No Date News Article Up For Auction Cedar Creek Golf Course up for auction Cedar Creek Golf Course of Albertville owner Kent Roessler recently informed Albertville of his intention to sell or place the Cedar Creek Golf Course up for public auc- tion. Albertville City Administra- tor Larry Kruse said that' since that report, the city has fielded a large number of calls from concerned residents asking if the golf course could be discon- tinued and redeveloped in additional housing. Homeown- ers adjoining the golf course expressed concerns because they said they paid premium prices for golf course lots. City attorney Mike Couri explained to the city council that clauses contained within a document entitled "City of Albertville Developer's Agree- ment Cedar Creek Golf Course Planned Unit- Development Concept Plan Master Agree- ment", adopted Feb. 27, 1998, would not allow the conversion of the golf course to another use without the city council's approval. The agreement states the area. designated for the 18-hole I golf course shall be restricted . to use only as an 18-hole golf course with typical complimen- tary accessory uses related to and commonly associated in the industry with golf course uses. The agreement goes on to say that the restriction on the use of this land for golf course purposes may be modified only upon the written authorization of the city. And the city shall exercise sole discretion in determining whether to allow any use other than an 18-hole golf course on the property. The agreement further states the restrictions run with the land and shall be binding on all future assignees in per- petuity. Planned Unit Developments like Cedar Creek allow for some deviations from the nor- mal standards. For example the developer may be allowed to construct homes on smaller lots at high- er densities with the under- standing that green space would be accommodated within the golf course. The city council said .it expected it be a golf course when the agreements were made and strongly feels that would be the expectation today.
