removed last summer. Linda has the information on this.
• STREETS — All of the streets have been crack sealed. Pete Carlson and I will be assessing
the streets for any needed patching and overlayment.

CITY OF ALBERTVILLE
MEMORANDU
TO: Mayor and City Council
FROM: John Middendorf, Water Department
DATE: May 12, 2000
SUBJECT: WASTEWATER TREATMENT PLANT REPORT
Switch to Alum in late March. Alum pump would not pump enough. Talked to PSG, they
said they could get it to pump in the past. After trying different things I had to send it in for
repair. I switched to a Ferric Pump, which is smaller and could only pump 60 gallons per day.
Stopped discharging from Pond #3 in hopes we could pump enough with the smaller pump,
but samples failed on Phosphorus 1.59 and total solids 57.0.
As a result from that I borrowed a larger pump from Hawkins. I set it for 75 gallons per day.
Sampled on Monday, March 24th. Turned it up to 100 gallons per day. Re -sampled on
Tuesday, March 25`. The samples on Monday did not pass on total Phosphorus, but the
solids passed. Samples on Tuesday, March 25th — all the tests passed.
Continuing to by pass Pond #3. Continuing to discharge Pond #3 into mixing plant at a rate
of 60,000 gallons per day except for April 3 — 10. No major repairs. No bypasses.
• Changed oil in both gear boxes on clairfier drive.
• Unplugged #2 pump at DFs Lift Station - #2 plugged twice in April / once in May (so
far).
• Changed oil in both pump at DTs Lift Station — both had a small amount of water mixed
with the oil.
• Unbolted riser on Pond #2 — discharge pipe in early April = had to remove plug in later
April — Pond Level is less than one -foot.
• Viking Sewer came out and unplugged city halls sewer line.
• Continuing to do daily / weekly / monthly activities. Locates, meter reads, pond reading,
add Bacto-Dec clarifier maintenance, sludge pump maintenance, test and run generator,
clean UV tubes.
• Helped Tim and Ken crackseal.

FROM: Cynthia Putz-Yang / Deborah Garross
DATE: May 2, 2000
RE: Albertville - Psyks Eight Addition Preliminary and Final Plat
FILE NO: 163.06 - 00.13
EXECUTIVE SUMMARY
BACKGROUND
56C)
Doug Psyk has submitted a preliminary and final plat for the subdivision of 16 single family
lots. The subject area encompasses 5.99 acres and is located west of Main Street and
south of Psyks' earlier additions. The subject area was approved as phase two of the
Psyks Seventh Addition Preliminary Plat; however, a year and a half passed without an
application for final plat, and the preliminary plat approval has nowexpired. The submitted
plats are consistent with phase two of Psysks Seventh Addition Preliminary Plat. The
utilities and streets that will serve the plat were constructed with Psyk's Seventh Addition.
The subject property is zoned R-1, Residential Single Family District and the proposed
development is in conformance with the approved Land use Plan of the City.

