CONSENT: • The bills list is not included in your packet. It will be available for review on Monday. • The League of Minnesota Cities is requesting all cities participate in the Building Quality Communities Program and has provided a sample resolution for the City to adopt. Resolution 2000-26 is enclosed for your consideration. • Ordinance 2000-12 amends the old Fire Code Ordinance by updating it to the 1997 Uniform Fire Code, as requested by the Fire Department. • The Council did not include the cost of an additional civil defense siren in the preliminary budget on August 30. If the Council wants to budget for another civil defense siren ($15,000), it should be included in the preliminary levy. PLANNING & ZONING: • Burger King is proposing to build on Outlot D of the Outlets of Albertville site. Gregg Klohn will attend the meeting to present a concept plan for both the site plan and the signage requests. ENGINEERING: • John Darkenwald has approached Pete regarding the Roden property (on which he has an option) to discuss commercial development vs. industrial development. Pete is suggesting that a sub -committee meet with Darkenwald to discuss his proposal. 0 Page 1 ADMINISTRATION: Otsego Administrator Mike Robertson contacted me after the Otsego Council meeting . Otsego has appointed Mayor Larry Fournier and Councilmember Vein Heidner to a committee to discuss extension of sewer service to Otsego from Albertville. The Council should appoint two members to the committee and choose one of the dates suggested by Otsego to meet. I have included in your packet an ordinance detailing the procedures the City can take to eliminate grass and weed problems. Ordinance #2000-10 sets the procedures the City can use to get grass and weeds mowed. The ordinance comes from the City of Prior Lake and has been revised for the City of Albertville. City Attorney Mike Couri has also reviewed this ordinance. Should the Council choose to adopt this ordinance, I believe we could eliminate the need for legal actions through the court system for problem yards. I did not put the garage and house size question on the agenda this time. If the Council wants to change the Zoning Ordinance in regards to garage and house sizes, a public hearing must be scheduled. The Council can amend the agenda to schedule the public hearing. FOR YOUR INFORMATION: • I contacted Marlin & Jan Fickle, owners of the property at 6213 Kahler Drive, regarding progress on complying with the City's ordinance regarding his yard. Grass seed was planted on Thursday, August 31 ". I drove by the property and took pictures of the Fickle's seeding their lawn. Jan Fickle also told me that they have ordered sod that will be laid on September 28t', but that they are complying with the City ordinance to plant grass seed at this time. Mrs. Fickle also advised me that her neighbors to the north (5629 Kahler Drive) have landscaped 6'-8' beyond their property border into the wetlands area abutting the lot . I looked at the area she referred to and, provided the post marking the property is accurate, it's apparent that the landscaping definitely is located beyond the lot line. City Attorney Mike Couri has advised me that two of the four lawsuits have been served on the property owners and will be filed with the court system. Mike has been unable to serve the other two lawsuits on the owners and will have the Sheriff s Department serve those property owners. Gundersen made a motion to approve the agenda as presented. Franklin seconded the motion. All voted aye. Gundersen made a motion to approve the minutes of the July 17, 2000, meeting as presented. Franklin seconded the motion. All voted aye. Mayor Olson asked if anyone present wished to address the Council under the Citizen Forum portion of the agenda. Tiffany Nelson addressed the Council requesting that they allow a 48" chain link fence to be installed on her property at 10145 Karston Avenue NE, instead of a 42" high fence. Franklin made a motion to approve a variance from the fence ordinance to allow Tiffany Nelson to install a 48" high chain link fence at 10145 Karston Avenue. Gundersen seconded the motion. All voted aye. Kim Molesky asked what progress has occurred regarding the lawn at 5612 Kahler Drive. Mayor Olson explained that the property owner has indicated he will plant grass seed by September 1. At the last Council meeting, the Council agreed to allow the property owner until September 1 to complete his seeding. Chris Olson questioned why nothing had been done with the other property owners who have not complied. City Attorney Mike Couri explained that lawsuits are being drawn up and must be served on the owners. After that time the suits will be filed in court and a court date will be set. He further explained there is a possibility of not getting a court date set until too late in the fall to plant grass seed. Gundersen made a motion to approve payment of Check #'s 11376 - 13426 as presented. McCormack seconded the motion. All voted aye. Gundersen made a motion ALBERTVILLE CITY COUNCIL August 7, 2000 Page 2 of 5 to approve RESOLUTION #2000-25 titled A RESOLUTION TERMINATING AN INTERIM ORDINANCE IMPOSING A MORATORIUM ON THE PLATTING OF PROPERTY LOCATED IN THE R-5, R-6, R-7 AND R-8 ZONING DISTRICTS WITHIN THE CITY OF ALBERTVILL. McCormack seconded the motion. All voted aye. Brian Bloch, CPA with Kern, DeWenter & Viere, presented the 1999 Audit Report and Management Letter to the Council. Ben Steiner, a student at STMA High School, gave a presentation on the Big Woods project and asked the City to consider financial support to purchase 35 square acres of Big Woods located in the City of St. Michael across from the Junior High School. Bridget Falbo, Patti Moses and Pat Stanglein were also present to request the City's support. The