RE: Prelirninal"V Plat Plans for Parkside 4th Addition
Dear Mr. Couri:
This letter outlines the acceptance of the conditions of approval as outlined in the Planning
Commission findings of fact dated October 9, 1996 with the exception of condition number 7 and
a clarification of condition # 4 & 5. This letter should accompany our letter of September 30
addressed to the Planning Commissioners via Ms. Stockman, planning consultant.
Condition #4 & 5
Consistent with park dedication code requirements in place at the time of application for the
preliminary plat, Kenco is installing facilities and providing land in lieu of cash dedication to the
City in order to satisfy condition #4. Kenco's letter of September 30 outlined the proposal.
Condition # 5 will be fulfilled via the provision of a 6' minimum width asphalt trail to connect to
the existing trail at the park in Parks ide 3rd addition. Since the trail lineal footage is beyond the
scope of the plat, credits or rebates are likely due the developer. Bids for this trail will be
forwarded to the City Engineer and Attorney prior to the final plat development contract. Costs
for the trail will be examined against the dedication requirements of cash/land less the acreage of
park land, less sewer and water stubs. The remaining balance if any will satisfy condition #4. If
an overage occurs, Kenco requests a rebate of park dedication currently paid to the City as part
of the Parkside 3rd plat release money.

Road Access for commercial parcels & condition 6 & 7
During discussion of the plat at Planning Commission, concern surfaced about access to the B-3
parcel east of the project. Kenco does not believe that it is legal nor appropriate to attach
conditions which have no relationship to this plat merely because it is an adjacent parcel.
The parcel east of Parkside 4th stands alone, has legal access to a County highway, has a full
intersection at 60th street present and has no code requirement to attach to any adjacent parcel,
especially Parks ide 3rd or 4th additions. This condition should be deleted from project approvals
and be dealt with solely at the time of the development of the Beatrice Roden B-3 zoned
property.
Kenco accepted the condition to plant evergreens which usually falls to the higher category land
use owner to provide in condition #6. Kenco accepted in Parkside 3rd addition since we were
the higher land use owner. As proposed, Kenco would request that the planting of evergreens be
a non bonded item so that we can keep our development costs lower.