RECOMMENDATION
Analysis of the Pysks Eighth Addition Plat has shown that it is consistent with the Pysks
Seventh Addition Plat. The subdivision and construction of homes which follows is
capable of meeting all Subdivision and Zoning Ordinance requirements. Based on the
review of submitted plans and established City Ordinances, our office recommends
approval of the Psyks Eight Addition Preliminary and Final Plats subject to the following
conditions:
Conditions of Preliminary Plat:
1. All grading, drainage, and utility issues are subject to review and approval by the
City Engineer.
2. All requirements of the City Engineer regarding easement location, configuration
and size, grading and drainage and utility plans are satisfied.
3. The preliminary plat shall be amended to show an 8-foot bituminous trail along the
north side of 53rd street. Any remaining park dedication is to be paid to the City as
a cash dedication at the time of final plat. *
4. The preliminary plat shall be amended to show the required building setback
standards for the R-1 Zoning District.
5. A minimum of one shade tree with a 2 inch minimum diameter trunk or evergreen
tree with a minimum 3-foot height is provided for each lot.
6. Any other comments of City Staff, Planning Commission, City Council, or other
responsible reviewing agency.
Conditions of Final Plat.
4. The preliminary plat shall be amended to show the required building setback
2
standards for the R-1 Zoning District.
5. A minimum of one shade tree with a 2 inch minimum diameter trunk or evergreen
tree with a minimum 3-foot height is provided for each lot.
6. The developer shall submit a Storm Water Pollution Control Plan and escrow
consistent with the requirements of the Subdivision Ordinance and subject to review
and approval of the City Engineer.
7. The developer shall submit a cost estimate for installation of the trail. All park
dedication fees shall be paid prior to release of the final plat mylars for recording.
8. The developer shall construct the trail within the 53rd Street right-of-way.
9. All required driveway, utility, trail and other permits required by the City Engineer
shall be obtained by the applicant.
10. A current title opinion or commitment of title insurance shall be submitted
acceptable to the City Attorney.
11. The developer shall provide the City with a reproducible copy of the recorded final
plat, either chronoflex or its equivalent, and two (2) prints prior to issuance of a
building permit for any of the lots.
12. A developer's agreement is prepared by the City Attorney and signed by the
applicant.
13. All fees associated with this project shall be paid prior to the release of the final plat
mylars to the applicant.
14. The developer shall provide financial security for all applicable site improvements,
acceptable to the City Engineer and City Attorney.
15. The final plat, developer's agreement and all pertinent documents must be filed with
Wright County within 120 days from the date of City Council approval of the final
plat. Failure to record the documents by July 4, 2000 will render the final plat null
and void.
16. Any other conditions as set forth by the City Council, City staff, City Consultants or
other agency responsible for review of this application.
3
ISSUES ANALYSIS
Approval Process. The Subdivision Ordinance states that following City Council approval
of a preliminary plat, the applicant must submit a final plat to the City Administrator within
100 days of preliminary approval unless otherwise specified as part of a development
agreement. If this procedure is not followed, then approval of the preliminary plat shall be
considered void, unless a request for time extension is submitted in writing and approved
by the City Council. Although the subject area was approved as part of Psyks Seventh
Addition, a newapplication of preliminary plat was required because the previous approval
had expired.
Lot Size Requirements. The proposed lots are consistent in size, shape, and
configuration with Psyks Seventh Addition Preliminary Plat. All lots meet or exceed the
minimum lot size requirement of 12,500 square feet and the minimum lot width
requirements for interior (90 feet) and corner (100 feet) lots. All lots contain
usable/buildable upland equal to at least 80 percent of the required minimum lot area, in
this case 10,000 square feet, as required. All lots are capable of meeting the following
required structure setbacks: 30 feet front, 10 feet side interior, 20 feet side corner, 25 feet
rear.
Lot Coverage Requirement. In the R-1 District, a maximum lot coverage requirement is
applicable which states that no structure or combination of structures shall occupy more
than twenty-five (25) percent of the lot area. Through analysis of the prposed building pad
locations in relation to the lot sizes and configurations, it appears as though this
requirement should not pose any problem for future land owners.
Grading, Drainage, & Utilities. Grading, Drainage, and Erosion Control plans were
submitted with Psyks Seventh Addition. Any grading, drainage, or erosion control issues
that may arise are subject to review and approval by the City Engineer.
Park & Trail Dedication. The Psyks Seventh Addition Preliminary Plat illustrated an
eight -foot -wide bituminous trail running along the north side of 53`d Street. The trail is
consistent with the City's Park and Trail Plan. Unless the Planning Commission and City
Council decide that the trail is not needed, the trail must be constructed as shown in the
Psysks Seventh Addition Preliminary Plat. The cost of the trail construction will be
subtracted from the required park dedication fee.
Landscaping. In addition to required ground cover after completion of grading to prevent
soil erosion and sodding of all front and side yards following home construction, the
Zoning Ordinance requires that the developer plant a minimum of one shade tree or large
evergreen tree per lot that conforms to the following size requirements:
shade trees 2 inch diameter trunk
evergreen trees 3 feet high
In
CONCLUSION
Analysis of the Pysks Eighth Addition Plat has shown that it is consistent with the Pysks
Seventh Addition Plat. The subdivision and construction of homes which follows is
capable of meeting all Subdivision and Zoning Ordinance requirements. Based on the
review of submitted plans and established City Ordinances, our office recommends
approval of the Psyks Eight Addition Preliminary and Final Plats subject to the conditions
as outlined in the Executive Summary of this report.
* The 8-foot wide trail shown in Phase 1 of Pysk's Seventh Addition has not been
constructed. This trail segment must be constructed unless the Planning Commission and
City Council decide that this trail is not needed.