Council agreed to consider supporting the program at the budget meeting scheduled for August 30. Gundersen made a motion to approve the Water & Wastewater Treatment Department Report as presented. Vetsch seconded the motion. All voted aye. Planner Sherman explained that Contractor Property Developer Company (CPDC) has submitted an application for rezoning from R-IA to PUD, CUP/PUD preliminary plat and variance under the Shoreland Regulations for the property located between School Lake and Mud Lake in the northeast quadrant of the city. The plat proposes 150 single family home sites designed in a "traditional neighborhood" fashion on 85 acres, for a density of 1.76 units per acre. An EAW has been prepared and submitted for review. The plat requires three variances from the Shoreland Regulations and the variances impact the ability to process the application as a PUD/CUP under the shoreland regulation. The variances must be granted in order for the project to be eligible for PUD Ordinances. Craig Rapp and Planner Mark Putnam, representing CPDC, made a presentation of the proposed development. They explained that a 20' minimum buffer area around the shores of the lakes would be dedicated as a shoreland conservation easement with the developer planting native trees and shrubs within the easement to encourage wildlife habitat and decrease the visual impact of the development on the natural environment Lakeshore. The developers proposed to install sidewalks on both sides of the streets and trails throughout the plat and green spaces. They are committed to constructing and maintaining a gazebo in the entrance park. They will also construct at their cost a practice ballfield and soccer field in accordance with the City's Comprehensive Park Plan. The Towne Lakes plat proposes 20+acres of park area in the high land areas, plus and additional 9 acres of parks located in the wetland areas, ALBERTVILLE CITY COUNCIL August 7, 2000 Page 3 of 5 City Attorney Couri suggested that the Council require that a Master PUD Agreement be drafted that incorporates all the items the developer has indicated they will install, as well as all setback, lot size, etc. flexibility approved before the Council approved the preliminary plat. Franklin made a motion to approve the Findings of Fact & Decision amended to include all items that the developer has agreed upon, thereby approving the PUD/CUP, preliminary plat development plan, and variances under the Shoreland Regulations for the Towne Lake addition. Gundersen seconded the motion. Franklin, Gundersen, McCormack and Olson voted aye. Vetsch voted no. The motion carried. The Council reviewed the Albertville Park & Trail Plan Study presented by Planner Deb Garross. The park system costs has been increased to reflect the costs of the ballfields at City Park. The Planning Commission has reviewed the changes and has recommended that the Council establish the park dedication fee for commercial and industrial properties at $4,500 per acre. Olson made a motion to set park dedication fees as follows: $1,400 per residential unit $6,000 per acre for commercial properties 5% of market value for industrial properties Franklin seconded the motion. Olson and Franklin voted aye. McCormack, Gundersen, and Vetsch voted no. The motion failed. McCormack made a motion to set park dedication fees as follows: $1,500 per residential unit $7,000 per acre for commercial properties 5% of market value for industrial properties Vetsch seconded the motion. ALBERTVILLE CITY COUNCIL August 7, 2000 Page 4 of 5 Gundersen made a motion to approve RESOLTUION #2000-21 titled RESOLUTION AMENDING THE FEE SCHEDULE FOR PARK DEDICATION EFFECTIVE AS OF AUGUST 21, 2000 setting fees as follows: $1,500 per residential unit $7,385 per acre for commercial/industrial properties The motion also requests that the Council and Planning Commission meet to consider discuss the park plan and make adjustments. This may lead to a decrease in park dedication fees for industrial properties. Vetsch seconded the motion. Gundersen, Vetsch and McCormack voted aye. Franklin and Olson voted no. The motion carried. Gundersen made a motion to adopt ORDINANCE #2000-9 titled AN ORDINANCE AMENDING SECTION A-600.8. (PARK & TRAIL DESIGN) AND SECTION A- 600.15. (PARK AND TRAIL DEDICATION REQUIRMENTS) OF THE ALBERTVILLE SUBDIVISION ORDINANCE TO INCORPORATE REVISED TRAIL, SIDEWALK AND PARK DEDICATION STANDARDS. McCormack seconded the motion. Gundersen, McCormack, Vetsch, and Olson voted aye. Franklin voted no. The motion carried. Vetsch made a motion to table discussion of an ordinance amendment regarding house and garage sizes. McCormack seconded the motion. All voted aye. Engineer Wayne Stark presented the cost estimates for a baseball and a softball field at City Park. Costs to complete both fields is estimated at $175,284. These costs do not include dugouts or bleachers. The Council requested that the costs for each field be broken down separately and brought back to the next Council meeting. The Council concurred that the joint meeting with Otsego would not cover specific issue or amounts, but rather be a general discussion. Gundersen made a motion to approve the Developer's Agreement for Psyk's 8th Addition. Franklin seconded the motion. All voted aye. Vetsch made a motion to approve the Contract for Private Development By and Between City of Albertville, Minnesota and Mold -Tech, Inc. as presented. Gundersen seconded the motion. All voted aye. Olson made a motion to table the request to participate in the River Rider Program to the August 30 budget meeting. Franklin seconded the motion. All voted aye. CITY OF ALBERTVILLE John Olson, Mayor Linda Goeb, City Administrator 'c CITY OF ALBERTVILLE ORDINANCE # 2000-12 AN ORDINANCE AMENDING ORDINANCE NO. 1989-9 UNIFORM FIRE CODE THE