Dear Maureen:
During construction of the CSAH 37 interceptor and
watermain, Latour Construction stripped the topsoil along the
Highway '57 ditch and stockpiled it within the plat near the
intersection of Kalland Drive and Highway '37. It was their
intention, to ut;i.lize this same stockpile to provide the four
inches of black dirt in the highway diteh as part of
restoration. Sine. restoration of the di.tch could not occur
until after the right turn lane was paved, the ditch was left
four indnes low, and Latour completed the interceptor
installation on the other side of Highway 19 and proceeded to
the Braun Development.
On two separate occasions, John Darkenwald complained to
me about tn. Unsightly pile of dirt across the road from the
motlel home . Howeve~, no mention was made of paying the
Contractor extra to move this pile of dirt. I passed his
complaints along to Ken' La~our.

Shortly before the'~.parade of Homes" ,the developer sold
the black dirt stQCkpile to Buffalo Bituminous, who then
proceeded to use it to fill in the back of curbs on Barthel
Manor Second Addition and Hackenmueller's road shoulders.
When Latour Construction returned to Westwind to complete
the ditch restoration, there was no black dirt available for
their effort. The utility companies were placing their feeder
lines in the ditch at the same time, so restoration would have
been impractical at this point anyway.

At the last Council meeting, you expressed some concern
over whether the ditehrestoration would be completed in the
near future. Latour Construction intends to complete this as
soon as possible. However, since the black dirt which they
intended to use for restoration is nolollger available, they
feel they are entitled to an extra for hauling the dirt from
another location. Apparently they may be able to obtain
sufficient black dir'tfrom along the temporary s'torm sewer
ditch.
I am of the opinion that Latour is enti tIed to be
compe~sated for any extra costs associated with obtaining
black dirt fortfte ,.igbway ditch. I do not feel that this
should be taken out of contingency, however. The developer
should pay these eos:ts directly, in my opinion.

Section 1200.4, h. 16 of the city of Albertville zoning
code states in part: "All open, off-street parking shall
have a perimeter curb barrier around the entire parking
lot; said curb barl"ier shall not be closer than fi ve (5)
feet to any lot 1 ine . " In . reviewing the site plan for
the newly constructed Westwind Apartments, it would appear
a continuous curb was shown, but has not been constructed..
This should be brought to the attention of the Owner and
the installation of the curb barrier could possibly be
incorporated with the site work for the second apartment
building. A more detailed site plan for the second apartment
building should be submitted to the city of Albertville
for reviewal regarding drainage., elevations, parking stall
d1.....ions,etc.
