("cit~"): and Ke!nco Construction, Inc. ("Developer") dated Ju~y .24,
1996.! 'The fdllowing paragraphs shall' be chanqed' to read ' as

appear in the July 24, 1996 contract:

i. REQUEST' FOR GRADING APPROVAL. The Developer has asked the
City t;o approvd the grading for Parks ide 3rd Add,ition and Parkside
4th Addition (~ollectively referred to in this contract as the
"plat'~) . The City has approved the preliminary plat for parks.ide
3rd Addition a~d parkside 4th Addition, both legally described on ,.
the attached E'>Chibi t "A", but the Developer wishes to grade the ~ye~i4e-
plat b.efore final plat approval.
3 .GRADtNG AND DRAINAGE PLAN. The plat shall be graded in
accorqance with the Grading and Drainage plan dated May 30, 1.996
(for ~arkside 3~d Addition) and the Grading and Drainage plan dated
October 7,: 1996 (for Parks ide 4th Addition) and on file with the
City of Albertville. The plan shall not be attached to this
permi~. If th~ plan varies from the written terms of this permit,
the wi;itten terms shall control.
4. TIME!OF PERFORMANCE. The Developer shall complete the ~
grading and erqsion control on parkside 3r~A<:i'pition by September .
30, 1996 and o~ Parks ide 4th Addition by ~i~iit~r 15, 199~~ The .
Developer may, however, request an extension of time from the City.
If an 'extension is granted, it shall be conditioned upon updating
the s~curity p~sted by the Developer to reflect cost increases and.
the e~ended completion date.