CITY COUNCIL OF THE CITY OF ALBERTVILLE ORDAINS: Section 1: ADOPTION OF UNIFORM FIRE CODE: It is hereby adopted by the City of Albertville for the purpose of prescribing regulations governing conditions hazardous to life and property from fire and explosion, that certain Code and Standards known as the Uniform Fire Code, including all appendix chapters therein, and the Uniform Fire Cod Standards published by the Western Fire Chief s Association and the International Conference of Building Officials, being particularly the 1997 Uniform Fire Code thereof and the whole thereof, save and except such portions as are hereinafter deleted, modified, or amended, of which Code and Standards not less than one (1) copy has been and is now filed in the office of the City Clerk of the City of Albertville, and the same are hereby adopted and incorporated as fully as if set out at length herein, and the provisions thereof shall be controlling within the limits of the City of Albertville. Section 2: PERMIT REQUIRED: A permit shall be obtained in advance form the Bureau of Fire Prevention for the activities described in Section 4.101 of the Uniform Fire Code as adopted by reference in Section 1 above. Section 3: ESTABLISHMENT AND DUTIES OF BUREAU OF FIRE PREVENTION: Said Uniform Fire Code shall be enforced by the Bureau of Fire Prevention which is hereby established in the Fire Department of the City of Albertville and which shall be operated under the supervision of the Chief of the Fire Department for the City of Albertville. Said Chief shall be in charge of the Bureau of Fire Prevention until such time as the City Council shall deem it advisable and shall appoint a separate chief in charge of the Bureau of Fire Prevention. The Chief of Albertville Fire Department may detail such members of the Fire Department, as inspectors as shall from time -to -time be necessary. Section 4: DEFINITIONS: The term "Jurisdiction", as used in said Uniform Fire Code, shall mean the City of Albertville. . Updated 09/05/00 - 1 - City of Albertville Ordinance 2000-12 Section 5: STORAGE OF DANGEROUS SUBSTANCES: The limits referred to in Section 82/105(a) and 77/106(b) of said Uniform Fire code restricting the storage of liquefied petroleum gases and the storage of explosives and blasting agents respectively, together with the limits for the storage of flammable or combustible liquids in outside above ground tanks are hereby established as being the entire area lying within the City of Albertville unless a special permit is issued by said City. Section 6: STATE REGULATIONS ADOPTED: In addition to the foregoing, the City of Albertville also adopts by reference as if fully set forth herein any and all amendments and changes to said Code and Standards and any other matters relative thereto set forth in Minnesota State Rules and Regulations of the Department of Public Safety, Fire Marshall Division, 11 MCAR §1.50101-1.5156. Section 7: APPEALS: Whenever the Chief of the Fire Department disapproves an application or refuses to grant a permit applied for, or when it is claimed that the provisions of the Uniform Fire code do not apply or that the true intent and meaning of said code have been misconstrued or wrongly interpreted, the applicant may appeal from the decision of said Chief to the City Council of the City of Albertville within thirty (30) days from the date of the decision appealed. Section 8: NEW MATERIALS, PROCESSES, OR OCCUPANCIES, WHICH MAY REQUIRE PERMITS: The City Administrator and the Chief of the Fire Department shall act as a committee to determine and specify, after giving affected persons an opportunity to be heard, any new materials, processes, or occupancies for which permits are required in addition to those now enumerated in said Uniform fire Code. The Chief of the Bureau of Fire Prevention shall post such list in a conspicuous place in his office, and distribute copies thereof to interested persons. Section 9: BARBECUES AND DECK FIRES: Part A: In any structure containing two (2) or more vertically stacked residential units or that contains two (2) or more residential units sharing as a means of ingress or egress a common hallway; no person shall kindle, maintain, cause or use any fire, open flame or electric heating element on any balcony -2- City of Albertville Ordinance 2000-12 or deck above the ground; nor shall such activity occur on any patio set in and level with the ground unless such activity occurs at least fifteen (15) feet from all portions of all such units in such a structure. Part B: No person shall keep or use any charcoal, nor any lighter fluid, natural gas, fuel, torch, barbecue grill or other similar heating or lighting chemical or device in any place where fire, open flame or electric heating element is prohibited in Part A above. Part C: Barbecue grills that burn natural gas are prohibited in any place where prohibited in Part A above unless such a grill is permanently mounted, plumbed to the structure's natural gas supply, and set at least six (6) feet at all points from all combustibles and all portions of all such residential units. Section 10: KEY BOX AND MYLARS: Part A: When access to or within a multi -housing building of three (3) or more units or other multi -housing, commercial or industrial structure or an area is unduly difficult because of secured openings or where immediate access is necessary for lifesaving or fire -fighting purposes, the Chief of the Fire Department may require a key box to be installed in an accessible location. The key box shall be a type approved by the Chief of the Fire Department and shall contain keys to gain necessary access as required by the Chief of the Fire Department. Part B: No owner of any building hereafter erected or remodeled shall use, maintain or keep the same for