As part of the preliminary plat and PUD approval all subsequent commercial sites are required to be processed as
a Site and Building plan application requiring both planning commission review and city council approval.
Your attached building plan is different from any of the building configurations approved with the PUD. In this
respect, we are concerned as to how this site will fit within the overall PUD design related to building orientation,
parking layout, traffic circulation, landscaping, etc. You will need to demonstrate that the site design and building
architecture will accomplish the objectives of the original PUD.
With the approval of Shoppes of Towne Lakes II, there is an expectations of higher quality architecture than in
Phase I. Specifically the city council is not satisfied with the building that you are now proposing. When Dan
presented this Phase II, he represented that this area would have a higher quality building design. The city council
is expecting a predominately brick or stone building exteriors.
We are also concerned with the lack of detail given to HVAC equipment related to this building design and its
application in Phase I.
The first building in Phase I placed the HVAC in the C.R. 19 setback and subsequently required an adjustment in
the site plan just to accommodate the screen walls. On the second building in Phase I, the HVAC is located to
the east toward the Towne Lake Townhomes, This location is not appropriate and if you visit the site you may
agree that landscaping does adequately screen this large unsightly equipment. The city will not approve this
condition in Phase II.
I should also note that the city has had a number of issues with trash enclosures, outdoor storage of material and
parking of trucks in areas not designed for these types of vehicles within Phase I.
You will need to apply for a Site and Building plan review, If the building configuration is different than that
approved for the PUD you can expect that we will request plans and information that show how this revised site
plan will relate to the previous approve PUD. The aforementioned issue are identified to give you a heads up on
city concerns.

I spoke with Jon yesterday about a retail building AI Keller would like to build in the next phase of
Towne Lakes. He requested I send a copy to the city and to Alan Brixius of the plan. It is the
same concept as the retail building in Phase I. Can we bring this in for building permit?
