Re: Development Agreement - Towne Lakes

We have received a draft of the Development Agreement for Towne Lakes. After
review and discussions with Mr. Couri, City Attorney we still have some concerns
and/or requests that we would like to discuss further with the City. We are in general
agreement with the Developer's Agreement pverall except in the following areas.
1. Item 1. Conditional Use Permits.. Subparagraph vi. b. . Garage Side yard
Setbacks
We would like to amend this condition to allow garage structures to be placed within e)
feet of the side property line provided there is a minimum separation of 15 feet
between structures when there is a house on the adjoining parcel and 10 feet of
separation between structures when there is a garage structure on the adjacent
parcel. Exhibit B (setbacks) reflects our proposed requests with regards to setbacks.
2. Item 1. Condition.1 U.e Permits - subparagraph vi. Acceuory dwelling unit
We would like to give a presentation to the City Council of the advantages and
opportunities of rental units.
3. Item 1. Conditional Use Permits. subparagraphs ~cO & It! Wetland Setbacks
This condition does not effect our flrst phase however, it does impact the buildable
area of three lots In a future phase. We would like to know why the change from a 20
foot to a 30 foot setback?

4. Item B . Park Dedication Requirements
In the Development Agreement under section B subparagraph v. is requiring the
developer to install $100,000 of recreational equipment In Parks 1 &2. In addition,
subparagraph vi. Is requiring the Developer to Install park benches, picnic tables,
volleyball court and tennis court, tot lot, gazebo and parking late as shown on park
plans. According to the Preliminary Plat Findings of Fact and Decision dated 8/21/00
the city council approved the preliminary plat of Towne Lakes with a condition that
Part< dedication shall be 20% of the 85 acre site, which equates to 17 acres. We are
dedicating to the city the following areas for Park purposes and/or open spaces.

In addition to the land dedication we are proposing to install the park gazebo,
landscaping, playground equipment (swings, spring toys, play structure),
benches/chairs, pergolas construct the 2 parking lots as shown on the park amenity
plan. We are also planning on fencing the perimeter of Park Area 1 with B decorative
style fence. An estimate of the of the park amenities (installed) are as follows:
- Park gazebo
- Play structure
- Swing
- 2 Diggers/2 spring toys
- Play area subgrade/curblng
- Fencing 1,300 I..F. A$16/I..F.
- Water fountain
- Chairs/benches
- 3 Percales (Dark area and overlooks)

We are requesting that condition "B. v." be revised by deleting the $100,000
requirement of playground equipment and Item liB. vi.1I delete the developer's
requirement to install the volleyball and tennis courts.
