He also reported on the School District’s Finance Advisory Committee meeting where information was presented regarding the District’s fund balance projections for the next few years. Councilmember Zagorski then responded to questions from the other Councilmembers. Acting Mayor Olson provided an update from the FYCC meeting and reported that FYCC was down to one person. City Administrator Nafstad added that the summer field program scheduling currently overseen by FYCC may potentially be moved to the School District. B. Building – None C. City Clerk – None D. Java Retail Additional Planned Unit Development Agreement – Minor Revisions City Attorney Allseits provided background on the proposed revisions to the Developer’s Agreement, noting that the agreement had previously been approved by the Council; however, following that approval, the Developer requested minor revisions, resulting in the agreement return to Council for considerations. He reported that the City Attorney’s Office had reviewed the proposed changes and had no objections to the agreement being presented at this meeting. Attorney Allseits responded to questions from Council. Administration 1. County Road 18 Phasing Discussion City Administrator Nafstad reported that Wright County continues to pursue the County Road 18 project and explained that the work would be phased over a two-year period due to school- related and traffic considerations. He noted that Phase One, anticipated in 2026, would focus on intersection control at the Middle School entrance, while Phase Two would be a larger project including a roundabout at the intersection of County Roads 18 and 19, tentatively occurring in 2028. He explained that in 2027 a separate road project is planned further south on County Road 19, which may result in excessive traffic congestion and disruption if 18/19 is being constructed at the same time. City Administrator Nafstad responded to Council questions and provided additional information on other upcoming construction projects. 2. City Administrator’s Update – Verbal City Administrator Nafstad updated the Council on upcoming events including the I-94 West Chamber State of the Cities Luncheon, I-94 Corridor Coalition Legislative Preview and the Annual Albertville Fire Relief Holiday Celebration. 10. Michael B’s located 6550 Lamplight Drive. • Resolution No. 2026-04 imposing civil penalty for liquor license violations occurring on December 26, 2025, at Cedar Creek Bar & Grill located 5700 Jason Avenue NE. BACKGROUND: The Wright County Sheriff’s Department, along with Wright County Public Health staff performed alcohol compliance checks on the City’s liquor establishments on December 26, 2025. Under the direction of the Wright County Sheriff’s Department, an underaged buyer attempted to purchase alcoholic beverages at the licensed establishment throughout the City. The youth buyer was not disguised and provided their valid MN Driver’s License if asked for proof of age. Two of the licensed establishments failed the compliance check by selling alcohol to the underaged buyer. The City is responsible for imposing civil penalties against the license holders. Minnesota Statute 340A.415 limits civil penalty fees to a maximum of $2,000 for each violation. The Albertville City Code section 4-1-15 Suspension or Revocation of License; Civil Fine establishes guidelines for the imposition of civil penalties against liquor licensee for liquor violations. Wright County Public Health continues to offer alcohol sale training classes for all Wright County Establishments. Establishments are notified of upcoming training classes and are encouraged to attend. KEY ISSUES: • The Wright County Sheriff’s Department performed alcohol compliance checks on the City’s liquor establishments on December 26, 2025 in which two of the Albertville establishments failed by selling alcohol to an underaged buyer. • The City Council has the authority under the provisions of MN Statute Section 340A.415 to either revoke the license, suspend the license for up to 60 days, impose a civil penalty of up to $2000 for each violation, or impose any combination of these sanctions. • The City has adopted guidelines for enforcement which are contained in Albertville City Code section 4-1-15 Suspension or Revocation of License; Civil Fine which call for fines for the first violation within a two-year period, subject to Council discretion. • Per Albertville City Code if the licensee should wish to dispute the fine, the establishment may be given an opportunity to request a hearing in front of the Albertville City Council. ALBERT RECOMMENDATION: It is respectfully requested that the Mayor and Council consider the following: MOTION TO: Approve renewal of the Consumption and Display permit for the Church of St. Albert’s for the Parish Center located at 11400 57th Street NE and further subject to receipt of licensing approval from the State of Minnesota. BACKGROUND: Staff has received the renewal Consumption and Display permit application from the Church of St. Albertville for the Parish Center. The Church rents the Parish Center for event (example: wedding, etc.) and permit allows customers renting the Parish Center to bring and consume their own alcoholic beverages with the Church’s permission. KEY ISSUES: • Consumption and display permits are not issued by the City, but by the State. However, the local authority (Albertville City