The applicant is proposing to reduce side yard setbacks. The Towne Lakes 5111 Addition PUD granted flexibility in lot width lot size, setbacks, street widths and maximum building coverage. In a memorandum dated June 24, 2005, front yard, side yard and rear yard setbacks were more clearly identified by our office as follows: Front Yard Setbacks . 15 foot front yard setback to house · 24 foot front yard setback to front of garage - garages must be recessed a minimum of nine feet from the front of the house Side Yard Setbacks . Side yard setback garage - 5 feet interior lot line · Side yard setback garage setback on a comer lot - 24 feet to the front of garage from street right-of-way . Side yard setback house interior lot - 10 feet · Side yard setback house on a comer lot to the street - 15 feet Rear Yard Setbacks . 25 feet I~ IOI~ A1 ~d+o KHoJ(f:y Lot 19, Block 4 depicts a 6.28 foot and 5.49 foot side yard garage setback which exceeds Towne Lakes 5111 Addition PUD standards. The side yard house setback on this same lot depicts a 9.08 foot and 8.04 foot setback which is incompliant Our staff believes that the structure cen be shifted west to alleviate the eastern side yard house setback encroachment. In regards to Lot 18, Block 4, our staff finds that this parcel complies with Towne Lakes 5111 Addition PUD setback standards. No changes are advised. In review of the surveys for Lot 19, Block 4 and Lot 18, Block 4 submitted by K Hovnanian Homes, it is determined that a variance to reduce side yard setback would be unfavorable.
