Re: Special assessments on commercial land in Westwind
development
We are submitting this memorandum in order to clat~ify the
background facts with reference to the proposed special
assessments on the commercial land fronting on County Road
No. 19.
We are also concerned about the frequently made suggestion
tha t we are at temp t i ng II to get someth i ng fot~ nClth i ng II and
somehow reneging on an obligation to the city. It is our
intention, and i~ has always been our intention, to pay our
fair share of the cost of the sewer and water systems that
provide a special benefit to our property. Our concern is
pt~imat~ily when payment is to be t~equit"ed.
In 1986 we negotiated an option agreement to purchase the
Michael Becker farm. The option ran for 3 years and the
purchase agreement incorporated therein provided for cash
payment at closing or a contract for deed payable in monthly
inst.::dlments "until sewet~ is available to pt~emises, when
t~emaining unpaid balance shall be due and payable in full ~ II
During 1987 we had several meetings with various city
representatives as we planned our development and tried to
determine if our project was feasible. Late in 1987 the City
Engineer was directed to prepare a long range feasibility
study to determine how the required municipal improvements
could be e:.:tended tht~ough out the city to accomodate the
expected growth in population. At this same time we were
firming up our concept plans and negotiating the terms of a
Developer's Agreement with the city. Pertinent details are
laid out in the packet which we submitted to the council and
which we reviewed with your committee at our meeting on
J.::~nuat~y 22nd.
In order to serve the remaining undeveloped land in the city
it was obvious that a lift station and forcemain would be
required as well as an Interceptor line to serve areas A
(North of 1-94) and B (South of 1-94 and primarily west of
County 19). Area B also included some land east of County
19. The future interceptors would all feed into the lift
station and forcemain.