Council) must either approve or deny any applications before they are submitted to the State for approval. • A consumption and display permit will run April 1, 2026, through March 31, 2027. • There are no outstanding fire or building code issues and no outstanding fees or fines. • MN Statute allows any applicant to be eligible for this type of license so long as they have not been convicted of a felony or liquor law violations within five years. BACKGROUND: The developer, LEP Holdings, LLC, is interested in redeveloping the east side of the Albertville Outlet Mall (east of CR 19) currently owned by CPG Partners and managed by Simon. The site consists of one parcel approximately 15 acres, with four separate retail buildings. The site is zoned Albertville Outlet Mall 2 PUD (B-3) and is within the shoreland district of School Lake. The proposed development consists of removing all four of the existing buildings and redeveloping them with the following: • 10 Smaller commercial lots o Car Wash o Four drive-thru (restaurant) sites o Oil Change facility o Four general Purpose Commercial Buildings • Architectural Materials o Allowing fabric building as exterior building material for the car wash Agenda Page 63 Mayor and Council Communication – February 2, 2026 Planning – Due North Concept Review Page 2 of 2 KEY ISSUES: • The property is zoned B-3 Planned Unit Development. Allowed uses are general retail. The PUD will need to be amended to allow for this particular layout and uses. Each lot with a drive-through would be required to get a separate Conditional Use Permit. • There are restrictions on the deed that limit the reuse of the site. Existing use exclusions include competing retail and restaurants with existing mall tenants on the west side. This means no general retail or and most restaurants would not be allowed. The type of B-3 uses that could be allowed, include auto repair, schools/studios, personal office, daycare, hotel, entertainment, fitness. Residential generally does not work due to shoreland requirements and density with proximity to the lake. • Proposed building is unique. The building type/layout will allow vacuuming inside a building, and the materials (fabric type interior) will help with the maintenance of the carwash (anti-mold). There are glass overhead doors, metal panels with wood appearance, and aluminum panels at the base of the structure. The remainder is a combination of white (translucent), gray and blue fabric, Allowed architectural materials in the B-3 are a minimum of 50% of all must be brick, stone, glass, stucco and its replicas, woods, rock faced block, or aggregate precast concrete panels. • Wall signage appears to be under 15% of the facade facing a street (the west wall). Special considerations will have to be given in the PUD as there are no internal public streets, they are all private drives. Additionally, there is proposed wall signage on a building wall not facing a street or drive. POLICY/PRACTICES CONSIDERATIONS: The development requires a PUD Amendment which gives the Council the most discretion within land use decisions. This is a site that is blighted and has been vacant for some time. Redevelopment is a priority for the City. FINANCIAL CONSIDERATIONS: The proposed development will be seeking TIF. There are significant acquisition and demolition costs to redevelop the site, in addition to the use restriction which represents additional challenges in the opportunities to redevelop. LEGAL CONSIDERATIONS: The City Attorney has reviewed the concept concurs that a PUD Amendment and replating are necessary to facilitate the proposed redevelopment. A preliminary plat, final plat, and developer agreement will also be required. BACKGROUND: The Planning Commission reviewed the applications and held a public hearing on the rezoning and preliminary plat at their January 13, 2026, meeting. No public comments were received. The Planning Commission discussed access to the site. The Planning Commission recommends approval of the applications citing consistency with the City’s Comprehensive Plan, zoning ordinance, and economic development goals. There are no outstanding issues, however, conditions are included for the approval of the preliminary and final plat. KEY ISSUES: • The plat will combine four lots into a single approximately 2.91-acre lot. • The proposed rezoning will create consistency among the parcels included within the plat and ensure that the uses on the site are allowed through the Federated Co-ops PUD. • Access to the site is currently dependent on a private agreement between the owner and BNSF Railroad. If this agreement is discontinued, access to the site will need to be created. A condition has been included that details how access will be the responsibility of the applicant and shall require an amendment to the Federated Co-op PUD should it change in the future. • All performance standards have been met, however, additional easements are required. The easements are addressed within the Developers Agreement. • The rezoning and plat was recommended for approval by the Planning Commission with four conditions. Two additional conditions have been added by staff since the Planning Commission meeting. POLICY/PRACTICES CONSIDERATIONS: Approval of the zoning map amendment, preliminary plat, and final plat are consistent with the City’s long range land use plan, subdivision ordinance, and zoning