(Pinnacle) was retained by Edina Development Corporation (Edina) to monitor the mitigation wetlands at the Albert Villas development (Site). The Albert Villas Development is located within Sections 2 and 11, Township 120N, Range 23W in Albertville, Wright County, Minnesota, as depicted on Figure 1. The local governmental unit (LGU) is the City of Albertville, and their consultant Short Elliot and Hendrickson (SEH) provides technical assistance for the wetland and engineering issues. This is to be the first year of revised wetland monitoring requirements for this Site. Edina was issued a Restoration Order on February 23, 2005 for non-compliance with the requirements of the Wetland Conservation Act (WCA) permits issued for multiple phases of the Albert Villa's residential development. This monitoring report is a condition of that Restoration Order and Restoration Order Response (Response). The original mitigation wetlands were to be created by excavating and grading the upland soils to match the elevation of the adjacent, existing wetlands. This procedure was conducted in 10 different locations throughout the Site, with the proposed created wetlands ranging in size from 0.08 to 1.05 acres and totaling 3.00 acres. Previous monitoring reports indicated that several mitigation areas were unsuccessful. Several of the mitigation areas were re -graded in an effort to meet the requirements of the Restoration Order. One area was eliminated. Maple Grove, Minnesota Rochester, Minnesota La Crosse, Wisconsin ' Mr. Deric Deuschle Pinnacle Project No.: MN00039.00 BG005 ' August 15, 2005 Page 2 ' Based on as -built Y surveys conducted in earl June 2005 and onsite review of the mitigation areas; the new total for the mitigation areas is 2.59 acres of reconstructed and ' successful mitigation. This is 0.41 acres below the original proposed mitigation. Another 0.09-acres of impact (between 7f and 80 was added to total mitigation area be replaced. The current total area requiring replacement is 0.50-acres. The Restoration ' Order requires that the replacement mitigation be at a 4:1 ratio. This means that a total of 2-acres of new wetland credit and upland buffers area is needed as mitigation ' replacement. Replacement Areas totaling 2.14-acres are being constructed. Pinnacle visited the Site on July 6, July 22 and August 10 of this year to document the ' hydrologic and vegetative conditions of the mitigation wetlands. Each mitigation area depicted on figure 2 is discussed in the sections below. Photographs taken during the growing season are included within the text of the report. Pinnacle has created a check list by mitigation area of tasks that were required by the ' Restoration Order. The approximate date when the task was completed is listed in the check list table. Edina has had continuing conversations with the LGU concerning meeting the requirements of the Restoration Order and has received documents verifying the completion of some tasks. Onsite verification of other tasks has also occurred. Full size drawings of the Site have been included with this report. The attached figures represent the individual mitigation areas and are not to scale. Original wetland ' boundaries are represented as green lines, the upland sides of mitigation areas are represented by red lines and blue lines depict the edge of the easement areas. ' Mitigation Area 1M Mitigation area 1M is located south of Kahl Avenue, north of 52nd Street, west of Jason ' Avenue, in the northern portion of Albert Villas. This area is adjacent to the south of an existing wetland and adjacent to the east of stormwater detention pond #2. The viability of the existing wetland adjacent to the north would suggest that the ' stormwater pond is not affecting the wetland or the mitigation area hydrology. 1M was proposed to be 0.35-acre in size. All of the proposed mitigation area did not meet the ' wetland criteria. Discussions with the property owners of lots 6, 7 and 8 of Block 1, Phase II indicated ' that they would not permit further restoration activities on their properties. Without the restoration activities, the size of the mitigation area was reduced from 0.35-acres to 0 11i Mr. Deric Deuschle Pinnacle Project No.: MN00039.00 BG005 August 15, 2005 Page 3 0.10 acre. The revised 1M was excavated an additional 12 inches to ensure sufficient wetland hydrology, seeded with a wet meadow seed mixture (BWSR W2 or similar) and mulched to prevent erosion and hold the seeds. Additional wetland vegetation from the adjacent wetland should establish itself in the re -graded mitigation area. The as -built drawings of early June indicate the area was excavated to the proposed design specifications and to match the existing wetland topography. The needed 0.25 acres of mitigation area will be replaced by means of constructing replacement mitigation wetlands to the east of County Ditch Number 9, east of the impacted wetland area, as indicated in the Response. The mitigation will be at a 4:1 replacement ratio as required by the Restoration Order. ' Signage has been placed on the lot corners identifying the area as a mitigation area not to be disturbed. The August 10 monitoring event noted the home owners of Lot 7 have mowed approximately 600 square feet of the mitigation area beyond the signage. The ' remainder of the mitigation area within the conservation easement has not been disturbed. Please note that the 600 square feet was not applied to the proposed mitigation area per the Response. 