commercial, industrial or multi -housing (other than two -unit dwellings) purposes unless there is on file in the office of the City Clerk an 8'/2" x 11" reproducible mylar "as -built" print of each floor of the building. The City Clerk shall not issue a certificate of occupancy for any new or remodeled commercial, industrial or multi - housing building (other than two -unit dwellings) unless such mylars shall be on file. Section 11: PENALTIES: Part A: Any person who shall violate any of the provisions of said Code or Standards hereby adopted or fail to comply therewith, or who shall violate or fail to comply with any order made thereunder, or who shall build in violation of any detailed statement or specifications or plans submitted and -3- City of Albertville Ordinance 2000-12 approved from which no appeal has been taken, or who shall fail to comply with such an order as affirmed or modified by the City Council or by a court of competent jurisdiction, within the time fixed herein, shall severally for each and every such violation and non-compliance respectively by guilty of a misdemeanor. Part B: The imposition of one penalty for any violation shall not excuse the violation or permit it to continue; and all such persons shall be required to correct or remedy such violations or defects within a reasonable time; and when not otherwise specified, each ten (10) days that prohibited conditions are maintained shall constitute a separate offense. Part C: The application of the above penalties shall not be held to prevent the enforced removal of prohibited conditions. Section 12: EFFECTIVE DATE: This ordinance shall take effect and be in full force from and after its passage and publication. Loader: • The loader should be here sometime in December 2000. Parks: • During the weekend of August 26`h someone(s) drove a vehicle into Oakside Park and tore up the baseball infield and some of the outfield. We will be reseeding parts of Oakside Park in September 2000. Wastewater Treatment Plant: • I attended a school in Grand Rapids August 29`h and 30`h. I hope to complete the necessary courses to obtain my Class D Operators License. The plat includes 20 detached townhome lots on 5 acres and a 1.1 acre triangular parcel that is part of Cedar Creek Golf Course. The plan differs from the development stage plan in the number and type of units proposed and parking arrangement. The PUD development stage plan included 22 attached townhome units in groups of 2 units each with a 15-stall angle parking area within the central court of the development. The 2 units that have been deleted from the 6th Addition are proposed to be moved to the future townhome plat to the east (Cedar Creek South 7th Addition). The proposed plan includes 2 fewer units in a detached townhome style, removal of the 15 stall, central angle parking areas to be replaced with a 6 stall parking area and 12 proposed parallel parking spaces along the 22-foot wide private road. The property is zoned Planned Unit Development (PUD). All grading, drainage, and utility issues are reviewed and approved by the City Engineer. 2. Parking and internal road circulation (with proposed parallel parking on the 22-foot wide private street) are reviewed and approved by the City Engineer and Fire Department. 3. The 27-foot-wide strip of land along CSAH 18, (proposed Outlot A), northwest of the proposed detached townhomes, must be dedicated as right-of-way, rather than platted as an outlot. 4. The applicant shall obtain all required driveway, utility and other permits required by the City Engineer and/or Wright County. 5. The private street shall be named Jason Court. 6. A street lighting plan is submitted specifying the style, height, strength/wattage and distribution of lights proposed within the development. Said lighting plan and the location of lights shall be subject to review and approval of the City Engineer. 7. City Council approval to allow PUD flexibility for building separation to be reduced from 17.5' to 12 feet to accommodate the detached townhome units. 8. A full size landscape plan (and 11 x 17" exhibit to attach to the development agreement), is submitted showing planting locations, species, planting instructions and addressing the following conditions: a. Proposed screening along CSAH 18. b. Foundation plantings conforming to the requirements of the Zoning Ordinance. c. The front and side yards (and/or any other yard which abuts a public street) of all lots shall be sodded. Rear yards that do not abut a public street may be seeded and mulched. d. A minimum of one shade tree or evergreen tree, conforming to the minimum 2 Cedar Creek So. 6th Addn. Final PUD/Final Plat C.C. Report size and species requirements of the Albertville Zoning Ordinance shall be planted prior to issuance of an occupancy permit for each lot within the final plat. e. A cost estimate for plant materials and installation of screening shall be provided for the purposes of calculating the required escrow. f. An escrow for the landscape/screening materials in the amount equal to 150% of the estimated cost for said materials, is provided to assure installation and survivability of all required plantings. (All new plants shall be guaranteed for two full years from the time the planting has been completed). 9. The common area within the project must be platted as an outlot rather than Lot 21, Block 2. 10. The developer shall establish a homeowners' association via a recorded covenant for this development. The association shall provide for maintenance of all common areas (including the area of the platted lots that are not covered with structures), and the exterior of all town home structures. Said association agreements/covenants shall be in a form and content acceptable to the City Attorney. 