& Decision
Applicant's Name: Parkside 4th. Kenco
Request: Kenco has submitted a preliminary plat for the subdivision of 17 single family lots.
The property is zoned R-1, Single Family, and is located immediately north of
Parkside 3rd Addition. The plat provides critical connection between Parkside 3rd
and Westwind. VVhile the street and lot configurations for the plat are lim ited to the
arrangement shown on the plat, two concept plans were previously submitted to the
Planning Commission in order for them to make a determination on the inclusion or
exclusion of a cul-de-sac (eyelid) in the northeast corner of the plat. The Planning
Commission and City Staff concurred that "eyelids" are a maintenance headache
and that it should be eliminated. The same number of lots are possible either way,
except that three varianc~~ are needed for lot width on Lots 6,7 and 8 of Block 1.

Findings of Fact: Based on review of the application and evidence received, the Planning
Commission now makes the following findings of fact and recommendation:
1) The legal description of the subject property is as follows:

2) The Planning Report dated 1 October 1996, prepared by NAC, Inc. is incorporated herein.
3) On 8 October 1996 the Albertville Planning Commission conducted a public hearing to
consider the applicant's request, preceded by a published and mailed notice. Upon review
of the application and evidence received, the Planning Commission closed the public
hearing and recommended that the City Council approve the project.
Recommendation: Based on the foregoing considerations and applicable ordinances, the
applicant's request has been approved based on the most current plans and information received
to date, subject to the following conditions:
1. Three lot width variances are approved for Lots 6,7 and 8 of Block 1. Structure locations
on these lots may be placed ten feet in front of the required front setback line (which may
be at a point where the lots are less than ninety (90) feet wide), provided that minimum
side yard setbacks can be met.
2. The street within the plat is named Kalenda Drive rather than Kalland Drive or Kalland
Avenue to avoid confusion with the existing Kalland Drive.

A parking lot conta.g a minimum of six (6) stalls is pr.ed by the developer on land
dedicated to the City as parkland. A portion of the land is located within Parks ide 4th and
should be designated as parkland on revised plans. The lot should contain one
handicapped stall and a means for cars to turn around before re-entering the street right-
of-way. .

4. The remainder of cash dedication requirements are satisfied with a cash payment as
determined by the City Planner and City Attorney.
5. An off-street asphalt trail is constructed along the renamed Kalenda Drive from the stub
trail which exists in Westwind, through Parkside 4th and continuing south across 57th
Street to make connection with the recently acquired parkland in Parks ide 3rd. The trail
shall match the width of the existing stub and shall continue at a width not less than six (6)
feet along its entirety. The trail shall be separated from the curb a minimum of three (3)
feet.
6. Evergreen trees are planted at the rear of single family lots which abut the commercial
property to the east in a single row. The plantings shall be of the same species, size and
spacing that was required for Parks ide 3rd and shall be installed during the 1997 growing
season.
7. All grading, drainage and utility issues are reviewed and approved by the City Engineer,
including but not limited to: designation of outlots vs. easements, location of sewer/water
stubs, ponding area design, grading to be completed this Fall, and re-use of the lift station
as discussed herein.
8. The developer will stub sewer and water into Westwind Park as part of required park
dedication requirements.
9. The City Attorney prepare a grading contract for Parks ide 4th which stipulates the
requirements for completion, reseeding, and monetary assurances to see that the work will
be completed properly.