1 F� �I H Cli 7 During the July 6 and 22 monitoring events, the soils were saturated and standing water was present in the basin of the wetland. It appears that the re -graded 1M has adequate hydrology to sustain wetland plants. The vegetation was not seeded as of the August 10 monitoring event. The LGU has recommended postponing seeding until early fall, the recommended seeding time for the recommended seeding mixture. The vegetation of the undisturbed portion of this mitigation area contained Blue Vervain (Verbena hastata), Joe-pye weed (Eupatorium maculatum), Boneset (Eupatorium perfoliatum), cattails (Typha spp.), and reed canary grass (Phalaros arundinacea). Mitigation Area 2M Mitigation area 2M is located south of 52nd Street along the northern periphery of a large wetland that forms the heart of the development. The design specifications called for the mitigation area to be excavated to match the existing grade of the adjacent, existing wetland. The as -built drawings indicate the area was excavated to the proposed design specifications. The Response recommended the area be excavated an additional 6-12 inches to ensure sufficient wetland hydrology, seeded with a wet meadow seed mixture (BWSR W2 or similar) and mulched to prevent erosion and hold the seeds. One homeowner impacted the eastern portion of this mitigation area by placing a patio within the mitigation. As of the August 10 monitoring event, a swing set remains within the mitigation area in another homeowner's lot. The eastern area was noted by the LGU as part of the Restoration Order and arrangements have been made by Edina to provide mitigation in the form of buying wetland banking credits from an off -site wetland mitigation bank. The as -built drawings of early June indicate the previous excavations exceeded the wetland mitigation easements to the east and match the existing topography. Thus additional wetlands have been created beyond the easements. The Restoration Order specified the removal of sod inadvertently placed within the mitigation basin, seeding with a wet meadow seed mixture (BWSR W2 or similar) and ' mulching to prevent erosion and hold the seeds and the re -grading of the northern wetland basin bank. Edina removed the sod that was placed within the mitigation area. However, an area of approximately 1200 square feet along the northern bank will not I meet wetland criteria. The soils were saturated and standing water was present in the basin of the wetland ' during all monitoring events. The vegetation was not seeded as of the August 10 monitoring event. The LGU has recommended postponing seeding until early fall, the recommended seeding time for the recommended seeding mixture. The vegetation of ' the mitigation area prior to the re -grading contained Blue Vervain (Verbena hastata), and reed canary grass (Phalaros arundinacea). Mitigation Area 4M Mitigation area 4M is located southwest of 51st Court along the eastern boundary of the large central wetland. 4M was surveyed to confirm that the topography and area meet the specified size and depth as indicated in the Response. The as -built drawings of early June indicate the excavation was excavated to the proposed design specifications and matches the existing wetland topography. An area of approximately 400 square feet along the northeast wetland edge may not meet the wetland criteria. The Response recommended seeding with a wet meadow seed mixture (BWSR W2 or similar) and mulched to prevent erosion and hold the seeds. The soils were saturated during the all the monitoring events and standing water was present in the basin of the wetland during the July 6 and 22 monitoring events. The vegetation was not seeded as of the August 10 monitoring event. The LGU has recommended postponing seeding until early fall, the recommended seeding time for the recommended seeding mixture. The vegetation of the mitigation area prior to the re -grading contained Blue Vervain (Verbena hastata), sedges (Carex spp.), wild millet (Echinochloa crusgalli), and reed canary grass (Phalaros amndinacea). Signage has been placed on the lot corners identifying the area as a mitigation area not to be disturbed. Mitigation Area 5M ' Mitigation area 5M is located south of 51st Court along the north side of the large existing wetland. Discussions with the property owners indicated that they would not permit further restoration activities on their properties. Without the restoration ' activities, the size of the mitigation area was replaced by means of constructing additional replacement wetlands to the east of County Ditch Number 9, east of the ' impacted wetland area. The 0.08-acre mitigation area will be at a 4:1 replacement wetland to mitigation wetland ratio as required by the Restoration Order. ' Mitigation Area 6M ' Mitigation area 6M is a 1.05-acre area located north of Kahl Avenue, along the southeast periphery of the large existing wetland. The design specifications called