ordinance. The request includes the applications for a Zoning Map Amendment, Preliminary Plat, and Final Plat. For the plat to be approvable, the newly subdivided PID 101-500-012133, needs to be rezoned from R/W to the Federated Co-ops PUD/B-3, Highway Commercial District (PUD/B-3 district). BACKGROUND David Jurek of Bogart, Pederson & Associates, Inc, the applicant, has made an application on behalf of the property owner, Federated Co-ops, Inc for a Preliminary Plat and Zoning Map Amendment. The Planning Commission is responsible for reviewing and making a recommendation to City Council on the Preliminary Plat and Zoning Map Amendment applications. The Rezoning application is applicable to a parcel recently subdivided from the BNSF Railway parcel with PID 101-500-012133, changing its zoning from Railway to PUD/B-3, Highway Commercial District. Following the rezoning, the applicant intends to combine this parcel (via the proposed preliminary plat) with other contiguous parcels owned by Federated Co-ops. The parcels currently owned by Federated Co-ops are zoned Federated Co-ops PUD/B-3 district. This district has the same uses as the B-3 district, in addition to “farm supply sales and associated storage including fertilizer (dry and liquid), animal feed, seed, fuel and oil and related products per the approved site plan dated May 7, 2013.” The PUD district has the same setback requirements as the B-3 district. The PUD has 18 special conditions that apply to parcels within the PUD, which are detailed in Section 5200.14 of the Zoning Ordinance and attached to this staff report. The front of a lot shall be the boundary abutting a public right of way having the least width. The front of the lot for both proposed lots is the eastern lot line that abuts a unplatted parcel that is owned by the City of Albertville and zoned as Right-of- Way. The proposed lot is an irregular shape and staff have reviewed the site with the lot lines designated as shown in the adjacent image. Setbacks within the B-3 district allow for 20 ft. setbacks for the rear and side yard except where a lot abuts a residential property. The Federated Co-ops PUD allows for a 10 ft. setback for all lot lines. Additionally, the PUD details a 0 ft. setback “along north property lines of Blocks 1 and 2”. The existing parcels do not include lot and block descriptions. Staff have interpreted this standard to apply to the northern property line that abuts the parcel owned by BNSF Railway. The site meets the standards established in the PUD. The preliminary plat provided does not include a total for the site coverage on the proposed lot, but staff has calculated the total existing coverage to be approximately 68.8%. The applicant has not proposed any changes to the site that would impact site coverage. Rezoning and Preliminary Plat Page 3 of 4 Dedication Requirements Commercial subdivision or developments require 10% land dedication, however, property being divided with the same number of lots shall be exempt from all park land dedication requirements. As the combination results in fewer lots than currently exist, and park dedication was collected for the parcel that was subdivided from the BNSF lot to the north, staff believe park dedication is not required for the application. Easements around the perimeter of the lot are still required to be dedicated. Easements The proposed preliminary plat shows a numerous easements that exist on the property. As part of the combination of the lots, drainage and utility easements of at least 10 feet shall be provided on all lot lines, and may be centered on side and rear lot lines. The submitted final plat includes the easements, except on the north lot line. A condition has been included that easements must be approved by the City Engineer before the plat may be recorded. Additional drainage and utility easements may be required by the City Engineer. The size and location of easements shall be subject to the review and approval of the City Engineer. Erosion and Sediment Control No development or alteration to the lots is proposed, and therefore no erosion and sediment control plan is required. Access Access to the site is currently provided from a driveway off 60th Street Northeast that passes over the railway parcel to the north. An access agreement dated December 13, 2024, between BNSF and Federated Co-op is shown on the preliminary plat. Due to this private access and the abutting public right-of -way being an existing city owned parking lot, a condition has been included that the private access of 60th Street shall be retained in perpetuity. If in the future, access is modified, a PUD Amendment will be required. Compliance with Comprehensive Plan The proposed preliminary plat and zoning map amendment must comply with the Albertville Comprehensive Plan. The property is shown on the Proposed Land Use Plan as Agriculture/Rural, however, the same color is used to designate streets and the railway, so this area is likely not intended to be Agriculture/Rural. Instead, areas that function as right-of-way are not specifically defined on the Future Land Use map. The Albertville Vision/Comprehensive Plan does not set goals for property designated Agriculture/Rural, however, Federated Co-ops use as an agricultural business with outdoor storage. BACKGROUND: Federated Co-ops, Inc. has applied for final plat approval for properties which it has both owned