11.If a subdivision identification sign is desired by the developer to identify the Albert Villas development, a sign plan is submitted for review and approval of the City Planner. Deed restrictions or other appropriate documentation shall be provided to identify that the private homeowners association shall be responsible for the maintenance of the grounds as well as the subdivision sign in perpetuity. Said documents shall also provide a clause allowing the City to remove the sign in the event that it is not maintained. The written documentation shall be subject to review and approval of the City Attorney and filed with Wright County. 12. The City Council reserves the right to allocate wastewater treatment plant capacity in a manner it believes to be in the public's best interest. 13.A current title opinion or commitment of title insurance shall be submitted acceptable to the City Attorney. 14. The developer shall provide financial security for all applicable site improvements, acceptable to the City Engineer and City Attorney. 15. A developer's agreement is prepared by the City Attorney and signed by the applicant. 16. The developer shall provide the City with a reproducible copy of the recorded final 3 Cedar Creek So. 6th Addn. Final PUD/Final Plat C.C. Report plat, either chronoflex or its equivalent, and two prints prior to issuance of building permits for the lots. 17. The final plat, developer's agreement and all pertinent documents must be filed with Wright County within 120 days from the date of City Council approval of the final plat. Failure to record the documents by January 3, 2001 will render the final plat null and void. 18. Park dedication fees in the amount of $15,879.00 dollars shall be paid as set forth in the PUD Development Agreement. 19. All fees associated with this project shall be paid prior to the release of the final plat mylars to the applicant. 20. Any other conditions as set forth by the City Council, City staff, City Consultants or other agency responsible for review of this application. ISSUES AND ANALYSIS Conformance with Development Stage Plan. The proposed final stage plan for Cedar Creek South Sixth Addition contains a similar lot configuration and street layout as is shown in the development stage plan. However, the unit type has changed from 2-unit townhomes to detached, single -unit townhomes. The number of units has been reduced from 22 units to 20 units in the final stage plan. Parking has been revised from 15 angled stalls to six 90-degree stalls and 12 parallel parking stalls on the private road. Lot Size and Density. The lots are all approximately 4,100 square feet in size. The minimum lot area per unit for townhomes is 5,000 square feet based on the total acreage of the parcel. The proposed project exceeds this minimum with 10,890 square feet of lot area per unit. The parcel is 5 acres in size and contains 20 units; therefore, the density is 4 units per acre. Building Setbacks. The buildings are set back a minimum of 35 feet from the front property line along CSAH 18, 22 feet from the internal private street, and 20 feet from other parcel boundary lines. The proposed plan is consistent with the setback requirements. Building Separation. Buildings within the development are separated by at least 12 feet. Zoning Ordinance Section 2700.2(n) states that no building within the project shall be nearer to another building less than one-half the sum of the building heights of the two buildings. Given the proposed building, the building should be separated at least 17.5 feet. Flexibility from this standard has been proposed to allow a minimum building 4 Cedar Creek So. 6th Addn. Final PUD/Final Plat C.C. Report separation of twelve feet. Streets and Parking. The street configuration is the same that shown in the Development Stage Plan; however, the parking has been revised from 15 angled stalls to six 90-degree stalls and 12 parallel parking stalls. The City Engineer should comment on the acceptability of this arrangement. Parallel parking on a 22-foot-wide, curving street may be difficult. Outlots and Right -of- Way. The common area within the project must be platted as an outlot rather than Lot 21, Block 2. The 27-foot-wide strip of land along CSAH 18, northwest of the proposed detached townhomes, must be dedicated as right-of-way, rather than platted as an outlot. Grading, Drainage and Utilities. The grading, drainage and utility plans are attached as Exhibits E and F. The plans are subject to City Engineer review and approval. High Water Elevation. No structure shall be place at an elevation such that the lowest floor, including the basement floor, is less than two feet above the highest known surface water level or ordinary high water level or less than one foot above the 100-year flood level of any adjacent water body or wetland. If sufficient data on high water levels in not available, the elevation of the line of permanent aquatic vegetation shall be used as the estimated high water elevation. When fill is required to meet this elevation, the fill shall be allowed to stabilize and construction shall not begin until the property has been inspected by the Building Inspector. Park and Trail Dedication. The park dedication is subject to the formula established in the PUD Development Agreement. Park dedication shall be satisfied via the payment of cash to the City on a per -unit basis representing 52.93% of the residential units in the development, at the per -unit requirement in effect at the time each Phase receives final plan approval. The park dedication fee for Cedar Creek South 6th Addition is $15,879 which is calculated as follows: 52.93% of 20 units = 10.586 units * $1,500 per unit = $15,879.00 dollars park dedication requirement. Required Landscaping. Developers of all new residential subdivisions are required to