for the mitigation area to excavate match the existing grade of the adjacent existing wetland. ' The as -built drawings of early June indicate the excavation exceeded the wetland mitigation easements to the east and match the existing topography. Thus, additional wetlands were created outside the easements. However, the same survey indicates a portion the original wetland area was excavated during construction activities. This portion of the original wetland area was a type 2, farmed, wetland and a plowed field ' containing soybeans at the time of the wetland delineation. Currently this area is a transition from a type 3 emergent wetland to a type 2/6 wetland. ' The eastern portion of the adjacent wetland was re -graded during the mitigation construction to match the mitigation topography. The mass grading of the project ' appears to have altered the hydrology of this portion of the mitigation area. Lastly, an area of approximately 4500 square feet in the southwest portion of 6M does not meet the wetland criteria. This is the area where homeowners have placed gravel to aid in ' draining the area and bridges across the gravel. During all of the monitoring events the soils were saturated and standing water was ' present in the basin of the wetland. This area was inundated with approximately 12 to 24 inches of water during all of the monitoring events. This area is adjacent to the south of an existing drainage ditch. Replacement mitigation area A is proposed to be 0.26-acre in size. A 25 foot upland buffer is proposed to surround this wetland mitigation area. During the August 10 monitoring event the soils were saturated and standing water was present in the basin of the area. The vegetation was not seeded as of the August 10 monitoring event. The LGU has recommended postponing seeding until early fall, the recommended seeding time for the recommended seeding mixture. The replacement area is proposed to be 0.63 acres in size and A 25 foot upland buffer is proposed between the lots and this wetland mitigation area. During the August 10 monitoring event the area is staked and awaiting construction activities. As of August 12, construction of the replacement mitigation area had begun. REPLACEMENT MITIGATION AREA C Replacement area B is located along County Ditch No. 9, a stromwater pond and Lots 3 and 4 Block 1, 6th addition. The replacement area is proposed to be 0.18 acres in size and a 25 foot upland buffer is proposed between the lots and this wetland mitigation area. During the August 10 monitoring event the soils were saturated and standing water was present in the basin of the area. The vegetation was not seeded as of the August 10 monitoring event. The LGU has recommended postponing seeding until early fall, the recommended seeding time for the recommended seeding mixture. Signage has been placed on the lot corners identifying the area as a mitigation area not to be disturbed. ' Mr. Deric Deuschle Pinnacle Project No.: MN00039.00 BG005 August 15, 2005 Page 31 Conclusion ' Pinnacle monitored the hydrologic and vegetative conditions of the ten mitigation wetlands located within the Albert Villas housing development in Albertville, Wright County, Minnesota. The results of the monitoring revealed that monitoring area 6M, 7M, 8M, 9M and 10M are functioning as designed and exhibited wetland hydrology and vegetation. Mitigation areas 1M, 2M, and 3M have been re -graded and are awaiting the fall season to seed, mulch and disk. 4M was re -graded, seeded and mulched. 5M was eliminated. ' Signage designating the areas of the wetlands and mitigation areas was placed at the edge of the wetlands and mitigation areas on alternate lot lines. The signage stated ' "This area is a protected wetland mitigation area. The signage was placed on 4X4 wood monuments. A copy of the signage can be found in Appendix A. Recommendations To meet the Restoration Order and achieve the goals Response, Pinnacle advises completing the following recommendations: • Mitigation area 1M should be seeded with the seed mixture recommended in the ' Response for this area, then mulched and disked. Monitoring of the mitigation area should continue as well. Portions of the mitigation area that are not under ' the conservation easement should be added to the total of replacement wetland required in the replacement area per the Response. • Mitigation area 2M should be seeded with the seed mixture recommended in the Response for this area, then mulched and disked. Monitoring of the mitigation area should continue as well. • Mitigation area 3M should be seeded with the seed mixture recommended in the ' Response for this area, then mulched and disked. Monitoring of the mitigation area should continue as well. • Mitigation area 4M may need to be re -seeded with the seed mixture ' recommended in the Response for this area, then mulched and disked. An assessment of the vegetation should be made after the summer monitoring event ' next year. • Mitigation area 6M should be monitored. Portions of the mitigation area that are not under the conservation easement should be added to the total of replacement wetland required in the replacement area per the Response. • Mitigation area 7M should be monitored.