and leased from the railroad and which house Federated’s fertilizer and fuel businesses. Federated has recently purchased the property it leased from the railroad and is now platting all of its property into one lot. Because no changes to the existing conditions on the site are proposed, this Developer’s Agreement is a slimmed down version of the City’s normal Developer’s Agreement. KEY ISSUES: • Federated is not changing its operations, but merely consolidating all lots that it is currently operating on into Lot 1, Block 1 of the Federated Co-ops Albertville plat. • Federated is not installing any municipal improvements or on-site improvements in conjunction with this plat, nor will a letter of credit be required. • Park dedication fees have recently been paid on the property Federated purchased from the railroad; park dedication fees on the remainder of the property is not due as the property had been developed with buildings prior to the enactment of the City’s Zoning Ordinance which normally would require park dedication. • The property is not served by public utilities and none are proposed to be installed, so no utility-related trunk fees are due on the property at this time. • The property does not abut on a public road but instead accesses 60th Street via a 25-year easement from the railroad. The Developer’s Agreement contains a provision that if the access easement is not renewed, Federated will need to apply for a modification of the PUD and the Developer’s Agreement for the City’s approval of whatever new access the property may have, particularly given the public safety and fire issues associated with the storage and handling of fertilizers and fuel on the site. POLICY/PRACTICES CONSIDERATIONS: This Developer’s Agreement mainly addresses the future access issue should the railroad not renew the access easement at some point in the future. FINANCIAL CONSIDERATIONS: There are no financial considerations raised by the platting of this property. Agenda Page 107 1 CITY OF ALBERTVILLE PLANNED UNIT DEVELOPMENT AGREEMENT FEDERATED CO-OPS ALBERTVILLE THIS AGREEMENT, entered into this ______ day of February, 2026 by and between Federated Co-ops, Inc., a Minnesota corporation, referred to herein as “Developer”; and the CITY OF ALBERTVILLE, County of Wright, State of Minnesota, a municipal corporation, hereinafter referred to as “City”; WITNESSETH: WHEREAS, Developer is the fee owner and developer of the real property described as Lot 1, Block 1, Federated Co-ops Albertville, Wright County, Minnesota (“Said Plat” or “Subject Property”), which real property is proposed to be subdivided and platted for development as the plat of Federated Co-ops Albertville (a copy of the final plat is attached hereto as Exhibit A and incorporated herein by reference), and which is subject to the provisions of this Agreement; and WHEREAS, Developer is proposing to plat several lots into Lot 1 of Said Plat, to be used for farm supply sales and associated storage including fertilizer (dry and liquid), animal feed, seed, fuel and oil and related products per the approved site plan dated May 7, 2013 and governed by Federated Co-ops PUD/B3 Highway Commercial District (PUD/B3 District) approved by the City; and WHEREAS, the City has given final approval of Said Plat contingent upon compliance with certain City requirements including, but not limited to, matters set forth herein; and WHEREAS, this Agreement is entered into for the purpose of setting forth and memorializing for the parties and subsequent owners, the understandings and covenants of the parties concerning the development of Said Plat and the conditions imposed thereon; Agenda Page 108 2 NOW, THEREFORE, IT IS HEREBY AND HEREIN MUTUALLY AGREED, in consideration of each party’s promises and considerations herein set forth, as follows: 1. Planned Unit Development. The Development is hereby allowed to be developed as a Planned Unit Development with flexibility from the strict requirements of the City’s Zoning Ordinance in relation to selected items detailed in this paragraph: A. The uses on Said Plat shall be restricted to farm supply sales and associated storage including fertilizer (dry and liquid), animal feed, seed, fuel and oil and related products per the approved site plan dated May 7, 2013 and other uses allowed by the Federated Co-ops PUD/B3 Highway Commercial District (PUD/B3 District). B. Said Plat does not abut any public streets, although it accesses to 60th Street across a private easement provided by BNSF Railway to the north of Said Plat as shown on the attached Exhibit B (“Private Easement”). In the event that Developer is unable to renew the Private Easement with BNSF Railway at such time as the easement shall expire, Developer must apply for and receive an amendment to the PUD and this Agreement that provides an access to Said Plat that the City reasonably determines to be safe and adequate for the uses on the site without unduly burdening surrounding properties, City owned properties, or City streets. Due to the potential fire and safety hazards of Developer’s fertilizer and fuel business, Developer must utilize an access approved by the City to continue using Said Plat for its fuel and fertilizer related uses in the event the Private Easement expires and Developer is no longer able to use the Private Easement. 