provide one tree per single family lot. The tree may be evergreen (minimum three feet high) or deciduous (minimum two inch diameter trunk). Plantings shall not be located closer than three feet from the property line. All lots must be sodded or seeded/mulched within 30 days of building occupancy. Front and side yards as well as any other yard abutting a public street must be sodded. Rear yards, not abutting a public street, may be seeded and mulched. In cases where seeding/sodding has not been done within 30 days of occupancy, the developer shall be required to provide an escrow deposit equal to one and one-half times the estimated cost of the ground cover which shall be returned to the developer upon completion of the work. Report other uncontrollable factors prevent the sodding or seeding of bare ground within 14 days of final grading, the area shall be covered with straw or other temporary material to control erosion. Development Contract. The applicant must enter into a development agreement as a condition of approval. CONCLUSION Analysis of the Cedar Creek South Sixth Addition final stage plans has shown that it is generally in conformance with the development stage plans with the exceptions of revision to building type and parking. An historical site review will be conducted and will include a review of existing site topographic and wetland maps, soil survey and air photos, and other pertinent information to evaluate historical wetland existence and land use. A visit to the site will be made to visually estimate the location and extent of any wetland habitat on the site. Task 2 Wetland Permit Application Based upon previous wetland delineations, historical wetland assessment, and field review the extent of jurisdictional wetland for regulatory purposes will be determined. A wetlands functions and values assessment will be conducted using the MNRAM assessment methodology to determine lost wetland functions and values. Applicable wetland permit requirements will be identified. The proposed project will likely require an individual permit from the U.S. Army Corps of Engineers unless wetland impacts can be kept under two acres. Agency staff will be contacted to review the project and proposed mitigation. The appropriate wetland permits will be completed and submitted to the agencies. Task 3 Wetland Replacement Plan As part of the wetland permit application, SEH will develop a replacement plan in conjunction with the City to replace wetlands impacted by the proposed site development. Under the Minnesota Wetland Conservation Act (MWCA) replacement for wetlands impacted must be at a 2:1 ratio. Wetland functions and values lost from impacted wetlands must be replaced. This task will include identifying one to two potential wetland mitigation sites. Task 4 Mitigation Monitoring SEH will monitor the success of the wetland mitigation in accordance with standard requirements in all wetland permits. Standard monitoring is for five years. Policy: It is the policy of the city of Albertville to review streets in all new development proposals to determine the need for stop signs at intersections. Further, it is the policy of the city of Albertville to handle citizen's request for stop signs by conducting an objective study of the intersection. The city council has final authority to approve or deny requests for stop sign placement within the city. The placement of stop signs will not be used as a method of vehicular speed control. Procedures: To enhance the city council's ability to use rational criteria in evaluating stop sign requests, and minimize the proliferation of stop signs, except where required, the following guidelines are to be used: 1) A completed Traffic Study Request Form must accompany all stop sign requests. 2) Direct requests to city engineer for evaluation. 3) The city engineer will evaluate each request using the criteria identified in the Minnesota Manual of Uniform Traffic Control Devices. A stop sign may be warranted at an intersection where one or more of the following conditions exist: a) The intersection of a less important road with a main road where the application of the normal right-of-way rules is unduly hazardous. b) A street enters a through street or highway. c) Unsignalized intersection in a signalized area. d) Other intersections where combination of high speed, restricted view, and serious accident record indicates a need for control by a stop sign. 4) The city engineer will evaluate a request for a Multiway Stop Sign by the criteria identified in the Minnesota Manual of Uniform Traffic Control Devices, and by the Residential Street Multiway Stop Control Justifications Worksheet. One of the following conditions may warrant a Multiway Stop Sign installation: a) Where traffic signals are warranted and urgently needed, the multiway stop is an interim measure that can be installed quickly to control traffic while arrangements are being made for the signal installation. b) Accident problem, as indicated by five or more reported accidents of a type susceptible of correction by a multiway stop installation in a 12-month period. Such accidents include right- and left -turn collisions, as well as right-angle collisions. ! I ' N c) Minimum Traffic. Volumes: i) the total vehicular volume entering the intersection from all approaches must average at least 500 vehicles per hour for any 8 hours of an average day, and or ii) the combined vehicular and pedestrian volume from the minor street or highway must average at least 200 units per hour for the same 8 hours, with an average delay to minor street vehicular traffic of at least 30 seconds per vehicle during the maximum hour, but iii) when the 85-percentile approach speed of the major street traffic exceeds 40 miles per hour, the minimum vehicular volume warrant is 70 percent of the above requirements. d) Other factors may be considered as applicable. 