City of Albertville
Kollville Estates Grading Agreement
THIS AGREEMENT, dated May , 2000 by and between the CITY OF
ALBERTVILLE, a municipal corporation ("City"), and, Lueur-Munsterteiger Properties,
Inc., ("Developer"), memorializes the agreement of the parties as follows.
1. REQUEST FOR GRADING APPROVAL. The Developer has asked the City
to approve the grading for that property proposed to be platted as Kollville Estates
("Property").
2. CONDITIONS OF APPROVAL. The City hereby approves the grading on
the condition the Developer enter into this Contract, abide by its terms and furnish the
security required by it.
3. GRADING AND DRAINAGE PLAN. The Property shall be graded in
accordance with the Grading Plan of Kollville Estates for phase one of Kollville Estates as
prepared by Quality Site Design, LLC, and dated and on file with the
City of Albertville.
4. TIME OF PERFORMANCE. The Developer shall complete the grading by
August 15, 2000, weather permitting. The Developer may, however, request an extension
of time from the City. If an extension is granted, it shall be conditioned upon updating the
security posted by the Developer to reflect cost increases (if any) and the extended
completion date.
5. EROSION CONTROL. Developer shall implement all erosion control
measures detailed on the Grading and Drainage plan (including construction of all ponds) in
the order required by the City Engineer. Developer shall also implement any additional
erosion control measures required by the City Engineer or the Wright County Soil and
Water Conservation District, and shall abide by all erosion control requirements contained
in the Albertville Subdivision ordinance. All areas disturbed by the excavation and
backfiling operations shall be reseeded forthwith after the completion of the work in that
area. Except as otherwise provided in the erosion control plan, seed shall be rye grass or
other fast-growing seed suitable to the existing soil to provide a temporary ground cover as
rapidly as possible. All seeded areas shall be mulched and disc anchored as necessary for
seed retention. The parties recognize that time is of the essence in controlling erosion. If
the Developer does not comply with the erosion control plan and/or the requirements of the
City Engineer or Wright County Soil and Water Conservation District, the City may take
such action as it deems appropriate to control erosion, and the landowner hereby grants the
City permission to enter upon the land and take such necessary erosion control actions. The
` 1
City will endeavor to notify the Developer in advance of any proposed action, but failure of
the City to do so will not affect the Developer's and City's rights or obligations hereunder.
If the Developer does not reimburse the City for any cost the City incurred for such work
within thirty (30) days, the City may draw down the letter of credit to pay any costs or may
specially assess Developer's land for the costs not covered by the letter of credit. No
development will be allowed and no building permits will be issued unless the Golf Course
is in full compliance with the erosion control requirements.
6. "AS BUILT" GRADING PLAN. Within thirty (30) days after completion of
the grading and before the City releases the security, the Developer shall provide the City
with an "as constructed" grading plan, unless the City Engineer waives 's requirement.
7. CLEAN UP. The Developer shall clean di
promptly Y
rom tl nd debris from streets
that has resulted from construction work by the Developer, its agents or assigns.
8. SECURITY. To guarantee compliance with the terms of this permit and to
reimburse the City for any damage to public property as a result of the grading permitted
herein, the Developer shall furnish the City with a cash escrow or irrevocable letter of credit
from a bank ("security") in the amount of $30,000. The bank and form of the letter of credit
shall be subject to the approval of the City Attorney. The letter of credit shall be for a term
ending not earlier than one year from the date of this agreement, and shall be renewed
annually by the Developer until all grading is complete as specified herein. The City
reserves the right to draw on the letter of credit anytime within 45 days of its expiration if
the Developer does not provide the City with a renewal or an acceptable substitute letter of
credit.
9. RESPONSIBILITY FOR COSTS.
A. Except as otherwise specified herein, the Developer shall pay all costs
incurred by it or the City in conjunction with the grading and erosion control, including but
not limited to Soil and Water Conservation District charges, legal, planning, engineering
and inspection expenses incurred in connection with approval and acceptance of the permit,
the preparation of this permit, and all costs and expenses incurred by the City in monitoring
and inspecting the grading and erosion control.
B. The Developer shall hold the City and its officers and employees
harmless from claims made by itself and third parties for damages sustained or costs
incurred resulting from permit approval and work done in conjunction with it. The
Developer shall indemnify the City and its officers and employees for all costs, damages
and expenses which the City may pay or incur in consequence of such claims, including
attorney's fees.
C. The Developer shall reimburse the City for costs incurred in the
enforcement of this permit, including engineering and attorney's fees.
D. The Developer shall pay in full all bills submitted to it by the City for
obligations incurred under this permit within thirty (30) days after receipt. If the bills are
not paid on time, the City may halt all work and construction.
10. DEVELOPER'S DEFAULT. In the event of default by the Developer as to
any of the work to be performed by it hereunder, the City may, at its option, perform the
work and Developer shall promptly reimburse the City for any expense incurred by the City,
provided the Developer is first given notice of the work in default not less than 48 hours in
advance. This permit is a license for the City to act, and it shall not be necessary for the
City to seek a court order for permission to enter the land. When the City does any such
work, the City may, in addition to its other remedies, assess the cost of such in whole or in
part to the property under this agreement.
11. PLAT APPROVAL. The City's approval to grade the property is given
without prejudice to the City's right to approve or deny the final plat for any portion of
Kollville Estates. Developer understands that final City approval of the Kollville Estates
project may materially differ from the grading plan, and Developer assumes any risk and
expense which Developer may incur as a result of commencing grading prior to final plat
approval.
12. WETLANDS. Developer agrees that it shall not fill or otherwise perform any
grading activities in or upon any lands which have been identified as wetlands until such
time as the City Engineer permits said activities to occur in said wetlands. City and
Developer expect that such permission will occur after all wetland approval procedures have
been completed.

