial park dedication fee to
be more in line with $2,000/acre to $3,000/acre.

400.030
(3) Lots intended for any B-1, B-2, B-3 or I-1 zoning districts must be designed as
such, and the lot must be of adequate size to meet the zoning requirements of that
district to allow off street parking, loading areas and such other facilities as are
required to satisfy the requirements of section 300, zoning ordinance of the city
of Minnetonka.
b. In addition to the above stated minimum Iot size and dimensions, the following
general regulations shall be required in all subdivisions.
(1) All lots must have at least the minimum required frontage on a public dedicated
street;
(2) All lots must have a minimum of 30 feet in width at the rear lot line.
(3) Side lot lines shall be substantially at right angles or radial to the street lines.
(4) Double -frontage, or lots with frontage on two parallel streets, shall not be
permitted except:
(a) where lots back on arterial streets or highways, or where topographic or
other conditions render subdividing otherwise unreasonable. Such double
frontage lots shall have an additional depth of at least 20 feet in order to
allow space for screen planting along the back lot line.
(5) Lots abutting on a water course, drainage way, channel or stream shall have an
additional depth or width, as required, to assure house sites that are not subject to
flooding.
(6) Lot remnants which are below the minimum lot size must be added to adjacent or
surrounding lots rather than be allowed to remain as an unusable outlot or parcel
unless the owner can show acceptable plans for the future use of such remnants.
400.030. Park Dedication.
The owners of land being subdivided shall dedicate to the city a reasonable portion of the
land for use as public parks, playgrounds, trails or open space. Generally, the reasonable
portion should not be less than 10 percent of the total land in the proposed subdivision.
The city may determine the location and configuration of any land dedicated, taking into
consideration the suitability of the land for its intended purpose and future needs of the

We are submitting a proposed solution to address the Apparatus Bay floor. We have
based our recommendation on floor integrity, firefighter safety, and uniform appearance.
The proposed solution for installing a new layer of epoxy flooring over the entire floor is
outlined below:
1. Rough up low spots and apply epoxy patch for uniform leveling.
2. Flood floor and have City accept drainage 24 hours after flooding. Standing water
will not be accepted
3, Grind entire floor area with diamond stones, especially first patches.
4. Level and fill with epoxy wherever needed.
5. Re -grind where needed.
6. Apply first layer of color quartz where new concrete patches have been installed for
uniform finish,
7. Apply epoxy / color quartz over entire floor.
8. Apply grout coat (epoxy) over entire floor.
P. Apply top coat (epoxy) over entire floor.
Shingobee Builden and Grove Johnson will guarantee this work for ten years against
delamination or epoxy breakdown. We estimate the work to take abrntt two to three
weeks. Moisture density tests will determine the time span.
Shingobee Builders apologizes for misstating the necessary corrective action at the City
Council meeting. At the time, we believed the problem and corrective method to be
workable. The experienced Grove Johnson applicators convinced us on February 28,
2000, that the floor drainage problem was more serious than originally understood. We
failed to inform the City Council of our new course of action and receive approval.