5) Upon completion of the review, a report will be forwarded to the city administrator outlining the study and recommendation. 6) City administrator will forward results of the report to the city council for their consideration. 7) City engineer will respond to the requesting party with results of the report and the decision by the city council on the stop sign request. One of the most common street -related requests received by city officials is for the installation of stop signs. This sheet offers a few items to consider when making such a request. What does a stop sign cost? When you consider the average cost to install a stop sign is about $200, it seems difficult to believe that any stop sign request is ever turned down. The cost of installation, however, is rarely a major factor in considering such a request. The true cost of a stop sign includes not only installation, but also street user costs such as excess vehicle operation cost, lost time, and increased pollution. Individually, street user costs for each stop sign are minimal; however, when the costs are added together for all users over a one-year period, they are substantial. Annual Highway User Costs: (per 1,000 vehicles stopping at stop sign on a 35 mile per hour street — from Federal Highway Administration statistics) $18,000 in excess vehicle operation costs 1,400 hours of lost time 3,800 gallons of extra fuel 8,400 pounds of carbon monoxide emissions 600 pounds of hydrocarbon emissions 600 pounds of nitrogen oxide emissions What is our primary consideration? More than the cost, the primary consideration in approving a stop sign request is to make sure a stop sign is the most appropriate and effective solution to the problem. Stop signs do not necessarily make an intersection safer. Studies of low volume intersections with less than one accident per year have shown that adding stop signs do not reduce the accident rate. This is especially true in cases where unnecessary multi - way stops are created. The city's goal is to provide for public safety and efficient free flow of traffic. City of Albertville Stop Sign Information Rev 8-00 Page 1 What is actually the problem? When a stop sign request is made, the reason for the request must be clear. The main purpose of a stop sign is to assign right-of-way at an intersection. If the problem to be addressed is not related to right-of-way, then a stop sign is not the answer. In many cases, stop signs are requested to curb speeding on a street. Numerous studies have been conducted examining the effect of stop signs on speeding. These studies consistently show stop signs are poor speed control devices. Stop signs do reduce speeds at the point of the installation, but the effect of this speed reduction is gone in a very short distance (less than 200 feet). How will the city process the stop sign request? The city established a policy to process stop sign requests. The process is as follows: 1. The requestor completes the Traffic Study Request form and turns it into City Hall. 2. The city engineer will evaluate each request using State Traffic Control Procedures, which are based on • Traffic Volumes • Sight Distance • Accident Reports 3. The city engineer will report the study findings to the city administrator. 4. The administrator will forward the results of the study to the city council. 5. The city council will make the final determination as to the need for the stop sign. 6. The city engineer will respond to the requestor with results of the report and council action. Subd. 1. "CITY" means the City of Albertville, Wright County, Minnesota. Subd. 2. "OWNER" means an individual or entity holding legal or equitable title to property within the City of Albertville. Subd.3. "MUNICIPAL WATER SYSTEM" means any part of the network of municipal water connections and pipes located within the City of Albertville, including water trunk lines and lateral water lines. Subd. 4. "MUNICIPAL WATER TRUNK ACCESS CHARGE" means a charge imposed by the city for connection to the city's trunk water line within a given municipal water district. Subd. 5. "MUNICIPAL WATER DISTRICT" means a geographical division of property within the City providing the basis for the municipal water trunk access charge. Subd. 6. "MUNICIPAL WATER CONNECTION" means the act of connecting any property or structure to City municipal water system such that said property or structure is able to draw water from the municipal water system. SECTION 2. MUNICIPAL WATER DISTRICTS The City may by resolution establish one or more municipal water districts. I r I r SECTION 3. MUNICIPAL WATER TRUNK ACCESS CHARGE Municipal water trunk access charges shall be imposed on all land within each municipal water district so as to reimburse the costs associated with the installation of trunk water lines, water mains and other necessary water distribution facilities. The City Council may by resolution exempt from the municipal water trunk access charge those lands within each municipal water district which are already connected to the City's municipal water or which have been previously assessed for the costs of the installation of municipal water trunk facilities. No connection shall be made to the City municipal water system serving the property of any person or occupants of the land, parcel or premises upon which municipal water trunk access charges remain unpaid. SECTION 4. METHOD OF CALCULATING CHARGE The City may by resolution set the per -acre rates to be charged for the municipal water trunk access charge in each district, and may set different rates for different districts. The charge shall be based on the gross area of land on the plat or other property, including all outlots and