In regards to the change orders from Singobee dated April 14, 2000:
#1 This is between S.E.H. and Shingobee (committee had no involvement).
#2 The dryer was in the print and the vent should have been included.
#3 This is a building code issue.
#4 This is a building code issue.
#5 Committee had no involvement.
#6 A call was placed to Chad Cichos in regards to the hose. According to Chad's
conversation with Vossens Plumbing, this hose was included with no additional
cost.
#7 The committee's understanding was that S.E.H. was putting in this PVC pipe
because they were the ones who put in the parking lot.
#8 This was brought up at a progress meeting. We mentioned about a pipe through
the wall panel underground for a future lawn sprinkling system. Steve Voss
from Vossens Plumbing said, "I'll throw that in." Bill Valerius asked him again,
"This will not cost us anything." Steve said, "No."
#9 Snow guards were omitted at a council meeting.
#10 The proper channels were not followed in regards to these faucets, but they were
approved by a committee member.
These are additional issues that need to be addressed/corrected:
■ the first overhead door does not operate;
■ the steel above the overhead doors is drooping down;
■ painting of the areas by the overhead doors — the original paint froze and is
peeling,
■ the shelf in the men's restroom needs to be hung; and
■ we need to do a final walk-through of the building.

Re: High School Addition SAC Charges
Comm. # 1578
Dear Linda:
This letter is a follow-up to recent correspondence between Peter Carlson, the City's engineer, and Tyler
Green, the school's Construction Manager representative. The I school board has directed me'to request
the City to drop the SAC" charges or lower the charges to the previous lower' formula rate. Issues that
should be taken into consideration are outlined below:-
1) At the time the Albertville Primary was constructed a meeting was held with David Lund,'a
former City administrator, to discuss the :City requirements 'other than what had been already ,
received: Both the High School and Primary additions were discussed and SAC charges were not
an issue.
2) At the time the voters approved the bond issue to build the additions, the older and lower cost
formula was used. Even thought the high school addition was not built until sometime later, it
seems inequitable to charge the school district (taxpayers) a higher rate. One would hope that the
City does not need to treat the school district like they do for profit developers.
On behalf of the school, I am requesting that the City Council reconsider their current position and lower
or drop the SAC charges for the high school addition. Please feel free to contact me regarding the ,issue.
Thank you. .
Sincerely,
Robert Reg -

