2015-07-06 Partial Release of Barthel Indust Development AgreementPARTIAL RELEASE OF DEVELOPMENT AGREEMENT
WHEREAS, on September 10, 1979, Barthel Homes, Inc. (hereafter, "BHI")
entered into a Developer's Agreement with the City of Albertville (hereafter, "City")
titled "Developer's Agreement" (hereafter, "Developer's Agreement"), said Developer's
Agreement having been recorded at the Wright County Recorder's Office on October 17,
1979, in Book 75 of Misc., Page 201, as document number 342276; and
WHEREAS, the Developer's Agreement applied to a number of properties,
including those properties that now constitute Lot 1, Block 2, Barthel's Industrial Park
2" d Addition, according to the plat of record in the Wright County Recorder's Office,
Wright County, Minnesota (hereinafter, "Property");
WHEREAS, the Developer's Agreement imposed certain obligations on BHI and
its successors in title to the Property; and
WHEREAS, BHI and its successors in title have fulfilled the obligations imposed
by the Developer's Agreement such that the Developer's Agreement can be released as it
applies to the Property;
NOW, THEREFORE, Let it be known, that the undersigned, do hereby certify
that the City of Albertville has released the Property from the Developer's Agreement.