wetlands. SECTION 4. TIME OF PAYMENT All trunk access charges shall be paid to the City at the earlier of: 1) final plat approval for any plat in which a new municipal water connection is required for any property in such plat which is located within a municipal water district, or 2) issuance of a building permit by the City for which a new municipal water connection is required within a municipal water district. No final plat approval or building permits shall be issued prior to payment of the trunk access charges unless other arrangements for the payment of the municipal water trunk access charge are made and approved by the City. Payment shall be in cash or by check acceptable to the City Clerk and/or Administrator. SECTION 5. USE OF TRUNK ACCESS CHARGES The City may establish one or more Trunk Water Funds, and may credit all trunk access charges to such fund. Such funds may, as determined by Council resolution, be used to offset costs incurred in the installation or maintenance of existing or future water lines, general water maintenance costs, or any debt service incurred in the past or to be incurred in the future to finance the municipal water expansions, improvements, operations or maintenance, or any combination of the above. SECTION 6. RESERVATION This ordinance in no way precludes the City Council from adopting additional ordinances imposing other water -related charges in lieu of assessments, or other such ordinances relating to area or service charges with regard to the municipal water system, nor does this ordinance preclude the City from assessing to property owners the costs related to the installation of water lines, trunk mains, laterals and other water related facilities installed by the City. Nothing contained in this ordinance shall act to revoke any existing water access charges. SECTION 7. EFFECTIVE DATE This ordinance shall be effective upon passage by the City Council and publication in the official city newspaper. Passed this 51h day of September, 2000. Mayor City Clerk Se�3� CITY OF ALBERTVILLE ORDINANCE # 2000-10 AN ORDINANCE ESTABLISHING GUIDELINES FOR CUTTING AND REMOVAL OF GRASS AND WEEDS THE CITY COUNCIL OF THE CITY OF ALBERTVILLE ORDAINS: Section 1: CUTTING AND REMOVAL OF GRASS AND WEEDS: Part A: It shall be unlawful for any owner, lessee or occupant or any agent, servant, representative or employee of any such owner, lessee or occupant having control of any occupied or unoccupied lot or land or any part thereof in the City to permit or maintain on any such lot or property or along the sidewalk, street or alley adjacent to the same, any growth of plants, grass, brush, or other weeds or vegetation which is horticulturally out of place to a height greater than twelve inches (12"). This requirement does not apply to the following: ♦ A wetland or flood plain designated on the official Zoning Map; ♦ A drainage pond or ditch which stores or conveys storm water; ♦ Maintained and weeded gardens, trees and shrub plantings; ♦ Property being used for agricultural purposes; and ♦ An area designated as a "natural preserve" by the City Council. Part B: The determination of what constitutes a "natural preserve" shall be made by the City Council in its sole discretion. The City Council shall consider the following factors in making its determination: ♦ Whether there are compelling reasons to preserve the property in its natural state; ♦ The zoning district of the City within which the property is located; and ♦ Whether any public safety or health problems may result if the area is designated a "natural preserve". Section 2: DUTY OF OWNER, LESSEE, OR OCCUPANT TO REMOVE: Part A: It shall be the duty of any owner, lessee, or occupant of any lot or land to cut and remove or cause to be but and removed all such weeds, grass, brush or other poisonous or harmful vegetation as often as may be necessary to comply with the provisions of Section 1; provided, however, that cutting and removing such weeds, grass and vegetation at least once in every three (3) weeks, between May 15 and September 15, shall be deemed to be in compliance with this Section. City of Albertville Ordinance 2000-10 Section 3: WORK DONE BY CITY: Part A: If the provisions of the foregoing sections are not complied with, the City shall serve written notice upon the owner, lessee, or occupant or any person having control of such lot or land, to comply with the provision of this Section. If the person upon whom the notice is served fails or brush or other vegetation within five (5) days from the date such notice is post -marked or delivered, then the City shall cause the weeds, grass, brush and other vegetation of such lot or land to be cut and removed. The actual cost of cutting and the removal, plus such sums as determined by the City Council to reimburse the City for its costs of inspection, shall be certified by the City Administrator and shall thereupon become a lien upon the lot or land on which such weeds, grass, brush, and other vegetation were located and shall be added to and become and form a part of the taxes next to be assessed and levied upon such lot or land and shall bear interest at the same ate as taxes and shall be collected and enforced in the same manner as real estate taxes; provided, however, the owner, lessee or occupant or any person having control of the lot or land, may pay to the City in full the actual costs incurred for cutting and removal plus the inspection fee by September 150' or the same calendar year in which the cutting and removal occurred in order to avoid having such costs levied upon the lot or land. Section 4: PENALTY: Part A: Any person violating any provision of this Section shall be guilty of a petty misdemeanor and upon conviction thereof shall be punished by a fine of not more than two hundred dollars ($200.00).