2. Developer to Pay City’s Costs and Expenses. It is understood and agreed that the Developer will reimburse the City for all reasonable actual, out-of-pocket administrative, legal, planning, engineering and other professional costs incurred in the creation, administration, enforcement or execution of this Agreement and the approval of Said Plat. In addition, Developer shall reimburse the City for all reasonable, actual costs of enforcing this Agreement as it pertains to Said Plat, including the City’s court costs and reasonable attorney’s fees. Developer agrees to pay all such costs within 30 days of billing by the City including documentation reasonably requested by Developer regarding such costs. Developer has the right to request time sheets or work records to verify said billing prior to payment. 3. Miscellaneous. A. If any portion, section, subsection, sentence, clause, paragraph or phrase of this Agreement is for any reason held invalid by a Court of competent jurisdiction, Agenda Page 109 3 such decision shall not affect the validity of the remaining portion of this Agreement. B. The action or inaction of the City shall not constitute a waiver or amendment to the provisions of this Agreement. To be binding, amendments or waivers shall be in writing, signed by the parties and approved by written resolution of the City Council. The City’s failure to promptly take legal action to enforce this Agreement shall not be a waiver or release. C. This Agreement shall run with the land, shall be recorded against the title to Said Plat and shall bind future owners of the lots in Said Plat. D. Prior to the execution of this Agreement and prior to the start of any construction on Said Plat, Developer shall provide the City with evidence of good and marketable title to all of Said Plat. Evidence of good and marketable title shall consist of a Title Insurance Policy or Commitment from a national title insurance company, or an abstract of title updated by an abstract company registered under the laws of the State of Minnesota. 4. Violation of Agreement. A. In the case of default by the Developer, its successors or assigns, of any of the covenants and agreements herein contained, the City shall give Developer thirty (30) days’ mailed notice thereof (via certified mail), and if such default is not cured within said thirty (30) day period, or such longer period of time as may be reasonably required to cure such default provided Developer is proceeding with diligence to cure such default, the City is hereby granted the right and the privilege to declare any deficiencies governed by this Agreement due and payable to the City in full. The thirty (30) day notice period shall be deemed to run from the date of deposit in the United States Mail. Upon failure to cure by Developer, the City may thence immediately and without further notice or consent bring legal action against the Developer for specific performance, to collect any sums due to the City pursuant to this Agreement, plus all costs and reasonable attorney’s fees incurred in enforcing this agreement, and any other remedy available under law. B. Notwithstanding the 30-day notice period provided for in paragraph 4A above, in the event that a default by Developer will reasonably result in irreparable harm to the environment or to public property, or result in an imminent and serious public safety hazard, the City may immediately exercise all remedies available to it under this agreement in an effort to prevent, reduce or otherwise mitigate such irreparable harm or safety hazard, provided that the City makes good-faith, reasonable efforts to notify the Developer as soon as is practicable Agenda Page 110 4 of the default, the projected irreparable harm or safety hazard, and the intended actions of the City to remedy said harm. C. An uncured default beyond all applicable notice and cure periods hereunder of any of the terms of this Agreement by the Developer shall be grounds for denial of building permits. 5. Indemnity. Developer shall hold the City and its officers and employees harmless from claims made by Developer and third parties for damages sustained or costs incurred resulting from Said Plat approval and development, except to the extent caused by the willful misconduct or negligence of the City, or someone acting on its behalf, or a breach of this Agreement by the City. The Developer shall indemnify the City and its officers and employees for all costs, damages or expenses that the City may pay or incur in consequence of such claims, including reasonable attorney’s fees. Third parties shall have no recourse against the City under this Agreement. 6. Assignment of Contract. The Developer can assign the obligations of the Developer under this Agreement. However, the Developer shall not be released from its obligations under this Agreement without the express written consent of the City Council through Council resolution. 7. Limited Approval. Approval of this Agreement by the City Council in no way constitutes approval of anything other than that which is explicitly specified in this Agreement. 8. Integration Clause, Modification by Written Agreement Only. This Agreement represents the full and complete understanding of the parties and neither party is relying on any prior agreement or statement(s), whether oral or written. Modification of this Agreement may occur only if in writing and signed by a duly authorized agent of both parties. 9. Notification Information.
