1996-08-05 CC Findings of Fact .. ,. . , CITY OF ALBERTVILLE . 5 August 1996 City Council Findings of Fact & Decision Applicant's Name: Kent Roessler, Center Oaks Request: The applicants are requesting rezoning of a +/-70 acre parcel from R-1 A, Low Density Single Family to R-1, Single Family Residential. The property is located west of CSAH 19 and south of Parks ide 3rd Addition. City Council Meeting Date: 5 August 1996 Findings of Fact: BaSed on review of the application. evidence received, and recommendation of the Planning Commission. the City Council now makes the follOWing findings of fact and decision: 1) The regal description of the subject property is as folJows: Part of the NE 1/4 of Section 2, Township 120, Range 24, Wright County, Minnesota PJD# 101-500-021401 2) The Planning Report dated 26 June 1996 and Memorandums dated 3 July 1996 and 15 July 1996, prepared by Northwest Associated Consultants, Inc. are incorporated herein. 3) On 9 July 1996 the Albertville Planning Commission conducted a public hearing to consider the applicant1s request, preceded by a published and mailed notice. Upon review of the application and evidence received, the Planning Commission closed the public hearing and recommended that the City Council deny the rezoning. Decision: Based on .regOing considerations and apPlale ordinances, the applicant's . request for rezoning is: [xl Denied, based on the most current plans and information receiVed to date, for the following reasons: 1) The standards by which the City must consider approval of rezoning requests, as inCluded in Section 300.1 (f), requires that aU of the following criteria be met: I. a) The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. b) The proposed use is or will be compatible with present and future land uses of the area. C) The proposed use conforms with all performance standards contained in the City's Zoning Ordinance. d) The proposed use will not tend to or actually depreciate the area in which it is proposed. e) The proposed use can be accommodated with existing public services and will not overburden the City's service capacity. f) Traffic generation by the proposed use is within the capabilities of streets serving the property. 2) The proposed rezoning does not meet all of the criteria outlined in (1) above which were established as a means of determining possible adverse effects of the proposed rezoning and which were discussed within the referenced Planning Repqrt. Specifically, the Center Oaks request for rezoning is in opposition to the policies and provisions of the City's Comprehensive Plan. adopted on 17 June 1996, which were specifically created 14to provide 'life cycle' residential environments inclusive of a broad and balanced choice of housing types" and "to promote large lot residential development in all remaining low density residential areas located west of CSAH 19". 3) The City is not concemed with the timing or absorption rate of development, but rather the establishment of the desired large lot low density and quality development which will satisfy long term needs as defined by the adopted Comprehensive Plan. 4) large lot, low density residential development of 15,000 square foot or larger lots has been a goal of the City since before September of 1995 when Planning Tactics studies were completed. 2 5) The size and.quallt.ger homes selling in the Wright ~ region, specifically in the communities of Delano, Sl Michael, Frankfort Township, and Rogers, supports the City's development objective of attaining the same through supplementing the City's existing housing stock with low densityl large lot sites.