Dear Mr. Green:
RE: Albertville, Minnesota
St. Michael -Albertville School SAC Charge
SEH No. A-ALBEV 0001.00 14.00
I received your letter, dated April 13, 2000, regarding the SAC charge for the addition to the high
school. The formula used to calculate the SAC charge has stayed the same, however, the rate has
increase to $3,500 per unit. This rate is reviewed annually by the City Council.
Regarding the SAC charges that are applied to a building permit, the consensus of the City
Council was to use the SAC rate current at the time the building permit is obtained. For example,
the first phase of a two-phase project would pay the SAC rate that is current at the time the first
phase is built. The second phase does not occur for 10 years. Over the course of the next 10
years, the SAC rate will more than likely be revised. It will be the revised SAC rate that will be
used to calculate the SAC charge applied to the building permit for the second phase. This would
be true for all types of projects.
Please call me if you have additional questions.

RE: 2000 Additions & Alternations
to St. Michael -Albertville Schools
Donlar Job #341
Dear Mr. Carlson:
Per our phone discussion March 20, 2000 you had stated that the City of Albertville could elect to use
an older calculation and arrive at a $ 8,000 or $ 9,000 SAC Charge or use the new calculation and
arrive at a $26,740 SAC Charge.
Independent School District #885 requests an explanation regarding the calculations for the Sanitary
Sewer Availability Charge (SAC). Please explain how the City of Albertville determined whether to
use the old calculation or the new calculation.
Send your response to Donlar Corporation's St. Paul Office. If you have any questions please contact
me at 651-227-0631.

Re: City of Otsego Proposal
Albertville Sewer Plant
Dear Albertville City Council:
The Otsego City Council has approved the following proposal
for discussion with the City of Albertville.
1) Otsego wishes to purchase 100,000 gallons per day of
sewer plant capacity from the City of Albertville.
2) The land uses to be served would be
industrial/commercial land use north of County Road 37 and
single family detached land use south of County Road 37.
3) No more than 30% of Otsego's sewer capacity would be
used for residential development.
4) The wastewater produced would be residential strength.
The City of Otsego would not allow any industrial processors
who would produce a wastewater of higher than residential
strength.
5) The industrial/commercial building standards would be
equal to or greater than the standards currently in use in
the Otsego industrial park. No pole structures or metal
buildings would be allowed.
The City Council of Otsego would like to meet with the City
Council of Albertville within the next six weeks to discuss
this proposal. Please give me a call to set a convenient
time.
Sincerely,
Michael obertson

The following are my recommendations for requests for Change Orders from Shingobee
Builders:
1. Extend water service into building: I recommend the sharing of the expense as indicated on
attached worksheet No. 15R. The construction documents state that the Owner would install

2. Install dryer vent: I recommend rejecting Change Order Worksheet No. 16. The project was
Design/Build; the dryer was indicated.
3. Install water heater fresh air intake: I recommend rejecting Change Order worksheet No. 19.
The project was Design/Build; the water heater was indicated.
4. Install fresh air intake for infrared heaters: I recommend rejecting Change Order worksheet
No. 20. The project was Design/Build; the infra -red heaters were indicated.
5. Cost of delay due to delay in issuing State Plumbing Permit: I recommend rejection. Remely
requested additional information on 10/15/99. SEH sent information on 10/15/99.
6. Supply storks fitting on hose: I recommend approving Change Order worksheet No. 26. An
independent supplier confirmed the additional cost of the fittings. + $1,084.21
7. Install PVC pipe under the driveways for telephone and future parking lights: I recommend
approving Change Order worksheet No. 27. This was better than cutting into, the new
bituminous. + $407.61
